she will tell lawmakers whether their stories posed a risk to national security. bill has time off. good morning, trace. >> moon to mar-a-lago might be the scene of today's show. house oversight leaders welcoming the dni's decision saying officials must swiftly move to mitigate any potential risk. at the same time federal judge is siding with the former president saying she intends to appoint an independent special master to review how the f.b.i. handled the documents. >> dana: all this after the f.b.i. unsealed a heavily redacted affidavit showed the agency had probable cause to believe that the former president was keeping classified information at his resort. some of it apparently dealing with spies and secrets. >> bill: former congressman trey gowdy is making the case for more transparency. >> perhaps some people have already made up their minds.

but many have not. they want more information. is this really about the return of documents or something else? what is at stake are two foundational beliefs that no one is above or beneath the law, not even former presidents. number two, similar facts should lead to similar outcomes. justice should be the same for everyone. and never be used as a political weapon. >> dana: david spunt is reporting live from the justice department. good morning, david. >> good morning. dni admiral hayes will be meeting with congress at some point after assessing some of these documents, hundreds of classified documents taken from mar-a-lago -- the white house to mar-a-lago during the trump presidency. several members of congress are told that haines and the

intelligence community will look at assessments to national security resulting from the disclosure of relevant documents. the former president's team is celebrating what appears to be a legal victory in court after a federal judge signaled she wanted to bring in a special master. a neutral third party arbiter to take a look at how d.o.j. is handling some of the evidence in this specific case. a special master could be a retired judge, an attorney that really has nothing specifically to do with the case but to make sure that evidence now in federal custody was handled properly. they may be able to return some evidence back to mar-a-lago not needed in this exact investigation. typically special masters are named by the judge although we don't know who the special master will be in this case if the motion is officially granted. judge cannon has to make that decision. right now it's on a preliminary basis. f.b.i. agents went to mar-a-lago three weeks ago

today. the federal government has had three weeks to look at the evidence. legal experts say it is too late for a special master as time is not on the side of team trump. the trump team says it's important to have the neutral third party view. the judge wants to hear arguments from both sides of the issue in person in court in west palm beach on thursday. dana. >> dana: all eyes to thursday. thank you very much, david. >> david makes a great point. 18 days the d.o.j. has been looking at documents but a victory for the former president. there is a neutral set of eyes looking at these things. >> dana: "wall street journal" editorial board saying the comey/clinton document standard on trump when hillary kept classified information on her private email server the justice let her off. it goes back to what trey gowdy was saying in the segment. you can't erase what happened back then. people are paying attention to that and so much else this morning. >> equal justice is the only comparison we have right now

the head coach visited robinson in the hospital saying he is in good spirits and wanted me to thank everyone for kind words, prayers and support. robinson played at alabama before being drafted by washington in the third round of the nfl draft. the commanders say he has had a strong training camp and was expected to be named starting running back for the season. one shocking aspect is the timing. it was before 6:00 p.m. yesterday so broad daylight nfl network is reporting he was struck twice in the lower body and hospitalized in stable condition. police are looking for two suspect who fled the scene. a gun was also recovered. this incident comes days after a woman in washington defended herself against an armed suspect. she had a gun pulled on her. when he demanded her car keys she resisted challenging the gunman to shoot her and now she is talking about the disturbing incident. >> gone are the days of having older neighbors who sat on the porch and watched and waved you on when you got home from work.

officers found the suspect dead with two firearms nearby. the department says no officer fired their weapon. >> there is no pill that is safe. these aren't made in a lawful lab. these are made on the streets, in garages, in your backyards. they are made by criminals. their intent is to harm and get our children adibted to drugs. what we need to do is first have the conversation with our children. >> dana: dire warning out of texas. officials say teenagers are the ones paying the price of deadly drugs flooding the southern border. in hays county three high school students have died in recent weeks. the grief must be unimaginable. senior correspondent casey stiegel live in dallas with more. >> good morning. this impacted community is southwest of austin and leaders with the hays county independent school district are calling what they have on their hands a crisis after a high

school sophomore died of a suspected fentanyl overdose on august 20th. the fire chief tells us sings the start of 2022 his department has responded to at least 16 fentanyl-related overdoses, seven of which have been fatal. two other hays county students. high school seniors, 17, died earlier this summer in separate overdose cases. again, three students now from the same district. officials say one factor largely driving these fatal cases are counterfeit pills. fake medications mixed with fentanyl. the person taking it has no idea until it's too late. >> we're talking about children as young as 14 years old. middle school parents, elementary school parents, begin to have those conversations as well. even if you don't think they're exposed to illegal drugs, you need to ask them. >> much of the fentanyl turning

up on american streets is being smuggled in from mexico. cbp agents seized many pounds last week at a street value of $400,000. major busts like this increasingly dominate the headlines. as we know, agents can only do so much and it's the drugs they don't catch that could wind up in your children's hands. >> dana: an important message to get out. casey stiegel, thank you. >> trace: let's bring in dr. eric wright the superintendent from the hays school district in texas. your schools are providing narcan for some of the nurses in your schools and you have to applaud that but you also have to ask and would you agree that by the time a student has to go to one of your nurses for a lifesaving remedy that child has been failed. >> it is a positive thing we have narcan on our campuses and

that. we're leaving all that up to law enforcement to track it but we know it's here and obviously we have had three deaths and it is gut wrenching. >> trace: what about the role that social media is playing in this, sir? how much of a role where you have kids going on social media and buying what they believe are prescription drugs and it turns out to be fentanyl? how do you combat that? >> you know, it's all about education and letting them know that no matter where you attempt to purchase illegal drugs, you have an opportunity to buy a pill that may be laced are fentanyl and may be the end of your life if you ingest this particular pill. >> trace: we talked to a dad last week who lost his son a couple of years ago and he said what he would say instead of hiring 87,000 i.r.s. agents, that we should hire 87,000 border patrol agents to protect our borders and keep this stuff from coming in. what would you say to that dad?

