piece of damming evidence. >> bill: new video shows the suspect standing by the passenger side of that s.u.v. and cleaning it out. this was taken only hours after fletcher had disappeared. >> dana: we're learning more about abston's criminal history. authorities confirmed he was charged with rape at the age of 14. he was 16 years old when he kidnapped a memphis lawyer at gun point and a 24 year prison sentence and released four years early from that. team fox coverage plus reaction from the prosecutor who is overseeing this case, shelby county district attorney. let's begin with jonathan serry with a live update from memphis. >> the second day in a row we've seen the defendant appear in court for an arraignment. today on new charges including first degree murder and first degree murder while kidnapping stemming from police positively

identifying the body of eliza fletcher. video spotted the mother of two being forced into an s.u.v. while going for a pre-dawn jog friday near the university of memphis. the s.u.v. was traced to her alleged killer. authorities discovered fletcher's body behind an abandoned duplex. >> the outcome of this investigation is not what we hoped for. we are nonetheless pleased to remove this dangerous predator off the streets of memphis. >> during his arraignment yesterday on the initial charges associated with the kidnapping, cleotha abston said he could neither afford his bond nor an attorney. the judge appointed a public defender to represent him and the judge is likely to consider a motion to revoke his bond based on the new murder charges he faces. the victim's relatives say they're heartbroken and

devastated by the senseless loss but now time to remember how special she was. one tribute is this video fletcher made for her kindergarten students at st. mary's school. she sings this little light of mine and introduced the class to her dog. this friday morning at 4:20 a group of female joggers will meet near the area where fletcher was abducted and complete what would have been the course she would have taken while jogging. back to you guys. >> dana: thank you. >> bill: shelby county d.a. is with us now. thank you for your time. we're waiting for court to begin there. yesterday you said repeat violent offender deserve a strong response. this offender didn't serve all the time. had he served that time would this mother still be alive?

>> well, it's impossible to say. clearly he would not be released right now, right, if he was serving his full sentence. we don't know what would have happened after that, but clearly this particular crime would not have occurred, yes. >> dana: we take a look at his rap sheet going back. from september 4, 2022 especially aggravated kidnapping was the most recent one. if you look back to when he was a juvenile, records from 1995-1999. left, aggravated assault with a weapon and rape. would you support changing any of the laws that would have kept somebody like cleotha abston in jail for a longer period of time given his violent crimes in the past? >> our office opposed parole in this case and i think appropriately so given his

extensive record of violent crimes before the conviction for the kidnapping. but a law that would say that no one could ever have parole, i don't think is the appropriate way to go. we tried something similar to that in tennessee a few decades ago and the result was crime did not go down but prison budgets ballooned and the governor of tennessee opposed the recent truth in sentencing law for that reason. the idea one could never have parole regardless of how good their record was, i don't think that really makes us safer over the long run. there clearly are cases where person's individual records are so bad like in this case that parole should not have been granted. >> bill: first degree murder is as serious as it gets. are you learning something about this case that we don't know yet that still has stunned

you, perhaps? >> well, if i did, i wouldn't be at liberty to discuss it. there is an ongoing investigation there are restrictions what a prosecutor can say. we wouldn't be bringing first degree murder charges unless we were confident that we could prove these charges beyond a reasonable doubt. >> bill: is the brother cooperating? >> to my knowledge, there is no active cooperation on the part of the brother. we're at a point right now where things are very fluid but i can't say anything about cooperation by the brother. >> bill: it was reported over the weekend that the brother told investigators that he saw the suspect cleaning out that vehicle near his home. is that true? >> i can't comment on individual items of evidence.

