"the faulkner focus" is up next. here is harris. >> harris: we begin with a fox news alert. if anyone thought texas was messing around they were wrong. democrat-led cities are definitely getting a bitter taste of what texas has been dealing with on the southern border with mexico. new york city mayor eric adams just sent his staff to the lone star state to finally witness the crisis firsthand. i'm harris faulkner and you are in "the faulkner focus". yesterday that so-called fact finding delegation met with border patrol and saw river crossings along the rio grande. the first time new york city officials have been down to the

border. they made the trip as more of those buses from texas have been arriving in manhattan, including today. texas governor abbott's office giving us a breakdown of the numbers so far. new york city 40 buses carrying 2100 illegal immigrants hoping to stay in the u.s. washington, d.c. 180 buses carrying 8,000. and chicago the newest destination three buses carrying roughly 150. chicago's mayor lori lightfoot is not going to the border but she is going to d.c. it's about cash. the sanctuary cities want lawmakers to give them federal cash to pay for the so-called conditions they're facing on the ground. lightfoot with choice words now for the texas governor. >> this is entirely within the knowledge of the texas governor who he is putting on buses when they are coming, what their

specific conditions and needs are. the same thing he is saying hey, i need more help, so do we. he is treating these human beings like freight. all this is about is a manufactured political crisis. >> harris: new op-ed calling out that liberal mayor. the headline, lightfoot attacks texas to not look at her failures. let's not even talk about crime in her city. that includes 46 people shot in her city over the labor day weekend. senator john cornyn from the great state of texas is in "focus." first let's go to garrett tenney in eagle pass, texas. garrett. >> harris, this visit to the border is significant not only because it's the first time officials from a sanctuary city have come but also an acknowledgement of what leaders in border states have been saying for the past year and a half. this is a crisis and the federal government needs to do more to help.

fox news cameras were the only ones here yesterday when this delegation met with border patrol officials along the rio grande, a focal point for the migrant crisis. the group also got a small glimpse of what officials are dealing with on a daily basis when they toured a recently build cbp processing facility in eagle pass that was packed with migrants waiting to be processed. some of the big questions is what kind of impact did the trip have on the staff and how they view this crisis and the biden administration's handling of it? we just got a statement. here in new york we'll continue to welcome asylum seekers with open arms as we learn more about the process, meet with real partners and see firsthand the reportedly inhumane conditions that asylum seekers are being subjected to in texas. the mayors are asking the federal government to give them more resources to handle the

relative handful of migrants they've received while small towns along the border have been flooded with tens of thousands of migrants over the past year and a half. texas governor greg abbott's office tells us the invitation is still open for mayor adams to visit the southern border and see firsthand the devastating impacts on the biden-made crisis on towns smaller than a new york city borough. if texas hadn't bused the migrants up north this delegation from new york likely never would have come to see what's happening for themselves. harris. >> harris: likely, i would say never. i mean, look how many of them have been coming across the southern border of our nation for months now and no one has gone down there like this. so no, i think you're right about that. garrett, thank you very much. republican senator john cornyn of texas joining me now. great to have you in focus today. you know, simply getting a

reaction to mayor lightfoot isn't enough. it is more than just a reaction. they are finally feeling some of the pressure that you have been feeling along the border for quite a while now. >> well, you begin to wonder what does it take to get president biden's attention? and hopefully the mayors of new york, chicago, and washington, d.c. can do that because 108,000 americans have died of drug overdoses of drugs that came across the southwest border and president biden and his administration apparently haven't noticed. and 2.3 million migrants have flooded the border overwhelmed border patrol and border communities. so i think governor abbott is doing the right thing trying to get the attention of people who might be able to get president biden's attention so we can actually fix the problem. >> harris: you know, cheryl

casone and i were looking in depth at this. you are getting so hard in texas, too. the drug cartels want it to happen to you so they can work the arizona crossing points with their tunnels and so on and so forth. are you now being targeted like never before. you can just look at the numbers. >> well, the welcome mat is out. secretary mayorkas, the secretary of the department of homeland security said the border is secure but all you need to do is watch with your own eyes to see that is a false statement. they are living in a different dimension and fantasy world. they are hoping that people won't notice because the progressive wing of the democratic party actually believes in open borders and that's exactly what we have and this is the consequence. >> harris: we have a generation of young people getting hit by fentanyl and we know china loves that. they make more of it than anybody else in the world.

