and fairness and equal treatment regardless of what political party you belong to. but that's a problem for joe biden because he hasn't been able to deliver on any of that. so he's resorting to name-calling and smears in the hope that it will save democrats in the midterms. joining me now is bret baier, anger of "special report" and fox news chief political anchor. it's very interesting that we've got a president and a politician basically trashing those people that were 73 million of them voting for donald trump who's not running as far as i know right now, but he's in the center of this midterm race. very unusual for a president and politician to go after the voters as opposed to other candidates. >> you're right, judge. this is political calculation today the white house press secretary said it's not going to be a political speech but of

course it's going to be a political speech. if it's essentially political advisors to president biden who have made the determination that they have to have this stark contrast setting into november. it's democrats versus the extreme maga republicans. the problem as you know is that 74 plus million voters voted for former president trump and some of them didn't like everything that trump did or said. but they like the policies. once you start going down the road, it's a dangerous political calculation. if you look back and played some of it to a speech that then candidate biden gave i october 2020, instead of treating each other's parties as opposition, we treat them as the enemy and this must end. the clips are easy to pull up. if this is a speech we think it's going to be by the excerpts. >> judge jeanine: but he knew that and the handlers knew that.

they think they can get the american people behind him with that kind of divisive speech? don't americans look to the president for some kind of collimating -- some kind of -- something that gives them a sense of support and a sense of togetherness? >> i agree with you and that's what candidate biden promised when he ran for office. when backed into a political corner, he's given a hat tip to the progressive side of the party in this speech it seems and will have to wait and see and hear what he says, but it seems like it's an effort to stir up the base and get them fired up for november. right now, i think democrats have moved some races, they've shifted a couple races around the country that have moved more toward the democratic way. dell might just buy the environment we have seen. but now after labor day people start paying attention and the ad start flowing and policies are on the docket here.

>> while, joe biden this week judge jeanine, launched his 2024 reelection bid. it's a way to stave off the 64% of democrats in his own party who told the new york time posters he wants to run. it's why he talks about climate change, abortion, january 6th, all the things that the fox news poll suggests give democrats a single digit advantage but the same independence in the fox news poll give the republicans like kevin mccarthy and his agenda and the maga republicans double digit advantages on which party do you trust more on crime and border security. inflation, national security, and so on and so forth. i think he failed his commander-in-chief and listen to the families of the 13 service members who died last year not necessarily because of joe biden. he's a terrible commander in chief and now he's politician in

chief. it's a big risk for him because i think any president is more of a squealer than healer, and for this guy whose accident-prone accidental president, absentee president, through absentee ballots, he's running a huge risk which he already has little goodwill built up among swing voters across the country will heal have to rely upon. you're very right, anybody who pays attention to this modestly knows that the first rule of politics is that you want to engage people and you don't enrage people. you do not insult people and you inspire people and we try to do that and president particularly one who ran affirmatively on the platform must do that. one last thing, and whenever but need to know that 234 of the 589 days joe biden has been in office he's either been on vacation or in some other leisure pursuit that had nothing to do with his job.

judge aileen cannon decision to make with no road map. unprecedented case unfold behind me at the federal courthouse in west palm beach, florida. attorneys from the government and attorneys for president trump argued before her today over this issue of a special master. we have been talking about this since the feds went into mar-a-lago on august #th. a special master is a neutral third party arbiter, someone to come in and look at the evidence at a distant view and see if some of that evidence should be returned that is not part of the scope of the investigation. trump's team says this is fine. this is food to have a person that's not a trump person or a biden person, but doj has problems with that. federal judge cannon indicated today she was skeptical of the government's opposition to having this outside arbiter examine documents. appoint ago special master. that's what she asked. this after lawyers for the former president told the american -- told the court, rather, the american people

don't trust the government when federal prosecutors claim to have already scrubbed, seized documents and p put aside those involving attorney general privilege and executive privilege. now today in court christopher, the trump attorney said quote these are presidential records in the hands of the 45th president at a place which was used frequently for work during his presidency. this is not some dod meeting, department of defense staffer stuffing documents in a bag and sneaking off. a special master will give greater confidence in the process but judge, the department of justice believes it's quite simple federal prosecutors say the former president likely violated the espionage act and committed obstruction of justice. trump's team does not address the obstruction in its filing. so right now, judge, we are waiting for this federal judge, aileen cannon to make a decision. she said she is going to do it in a written order. if it does come, it's possible it may slow down the criminal investigation that's brewing right now with the department of justice.

