washington, d.c., they cross into the country right here in eagle pass, texas. this is one of the busiest ports of entry in all the southern border. we want to show you live some drone video of an ongoing rescue mission in the rio grande river. the river is raging very fast right now. the water levels are very high because there have been a few days of rain here. the national guard is out in the river with rafts and boats attempting to rescue and help facilitate migrants who are coming from the mexican side of the river here into the united states. over the past couple of days some of the migrant groups have slowed down because the river was moving so fast. now picking up again today and we're seeing migrants make a potentially deadly cross into the rio grande river that is moving very fast. national guard is doing everything they can to prevent anymore drownings here. we'll keep you updated on the rescue mission happening now. this morning we've seen 150

migrants cross by foot and others swam across the river. they are wet and hugging loved ones, mother hugging a child. they made it across the river alive. fox news did a ride along with the police chief in a small town, texas not far from the border. a police chief pulled over a man from san antonio saying he drove to the border to see his aunt but he was given coordinates to pick up migrants and paid based on how many fit into his truck. the police chief tells us smugglers don't look like a menacing criminal. now everyday people who might want to make quick money by picking up migrants and giving them a ride. >> we have nurses that have done it, teachers, we have teenagers that are being targeted because, you know, easy money for a teenager. one of the oldest people we've appear rehenlded was a 77-year-old woman out here picking up people she doesn't

represents the desperation that you get along the border states. whether it's arizona, new mexico, texas, to some extent california. the sheer number of illegal immigrants pouring in, well over 2 million so far in the biden administration. if you count the ones they aren't catching, maybe as much as 3 million people have poured in. some of them are dangerous. we were told just yesterday that three illegal immigrants apparently are being charged with killing a deputy sheriff in north carolina. what abbott has done is clever saying to the northern liberal states if you want to be a sanctuary city, let me ship you a whole bunch of folks so you can practice being a sanctuary. i think that the liberal mayors all of a sudden find themselves faced with the realization that the problem on the border can't just be a texas problem. it is an american problem. and i think governor abbott is right to try to communicate

that to the whole country. >> sandra: it is also an american problem now to deal with this massive amount of drugs flowing over the border and now there are more massive drug seizures that we're seeing happen at the border, speaker. agents found nearly 12 million dollars worth of cocaine in a shipment labeled baby wipes near laredo, texas, 2,000 packages of the drug. the biggest cocaine bust in 20 years coming after a warning about rainbow fentanyl coming over the border. the white house was pressed on that yesterday. >> the big problem now that rainbow fentanyl. what is the president doing about this? >> we just talked about the day, the overdose awareness day that we are observing today. >> americans life expect tan sees are going down at a rate not seen in a century and that is being driven by drug

the border? you just saw footage of how uncontrolled the border is. and this is an administration which every single day lies to the american people. we have to recognize something which neither party has taken on as much as they have to. in many ways, mexico is becoming a failed state. the cartels have enormous power in mexico and as long as the cartels are as powerful as they are, i think they are a real danger to the united states not just from drugs but presently they will start exerting the same kind of violence here that they routinely exert in mexico. that's something people need to really think about. we have gone a long period of assuming our southern border was safe. now it is not only open but our next door neighbor is increasingly dominated by very violent organizations that are, i think, ultimately going to also seep into the united states and who get most of their money, frankly, from sales in the united states.

not being candid about answers and potentially moving evidence and not being forthright with justice department officials. the trump team filed a 19-page response to the government last night. the word obstruction or obstruct was not mentioned once in that document. today here at federal court the focus is on the special master. for those who have not followed, the special master is a neutral third party arbiter to come in, look at some of the evidence taken from mar-a-lago and potentially return some evidence, sandra, that is outside the scope of the investigation. the department of justice says a special master is not necessary because d.o.j. already had a neutral third party filter team complete a review of the evidence and d.o.j. claims to have the situation under control. the trump legal team said in the filing last night the government appears to argue simultaneously that a special master is unnecessary because the review is complete and that a special master is inappropriate because such an appointment would interfere

