request and there didn't seem to be urgency to go through the material and what the fbi is doing is having a team go through it that walled off from the investigative team. the issue here is we have this -- obviously politics involved and appearance of political involvement from the beginning. they should be extra careful and they want the american public to believe they are going to keep things separate from the investigative team, but the department of justice team has been leaking grand jury material to the press and leaking other information to the press, so we're expected to believe they will keep these things separate, yet they haven't been able to fulfill their obligation with respect to the grand jury.

not sure why they didn't think there would be privilege issues within the documents and they should have taken every safeguard possible to do it right and have ashgsz peerance they are being fair and they have failed. >> todd: when it comes to the attorney-client privilege, this is not how at large. the president's attorney at that point, take a listen to her. >> imagine that i say i'm going to go into the white house and take biden's confidential records he has privately with his attorney, privileged records, no one allowed to see them, but the attorney and client. don't worry, we will go through what is good and isn't good for me and give back to you. go clean house. >> todd:

procedure that the client is the party that gets first crack at determining whether the attorney-client privilege attaches, not the prosecutor, isn't this perfect proof this search was overbroad from the start? >> it does seem like again, they should have taken safeguards here and at the front end gone to the judge and asked for a special master to review the materials and make the initial determination. they will never get around the allegation that the items or materials were co-mingled and you have to take extra precaution when talking about the former president of the united states and executive privilege and things like that. it makes no sense the way they have gone about this. they say we are doing this the normal way, they are doing things they normally don't do.
