kill anybody. we want all social media, whenever there is any type of illicit drug traffic going on, we want them to proactively reach out to law enforcement officers and stop this. this is poisoning. these children, young adults, number one killer of young adults is fentanyl poisoning and it's not an accidental overdose. we are asking our d.a.s and county attorneys to try it as capital murder. we need your help. parents, take a look at what's going on in your children's social media as well. >> sandra: the distinction between overdose deaths is important, it's not like the kids are taking multiple drugs or too much of it, it is one time and not what they think it is. and it stops their heart and they die. here is the fentanyl death tally. in 2021, 71,000 in this country to be exact. 71,238. up 23% from 2020. this is an enormous problem. what makes you think, though,

that the social media companies who all they want to do is attract younger users are going to step in and interact with law enforcement to stop this. >> well, sandra, i hope they do it because it's the right thing and if they don't, it's when congress has to step in and tighter guardrails around them and then hold them accountable. we need legislation to say they have to proactively do it, and i can't go any further than to say this would not be so bad if it was not for joe biden's open borders. last month seized a ton, 2,000 pounds of fentanyl at the border. this is going to get worse, the kids are all going back to school. parents, please reach out, talk to your children and warn them. one pill can kill. >> sandra: and you think about the younger teenagers getting on social media platforms for the first time, parents are not always looking or able to look over their shoulder and they just can't see this activity. the social media giants, to your point, they can, and they can step in and do something about it. we'll watch what happens with

>> sandra: california law enforcement are now performing an autopsy on the body officials believe to be keily rodni's. the 16-year-old, her car was found on sunday after she went missing about two and a half weeks ago. william is live for us in los angeles. he's got more details for us at this hour. so, william, are police still unsure the body is actually hers? >> right. and we are still waiting for the autopsy. should be this afternoon, but you are right. police have not yet positively identified her body yet last night keily's family issued this statement quoting, while we accept the sadness cast under death's shadow, the rising sun shines light upon us, reminding us not to mourn our loss, but to

members of congress. josh, senior political correspondent for axios. all eyes on the 12th district in florida, carol maloney and gerald nadler are facing off against each other, for all the marble, one of them will not return to congress. >> clash of the political titans. longest serving and house democrats, drawn into the same manhattan district. and the "new york times" editorial page, the endorsement does not usually matter but they endorsed gerry nadler, chuck schumer and endorsement of nadler, a boost of momentum for one of the congressmen nadler. >> john: maloney is 76 years old, in congress 25 years, and nadler 75, been there for 30, and some are saying maybe the old guard should step aside for

new blood. >> that's not going to happen, in new york, more progressive challengers are taking on long standing incumbents and a third candidate, patel, running and hoping to run on the message but powerful iconic figures, looks like one will hold on. >> who do you put your money on? >> the endorsements give nadler the edge. >> john: and a couple others to sit out until january 3rd, ryan against molinaro, they could end up in congress, running on november 8th, on the 18th and the 19th district, but this is an important race because of optics. >> it gives a test what the political environment will look like in november. this is like the swing district, voted for obama, trump, and for biden. very competitive district and you have two pretty strong

candidates on both sides and national democrats and national republicans spending over a million dollars in this race. it's a biden plus two district. if a republican wins going away, a good sign for republicans. if ryan wins or if it's very, very close, democrats will make the argument they are gaining some momentum in the midterms. >> and the 23rd congressional district important, indicator of where we may be going. >> if democrats are closer than expected, it would be a good sign. >> let's go to florida, who will run against desantis, crist, a former governor and former republican turned democrat or nikki fried. >> crist has the edge, but democrats want someone more progressive, the issue of abortion, the dominant issue for democrats, nikki fried has made

that the central of her campaign. is charlie crist running in the democratic primary, fried is trying to get the progresstive energy and the base to pull off the upset. >> john: and val demings, former orlando police chief and congresswoman from that district looks like she has the edge in today's primary and polling pretty well against rubio. >> early polling, i would not read too much into it. but sure, like val demings is a very good candidate. talked about as a possible running mate for joe biden in 2020, a police chief, a lot of i innoculation against the attacks the democratic party is defunding the police, but rubio has not spent a whole lot of money, and desantis is the top of the tibt. even though florida is a close state, it's voted for republicans in the most recent

preferential treatment. >> well, that's right, sandra. paul pelosi is a convicted drunk driver, not here in person, but entered a guilty plea to one count of misdemeanor dui, second count was dropped and agreed to a long list of penalties that as you say enable him to avoid more jail time, including three years of probation, completion of a three-month dui course, court fines and fees of more than $1,700, another administration fine of $150, and 5 days in jail, but he gets two days of time served for when he was arrested and booked overnight at the napa county jail in may and two days of credit for good behavior. that leaves one day left which the judge said he can serve on a court approved work program instead. so basically community service. all because the 82-year-old drove home drunk from a dinner party causing a two-car crash

