charged with rape at 14, and at 16, kidnapped an memphis lawyer at gunpoint. >> john: former homicide detective pat dias joins us, but first, jonathan is live outside the courthouse. what are we learning about the hearing today, jonathan? >> jonathan: the judge revoked the $500,000 bond for the defendant cleotha abston as a result of the new first-degree murder charges, the new charges coming as a result of the positive i.d. of eliza fletcher's body. the judge pushed the arraignment on the new charges to thursday, while he considers a defense request regarding representation. the defendant is no stranger to courtrooms, recently paroled after serving 20 years of a 24-year sentence for kidnapping and attempting to rob an attorney back when abston was 16 years old. >> our office opposed parole in

this case and i think appropriately so given his extensive record of violent crimes before the conviction for the kidnapping. >> jonathan: police say abston forced fletcher into his suv and surveillance video obtained by wreg, abston is seen cleaning the vehicle outside his brother's apartment just hours after the abduction. investigators searching the area found a body behind an abandoned home on monday and confirmed a positive i.d. yesterday. family members say they are devastated by fletcher's senseless loss but also want to remember and celebrate how special she was. one of those tributes has surfaced in the form of a video fletcher made for her student at st. mary's episcopal school, she taught kindergarten. she sang "this little light of mine" and introduced the class to her dog janie. and a group of female runners

will meet at the spot where she was abducted and complete the route that she would have taken last friday. back to you. >> john: such a sad story. jonathan, thanks. bring in former homicide detective pat dias for more on this. thanks for joining us with your learned analysis and perspective. a lot of questions raised by this tragic case. first and foremost among them, why was cleotha abston ever out on the streets? >> that's the system that we are seeing all over the country, where early parolees are being released, overcrowding in the prison system, and in this case, with his extensive background he probably should have never been paroled from prison at all. >> john: so folks at home understand how familiar police were with this fella, let's put up on the screen his long rap sheet, starts at age 11, when he was arrested for theft. convicted of rape at the age of

14 as a juvenile, age of 16 imagine he was tried as an adult here because he was sentenced to 24 years in prison for abducting a well-known attorney, and forcing that attorney to withdraw money from several atms and then released early on parole in november of 2020 as we saw, above the protestation of the prosecutor. why would the judge not take into account the desires and keep him in jail? >> here we have a system that's broken down. parole board did not look at the aggravating factors of his past history, clearly, and then we have him being paroled and nobody followed up on the parolee, where he was or what he was doing. break down of the system. >> john: you talk about aggravated circumstances or enhancements, we see a lot of the far left prosecutors are refusing to apply those in cases. could we expect more cases like

this, either let out on parole or out of jail on a more minor offense, other to commit a more major offense once they are on the streets. >> that is a problem now in the country. we are not taking the past history of a lot of these offenders and applying them to cases that are involved now. so with that said, yes, i can see that's why i was seeing more and more offenders release frommed jail, not taking into consideration the past history. some have valid history that you cannot, you know, can't hide. >> john: case after case that we have been exploring the last couple of years. clay travis of outkick was on with bill and dana earlier today. here is what he said about the case. >> perfect crystallization of everything going wrong with our inability to put people who are violent behind bars and keep them there and innocent people all over the country that continue to be victims. she is just a metaphor of a

heinous nature of the crime, which way do you think prosecutors will go? >> the memphis police department did an absolute great job in this case and still building evidence and i think it's clearly going to be a death penalty case based on his past history, his, and what he did now and all the evidence able to come up with. without a doubt, death penalty case. >> john: pat, good to talk to you. thanks for kicking us off today. >> thank you. >> john: so sad, but so many examples across the united states of people who get out of jail, whether they are paroled or just go through the revolving door of justice and they kill somebody. >> gillian: i heard one criminal analyst tell fox digital yesterday that most violent criminals follow the specific pattern where they escalate over time, crimes become more violent. he certainly fits that profile. >> john: yeah, and again, there's this idea, too, of leave no witnesses, right. that's what might have been the