back to you. >> thank you very much, david, appreciate it all right. let's now turn to former deputy assistant attorney general tom dupree, good evening, tom, you know, a lot of issues here. this. >> judge: aileen cannon seemed inclined to have a special master appointed and she deferred today she didn't issue a ruling. what's going on here? >> that was pretty intriguing, judge, i thought she was going to rule from the bench shy didn't. i suspect she wants to take more time with this case obviously hugely important. she knows the decision is going to be apeeltd. it's possible she just wanted to make sure she got it right. >> the government is really fighting this issue of a special master. they said that, quote the appointment special master will interfere with our ongoing intelligence investigation in their papers. and, yet, why are they fighting so hard this special master is nothing more than an objective

third party. and they are moving so quickly to get it all done a and he yet. they say we are still working ton? >> yeah, you heard today from the hearing that the judge really pounded away on the government's lawyers because she kept saying what's the harm. what's the harm from the special master. and you are right. i think a special master is a neutral referee. might slow the process down slightly. at the end of the day it would give people a lot of comfort independent neutral third party referee supervising the process and making sure that any privileged documents are properly secured. >> and with respect to this, does the delay help either side? >> you know, it probably helps the president a little bit. in other words, when you are the defendant's posture a lot of times you will file motions, ask for extra procedures just to she things down a little bit. gives the trump defense team a little time think about presenting case, gathering evidence and doing what they need to do in order to defend this the doj turning the heat up

on the obstruction front as we have seen in the briefs the last few days. >> one of the things about obstruction. some discussion about obstruction as it relates to grand jury subpoena that was given to president donald trump to produce all the classified documents in lieu of grand jury appearance. and apparently there was an affidavit of some sort that said we have given you everything. and the doj said you didn't give us everything, when he handed over the 38 bobletion, i believe, in june. talk about obstruction. if the president didn't make that statement and his attorney made that statement what are we talking about here. >> i suppose the justice department could push a little bit on the lawyers. try to get them to dragnet and say who told you to say the things? what did you base your statement on? that's the tactic i suspect that doj is going to use here. you are right.

so far the justice department is focused on the advisers to trump, the lawyers surrounding him and people making statements on his behalf about what documents were stored at mar-a-lago and where. >> judge jeanine: yeah. one last thing that i want to say in reading the papers that trump's papers, one of the things he says you know, you say i don't have standing, what are you talking about, they came to my house. of course they had standing. do you think they have standing argument by the government off the rails? >> i got to tell you, judge, i was puzzled by that, too. look as you know the whole reason the fourth amendment oour constitution protect you and the sanctity of your home and if government agents can raid your home, cart your documents away and say oh, that's perfectly constitutional. i guess we have all been misreading the fourth amendment for a few centuries now. >> judge jeanine: tom dupree, thank you for being with us. as illegals sneak it, buses from the border are rolling out to democrat cities. and now, another big city mayor

baldwin is being sued by the family of fallen marine lance corporal reilly mccollum. reilly was one of the 13 service members killed during the pullout of afghanistan last year. now, his family is suing alec baldwin for defamation after the actor accused mccollum's sister, whose name is royce, of taking part in the january 6th riot. things went off the rails when royce posted a photo that she took of the rally outside the capitol. alec baldwin saw that photo and messaged her writing in part: are you the same woman i sent the money for your sister's husband who was killed during the afghanistan exit? when i sent the money for your late brother out of real respect for his service to this country, i didn't know you were a januar. mccollum responded, protest something perfectly legal in the country. and i have already had my

i'm going to start with you, cheyenne. when alec baldwin reposted the photo that your sister took of someone else and said that it was her, what happened to your family? it took moments from the time he posted for hateful, disgusting messages to start flooding into not only my sister's instagram, facebook, tiktoks, any social media. she started getting messages immediately and very quick after i also started receiving messages as did my brother's widow. >> and what kind of messages were they? >> we were called every name under the sun that i'm sure i can't share live. we are told we are racist. insur rexists, bigots. southern trash. we are from wyoming. and they still come in. we still get them all of the

time and it was hurtful, hurtful things. i have been told that i didn't love my brother and he deserved to die. >> judge jeanine: how did that make you feel and your sister? >> i mean, it's so hurtful. it's disgusting. it's, you know, there is people who are going to say mean things no matter where you are in the world. but to have it pushed by somebody who has such a following and influence on people to be told that my brother who died for these same people's freedoms diseenkd it because my sisters happened to be at the capitol on january 6th. she wasn't part of any riot or anything. she was nowhere near any of that. but we are being told that we are terrible people and my brother deserved what he got. >> judge jeanine: are you in fear? >> oh, yes. it -- after my brother's death, we saw the very, very good side

of a lot of people. i had flowers, gifts, things, mail coming to our addresses. so, people were able to find us for good things. and it's not hard to find us, obviously, so who knows who we are going to run into or who can just swing by either of our houses at any point in time. >> judge jeanine: counsel, you have decided to sue for $25 million defamation. where are you now on the lawsuit and what are your expectations? >> the expectations is that he will be held accountable. i think that's number one. number two we filed the lawsuit originally in wyoming. that's where the family is and we believe we had a strong jurisdictional argument there. unfortunately, the law hasn't caught up with the internet yet. the judge dismissed that on jurisdictional grounds basically saying because baldwin can't be sued in wyoming, he doesn't have a context with the jurisdiction. so we have refiled the lawsuit in the southern district of new