you mentioned the president of the united states, senator, trying to get his attention. the white house, i don't know if they're listening. check this out. watch. >> senator ted cruz of texas, he suggested that you come down and see for yourself whether migrants are actually crossing the border. >> i've been to the border. one thing i will say is i certainly don't need lectures or invitations from republicans about the border or border policies. i will use this opportunity to invite him or anyone else next time to vote for record funding for dhs. >> harris: wow, that got chippy. your reaction. >> they are willfully ignorant of what is happening at the border and my only hope is that the mid-term elections coming up in two months that the voters will send a very loud and clear message that this is

unacceptable. we've been experiencing this for a long time now in texas because of our 1200 mile common border with mexico. literally there are people coming from around the planet. we have ukrainians showing up claiming asylum on the southern border. we have people from a variety of different countries, of particular concern because of terrorism showing up at the border as well as all of these drugs that, as i said, took the lives of 108,000 americans alone. >> harris: it's interesting when you say that. some people would have asylum, you know, court sessions to come up and they could stay particularly those people from ukraine. but they can't even get through the crowds at the border because the drug cartels are flooding the gates and they know exactly what they're doing. >> that's exactly right. >> harris: damage control mode for the white house and president biden on this, non-stop criticism after he repeated attacks on maga supporters. the president now doing a delicate dance when it comes to

that line of attack. he wrote this in a tweet. i want to be clear not every congressional republican is a maga republican. i know because i've been able to work with these mainstream republicans. but an extreme set of maga republicans in congress have chosen to take us backward. the name calling is non-stop. >> i don't think we should be calling our fellow americans the enemy. we are all in this together. president biden was elected as a unifier and he hasn't unified the country. it has become more polarized if anything else. this is purely an effort to try to energize the democratic base in the mid-term election. he knows his polling numbers are bad and he is likely to drag down some of the candidates running for the house and the senate. this is the way he is trying to energize those voters for the mid-term elections. i don't think it will work. not a message we expect from the president of the united

states and he should be trying to unify and lead the country together, not separate us and divide us. >> harris: how embarrassing is it for the democrats not to learn the lesson from hillary clinton who called hers across from her in the political aisle deplorables. >> unfortunately there are some people you can't embarrass. they are willing to do or say anything in order to achieve political power and that's what i think this is. but coming from the president of the united states is completely inappropriate and again, just the joe biden that people voted for in 2020 was joe biden who said he wanted to be the unifier, not the divider. >> harris: let's get to the mid-terms you just mentioned, 62 days away. we have a countdown on "the faulkner focus". and house minority leader kevin mccarthy is looking to lead republicans to victory in the house and rolling out a four-part pitch later this

month to tell voters why they should show up for the g.o.p. the commitment to america plan focus essential on four major points. strong economy, safe nation, a free country, and government accountability. a unified message is what he is calling for. something larry kudlow says president biden is failing on right now. let's watch. >> biden's america is not the america we love. biden's america is not the america that works. biden's america is authoritarian, it is dictatorial, it is devoid of truth and more divisive than anything we've ever seen. joe biden's america will not stand. simply because americans truly, truly believe in freedom and democracy. >> harris: and what kind of america under republicans, that's the focus right now, senator? >> well, larry is right. that's not the kind of america

people are aspiring to, one that divides our country and ignores some of the biggest problems, things like paychecks, purchasing power being reduced because of the highest inflation in 40 years, public safety in tatters because of the disrespect and demoralizing of law enforcement agencies and the border which we've already talked about which is basically on fire. we have a lot of challenges, but we can face these challenges if we work on them together. but we can't help make things better if we ignore the most pressing issues. so i'm glad to hear the house and speaker mccarthy talking about their plan. we'll be talking about much of those same things in the senate races leading up to november. >> harris: that was my follow-up. will this be, in fact, a united

message? great to have you in focus. thank you. this won't be a surprise to you if you've been following what's going on at america's school. voter satisfaction in education now at its lowest levels in decades. a political divide on that issue that could play out on november 8th. plus the big controversy in a race that could decide the balance of power in the senate. democrat john fetterman says he will not debate the republican candidate dr. oz. fetterman is recovering from a stroke as you may well know. critics say there is a different reason for why he is dodging. >> he can't come out in the open and debate even if he was healthy. he couldn't defend his record. so he is going to try to be clever about dr. oz and try to have cute things to say but he can't defend his record.