i understood your question to be getting some sort of deal with the prosecution and i don't know about that kind of cooperation. as to individual items of evidence, i'm not at liberty to discuss right now. >> bill: can you say the brother helped or assisted in any way? >> i would really rather not comment on that. i will say we got information from a variety of sources and we are confident that we have the ability to prove our case. >> dana: maybe a last question. there is a grieving family and a shaken community. you are the prosecutor there. your general message to them this morning. >> so there was an outpouring of affection and grief and concern from the entire community. this was a beloved member of the community. she touched a lot of lives. we have a community that's grieving. we have a community that's afraid. and i think i want the community to know that law enforcement and the d.a.'s

office is doing everything it cannot only with respect to this case, but other pending cases, to make sure that residents in shelby county are safe. people deserve to walk about their streets and without living in fear. people should be reassured we're on the case and we understand the grief and the fear that they're experiencing. >> bill: sir, thank you. we're watching for court today. the d.a. there in memphis, tennessee, shelby county, thank you. >> thank you. >> dana: the "washington post" reporting some of the classified documents the f.b.i. seized from former president trump's mar-a-lago estate contained foreign nuclear secrets. griff jenkins is live in washington there is a leak every day. this news breaking last night. >> that's right, dana, good morning. the "washington post" who you remember previously reported early on that f.b.i. agents were looking for any documents

related to nuclear secrets in the august 8 search reporting this. a document describing a foreign government's military defenses including its nuclear capabilities was found by f.b.i. agents. the post adds only the president, some members of his cabinet or cabinet level official could authorize other government officials to know details of these special access programs and they note such documents would likely require being kept in a secure compartmented information facility or scif. earlier this morning senator marco rubio had this reaction to the report. >> first of all again we really don't know. let's go back and understand that all of this information is coming from one side and one place, and that is sources with knowledge of the investigation. who are the sources of knowledge of the investigation? the f.b.i. and justice department. they are leaking to the media. >> this comes as federal judge cannon ruled a special master will be appointed to review

nearly 13,000 documents seized from mar-a-lago, more than 300 contain classified markings. the judge halted the government's continued access to the documents. she did allow the director of national intelligence to maintain access to determine any risk assessment to national security. finally neither the d.o.j. nor team trump is responding to our request for comment. both teams are facing a friday deadline to name potential candidates for the special master. >> dana: thank you. >> bill: so this is breaking as well. former trump white house stage gift steve bannon expected to turn himself in tomorrow in new york city expecting to face charges in a state criminal matter. the "washington post" reports he is accused of lying to donors who gave money to fund southern border wall construction. a similar federal case ended when president trump pardoned bannon. he calls the new charges phony and a political weaponization

for corruption. put that aside for a moment. he has been in office since i was in kindger gar ten. i'm the wife of a border patrol agent. he can say whatever he wants. the reality is he voted against infrastructure for the southern border and why the national border patrol council is endorsing me and not him in this race. >> bill: biggest issues among texas voters in a poll. overwhelmingly 29% say the border is issue number one. all about immigration. cassie, we have had henry cuellar on our program a lot. he is the lone house democrat who is pro-life. you are pro-life as well. he is also big on border security as well.

on those two main issues it seems like you are both riding the same commonality. do you agree on both those issues. what would a voter in your district select you over him or vice versa because of that. >> talking to voters every day in the district they tell me he has been there too long but nothing to secure the southern border and lost the endorsement of the national border patrol council. top issues in the district are gas, groceries and securing our southern voters. i get democrats every day saying i voted democrat my entire life and i'm voting republican come this november. we're talking about the values of pro-life, pro god, pro family. we're hard working. democrats are left the hispanic community. we're excited and running a fantastic race and so many supporters on the ground now and running on real issues that impacting everyday americans. we want a strong and secure

administration for colluding with social media companies to censor speech the court just ordered the d.o.j. to produce records from key white house and hhs officials like dr. fauci, white house press secretary and others. i reached out to the white house press secretary. no comment about this ruling. administration official tells me the president believes in freedom of speech but also believes it's important for almeida platforms including social media to represent factual, scientific information. now in the lawsuit joined by the louisiana attorney general, they identified 45 officials from this administration with contact with social media companies over misinformation including some with monthly meetings. so i asked the white house press secretary about this on friday. listen. >> so i don't have anything to share with you on that. i won't comment on that at this time. >> the attorney generals from missouri and louisiana say that it is a vast censorship

desperate over the lack of progress in ukraine they have might be about to shake hands on a huge arms deal with north korea. morgan, welcome back here. this hasn't been confirmed but if it were to happen, what would that tell you? >> well, i think the press secretary kirby, admiral kirby was right about the failure of the russian industrial base. you are looking to have to go overseas to north korea to even iran to supply basic needs for the war and shows, i think, the export controls have been effective and shut down those assembly lines but makes russia look desperate. bigger than that, the problem is that north korea is sanctioned at the united nations. russia and no other state should be doing this sort of business with north korea.