case. >> gillian: impetus to keep going at that point, terrible. now we turn to the midterms and the crucial pennsylvania senate race. republican candidate dr. mehmet oz is accusing john fetterman of dodging tough questions ahead of the midterms. fetterman says oz is desperate because he's behind. rich is covering the race. rich, are we going to see the candidates debate, do you think? >> rich: john fetterman says his campaign is coordinateing with tv networks to secure a debate. oz says he's ready to debate but says fetterman is ducking questions. debates or the absence of them has become a major issue in this campaign. >> john fetterman should be to educate the people of pennsylvania and he's unable to move forward and debating me and does not want to answer questions from the press or the voters and democracy is built on us asking difficult questions of

each other to figure out where the truth lies. >> in may, fetterman had a stroke. the pittsburgh post gazette editorial board said mr. oz has raised legitimate concerns. many voters will have concerns about the ability to represent them effectively in washington, the post gazette editorial board also wrote oz's campaign is pressing the issue in an adolescent manner, like when it offered to pay for medical personnel for fetterman during any debate. fetterman has been on the campaign trail, had at times had trouble speaking. and said he's still recovering, he's more capable of fitting for pa than dr. oz will be, and this is about mocking john for having a stroke because they have nothing else. fetterman's campaign says they are using it to distract talking about issues like abortion.

>> john: pressure growing for congress with allegations that the fbi could have interfered in the investigation into hunter biden. republican tennessee senator marsha blackburn sounds out, but first. a california teachers' union accused of spying parents who fought to reopen schools during the pandemic last year. a researcher from the california teachers association questioning the parents' motives and suggesting they were bank rolled

by special interest groups. william is live in los angeles with all of this. how did this come out? >> john, it was actually an email that the union rep had sent out internally that was accidentally went to a principal who refused to delete it and the parents got it through a public records request. those parents claimed the email is evidence that the teachers' union tried to "dig up dirt on them," while they fought to reopen schools during the pandemic, something the yawn i don't know opposed. the email shows the union researcher sought information about the parents themselves and if their association had obtained money from conservative interest groups. in a new deleted twitter account, said this is an all too common model where parents who want to make systemic changing for their kids being used for a larger goal to disrupt, stabilize and burn down public schools. so parents say the emails

seeking information about them are evidence that the union spied on them. candidate for the top education job in california calls it startling, disgusting that the union would "dedicate personnel to politically target moms and dads". the email showed what we new, the school board meetings were a battlefield during the pandemic and a concerted effort to keep schools closed and basically going after the parents or parents groups was really just part of the campaign. no response from the cta. >> john: as we saw in the state of virginia, such things have consequences at the ballot box. see how it plays out in november. william, in los angeles, where it's very hot. thanks so much, appreciate it. question remains, how much of an issue is this going to be, but when stories like this come out, parents feel it's them against the teachers' union, and the parents want to do the right things and get the kids back to school.

christopher wray but he was short on time that day, he needed to leave early, he didn't have time for a full round of questions. we want to have him back because we would like to know everything that surrounds this. who decided to go to facebook and say you needed to suppress this information n and of course we got that tidbit from mark zuckerberg himself. who else did they go to? did they go to twitter, did they go to youtube, who else were they going to in the big media platforms to say suppress this information. we also want to know how many people were involved with the russia collusion hoax and how they decided they were going to push this information forward and continue that. >> gillian: that's a separate issue. >> well, they are all related,

cannot maintain the power grid. it's a very dire situation, very serious and the most disturbing part, california has been held up as the model for the rest of the united states by president biden. >> john: in terms of whether or not there will be enough electricity in california to power the new electric vehicle fleet, in recent days you tweeted out some estimates. you wrote if we need 5.5 gigawatts for the electric vehicles, we would need it to power 29 million more e.v.s. in order for california to have sufficient electricity to power 30 million electrical vehicles, you write, it will need to build 20 new full size nuclear power plants. they've only got one nuclear power plant and that is extended, you are saying they need 20 more? >> well, that's right. my colleagues and i have been arguing for maintaining our last

nuclear power plant rather than shutting it down, which had been the plan of the current governor. he reversed his position because of the risk of blackouts at any moment but you would need 20 more nuclear reactors, the size of diablo canyon, or ten full power plants in order to generate sufficient electricity to power 30 million cars and trucks. it's not like the energy to power electric vehicles comes out of the sky, it has to be produced by power plants. we normally get our energy for our transportation from petroleum. that's very energy dense, it's a major source of our energy in the country, so to suddenly switch to electricity, you are talking about a huge expansion. we already shut down one of the plants in northern california, they wanted to shut down diablo

