social media and donated to barack obama. he is free to do all these things, but it does not make sense that he would recuse himself once, but not twice. why would he kick it back to the doj further reductions when we know they are going to redact anything of value. >> well, you know, i was not that troubled by the political contributions, because that does happen with judges and magistrates. but i was concerned about the statements he made on social media and the earlier recusal. this is an incredibly important and divisive matter. i'm a little surprised that he felt that he should be the one to sign off on the warrants and review the affidavit. after sending it back to the doj, i think that that was an appropriate order. you know, many of us expected that he would just defer to the department of justice and a lot of judges do that even though the department of justice has a long record of using these arguments to prevent disclosures even to criminal defendants.

the problem is that the department of justice is rather notorious for using redaction's, and they set up a reverse incentive. if they over redact, it's more likely the judge will disagree which means they can go on appeal and delay any release further. so they have a rather odd incentive that the more they redact, the more likely they can get more time. but we will have to see if this judge is willing to go mano a mano with the department of justice. and say, this is obsessive. i've said all along that i believe portions of the affidavit could be released without undermining the investigation, not because i have seen the affidavit, but i have seen lots of other affidavits, much of an affidavit involves material that will not necessarily compromise an investigation. it is one of the things we are most interested in is the information that is artie known to the trump team.

the period of notifications from june until the raid, what did they tell the court happened in those communications? did they faithfully report that there was cooperation according to the team? and that all other avenues had been exhausted? that's the type of information you should be able to give in a redacted affidavit. >> sean: yeah, all of the sections cited from the espionage act with the warrants they put out, they all have to show some level of intense on the part of president trump, and that is a very high legal bar from my perspective, because they are not really going to know the intent or maybe the intention was that he really believed it was declassified. or maybe the intention was it's a personal document they don't have a right to. it seems like a very high bar, but again this is a case brought to the jury in washington, d.c.?

>> yeah, and obviously that's not an ideal jury pool for the president come of the other thing that is troubling as you can be charged under these provisions even if this is not classified information and had been declassified. but it will be on untenable case in my view, and he would to really create some new law. the president has a role in declassification has not really been litigated that much. i mean, presidents are always assertive. they have the ultimate and immediate power to declassified. and usually if you turn up into pursuing the former president, you are talking about pursuing a case where you have everything you need and more. here you will be litigating an unknown area which is rather surprising. >> sean: all right, jonathan turley, as always, thank you. the author of "price and principle" alan dershowitz along with the attorney for former

donald trump. they will leave that in, because there certainly is going to be material unfavorable if there was an affidavit for a search warrant. then they get to adapt to the material that might be favorable to him. it still won't have anything to do with what is classified or unclassified or necessary for the investigation, it will have much more to do with how they can redact an unredacted in a way that saves their skin. >> sean: the doj does not want to redact it. they don't want it out in the public, donald trump does, doesn't that tell you a lot? >> it certainly does, but i bet the doj wants different things out in public and donald trump does. of course they are, but a stronger idea where they can actually show it. along with jonathan turley i've seen dozens and dozens of these redacted affidavits and they just redact, redact, redact. i also agree that the judge will

out at school board meetings as potentially being domestic terrorists, now we have teachers unions, parents dare say that they want age-appropriate materials and don't want crt and don't want gender identity to talk to their kids in school and one reading and writing, math, science and computers, somehow they are extremists? >> yes, let's be clear, the union is a arm of a democratic party. they are propaganda machines for the extreme left. you are an extremist if you believe in reading, writing, and mathematics for your school-age children. i used to be a schoolteacher. you are extremists if you are opposed to critical race theory or you do not believe that gender identification classes for third graders. this is just pure extremism on the left, and they are trying to use the kid. you see those commercials where the kids are being used as props. these unions do not care about

school children. they do not. they care about power to pull and their social answer for the democratic left. but i tell you right now, i am proud to be an extremist if i believe in quality education and keeping critical race theory which is nothing more than racism out of public schools. >> sean: pam, i look at what is happening with parents and why are they under assault? more per capita per student on education than any industrialized country and parents i think have a right to say they don't want their kids indoctrinated into value systems that they disagree with, especially when we are getting the worst results in the worst bang for our buck that any country on education for our kids. why don't they stick to the basics? let kids opt in if the parents want it. it's because that's exactly right, sean, and i come from a family of educators, look at what they did in new jersey. look at what they did in virginia with glenn young can, that helped propel him to the

governor's mansion and that's what it will happen in new jersey if they are not careful. they are extremists, and as leo said, not only that, parents have a right of course to know what their children are being taught in a right to know what their children are reading. if they are not treating with critical race theory. it is unbelievable now, but parents also have the right to school choice. if their educational needs are not being met in the school in which they are placed, they have a right to change schools for their students. and that's what conservatives believe in. school choice. and the democrats have just lost sight of that. they used to be known as the party of education and that's just gone, because all they care about are the teachers unions and not the students. >> sean: are you going to release your karaoke tapes? >> yes, a duet with sean hannity -- sean hannity, will sing "reunited" reunited,
