search warrant set to be released but only after the department of justice submits its redactions. the judge giving the d.o.j. a thursday deadline to make that decision. team trump saying put it all out there quoting here, the whole affidavit should be released given the democrats' penchant for using redactions to avoid government corruptions just like they did with the russia hoax. the burden is on the d.o.j. >> the burden is on the government to prove that this is not just a continuation of what has been a seven-year crusade to get trump. the senior membership of this agency has been targeting trump for years. they've got the documents they went in for. i see no reason not to release this affidavit except for if they have confidential informants in it. >> mark meredith is live with more on this from palm beach. good morning. >> good morning. we're in a holding pattern here.

the judge giving federal prosecutors until thursday next week to figure out which items in the affidavit need to remain sealed and which can be released and what items have to be kept private. just yesterday multiple lawyers for multiple media organizations argued there is so much public interest in this case that this entire affidavit should be released as this case still getting a lot of attention not just here but around the world. the justice department argues releasing the entire document could hamper its ongoing investigation into former president trump. we know these documents already released the feds are investigating him for possible obstruction and violations of the espionage act because of some government documents recovered here in florida. trump claims this is all another in a series of political attacks against him. his lawyers telling fox they don't believe the justice department will reveal much more even if a redacted affidavit is released. >> i think there won't be very much transparency.

i would expect we'll get a lot of black ink all over that piece of paper. if i was the d.o.j., biden d.o.j. i would be redacting everything other than the word and and the. >> the justice department says it is protecting investigators and witnesses cooperating with the government right now. we are hearing today from republican senator chuck grassley of iowa saying given the current political climate we're in the government should be revealing a lot more about what it's up to. >> the more the better. and the better the public relations of the f.b.i. would be, because i think there is plenty of evidence of political bias. >> we've already heard from the attorney general last week who says he still has a lot of faith in the men and women of the f.b.i. and they are simply doing their job. also while we're here at mar-a-lago we're interested to see whether or not the former

president may release the footage when agents were there a week ago. he hasn't said he will do it but there is speculation out there. we're in a holding pattern at this point. >> bill: we'll get back to you as the news breaks. march meredith in palm beach. matthew whitaker, former acting attorney general. the major complaint, right, from the right, from the g.o.p., is that the d.o.j. and f.b.i. in recent years have lost some trust. it appears to be a fair assessment. their belief is if you put out this affidavit, this document and 75% of it is blacked out, not exactly the best way to gain back that trust. your thoughts. >> yeah, i agree with my home state senator chuck grassley. i think the f.b.i. has a burden now to demonstrate that this isn't a continuation of the last seven years of them trying to get trump.

ultimately the confident of the american people will be improved in the f.b.i. if they have more transparency. going to court to first of all block this affidavit and then if they present next week a completely blacked out document that looks more than a real affidavit it will be the -- increase the accusations that the f.b.i. is playing politics in this investigation. >> you talk about the redacted affidavit and jonathan turley made a good point and want to get your reaction on the other side of this. >> they have routinely been accused of redacting too much out of material. i have been in cases where i've challenged that. they use this strategically. part of the problem is that they go and redact too much, they can delay release. they can go on appeal and fight this a little longer without releasing information.

>> i think what he is trying to say is look, the d.o.j. can hold this up in the courts for a while and while it is being held up in the courts, matt, they control the narrative. remember, they are the ones that say they give information to the "washington post" about things like nuclear weapons documents. they control the narrative. the other side doesn't get a chance to defend itself and the d.o.j. has all of the power going forward. >> trace, you are absolutely right. the leaking surrounding this case has been shameful and the department of justice needs to stop doing that. as it relates to the appeal, remember, this is a magistrate judge. so if he rules against the government and their redactions the first appeal to the district court and appellate court and if the supreme court would take it. they could delay this. we're also in the 90 day

political window that the d.o.j. doesn't do overt acts and investigations of a political nature. that is going to delay this investigation to the benefit of d.o.j. who to your point is controlling the narrative. >> they will want to push it past the 90 day mark. you were talking about the top republican on the senate judiciary committee demanding answers on the hunter biden investigation. senator chuck grassley says similar claims that the f.b.i. wrongly labeled evidence on hunter as quoting disinformation indicated quote deeply rooted political infection in its d.c. field office. grassley says his letter this week to director christopher wray is his fourth request for that information and he writes quoting here, the bureau has failed to address concerned i raised. the consistent failure to respond to congress continues to erode trust in the f.b.i. it is all hands on deck in the

trump investigation. when it comes to the hunter biden investigation we can't find any hands on deck. >> that's true. three years they have had the hunter biden laptop. first d.o.j. and f.b.i. off the record suggested it was disinformation. we found out that is authentic and is his laptop. that investigation doesn't seem to have any force behind it. we don't see any overt acts or search warrants being executed. we don't hear of grand jury witnesses. the american people continue to believe there is an ever-increasing two-tier system of justice and can't be sustainable if we continue down this path. >> if you're the f.b.i., matt, and not really responding to chuck grassley, you are not responding to the senate, i guess you don't have to respond to anybody, do you? if you are not going to respond to the senate, the president won't ask you to respond. i guess you really don't have accountability to anybody at this point. >> that's what it appears.

points. but a statistic call dead heat. also an enthusiasm gap that could boost johnson's chances. 66% of his voters are excited to vote compared to 57% those backing barnes. what do you make it the about the enthusiastic factor. is it real and play a part in the mid-terms? >> six years ago when ron johnson was on special report last night and pointed out that in the last election ron johnson was behind in the polls by 3 points right an election day and won by 3 1/2. the polls have gotten a lot of stuff wrong. what we have to go on and it is troubling. if you look at the 538 average of some of these key averages. dr. oz is losing by 11 points in pennsylvania. in arizona masters losing by 10. in georgia herschel walker is

losing by three. in ohio vance is losing by 1.2. a tie. rob portman won that seat six years ago by 20 points. joe biden is the least popular president in the history of presidential polling. we have the worst inflation in 40 years. the highest gas prices on record. the worst crime wave since the 199 0*s. the worst border crisis in american history. it should be a red wave of unprecedented proportion. republicans should be sweeping the democrats out of the house and senate. the fact that it is tight is really a testament to the fact that even though people don't like joe biden, they are not so thrilled with the gop and they aren't embracing us. i hope the red wave comes but it is not guaranteed and republicans, if it doesn't republicans need to take a hard look in the mirror. >> trace: democrats are looking at the president and some of them are running away. the list gets longer and longer.

demanding to know why he is still allowed out on the street. a week ago today, he walked out of a bronx restaurant and put on a pair of work gloves and without provocation allegedly punched cortez in the head. he left the same restaurant and he collapsed unconscious. he poses the greatest risk to the community. court documents say he told his parole officer i'm in trouble. i hit someone and he is in the hospital. i don't know if he is dead. i was at the restaurant and i know the police are looking for me. following his release as seen on video from the daily mail he was combative with a photographer at the courthouse. after being charged with attempted murdered the charges were downgraded to assault and harassment both misdemeanors under recent changes to the state's bail system are not bail eligible. >> certain crimes such as the one that this individual was charged with do not allow a judge to set bail.