canyon, they say they are going to shut it down in 2030 which is bonkers. >> supposed to be shut down in 2025, now extending to 2030, but takes on average a decade to build a new nuclear power plant and i don't know how they are going to build 10 or 20 nuclear reactors between now and 2025. call four number six, people at home think california is running on the famous sunshine, it's not. power generation here, electrical generation, 37.9% from natural gas, 3% from coal, 9.3% from the one nuclear plant. hydro electric, 9.2, california compared to other states has a lot of renewable energy. but you also contends that you can't meet the demands of the electric vehicle mandate with solar and wind. >> well, that's right. look at what's happening. between 2019 and 2021 the

percentage from 0 carbon sources declined from 51 to 49%. we have not had as much rain and so our hydro electric dams have not been producing as much electricity. so, we often will refer to solar and wind as weather dependent renewables, but it actually turns out that hydro electric dams are also weather dependent. why you have to have nuclear power if you want to deal with climate change or reduce air pollution, it is the only scalable and reliable weather independent source of energy and yet our establishment in california from the governor on down has an allergy to nuclear power based on some really bad ideas from the 1960s, a lot of scary tv movies, but really nuclear has turned out to be one of the most important sources of energy. it's really going to end up saving europe this winter when it goes into energy crisis, so we need a lot more nuclear power. the right way to do it, add more

median wage is $25,000 below that. we are seeing them move outside of cities and look to go elsewhere so that they can afford rent in this current market. we spoke to one representer in new york city, kelly, who moved to the big apple. the issue, her income is not allowing her to keep up with her rent which is around $3,500 a month. so now she's trying to desperately get out of her lease and move to texas. >> i kind of fell victim to the mindset i have to live here and i'm realizing once me accountants go through everything, i only have this much left over to invest and put into retirement. i don't have an emergency fund now, i spent it here. >> a big part of the problem is inventory. the housing market remains tight, so people who would have moved into homes that they own are instead signing rental leases again. mortgage rates rising could eventually bring down the

overall price but for now house prices are still strong and rising mortgage rates just makes buying that house even more expensive. further keeping people out. also why you are seeing a majority of young adults who moved back with their parents during the pandemic, unable to move into rentals or their own homes. there is some good signs in the rental market, a rental site says some of the pandemic boom towns like nashville, fort lauderdale and st. petersburg, florida, saw month over month decreases in one bedroom prices, indication that in those cities we are seeing supply meet demand. overall, it's a tight market so the landlords can charge what they want and renters have to either pay up or move out. >> john: i know so many people who have moved to nashville in the last couple years. no wonder rents there were on the rise. good to see them coming back down a little bit.

this whole story, it stays quiet until after the election. >> john: so you talk about suppression, and now we are talking about leaks to get information out there in terms of the latest in the washington post what the fbi took when they raided donald trump's home. washington post said material on former nations nuclear capabilities seized at trump's mar-a-lago, some seized documents were so closely held only the president, a cabinet level or near cabinet level official could authorize others to know. if that's not leaks from either the doj or the fbi trying to frame a narrative, i don't know what is. >> it seems that way. i would caution with leaks in washington, especially with investigations, you never can completely tell who the source of the leak is. sometimes defense lawyers know things. i know during the russia matter investigation --

>> john: you are suggesting not the doj. >> trying to think where it's not the doj but certainly looks like it's come out of people who are familiar with that very tightly held bunch of information. these boxes, which were taken up to, and brought to an information facility in the washington area and have been assessed and examined all this time. they have very tight controls on who gets to see these things and know about it. did somebody tell somebody who told the washington post, it's just hard to say exactly who but looks like it's coming from the government. >> gillian: if you take a step back a moment with the mar-a-lago raid, byron, i think most americans can agree that it's the interest of the nation that needs to be put forward here, not the interest of the former president versus the interest of the doj. what is in the country's best interest? is it -- but i'm serious, if you think about the crux of the issue, right. is it the danger of