you have the whole issue of energy. no one knows what will happen this winter? there is significant concerns that russia could cut off gas supplies to europe. "wall street journal" writes, germany's nuclear power half step keeping two of three reactors online is a tentative nod to reality. the point being germany reversed itself on closing power plants because they don't know what the deal is with the gas pipeline but also shows you the drive for green energy comes at a cost. in this sense, the cost is national security potentially. >> that's right. i think this is the canary in the coal mine for the united states as well. there is a lot of things that are similar here. if you look at what california is doing and telling people not to actually plug in and charge their electric cars looking at rolling black-outs, we should look at what is happening in germany and western europe as a warning sign that if we do not take our own energy security

needs seriously, this could happen to us. as we know famously, president trump warned germany and others about their reliance on russian energy and as a republican party and many people in national security in my line of work for a long time said america has to be energy independent. that's why we have always pursued being able to export and drill here at home. so what you are seeing now again, i think, is a very stark warning that if you pursue these climate change policies in and of itself without looking at the ability to be able to charge your electric car, heat your house for the winter, cool your house for the summer, we could be a very serious and precarious position the way germany is right now. by the way, it's of their own doing. this is a manufactured, manmade crisis by poor, poor policy decision making and putting

lately you might not recognize president biden as the candidate who campaigned on turning down the temperature after his week's long assault on maga republicans that started by likening the trump agenda to semi fascism. after first having to clarify he doesn't consider trump voters a threat to democracy he is now making the case his rhetoric was geared toward mega lawmakers. i want to be clear not every congressional republican is a maga republican. i know because i've been able to work with these mainstream republicans. an extreme set of maga republicans in congress have chosen to take us backwards. together we can choose a different path. republicans, though, say this hit and run strategy from president biden plays well for the g.o.p. in the mid-terms. >> biden keeps going around the country and goes to every swing state and gives his raving lunatic speech everywhere around the country. democrats aren't showing up to say let me be part of your speech.

the problem you are dealing with there. >> thank you for having me this morning. we had six of our facilities that were damaged during the flood. three of those schools had 6 to 8 feet of water in them. central office, another gymnasium and alternative school all sustained damage. >> dana: are the kids still at home waiting for the ability to go back to school? >> yes. we have not been able to start school yet. we have set the date of september 21st to be our first day with students. we have been able to relocate the schools that were damaged in existing facilities and share space. >> dana: how has this community come together after this tragedy? >> i think that's one of the positive things we've seen is neighbor helping neighbor. people who have lost everything have been working at our donation sites to help get others what they need. it has been a beautiful thing

to see the generosity of people, neighbors and neighboring states and counties have all joined in to help support the effort to clean up. >> dana: do you have a plan to help students who might have already, one, suffered from learning loss during the pandemic and now having this delay to the school year, is there a strategy you and your teachers have to try to get them up to speed? >> definitely. first the immediate needs. get them in school and we can identify any immediate things they have at home. we have students coming to us that will be living in tents or other types of temporary housing and have some immediate needs that we need to take care of. we have great partnerships with the medical facility and mental health facility and able to meet the needs they have as well as their everyday needs for food, clothing, those types of things. >> dana: flooding is so difficult to deal with. one, you lose your possessions and it takes a long time to

either clear out and rebuild and you have a lot ahead of you. one thing you are trying to do is restock the library. how many books do you think were lost there and has the effort that you are trying to do? >> we lost three libraries, two elementary and middle school libraries. every book and bookshelf and technology. we probably had more than 20,000 books. we had a local office who reached out to help in the book drive and put out the social media post and had an overwhelming positive response. we've gotten books and donations from across the united states. and all across the country to help restock the libraries. it's overwhelming and we're now out of storage space. luckily i think we'll be fine with books. >> dana: in case people have books i understand you don't want to be too overwhelmed. book donations can be mailed to 752 hazard road.
