"jesse watters primetime" with guest host will cain starts right now. hey, will. >> will: hey, bret. thank you so much. ♪ ♪ >> will: welcome to "jesse watters primetime," i am will cain. we are going to start with a fox news alert. the judge who signed off on the mar-a-lago raid says he may unseal parts of that affidavit. that headline sounds nice. it makes it seem like our justice system is being transparent but what does that actually mean? well, magistrate judge rinehart, who it is always worth remembering represented jeffrey epstein gave the doj a week to
4:01 pm
take a big sharpy and black out whatever they want in that affidavit. then rinehart can decide whether or not he agrees with those redactions. and after weeks, possibly months of appeals, we'll probably end up with, well, no new information. just like today, when the judge unsealed some documents related to the warrant. they didn't really tell us anything. the cover letter, a motion to seal. not exactly transparency. it's just another thin coat of paint over this raid and investigation that makes it look like rinehart is playing fair. but rinehart is so biased that he once had to recuse himself from the last trump case. not to mention he is obama donor. and he, again, used to represent jeffrey epstein who, by the way, did not kill himself. this is all by design. the doj made sure they found a judge who would play ball. it doesn't seem like we're going to get truth, at least not any time soon. a lawyer fighting for the release of the affidavit says this proceeding is all about

dirt on january 6th, not the nuclear codes. the doj also said this situation is too volatile right now to give out any more information. it could put people in danger. hey, if the country seems volatile, it's because americans know they are being lied to, bald faced lied to by their government. the president has been in hiding for weeks and the doj only talks to us through calculated leaks to the media. their story just doesn't add up. and if you are going to completely crush the country's norms, remember that? donald trump will crush our norms. now that they're going to crush the norms, you better have a damn good reason. let's turn now to harmeet dhillon, chair of the republican national lawyers association. harmeet, great to see you this evening. what do you think will be left of this affidavit once it's redacted and released to the public? >> well, first of all, i think you are going to see virtually nothing after the redactions are presented to the judge. i think that the judge will take
4:04 pm
a look and see he agrees with the recalculations or not and then there will be back and for the. ultimately though what we are seeing here is not some sort of outrageous change of behavior by the doj. this is actually their existing way that they deal with requests like this. they typically stonewall, they typically hold all the cards. they never want to show a target or a defendant what they have. and they are very rarely held accountable, including by magistrate judges. so this judge, you have to remember, signed off on an application to seal this entire intarnt. the predicate at that time was, well, you know, somebody might destroy evidence, which is kind of nonsense since president trump, who presumably they are aiming at wasn't at mar-a-lago and hasn't been for some time. so now what's the excuse? i think that the judge -- i was pleasantly surprised that he asked for any redactions at all and considering unveiling it i wouldn't hold my breath and here's why. even where a search warrant may
4:05 pm
be unveiled, the affidavit, rather, if it involves national security or alleged national security information, it is often the case that even after an indictment, the search warrant affidavit is restricted to the target of that investigation or the defendant in that case and their lawyer. so i don't think we are ever going to see what's in this search warrant application or not much. >> will: well, you started to answer the question, which i wanted to ask you, is that if the affidavit is ever released, it will be after at least an arrest and perhaps an indictment. i hear you that you are accident skeptical it would happen. lead to an arrest or an indictment. >> that's certainly how it looks. if you believe that merrick garland, the attorney general is not a great actor and he was indeed as rattled as he looked a week ago in his press conference, maybe they are having political second thoughts about this and backing off because this is actually behavior that the doj's own
