we talked about how student loan forgiveness is hurting middle-class americans. thanks for watching the "the ingraham angle," gutfeld starts right now. " gutfeld >> a top agent facing accusation of political bias is out of the fbi. timothy thibault resigning as zero nothing on allegations he tried to interfere with the hunter biden laptop investigation. you're watching "fox and friends first." i'm todd piro. >> ashley: i'm ashley strohmier, chuck grassley raced red flags about theeb weeks ago demanding the fbi take action. >> i talked about and released

information of the political biassed of guy named timothy thibault on fuzzy newspaper reports. he started an investigation on trump, on evidence of criminality and hunter biden, he stopped that investigation. if you go back and look at timothy thibault's social media, you know he's highly partisan guy. >> todd: jackie ibanez has more. >> jackie: good morning, the fbi agent accused of running interference in the investigation of hunter biden laptop is resigning. he called it a career a month after accusation of political bias in the handling of the hunter biden probe. timothy thibault was accused of slow walking the investigation in 2022. in july 18th letter to director

1:03 am
connection with the biden family. the american people deserve to know if the fbi used facebook or others as plan to discredit information about hunter biden. the senators are asking for names. >> todd: thank you. miranda devine had this reaction to the news of timothy thibault's resignation. >> miranda: he is one of the cabal of the fbi officers who have been playing these games since the very beginning of donald trump's entry into politics and the crossfire hurricane, russian collusion hoax, that was the fbi and there seem to be unlimited number of
1:04 am
agents and analysts there to do their dirty work. >> todd: biden says -- saying quote the team identified limited set of material that contained attorney-client information, completed return of the material ask in the process of following procedure to address potential privilege dispute if any. >> ashley: a former dhs secretary joins us now, jonathan, so many questions. the one we will start with now, how is this okay for fbi agents to go messing in the former president's things? they took his passport, how is this okay and can they get away with all of this? >> that's a good question and you see the thing about the special master request that the former president asked for. that seemed like a reasonable
1:05 am
request and there didn't seem to be urgency to go through the material and what the fbi is doing is having a team go through it that walled off from the investigative team. the issue here is we have this -- obviously politics involved and appearance of political involvement from the beginning. they should be extra careful and they want the american public to believe they are going to keep things separate from the investigative team, but the department of justice team has been leaking grand jury material to the press and leaking other information to the press, so we're expected to believe they will keep these things separate, yet they haven't been able to fulfill their obligation with respect to the grand jury.
1:06 am
not sure why they didn't think there would be privilege issues within the documents and they should have taken every safeguard possible to do it right and have ashgsz peerance they are being fair and they have failed. >> todd: when it comes to the attorney-client privilege, this is not how at large. the president's attorney at that point, take a listen to her. >> imagine that i say i'm going to go into the white house and take biden's confidential records he has privately with his attorney, privileged records, no one allowed to see them, but the attorney and client. don't worry, we will go through what is good and isn't good for me and give back to you. go clean house. >> todd:
1:07 am
procedure that the client is the party that gets first crack at determining whether the attorney-client privilege attaches, not the prosecutor, isn't this perfect proof this search was overbroad from the start? >> it does seem like again, they should have taken safeguards here and at the front end gone to the judge and asked for a special master to review the materials and make the initial determination. they will never get around the allegation that the items or materials were co-mingled and you have to take extra precaution when talking about the former president of the united states and executive privilege and things like that. it makes no sense the way they have gone about this. they say we are doing this the normal way, they are doing things they normally don't do.
1:08 am
they normally aren't leaking to the press and doing other things. the attorney general needs to ep it is up and take responsibility. his pledge ae weeks ago to be transparent on this investigation, he's failed in every respect with the redacted affidavit. they owe the american public more than they have done here. >> ashley: switch gears and talk about the border, the white house is denying migrants are walking over the border. bill posted this yesterday, this upon has multiple times a day eagle pass. they do just walk across and are then released, it is that simple. back and forth between peter doocy and the white house press secretary and she said that is not true. is the white house just now deciding they are going to lie
1:09 am
toure on faces when we can see it happening over and over and over? jonathan turley /* >> jonathan: they are not even benefiting themselves by not telling the truth, it doesn't make sense. peter doocy's questioning was fantastic, he honed in on two horrible policies inconsistent with each other and colliding with talking about novak djokovic and things like that. everyone knows we have an open border and for them to claim we are doing anything other than letting people in and ignoring all the responsibilities they have for law enforcement, public safety, no one is buying it anymore, it doesn't make any sense. at least think of a new lie or

humans in the world being prevented from playing a socially distanced sport while border crossers can cross at will, some seen thousand percent surge in the virus. is that the best she can do? the facts are not on her side here. >> jonathan: it was pretty bad. i agree, what can they possibly say, a world-class athlete that doesn't want to take a vaccine, it maybe mitigates effect of disease that will not hurt him at all. the policy makes no sense and they know it. then the border policy, not only unvaccinated people coming across, they don't care, it shows this administration commitment to open border is
1:12 am
unwaivering, the dhs secretary willing to put open border ahead of national security, public safety, public health or obvious now willing to compromise integrity. in way, it is remarkable and impr impressive, bad for america, they are not waivering and the novak djokovic thing is funny in a lot of respects and you wonder where is dr. fauci on this one, he'll have an opinion about everything, labor day coming up next week, he'll tell you how many people can come to your backyard, but won't weigh in on this one. he should have been out front with the border issue two years ago and instead he'll sit down on this one and it is just remarkable how our public health officials diminish themselves by

instituting horrible policies, doubling down on them and unwilling to be honest, straight-forward and push back against politicians unless they are part of the politicians. it is just such a remarkable thing and it is amazing watching the issues collide and watch them try to handle it. >> ashley: just because you are vaccinated didn't mean it will protect you from the omicron strain. the biden administration paying to bus migrants to new york city, the el paso city manager says fema grants cover the bill despite the white house slamming it as political ploy. texas transported 7000 migrants since may. >> we have 5700 currently in our

disruption. a keystone pipeline worker joins me. forecasters are saying this could be heavy hurricane season with refineries in the gulf, one natural disaster away from a big catastrophe in the northeast, should people be worried with what we're seeing with these numbers? >> with lack of development in energy infrastructure, with things like tropical activity in the gulf coast and even major winter storms there is potential, but early last year colonial pipeline was hacked and shut down, i was hoping that would draw attention to how vulnerable our infrastructure in the northeast is where we have a heavy big population, relying on a few small pipeline. >> ashley: energy secretary

removing any issues impediment to gas delivery to cut down wait time at stations, just another example, this is not a natural disaster, but shows we have to be prepared for things to happen and we're not. >> most aggravating part about this, governor from michigan has campaigned on shutting down a major pipeline called line five, that supplies more energy to the state than this refinery does. i'm wondering what was her plan if line five was cancelled? declare state of emergency? politicians don't think things through and say things to get votes and don't realize consequences of actions. >> ashley: she said effect would be widespread, federal government needs to step in, this should not be left to governors of the states.