that totalled both vehicles and left the driver of the other car injured. according to the criminal complaint, that victim, 48-year-old man suffered soreness and headaches, he's wracked up medical bills and missed work, and nearly $5,000 in restitution, his insurance has replaced that man's jeep and what napa county district attorney just said about filing the charges as misdemeanors as opposed to felonies. >> so his injuries were there and certainly a result of the crash but not the kind of injuries we see in a felony case like lacerated livers, or disfiguring lacerations or broken bones or coma. no, i think this case had been unusual in sometimes i watch news coverage and it's like they are talking about a completely different case. >> as part of his sentence here, paul pelosi must also have a

breathalyzer device in stadium in his car, but that may not matter because once the court sends his conviction records up to the state, the d.m.v. will suspend his license for a year. bottom line, paul pelosi will not be getting behind the wheel of a car to drive any time soon. >> sandra: thank you. >> john: at least not without blowing into a tube first. jonna, when you look here, pled guilty to one charge, the other charge was dropped, they were almost identical, do you think there is any sign of preferential treatment here? >> no, i have to tell you. i've handled thousands of these cases in my day and this was entirely run of the mill but for one thing and that's the defendant himself. he's not an average citizen, he's not an average joe. i am a little bit surprised he pled guilty as opposed to no

contest because there was property damage and supposedly bodily injury and wanted to save himself from wrongdoing, no contest was the way to go. a guilty plea from paul pelosi is not the same as me or you. he doesn't need to drive, he doesn't need to work, he doesn't need to worry about his professional licenses, he doesn't need to worry about his criminal conviction. when an average person is in this situation and pleads guilty, everything can be affected. but when you are a rich old man who never had any business getting behind the wheel at all. he's rich enough, he could have had a whole team of lumberyards carrying him from the winery to the home, there's no excuse for him to have done what he did. the fact he pled guilty and will

take some ownership is a good thing, but not out of the ordinary. >> difference between misdemeanor and felony dui in terms of injuries to the other party. is that pretty standard? >> that is pretty standard. you don't get charged with a felony involved in an alcohol-related crash unless the injuries are serious. the other thing, was his bac, blood alcohol concentration was low in terms of what the legal standard is. it was .08. that's the threshold. now, they did wait two hours before taking his blood alcohol concentration and that means he could have been higher at the time he was driving and at the time he had the crash than he was at the time he took it. that might be another reason why he's escaping a longer happened of the law here. but it was a low bac. >> john: so what about that? it was noted in the incident report that there was a strong odor of alcohol on his breath yet he was not tested for two

hours and 15 minutes afterwards and you can metabolize alcohol fairly quickly, particularly if you've got a lot of adrenalin in your system because you have just been in a crash and arrested. should they not have taken the breathalyzer test at the moment of the crash? >> so that's interesting because normally, around here, when this happens to you, you are going to get your bac taken relatively quickly, depending how close you are to the nearest police station. five minutes, 20, it could be an hour. you are not supposed to wait longer than two hours to take somebody's blood alcohol concentration. like i said, you don't know what they were at the time they were operating the motor vehicle. so the fact that they waited a fairly long time might have been a wink and a nod to paul pelosi, but i guess it does not matter now that he's pled guilty to the one charge. the other charge is typically dropped. that's not different in any respect.

>> john: and what about the time served, in the jailhouse for a few hours but ran the course of two days because it crossed over midnight so he was only there for a few hours but credit for two days and then credit two days for good behavior and then court ordered work program for a day. is that pretty standard or does that indicate, i don't want to say they bent the rules for him, but that he got favorable treatment? >> no, that's pretty standard. jail has weird math. if i have a client that needs to do time in jail, they are out friday morning and are out friday night and that covers five days. it's routine. >> always about to be here. >> sandra: the white house keeps painting a rather rosy picture of the american economy and point to the jobs market. but it turns out more than half of all u.s. companies are planning layoffs. fox business correspondent will

the current labor force participation rate, 62.1%. we have been watching this closely, why? >> we are watching that because it's lower than it has been historically, you don't have enough people participating in the labor market so the labor, the unemployment rate of 3.5% looks, you know, like everything is fine. people are still sitting home and collecting checks from their local and state governments, especially as we head into the back to school season and that was always my worry. why aren't people heading back to work? they know if they stay home, the spending bills passed will trickle back to them and still what's happening here with the passage of the inflation reduction act that will not reduce inflation. >> sandra: larry summers is weighing in on what could be an announcement from the biden administration on forgiving student loan debt. i hate saying that, it sounds so lovely, right. but what many are saying, and charles payne was talking about this, is that somebody always

concerning the lab leak. one of the things that fauci gets dinged for is saying almost unequivocally, and still think he's saying it to this day, that this did not emanate from the wuhan institute of virology, contrary to a lot of evidence that other people have amassed. >> well, i had him on special report and the answer has evolved a little bit, and that is he keeps an open mind. it was far more definitive at the beginning saying it was definitely from an animal in the wet market in wuhan, but there is an open mind answer to it now. you are right, there are more and more organizations that look back at this and the virus itself and how it has acted and say it looks more likely it came from a lab. and the early emails exchanged between dr. fauci, dr. collins, other medical experts, seem to suggest that they were at least trying to keep that option off
