make a difference for families out there struggling and they need a break. a lot of other people feel like maybe that is not something, especially if you didn't have the money to go to college. he still says this will give families some breathing room. listen to what he had to say. >> i believe my plan is fair and responsible. helping working people with student loans. i think he is dead wrong. >> is it unfair to people who paid student loans or chose not to take out loans? >> it is fair to people who, in fact, do not own businesses. is that fair? what do you think? >> todd: you have to go back and look at the transcript and listen to exactly what he said there. it literally made no sense. it was pretty interesting to watch. at least that is what i thought maybe you will think differently if you go back.

all right, back to the story now. we are talking about the program that will give up $20,000 in debt cancellation if you went to court on pell grants, $10,000 if you went beyond pell grants and individuals making under $125,000 and under $250,000 if you are a couple. and also monthly payments and have her undergrad loans and yes, it puts a freeze on those who are having to pay back the loans at least until december. >> will you forgive debt? you are not just disappearing dead. >> when you think about the $4 billion that will go back as revenue back into this process of folks pegging their college tuition, that matters as well. so, we are doing this in a smart way. >> but people that already paid

their student loans, they don't get anything out of this. >> right. >> todd: you have got to love peter doocy purity gets to the point of it, doesn't he? justifying student debt relief plan under the hero's act of 2003 which the administration argues gives sweeping authority to reduce or eliminate student they hit during a national emergency. as you can well imagine legal challenges are expected. but in the meantime criticism abounds and that is even from democrats. check this out, ex-obama advisor slamming the handouts as he puts them. this is jason furman pouring roughly half a trillion dollars in gasoline into the inflationary fire that is already burning his reckless spirit doing it while going will be on the campaign promise of $10,000 of student loan relief and breaking another all proposals paid for it. remember he said that? what he said is even worse. it wasn't just jason furman

taking shots. all day, here from chris. we know the cost of higher education is crushing families and that is why i have supported expanding pell grants and affordable community college and loan forgiveness for those entering professions like nursing. this announcement by president biden is no way to make policy and sidestep congress and our oversight on fiscal responsibility. as you can probably imagine g.o.p. lawmakers are blasting this idea. it will make for a very rough couple of days in the nation's capital for the white house, guys. >> carley: kevin corke live for us on this one, thank you so much. todd, kevin brings up a good point about the president's response. the democrats rebuttal to the criticism, bipartisan cruise to my criticism canceling student loan debt that is well, republicans decrease corporate taxes. but there is a very big difference between cutting

corporate taxes, which the economy creates jobs then cutting loans for somebody who already has a job and who benefits from this? the rich people! people making up to a quarter of a million dollars if you are a couple are getting their student loans cut. an economist said 70% of the benefits will go to the top 60% of income earners. this is a group of people -- this is stealing money from hardworking taxpayers. to buy votes from people who are disproportionately wealthy. >> todd: quickly to your point, the big difference between the argument of, oh, we gave these tax breaks. that is the individual's money. they earned that money. the government is taking that money from them. that is their money to begin with a peer of the the loan is the obligation. it is a debt of a person and the government is taking that away from the person who signed the

document for that loan and transferring it to somebody who didn't sign the dotted line. the big question help, carley can joe biden to this? my answer is no empire with me it is called the major question doctrine. the courts should not defer to agency statutory of vast economic political significance. of course the department is the department of education. that is the agency and $300 billion, carley, pretty darn economically significant. republicans need to sue to get this to court to show this is a question for congress and asked their star witness carley shimkus, they should: none other than nancy pelosi. listen. >> people think the president of the united states has the power for debt forgiveness. he does not. he can postpone, he can delay, but he does not have that power. that is an act of congress. i don't even like to call it

medical professionals and a end pandemic phase and the cdc says we are no longer an emergency dictates we are not in an emergency. >> carley: why is this happening? in july, "new york times" came out and said 1% of 18 to 29-year-old support president biden. but that is a group of really unreliable voters. so it seems like what the president is doing right now is angering the progressive sense i'm not going too far. moderates and democrats say this could be quite possibly not constitutional and also increase inflation and erase any sort of deficit reduction that was passed in the inflation reduction act. it is extremely unfair to people who either didn't go to college either because they didn't have the money or already paid off their student loans for possibly getting votes from a group of people that cannot be so willing to go to the polls anyway. >> todd: that is a great point