with the review process. the trump team goes on to say the subject of a search warrant, which means the former president always has the ability to seek neutral review of seized materials. the government says as an initial matter the former president lacks standing to seek judicial relief of oversight as to presidential records because those records do not belong to him. the presidential records act makes clear the united states has complete ownership, possession and control of them. the decision will rest today with federal judge appointed to the federal bench by president trump. she may decide on this or take time to think about it. a special master could be a retired judge, local attorney. someone not connected with the case. the hearing kicks off at 1:00 p.m. and expected to be quite lengthy. we're in uncharted territory involving a former president. >> sandra: we'll have the

>> sandra: confirmation of the devastating consequences pandemic school shutdowns had on american children. recent scores on a key national test show a massive drop over the last two years in fourth graders' education progress. "new york times" headline reads the pandemic erased two decades of progress. david lee miller is live with more on what we're seeing in this latest report. david lee. >> the nation's schools got a failing grade based on a government report that showed a big drop in post pandemic math and reading test scores for 9-year-olds. test results from this year compared to early 2020 showed a 7 point decline in math.

that's the first ever decrease since that data was first collected back in 1973. reading scores also suffered down 5 points. the largest drop in three decades. in both subjects, kids who already didn't do well in school had an even tougher time during the pandemic. so-called lower performing students had greater declines in test scores. education policy expert warns the findsings are a predictor of how well students might do in higher grades. >> i worry about the future given these scores because students who score low in early elementary school and then certainly moving into middle school are much less likely to see themselves as students and really engage in school. >> the study found that kids who performed the best during the pandemic had use of a computer, tablet and access to high speed internet.

students with higher test scores also had a teacher available to help with schoolwork almost every day. another takeaway from the data reveals the pandemic increased students seeking mental health services and resulted in more absenteeism. increased school violence and cyberbullying. >> sandra: we'll dig into that in a second. senator ron johnson is joining me now, republican of wisconsin who sits on several committees. great to see you. this is devastating, this report. it points out fourth graders being hit the hardest. but the declines, the report said, span almost all races, income levels and were markedly worse for the lowest performing students. they said i was taken aback by the scope and magnitude of this decline. this could take years to regain

that lost learning. >> so, sandra, i don't see how anybody can take a look to our response to covid and conclude it was a miserable failure. over a million americans dead. human toll of the economic devastation, what we did to our children. in addition to this study, rhode island hospital and brown university conducted a study that showed there was a 22-point drop in i.q. in infants born during the pandemic. what is so tragic about how we harmed our children during our responses, it wasn't driven by the science. school shutdowns and cdc response to how we were going to handle children was largely driven by the teachers unions. i've written oversight letters in terms of communication between the cdc and health agencies and the teachers unions and i have gotten no response. so this was not driven by science. remember how everybody was vilifying sweden because they

didn't shut down their schools? their children went to school, didn't wear masks. sweden's death per million is only 59% of america's. 1,894 people were million versus u.s. 3,223 people dead per million. not one of those swedish school children died from covid and teachers had a lower infection rate. our response driven by people like fauci and federal health agencies miserably failed in protecting americans and done great harm to our children. >> sandra: i'll ask you more how you and the republican party, if you regain control, plan to hold people like dr. fauci accountable. while i also note by the way the minority groups that are hit the hardest by that lost learning. black students lost 13 points compared to 5 points compared to white students.