in may. the candidates were scheduled to debate yesterday in the first of five meetings before the election but fetterman backed out at the end of august. a g.o.p. group has flagged his labor day remarks where he seemed to be struggling. >> send me to washington, d.c. to send -- so i can work with senator casey and i can champion the union way of life in jersey -- excuse me, in d.c. i live eight minutes away from here and when i leave tonight, i got three miles away, dr. oz in his mansion in new jersey, you've got a friend and you have an ally. send me to washington, d.c. >> harris: hum. dr. oz has accused fetterman of lying about the seriousness of the effects of the stroke and ramped up his criticism this way. >> i think he is insulting the voters of pennsylvania by dodging the debate. he is dodging their questions

and questions from the press. his campaign says he is doing fine and he said that as well. yet he doesn't debate. i can only assume because he wants the avoid answering for some of the far left radical comments that he has made. >> harris: a few minutes ago fetterman said this. it is about mocking john for having a stroke because they have nothing else. power panel now, lisa boothe, leslie marshall both fox news contributors. all right. i'll come to you first, lisa and get the baseline where you think the race is. >> fetterman is not healthy. we all saw the clip and heard him try to string sentences together. if he not healthy enough to debate he is not healthy enough to serve in the senate and the same with joe biden when they stuffed him in the basement. crime in the streets and high gas prices. because fetterman looks like a

hobo doesn't make him a man of the people. this is a guy who lives off mommy and daddy until recently. not only is he not a man of the people but not even a man. he says that he is to the left of bernie sanders. we should believe him. he wants to put the screws to the middle class by banning fracking. the guy hires convicted criminals for his campaign. let criminals out on the streets when he was lieutenant governor. he is a disaster for the state of pennsylvania and disaster for the country and not healthy enough to serve in the senate. >> harris: you know, ironically usually leslie, i would say well, we aren't doctors. dr. oz is a doctor. so, you know, he will weigh in the way he weighs in. lisa just put it out there, if you aren't willing to debate and you have five of these on the calendar and you won't even do one, what does that say? >> a few things, harris. i the other day interviewed a neurologist on my radio show about this and he said when you

have a minor stroke such as john fetterman has had, it does take some time to get back to 100%. if he were to debate right now, you are kind of forcing the neurotransmitters to go in the fast lane on the freeway and you will get to the same point but you want to take it a bit slow. i think that fetterman will debate dr. oz but what really bothers me here, harris, when we attack the person and when we try to become medical professionals ourselves, i mean, fetterman's physician knows what is best for fetterman. it makes my skin crawl when i see a medical like dr. oz attacking somebody personally and medically. >> i think he has been quite gracious. >> the numbers we're seeing, so much emphasis on this race by the republicans is we're seeing

incredible fundraising for fetterman and -- >> harris: there is a lot of emphasis on both sides. we'll move on. >> if you actually look at likely voter surveys, the race is tightening and in striking distance. the reason fetterman doesn't debate, he is not healthy. you don't have to be a doctor. watch the man. he can't put sentences together or complete a word. he is not healthy enough to debate and not healthy enough to serve in the senate and radical extremist policies that he is trying to hide. obvious to everyone, you can see it. >> harris: as i hear you say that, there are 62 days left, so if his stroke was between 90 and 100 days and his doctor thinks he needs more time those debates aren't going to happen after november 8th. that's again why this is such an issue. will voters really get to see who these candidates are with fetterman on the stage taking on dr. oz, who is willing, ready to go before they go to

the polls? some of them are going to vote early. this matters. this especially matters because of what is on the line on the hill, right? if a red wave or pink wave, they'll take some seats. the stress for democrats in the senate is important. your thoughts. >> well, obviously any time there is a mid-term election as a democrat i have stress. republicans show up in mid-terms to votes in numbers bigger than democrats typically. you need one seat on either side to get a majority. so whether it's the pennsylvania race or any senatorial or house race we have some nail biters. i like the numbers i see come out in the senate for democrats. i don't like the word tsunami and like to see it changed between now and november.