and to further that point, he already has the votes of the people in the ivy league towers. this is going to take off blue-collar workers, people with college degrees, people without college degrees and people who pay back their loans. they will be motivated to head to the polls in light of this. >> carley: and i love the education secretary 's conversation with peter doocy yesterday. peter doocy was like, so the people who already paid their loans, will they benefit from this? nope. okay, he answered that one. >> todd: think of how many of you worked extra shifts. now, to this another big story, the clock is ticking as a federal judge awaits the redacted version of its affidavit to raid mar-a-lago by noon today. >> brooke singman here with the latest, brooke. >> hey, good morning they drifted this morning to the justice department to hand overy the fbi's raid of the mar-a-lago

president biden had to make the determination himself whether he was going to waive executive privilege from a former president. >> meanwhile the justice department releasing nearly unredacted 2019 memo detailing a former attorney general bill barth against prosecuting and president trump with obstruction. robert mueller russian probe citing "the evidence not in our judgment evidence beyond a reasonable doubt that the president violated the obstruction of justice statute." robert mueller, however did not draw a conclusion of obstruction during his investigation into trump russia collusion. >> todd: mueller and his team should be under investigation perhaps some of these fbi agents are involved in this latest raid on mar-a-lago. >> trumps legal team suggesting that it could be repeating itself, carley and todd. >> carley: brooke singman live for us, let's bring in chris.

good morning to you. how do you expect today to unfold when it comes to the affidavit? >> yeah, to answer that question, you have to understand what is likely in the affidavit. there has to be evidence or facts that show a crime has occurred and there is evidence to that crime at a specific location. what you need to do that is describe the evidence itself, which in this case would be sensitive documents. i would not say classified because they talk about national defense related information. so it doesn't necessarily have to be classified but it doesn't have to be extremely sensitive or related to national defense. there is another part of the statute that involves destruction of the documents and that sort of thing. or whatever the conduct is that is the crime. now, you also have to show information has to come from sources that you can't get a search warrant of this nature without having lived information

from live sources people. that is where it will get hung up with the judge and the doj will win their argument. this judge, at least and that is, well, there will be so much information about the reliability of the sources. the specificity of the information that will identify them and we can't do that. we also can identify the documents that we are looking for. so all that leaves us is the conduct of the former president. and i think doj would be more than happy to release that you would if they release anything, my concern is that is all they will release. that is information that without context is detrimental to the vice president. >> carley: very interesting. >> todd: the documents and the administrative judge will say the redaction -- go to the public. let me get your thoughts the department of justice released 2019 memo advising

attorney general bill barr not to pursue president trump on obstruction of justice charges. the memo reads, there is considerable evidence the president took official action not for illegal purpose but rather the investigation was politically motivated and undermined his administration efforts to govern." chris, which of the american people take away from this? >> well, the first thing is the doj was spring-loaded and still is to investigate all things related to trump. however the moment that happens, the stigma attached to that never goes away. the total vindication, 100% vindication, no, we don't hear anything about it. so unless someone makes a formal request for it and in this case the nonprofit think tank that requested the information wasn't real happy with the result so they didn't publicize it. i think it is more evidence, i think that the justice department is not the equal

application of justice is definitely a question, if you will. that is an understatement. >> carley: senator ron johnson had information from an fbi whistle-blower. and that whistle-blower said the agency ordered investigating hunter biden's laptop before the 2020 election. and he wrote a letter to the doj inspector general saying, "after obtained the fbi from wilmington, delaware, computer shop, the whistle-blower site fbi leadership told them to leave. he will not look at the hunter biden laptop and that the fbi is "not going to change the outcome of the election again." a loaded statement there but what is your reaction to it? >> yeah, first off, there are multiple whistle-blowers on this and that is why i find it credible. i think it infuriates people because as i mentioned, the equal application of justice, if

you will. it seems like this guy. the hillary clinton matter with the server in the closet outside of the control of government. that got deep-sixed. all things mentioned earlier, all things trump get aggressive proactive investigation. so i talked to people inside and outside the fbi. colleagues of mine, a whole wide circle of people in this is the single issue that really get some worked up over how the justice department is operating now. that is, here is a laptop and obvious incriminating information on it, a two-year investigation plus they know money laundering investigation because the receipt given for the laptop had fbi money laundering case file number. and realize that destination on it. even people inside the bureau scratching their head and saying, why are we sitting on this? why hasn't this case moved into

oklahoma city police department chief wade morley joins me now. officer, thank you so much for joining us. this is an incredible lust for your community. what can you tell us about the shooting that took place monday? >> so our police department and officers responded to this address five times previous fairly recently. most of the incidents we were responding to were related to the mother of the suspects trying to evict the suspect from her home. this particular morning, we received a call but civil in nature because it involves eviction. the oklahoma county sheriff's office handles those evictions. so the police officers could not take action at that time but advised the mother that that is what she needed to do to serve her eviction. when those deputies arrived to