i want to ask about the massive student loan hand-out. you are talking $500 billion. the white house, senator, as you well know continues to insist this is all paid for. how? with deficit spending. because of the drop in the federal deficit this won't cost americans anything. to that you say what? >> they are completely detached from reality. as i have been traveling around the state since this was announced, this is a major area of conversation and people are outraged by it. individuals that worked hard, sacrificed, paid off student loans or people working hard and never went to college at all, that debt is being transferred to their backs. it is grotesquely unfair and people are very upset about it. i think it was the penn wharton estimate about a trillion dollars. there is not a trillion dollars of deficit relief and doubt there will be deficit relief in anything the democrats have

we see across our great american cities. new york city was a beacon of light for so many people. now they are scared to visit. this is disturbing. the bail reform that took place in 2020, the one that took effect in 2020 is allowing criminals to go in and out of the system. judges have less discretion when it comes to what amount they can put on in terms of bail. you see report from the "new york post" where 10 suspects, 10 people charged with crime committed almost 500 crimes since bail reform took effect. she really needs to look in her own backyard. clearly before making comments which i know is all about the state of new york but certainly across the country. it is not helpful and the city is seeing outrageous increases in crime. >> sandra: why does it always feel like the democrats are targeting the legal, lawful gun

owners rather than targeting the violent criminals walking our streets? >> democrats are targeting unfairness. our cash bail system has only worked for the rich and wealthy. if you can afford to bail yourself out of jail you get your get out of jail free card. if you are poor and did not commit a crime you are stuck in the system. for example, one man spent time in ryker's for a crime he didn't commit 700 days in solitary confinement and later committed suicide. there is a real problem that the governor and democrats across the country are trying to address. judges do have judicial discretion. it does exist and they can decide when and where someone should get bail and be able to walk the streets. the cops have a tough job. we'll continue to see this go throughout the cycle. i know republicans are running on bail reform but it's something that only helps the wealthy. >> sandra: i don't think that quite addresses the question. why are they targeting lawful gun owners rather than those

using guns violently, that hold them illegally, to carry out crimes. they let them on the streets. on a national scale the "wall street journal" editorial board is kolg out president biden for his speech this week and crime control saying he misidentified the crime culture. it's a welcome line but remember that in 2020 such sentiments like defund police it was in the democratic party. mr. biden didn't offer any serious ideas to improve law enforcement. his speech was an exercise in damage control, not crime control. because gianno, can you point to any one policy that has been implemented by this white house that has effectively targeted criminals?

republicans and people who disagree with him on election reform is racist and said they were enemies of the united states of america. delaware acceptance speech he said we're not enemies, but fellow americans. a year later almost to the day he calls republicans enemies of the united states of america. so and the idea that he is going to give a prime time presidential address to unleash these kinds of attacks, i was the presidential speech writer and i wrote numerous prime time presidential addresses to the nation. they all had to do with a major policy initiative, responding to a tragedy like hurricane katrina or announcing some major policy initiative. i went back and looked at every president. not one have asked the networks to preempt programming to attack the other party before election day. it's unprecedented. >> sandra: not stopping the media from also parroting the

agenda, most people look back and say life -- compared with what's going on now life was good under the maga agenda. we had inflation was low, businesses could find workers, economy was growing, wages were rising, border was under control, crime was under control. gas was cheap, america was energy independent. enemies around the world feared and respected us and no shortage of baby formula. the maga agenda is not such a bad agenda when it comes to the actual policies of the trump administration. today none of that is true. the opposite is true on every front. i don't know that complaining about the maga agenda will have the effect he thinks it will. >> sandra: marc, with the minute or so we have left here. a lot of folks and critics are tearing into the president for spending 40% of his days as president away from the white house. president biden has spent 234 days on vacation out of his 589 total days in office.

rnc chairwoman said voters want republicans who actually show up to work. soon democrats will be able to join biden on his weekly vacations when americans vote them out in less than 70 days. the white house spokesperson pushing back on that saying it is a non-stop position. biden can do it from anywhere in the world and regardless of location he has taken fewer vacation days than the modern norm. your response, marc. >> i worked for george w. bush and he went to his ranch in crawford a lot but working on the ranch between cutting brunch and biking he was doing meetings with commanders in the field and having policy meetings. invited a lot of foreign leaders to his ranch which i haven't seen biden do. people wouldn't care about biden's vacations if things were going well in the country. if we didn't have the worst inflation and crime wave and the worst border crisis in american history. when americans are choosing between gas and food, they don't want to see the president biking on the beach. so if he does a better job he