>> i wouldn't. >> harris: lisa, quickly. >> there is a big problem right now with the media and the way people are looking at these races. registered voter surveys are garbage. they don't tell the story. there is a tighter reflection of the reality. likely voter surveys who is planning on voting republicans are much higher. you look at the likely voter surveys up by 5 or 6 on the congressional ballot alone. it's to suppress the vote and suppress republicans and get doaners to think the races aren't viable even though they are. >> harris: good to see you both. thank you. >> thank you. >> harris: well, the suspect in the murder of that memphis, tennessee teacher was back in court today. a judge ruled with new information in that case and new questions about the investigation into president

trump and those documents. they have the special master now. everything is on hold with that investigation. the f.b.i. and d.o.j. taking a look at things because a victory for the trump side. that special master will take a look at stuff. >> these people every single day are strategically leaking information that can't be rebutted, by the way, or in any way analyzed for a reason. that's politics, to influence the narrative.

justice department. david. >> the post reporting that former president donald trump had in his possession a document that describes the nuclear capabilities of a foreign nation in unnamed mystery foreign nation according to the post, those documents back in the hands of the federal government, the department of justice. the post also reporting some top secret documents taken if mar-a-lago have information so sensitive that only the president, members of his cabinet and a few others were allowed to read those documents. a trump attorney to fox news this morning said quote, even after the court noted specifically in its order that president trump faces an unquantifiable potential harm by way of improper disclosure of sensitive information to the public and asks counsel for the united states directly about leaks, they continue with no respect for the process nor any regard for the real truth. this does not serve well the

interests of justice. judge eileen cannon ordered the appointment of a neutral third party special master to go over the thousands of documents taken from mar-a-lago. cannon told d.o.j. to hold off using the seized documents in the investigation until a special master is done with his or her work. former attorney general bill barr in the last hour says the justice department, his former agency, must appeal this ruling and criticized judge cannon for her order. listen. >> she didn't address the only question that's in dispute, which is can the former president have standing to say that the investigators don't even get to look at the documents, the classified documents that he wrongfully had at mar-a-lago? >> you mentioned the precedent. something called a 60-day rule here at the justice department. i use the term rule lightly and loosely because it simply means d.o.j. officials typically in the past have not prosecuted a

situation. you heard what i was saying to david spunt. president biden is putting trump in the middle of everything and questions about him and can they touch him and what does the special master mean? >> both d.o.j. and trump legal team have this friday to come up with names to be the special master person looking through the documents seized at mar-a-lago. highly unlikely the two sides agree. that special master will have a big task. it will delay things. it is not that the d.o.j. criminal investigation can't proceed potentially against the former president but what happens is they can't use the documents, the fruits of that search at mar-a-lago which will slow them down. if we're talking about thousands of pages of documents, the special master will have a very big job. but the task that the judge has given them now is to come forward with names and she will take it from there. it could be appealed as the

former attorney general barr had said could happen. >> harris: digging into your legal actmen now why did it catch one side offguard. shouldn't the department of justice be able to see something like this could come down the road? were they really in the hands of f.b.i. agents that didn't have the right clearance, those documents? what do you make of it? >> it is a question of possible naive tee. the former president evoked strong emotions and to have a raid at his home, his residence, is unprecedented. they would have to know there would be a ton of attention on that. the d.o.j. has said we used tag teams. very common practice to go through documents the make sure things with attorney/client privilege don't end up in the hands of investigators. to ask for a special master not granted very often but not totally uncommon. they had to know this trump team will try every legal angle

they can. this one is one the courts recognize. >> harris: interesting. from what we're reading, they didn't go in there meticulously collating. they went in with with a pasta spoon and came out and found out you can't touch this or that. was the incompetence or what? we'll all be watching you, shannon in your new role this weekend as the official anchor of "fox news sunday". congratulations again. they repeatedly pushed to defund the police. records show another squad member spent loads of taxpayer cash for their own personal security detail. that big number coming up. plus yet again hillary clinton says no, she will not run for president again. oh, but some people are still skeptical about that. what she is saying about it. ♪♪

. >> harris: a memphis judge just ordered bond revoked for the man accused of killing a memphis pre-school teacher, cleotha abston facing first degree murder charges in the kidnapping and murder of eliza fletcher. her body was discovered behind a vae can't home on monday. crimes like this are happening in big cities and suburbs like where she lives. >> i think this case strikes a cord. the fact that this person was an innocent jogging on her own and got abducted. i said this all the time having been a prosecutor for many years. these are the kind of random crimes that make you afraid to have your daughter, your son, your wife, your husband go out because you never know if something like this is going to happen. >> harris: with all the repeat it is happening a lot more. like this guy who spent 19 to 20 years if prison.

jonathan serrie with the latest. >> the reason the judge decided to revoke the $500,000 bond was these new charges stemming from the positive identification of eliza fletcher's body, kidnapping defendant cleotha abston faces the additional charges of first degree murder and first degree murder in perpetration of kidnapping. the judge has revoked his bond. the official arraignment has been pushed to tomorrow while the judge considers a defense motion regarding abston's representation. prior to this case, abston had a record of violent crime. at 16, he abducted and attempted to rob a local attorney. he was convicted as an adult in that case and was released on parole after serving 20 years of a 24-year sentence.

