at risk. hello everyone welcome to "fox news live" i have eric shawn hi arthel. arthel: hello eric hello everyone i am arthel neville. says the intelligence committee will deliver an assessment of risk to national security if this top-secret documents were exposed. the fbi affidavit claims the records were not being stored in a secure location at mar-a-lago. they had probable cause to search the estate. former president trump and his legal team have refiled to have a special master review those records after judge said they improperly filled out the paperwork the first time around. eric: this is an ongoing story alexandria hoff is following with its new reaction from washington. >> what this affidavit does confirm the justice department had mounting concerns of the nature and handling of documents that were brought to mar-a-lago. in general trump represent his

turnover 15 boxes of record. the part mixed in with other personal unrelated work were highly classified documents. 184 the classification markings 25 marked top-secret others indicated they contain information on clandestine human sources or spies as one might call them. thus the probable calls stated to justify the raid of mar-a-lago was the belief additional documents would be found along with evidence of obstruction. here's a fox news contributor jonathan on that. >> we still do not quite know what the specifically of the obstruction allegation was, was in the handling of these documents and reporting of their possession? or did it go to something broader? >> he also suggested that answer might be found beneath the reductions. about half of the 38 page document was blacked out. president biden maintains he had no prior knowledge of the raid. yesterday he was asked about former president trump's claim

he had declassified the documents in his possession. >> i just want to know classified everything in the world i am the president. i'm not going to comment i do not know the details i don't even what to know. the justice department will take care of it. quick social media president trump once and called the investigation a witchhunt. due to a paperwork error the trumped legal team had to resubmit paperwork last night requesting that a third-party attorney be appointed to oversee the handling of what was collected, eric. >> thank you, arthel. >> thank you. the intelligence community's notice comes weeks after top democrats requested a review of the classified documents. the chair of the house oversight and intelligence committee released a statement today saying the d.o.j. affidavit partially unsealed yesterday affirmed grave concern that among the documents stored were

those that could endanger human sources. it is critical move the intelligence community move swiftly to assess and if necessary to mitigate the damage done. a process that should proceed in parallel with d.o.j. criminal investigation. meantime republicans are sounding off the heavily reductions in the affidavit ripping what they call a lack of transparency. >> the big story here is how much is redacted and not what they have told us not about the probable cause at the heart of the matter why would you do something so unprecedented there still more questions and answers. >> bring in now brett is a former prosecutor. brett, first of all will director haynes assessment posed by former president trump storing this top-secret documents at mar-a-lago answer questions posed by congressman?

>> well, they have the ability to give congress information and hopefully they will. certainly the american public wants to know. the redaction itself has really been something does not shed much light. we don't know much more than we knew a few weeks ago in terms of the handling of these documents. we do know the president is entitled to have documents but he has the ability to maintain classified documents. he can also declassify. arthel: this a lot happening there what to make sure i'm following up reducing the president has the rights of classified documents at his beach home? >> what we know is the law allows for former of the united states to be in possession of classified documents. the question where they stored

properly? arthel: a library perhaps exactly, exactly. we note congress needs a plu plumber. what is a potential security risk of any lawmakers outside of the oversight committee leaking information from the assessment to make a political point? >> isaac chief counsel and the judiciary committee we used to joke if you wanted to keep anything confidential, do not give it to congress. it is impossible to predict. that leaking has been terrible over the last many years. we have seen it both in congress and the fbi and the white house and the department of justice. leaking has become a much bigger problem than it ever has been. arthel: got way up there potentially the supreme court as well. let me go here, did attorney general garland and the d.o.j. have probable cause to search

mar-a-lago? did they get former president trump specific instructions on what should documents they back? in enough time to provide those documents before the legal search? it reads like a civil litigation brief or a dispute among parties of what the law actually is that applies in the facts and circumstances. based on what we know in the unredacted portion that is not sufficient. but it could be in the redacted portion. >> don't we have to wait? bucks we do. what we can tell from what is unredacted it's very questionable why they pursued this in the manner that they did. they clearly have the ability to do it sooner if it was urgent. they waited months and months to do so. they were in discussions of

negotiations with unsecured documents they could have done that continuously until the gout they want too. >> of both sides the d.o.j. on the former president side both have their issues in terms of time. d.o.j. said we gave you ample time we bent over backwards so to speak because you were the former president for you to hand over the documents that we are requesting. the president side saying you did not give me enough time i gave you stuff earlier in the year. that was that i had nothing else in the d.o.j. comes back and said yes you do have something else. let me point out by the way, brett, what was handed over by the former president earlier this year it happened in jan january. and those at document 67 of those documents were marked classified. there were 92 labeled secret in 25 of those documents classified as top-secret. let's try this theory.