conduct that eviction as part of the process, the suspect open fire within the house through a door and struck both deputies that were struck in the backyard knocking on the back door. >> carley: wow, you said the shooting was planned out by the gunman and his intention was to kill police officers. what do you mean by that? >> a lot of details about the investigation but through our interview with him and evidence in the house, he knew this was coming. he knew this eviction process was coming. he was very determined that whatever law enforcement and had it been from the oklahoma city police department or the sheriff's office, whoever showed up at the house, he would take deadly action, which is what he did. >> carley: where is the gunman now? >> he has been booked in the oklahoma county detention center. he has been booked on various charges for the murder of the deputy and also the attempted deadly assault on the other two deputies that were present.

>> carley: the 100 officers deputy mark john. what do you know about the status of that officer? >> he came out of surgery tuesday afternoon and doing much better. and we believe he will make a complete recovery out of this. and he is still hospitalized at this time, but he's doing well. >> carley: crime is up in the cities across the country. what is it going to take to make community safer? >> you know, the biggest thing that i believe, and i was talking to members of local media about this yesterday. i think a lot of the rhetoric against the police has got to stop. i believe there are people out there that feel like they are justified in committing acts of violence against the police. it is happening more and more. the statistics show that. also for us, every major city around the country is struggling with recruiting. it is very hard to get young people now coming out of

school, coming out of the military to want to be police officers because of the danger, the violence on police officers, but also to the rhetoric around the country and just the things that have really been going on in the attacks on law enforcement. it makes it difficult. of course, if you less police officers, it makes it difficult to hire. we see much more of an increase in retirement. crime is going to spike. >> carley: that is a great point, bobby short was killed in the shooting and has been with the oklahoma county sheriff's office since 1997. his family is remembering him as a good man and better dad and the world's greatest granddad. chief wade morley, thank you for joining us. >> thank you for having me. >> carley: absolutely. a new memo tells officers they can't congregate or have conversations on city streets. it says officers cannot "engage in unnecessary conversation with other members of the surface while on post."

endorsed by governor ron desantis and joins me now. congrats to all three of you. bridget how liberal was the sarasota school board before you won? >> well we live in a conservative county and it has had liberal majority for decades, as long as i can remember and it doesn't line up to the community we are representing. now we have 4-1 conservative with student focus so we could not be more cited in sarasota will benefit as well as the students. >> todd: robin, besides the demographics that bridget mentioned, why did you win? >> why did i win? i have the support of the community because they wanted a change. they were tired how parents were being treated at the school board meeting by the majority board members and they were not allowed to speak or their time was cut and they were fed up. so they wanted a conservative board and that is why i won. >> todd: timothy as she were

campaigning, what did parents specifically democrat parents tell you? >> especially in this time, school safety, i think when you look at the terrible tragedy around the country that continues to happen, safety crosses party lines. when it comes to me but the school safety aspects i have been doing this 32 years in law enforcement. the basically want their kids to learn and a safer environment. and they wanted to make sure we continue leading the state of florida. we ranked first out of 67 counties and safety last year and wanted to make sure that is how we continue to progress in that same manner. >> todd: bridget for other parents to woke school boards throughout the country, what lessons do you want him to take away from campaign and your win? >> listen the concerned citizen rose up and they worked hard. and amazing to support us and get that message out. the corporate woke media but we

were out they are working and making sure parents and the local community had a voice and were the ones that will elect the right school board members to represent them. i'm for anyone else in education and ensuring the students are being educated and not to push liberal or anyone's agenda. our community rose up, and i think it is an amazing success story. at the end of the day, like i said, the students are the winners here. so anyone else take your school board back to serving your families, communities and students. >> todd: robyn, what are the changes you are going to make? >> well, one of the main changes all of the discussions will be student focused. parents are going to be allowed to speak and given their time back to 3 minutes, they will be allowed to speak on agenda items and not have to wait until the end of the school board meeting

to speak on other things. that is not fair to a family to have a mom or dad not get home at two 8:30 at night to feed their children. and parents are going to have a seat at the table. >> todd: timothy, how much did governor ron desantis play a role in the outcome? >> i can tell you what is humbling to see a governor as popular as our governor and the state of florida to come down to sarasota, hold a rally, to endorse us, to have somebody in the batting cage in regards to children and make sure we represent the values in the state of florida. how big of an impact? unbelievable. i could not thank him enough as it was incredible to have him on our side and be able to push us to the finish line. it was really, really great. >> todd: glenn youngkin and desantis have set the tempo. congratulations. >> thank you. >> carley: cnn host and the baby boomers for the high cost
