women. >> steve: that's the bonus. >> brian: so important, too. the army recruiting is off about just under 40%. and it's just almost every branch even the air force which traditionally a much easier time. still people willing to serve and that's great. one of the most dangling things happened in owe you are country exit from afghanistan and the morale that dropped and people who served. was it alworth it. 7% were questioning their service. we don't and we truly appreciate you. you guys did great. the leadership was not worthy of the war fighters. >> steve: you know, brian, to your point. if will were to ask any of those members of the military that political question, i'm sure they would all have answers. but they are not to be political on tv. and, in fact, we knew that the speech that the president gave last night in the shadow of independence hall, you know, the white house had called all the networks and said can we have half hour of television time? all the major networks said no.

so it was ignored but it was clearly a political speech. the only thing missing was a balloon drop at the end. and we had heard earlier from karine jean-pierre it was going to be uniting the country. that the current president would not use any names. he wouldn't call out donald trump. but he did. he mentioned donald trump three times and he mentioned maga 12 times. >> rachel: yeah, you know, it's interesting because people -- by the way cnn, msnbc did carry it. >> steve: they did. >> rachel: none of the other broadcast networks did. >> steve: none of the major networks. >> rachel: interesting. because of the back drop of it, like, when you do a speech, a presidential speech, there's a lot of theater that goes behind it the lighting. >> steve: optics. >> rachel: exactly. and the lighting was so bad. it seemed -- it actually in some ways matched the tone of the speech. why don't we listen to a little bit of last night this is

everybody knows it. but he is saying after avoiding the president's name nor a year and a half, now he says it every chance he gets. according to the "wall street journal." it might be making progress, sadly. because it looks as they the generic poll it's down to 3 points and the democrats are back in play. we will see how it turns out. because it doesn't even bring up which, perhaps, the american people have standards when it comes to inflation and border, this stuff won't matter. here's kevin mccarthy last night. he tried to get ahead of this. >> in the past two years, joe biden has launched an assault on the soul of america. on its people, on its laws on its most sacred values. citizens are forced to making a gonizing choices. every single day just to pay the bills. you know, more than 20 million american households, that's about one in every six families have fallen behind on the

utility bills. the amount they owe has doubled since the beginning of the pandemic and winter is coming. >> steve: winter is coming. but november is coming. and quite smartly, what he was doing was he went to joe biden's hometown to talk about the issues. joe biden went to philadelphia to talk about, essentially igniting his base, which is not very interested. but, if he can make it about donald trump, that excite the democrats. and this closes the excitement gap. and that is what they are trying to do what are we 65 days out. something like that. and so what he is doing is talking about maga republicans. not all republicans were maga just like not all democrats, you know, love the squad. so, there are different factions within the republican party. focusing on the people who fall in line with donald trump. >> rachel: i would say the vast majority of republicans are probably maga republicans.

♪ >> rachel: the wait is on for documents that could shed light on the fbi's raid at mar-a-lago. a federal judge in florida delaying her ruling on former president trump's request for a special master who would review the findings seized from his home for executive privilege. we are going to bring in fox news contributor and constitutional law expert jonathan turley to break down this case. jonathan, so, the judge says we'll do this. we will release these documents or review them in due time. what does that mean for trump and why is she waiting? >> well, first of all, to appoint a special master she is going to likely want to go ahead and name the special master, that can be retired judge or

someone who has dealt with these cases in the past. so she may be just trying to get everything together. the expectation is that she will appoint a special master after indicating her intention to do so. you know, rachel, part of the problem here for the government is they adopted a position that was frankly absurd. i mean, they told the judge that the appointment of a special master would endanger national security. the judge pushed back on that for good reason. special masters appointed all the time. you can appoint a special master with a clearance. you have control of the documents. so, this is the same type of overwrought argument that the justice department used to try to blocked release of a redacted affidavit. they said they couldn't release a line of that without endanger national security. they released a lot more than that and they confirmed a lot of facts. and rome did not fall. >> rachel: exactly. in the boxes are also documents

that the president claims are attorney general are privilege. so, what can -- what happens there? i mean, he has -- they have already looked at them. isn't -- how do you unwind that, you know, process or how do you unring that bell? they have already seen the document. the fbi. >> the trump team should have filed -- the trump team should have filed this motion a day after the raid. there is no question about that. and so you won't get that cat to walk backwards. you know, they have the department of justice rushed to look at all these documents, use their tag team. they knew there was a special master could be appointed but never requested. there is still a value to a special master in this case to have an independent person looking at these documents, separating them out. i mean, what was weird in court is that the justice department is saying, you know, these are our documents. they don't even have the right to ask for a special master. and what are you talking about? i mean, these -- you admitted that you may have gathered up,

attorney-client material. i would surprise if they didn't. this was absurdly broad warrant. so saying that these are all your documents, that's the point ever the special master to decide whose documents they are. and it is those arguments that make me really whether attorney general garland really read these filings. i can't believe a judge would sign off on some of these arguments. >> definitely makes one think that this is political. it does not make a lot of sense. but it also, as you mentioned. why didn't his attorney, donald trump's attorney do this right away? it also speaks to quality of his team, perhaps. jonathan turley. thanks for joining us this morning. >> thank you, rachel. >> rachel: you quote it. still ahead, we go inside fort hood, will cain takes us behind the scenes to the heart of our nation's myrtle training and readiness. stay with us. ♪