>> anything we can do to combat this crisis i'm all for it. today i really wanted to meet with you guys and get the story out just so that parents will start having those crucial conversations with their kids. often kids won't let their parents know when they are mental health or physical issues that may lead them to search for a remedy on their own. a lot of times people are labeled as addicts and they are really not. like one of the students that just passed, i met with their parents and they were really just wanting a pill to help them sleep. they got ahold of a bad one and it cost them their lives. >> trace: education is your big push there, sir. what are you telling the students in your district? what is your biggest message to them about this problem? >> just don't take a pill unless you have been prescribed that pill or you have received it through the pharmacy. just don't take it. >> trace: good advice.

podium jean-pierre defended the president's comments and took it a step further. what are republican voters saying in nevada if they paid attention to it at all? >> a lot of our voters most certainly don't pay attention to this stuff. they are worried about inflation, which in nevada we're at 15%, dana. and that's costing $10,000 a year, if you add the student loan bail-out another $2,000 a year estimated. grocery prices are at all-time highs. gas prices we're number two in the country just behind only california. so a lot of this stuff that goes on in d.c. and a lot of the media, our voters are most certainly not tuned into. i will say, though, that this divisive rhetoric is exactly why joe biden is in the 30s. this is why he is as unpopular

today's launch attempt scrubbed after a series of delays. overnight concerns about lightning from offshore storms that delayed fueling for nearly an hour. then while loading the rocket's super cooled liquid oxygen and hydrogen fuel engineers investigated to potential leaks and able to resolve the concerns but ultimately it was a problem with the temperature of one of the rocket's four engines that led nasa officials to scooub the lunch. because of the super cooled temperatures of the fuel the engines have to reach a specific temperature range in order to start. engineers do this by releasing or as they say bleeding a small amount of fuel into the engines. but one of those engines, engine three, was not reaching that temperature during the engine bleed. nasa officials determined the issue could not be fixed within today's two-hour launch window and decided to scrub.

the covid shot and at-home tests. charles watson is in atlanta, home of the cdc, with more. >> the white house says it's being forced to scale back and prioritize its covid-19 response efforts because it doesn't have the funding anymore. as we speak moving forward, the plan will be to stop paying for things like vaccines, tests and other treatments in exchange those products will be pushed to the commercial market where states and healthcare providers can purchase them directly. if we're talking about the immediate future, that means folks won't get anymore at the free at home tests the federal government has been providing to americans. the white house says that programs will be suspended by the end of the week. statement posted to covid.gov ordering through this program will be suspended on friday, september 2, because congress hasn't provided additional funding to replenish the nation's stockpile of tests. this is raising concerns about the uninsured and their ability

to access necessary covid treatments in the future. the white house says that will certainly be a consideration moving forward. meantime, the fda is raising eyebrows after confirming plans to distribute updated booster shots before human clinical trials are completed. the agency plans to rely on other sources of data to determine effectiveness. for example, they may look at research conducted in mice in older vaccine data. experts say it is not the best idea and want the fda to wait until all the data that comes out of the human clinical trials is available. the agency says, though, it cannot wait. >> the problem is, if we wait a few months until we have the kind of clinical data we had before, you can see what happens with delta and omicron. well be onto the next thing. we may not be able to provide people with the kind of protection that we would like that will hold them for a

smell weakness in the white house? >> i think that there are a litany of concerns about the nuclear deal with iran starting with the fact that this deal doesn't address iran state sponsorship of terrorism which includes their attempt to assassinate our former national security advisor john bolton. it doesn't deal with their ballistic missile program and the fact that we found uranium at three previously undisclosed facilities in iran as the president refuses to discuss as part of this deal. but the overriding concern is that there is no chance that any such deal could be incorporated into a treaty. democrats and republicans oppose it. that means the deal in and of itself is unlikely to produce what we want. iran is a nuclear threshold state right now. even if a deal were signed with the nuclear sunset clauses it would increase the time before iran could have a nuclear

weapon to a couple of years. there is a lot of concern out there and mostly also from the israelis who happen to live in the backyard in the middle east and rightly so. >> trace: nobody is more concerned as the israelis. the defense minister plans to vits. the purpose of the visit is to convey a clear message regarding negotiations between the powers and iran on the nuclear agreement. an agreement that will not return iran's capabilities years back and will not leave it limited for many years to come is an agreement that will harm global and regional security. he is not alone. there is a lot of agreement on that exact statement. >> there is. and look, i think part of this discussion that has to take place is what is our plan? the israelis have launched attacks on iran's nuclear scientists, most notably back in november of 2020. the director of iran's nuclear program.