what if former president trump was on organize and did not follow rep record-keeping and filing protocol like its predecessors begin perhaps did not know what was in those boxes, wouldn't somebody know what's in those boxes? >> will certainly. there are a couple of things. one, merrick garland has the entire branch of the department of justice the olc the office of legal counsel pretty could have resulted a lot of the questions both sides seem to have. and remember you also have to show willfulness in terms of the espionage statute. if it's a matter and a rushed move and not knowing everything they have you still have it by the secret service. they have the ability to go in and out and decide what they wanted they did so earlier they had the ability to go in and look at the documents and request to take out why didn't

they do so? why pushes to a search warrant against a former president and political candidate? arthel: already discussed that per this is all and president we know this is uncharted waters. which is why all of the things happening seems so very strange to everyone. do you have any issue at all of why this is even happening? the fact whether he was in a hurry to get out of dodge or n not? these classified at the crux of the issue is that not bothersome on some level? >> that depends brief those documents with the documents surrounding the russian collision investigation and the president declassified them remove them because he wanted a copy felt the american people

wanted to have them, he has that ability of the president of the night safe to do so. >> no, we start out this segment by saying there are a lot of questions left unanswered. explain that to me the process of a president declassified any documents the it is personal telephone book of that's classified or top-secret intelligence information. does he just say i want this declassified and that is that? is that a process it's my understanding there is a process that could take a month even. ask the supreme court said his ability to declassify is unfettered. whether there is a process or not scholars dispute this. i have heard those say the very fact if he went to take documents with him and indicate they are declassified, they are. he does not all within those who have to go through a process.

when hillary clinton had classified documents she had no ability to declassify those. she would have had to go to the process. it is very unclear whether or not the president has any process in order to declassify. arthel: we are not going to get into hillary clinton that's going to take me another five minute with you what i don't have it. but last i checked she was not the president xi did not win. she has a different story here. but listen, for the sake of national security i think we all want the best outcome here, right? >> certainly. that is what we want to know what is in the redacted parts? arthel: and who got access to what wasn't it who had access to it for. >> certainly we want to know all the details. arthel: brett, thank you very much take care. eric: back in washington president biden now facing backlash from both sides of the aisle over the student loan forgiveness executive order that he signs.

been sitting here in the shade for a while but now border patrol just showed up. they are processing these illegal migrants. many we talk to have destinations all over the united states. texas republican governor greg abbott and arizona republican doug doocy have been sending busloads of migrants to new york city. and in washington d.c. but those are so sweet welcoming sanctuary cities hundreds of thousands of illegal migrants sending them to a sanctuary city like new york. the border of texas we sent to migrants in venezuela, nicaragua, columbia fox crew interviewed one migrant from cuba. he chose to make a 20 day journey from cuba to cross the border in texas. that migrants says he is a bartender and is going to try to find work or his sister lives in miami. >> what is your hope? >> freedom. i need freedom.

capability of defending ourselves, by ourselves. if you look back in history, look at what the u.s. did with lydia. when he wanted to send a message you sent a very strong message back then. you did not go with north korea and looked what happened with them. so yes, the u.s. and the europeans have the military capability to send a message for a but today the message sending is exactly the opposite. it is appeasement. they are ignoring all of the agreement for the just want to move on and say we are finished with the eye iran let's move to something else. eric: israel want something massachusetts on his same destroying his nuclear reactor is it possible for israel to have the reach to have the aircraft refueling capability to send fighter aircraft and bomb iranian nuclear facilities? and manufacturing facilities in the store areas in this type of thing? >> up eric, we took the decision