>> our office opposed parole in this case, i think appropriately so given his extensive record of violent crimes before the conviction for the kidnapping. >> eliza fletcher's relatives say they are devastated by her senseless loss but want to remember and celebrate how special she was. one tribute surfaced in the form of a video that fletcher initially made for her students at st. mary's school where she taught kindergarten. she sings this little light of mine and then introduces the class to her dog. this friday at 4:20 in the morning a group of female runners will run in her honor and complete the route she had been jogging. as you mentioned, harris, although attacks like this are exceedingly rare, this case has sent a chill throughout the community and this group of runners is hoping to restore

some of that confidence in the community. back to you, harris. >> harris: they should have known where this guy was, somebody ought to be keeping up with him. he got out after a little more than 19 years. what are we doing? jonathan serrie, thank you very much. when democrats don't listen to parents about education it can get complicated politically. look at republican glenn youngkin's big win last year. lawmakers on the left pay attention. americans are becoming less satisfied with the state of their children's education,. only 42% say they're satisfied compared to 51% in 2019. we're going in the wrong direction. republicans that number plummeted to 30%. just about half only of democrats are not satisfied with education, either.

the survey comes on the heels of a government study showing massive learning losses among fourth graders during the pandemic shutdowns. teachers unions and many liberals really wanted. stunning newly uncovered emails show a california teachers union spying on parents who were fighting to keep their kids inside the classroom during those shutdowns. the union was digging for dirt on those parents. kind of in the same way politicians conduct opposition research on their opponents. nasty. but politicians do it so they can win. why was the teachers union looking at parents that way? sean duffy, a former republican congressman of wisconsin and fox news contributor. sean, your reaction. >> first off, harris, there is a contract that we have in our communities with the school systems. we pay taxes on our houses so we can fund the school system to teach our kids how to read, write and teach them science,

the basics of an education. when our school systems start to get that wrong and teach them other things like crt or transgenderism where they fight to shut our schools down when we know we'll lose skill sets within our school communities. force the kids to wear mask when we know they aren't at risk for dying and transmission. they do this and american people lose faith and trust in the school system. when you look at the numbers, 30% of republicans support the school system or are satisfied with it. i imagine those in rural communities across the country that actually have a traditional education system or in private schools. if you are in a big woke school i think all parents aren't pleased with the school system and what is shocking is 51% of democrats aren't pleased with the education, 49% are not pleased. that's to your point with youngkin. this is a wide open door for a middle of the ground politician to walk through the door.

we'll fight about a lot of stuff. the one thing i'll fight for you on is your kids and look out for them and make sure they get a good education. that's a pathway to the american dream in the middle class. i got your back. that's a winning message just like glenn youngkin showed us in virginia. >> harris: he showed the country, didn't he? it lit up in new jersey and many argue that if there had been just a couple more weeks, new jersey's murphy might have got down in the cobalt state would have gone red. it was an issue heating up in new jersey, too. speaking of looking out for kids. these guys aren't doing it. the teachers union in seattle. after covid struggles, members of the seattle teachers union on strike today. the first scheduled day of school they are sitting down. it affects 54,000 students. the teachers want more money. of course they do. and help with special education, understandable.

ant multi-lingual students. they got an 11% raise in 2019 with salaries ranging between 63,000 and 120,000 a year. they are handling our most precious resource but to sit down on the first day of school. what's the priority here, sean? >> if i'm harris faulkner and my ratings are crushing it, i deserve a raise, right? >> harris: you are hired. >> but they are failing the kids. if you are not teaching kids the basics, kids are failing and you come to the taxpayer and say i deserve a raise, i think most americans shake their heads and go no you don't. once you do your job and educate my kids so they can actually meet some basic standards in math and science, then we'll talk about a raise. but again i think this is obscene. i look at what happened in arizona where you have now the state giving every child to their family the money for their kids to go to a school of their choosing, right? school choice to everybody. i think it will be a phenomenon
