kelly 19 years old and terrified mervians shelter in place as bloody rampage 4 dead and 8 injured. began at 12:56 a.m. memphis police department officers responded to a shooting that left a 24-year-old male dead. another victim gunned down at 4:35 p.m. at a gas station. after 7:00 p.m. a woman is shot and dies on the scene and just before 9:00 p.m. the fourth murder victim is killed. 9:28 p.m. finally kelly is taken into custody after crashing the car he stole. the worst part of it all as you mentioned steve he should have been behind bars not out on the street on a violent rampage. here is what we know about his criminal past. in 2020 kelly was charged with first degree attempted murder. aggravated assault, employment of a firearm with intent to commit a dangerous felony and reckless endangerment with a

deadly weapon. now, he was sentenced to three years in jail only served 11 months after charge was downgraded to assault. strict land had this reaction. >> if mr. kelly served his full three-year sentence he would still be in prison today and four of our fellow citizens would still be alive. >> this just after memphis mother and heirist eliza fletcher's body is found. suspect cleotha abston henderson back in court today facing first degree murder charges. he had a long rap sheet arrested 16 times. age 11 theft. age 1 convicted of rape, age 16 abducting a lawyer at gunpoint and served 20 years of a 24 year

look, crime has been a problem there for a while. and during this guy's guy spree when he murdered four people and carjacked a number of cars, at one point he crossed state lines. that just means he went across the river into mississippi and eventually somebody saw the charger -- dodge charger linked to the earlier carjacking, and they go oh, there he is. they chased him and finally got him. so is mississippi going to argue over his custody or he is going to stay in tennessee? >> griff: i think he will stay in tennessee. we will have to find out. you are right. i was born and raised in memphis. i have had no shortage of text messages that began when eliza fletcher was abducted. now, this morning, as we are speaking out. because i have got to tell you, i spent the majority of my childhood there. we didn't lock doors. i didn't know any victims of crime and now, as this city has slowly gone down hill tragically, sadly, now the folks have remained, i have family that still lives there, they want accountability.

and many of my friends that i went to high school with and acquaintances have been in the courtroom as we have been watching cleotha henderson being charged because they want some truth in the sentencing is what they are calling it. a law that will force the officials in these courts to hold these criminals accountable. >> steve: well, griff, you live in washington, d.c. now, which is a soft on crime town. has memphis become soft on crime, too? >> well, that's certainly what those that say. let's not forget 20 miles out of d.c. pg county has gone into a curfew because the juvenile arrest rate is something it's never been with carjackings off the charge. just indicative across the country. i think what is really so important people have been reaching out to me from memphis is we are not new york. we are not d.c. we are not chicago. it doesn't need to happen here.

it hasn't happened in the past. and now it's out of control. and losing faith very quickly in the officials in charge. >> carley: crime was high in the year 2020 in memphis over 5,000 violent crimes reported. and this year 5,783. so, closer to 6,000, a 7% increase. it's such a sad state of affairs because you are right, griff, it is such a beautiful city. thank you so much for that report. >> griff: thank you. >> brian: a story that is least surprising you will probably read as it turns out we didn't know exactly hot afghanis were who were coming to our country after they were so organizationally let out of average just about a year ago. ejection from a property that embarrassed our nation to its core that the president will not talk about that he fully authored. when it came to putting these afghanistan, i guess, refugees on to planes and sent to a third country and eventually come here, well, as organized as that looks yeah, jog in place and hop

on a wing and you will fall to your death. that's how great that looked. think about that. how could anyone even run for re-election or keep his job knowing that this was his policy? well, it turns out, when thousands came into our country, put our military bases we had no idea for the most part who was actually coming here. that is pretty much the least surprising story you will read all day. and it turns out according to the "new york post," at least two of them were wanted terrorists. >> they had derogatory things on their official record and, yet, we let them in which we were not supposed to do. >> brian: a lot of them gave wrong names and wrong identification. >> steve: exactly. many not vetted. according to the department of homeland security inspector general, he is the guy who takes a look at everything after things have happened to figure out if it happened correctly. he writes: we determined some information used to vet evacuees and i believe there was something like 76,000 of them through the u.s. government data base such as name, date of birth, i.d. number and travel

documentation data was incomplete, inaccurate or missing. we also determined cbp admitted or paroled evacuees not fully vetted into the united states. and this is particularly gulling because a year ago, at the podium, our press secretary to the president said that everybody was being vetted. now, this -- we will play that soundbite for you in main. first, here's the inquiry yesterday about what did you guys do? >> we were told no one is coming into the united states of america who has not been through a thorough screening and background check process. now, there is this dhs inspector general says cbp admitted or paroled evacuees who were not fully evetteed into the united states. that is not good. that is different than what you guys said. how did this happen? >> no, it's not different than what we have said. that very report, it did not take into account the key steps

in that rigorous, you heard from rigorous and multi layered screening and vetting process the u.s. government took before at risk afghans were permitted to come to the u.s. it did not take into full account of what the other eight agencies are involved in making sure that did this multi layered process and screening process, it is a -- it is a multi-agency effort. >> steve: so she is reading out of the big book of answers. it flies in the face of what we heard a year ago. we were told everybody was vetted. >> brian: no one believed it. now we know for sure. >> steve: yeah. because we know that the inspector general for the department of homeland security said they weren't. here is the hypocrisy. watch this. >> i can absolutely assure you that no one is coming into the united states of america who has not been through a thorough screening and background check process. >> carley: so what this report essentially said is that -- and brian is right. it is exactly what we already

knew. because we saw the images. we saw the people hopping on to planes. it was total chaos. so, obviously, some people were going to slip into the cracks. when this was all going down in august of last year, there was some rumblings of people being worried about it. those concerns were sort of batted down the overarching theme we need to get as many innocent people into the country as possible. with that the innocent comes the people on the terror watch list. what this report is saying that the united states really had no way of crosschecking the fake names that these people were giving. so, in everybody goes. this isn't the first time that we have heard about this. there was a whistleblower who told chuck grassley that the biden administration allowed over 300 evacuees into the united states who were on the terror watch list. and that is something that josh hawley questioned fbi director christopher wray about in august, just a couple weeks ago. and he said that he is aware of this reporting. he isn't exactly sure how many essentially bad people there are in this country.

the other thing he says is that there is no way of knowing exactly where they are at any given time. >> brian: keep in mind, what a terrible job we did because the state department evacuated itself and all the sivs that helped us out for 20 years were left there to die. and if it wasn't for special side groups that came out of retirement that spent their own money along with your donations to get them out, thousands more worthy people who have been killed or still behind enemy lines but others would not be out at all. we don't know who these people are. third country, we still wrestled with and even though we held for weeks. here is senator rob port map on the anarchy. >> all of us want to take care of the afghans who helped americans who stood shoulder to shoulder with us interpreters and soen o remember that chaotic withdrawal. a lot of theme got on those airplanes that had nothing to do with the u.s. presence there. we brought them to the united states without properly vetting them. that's what the inspector general has now said. it was pretty obvious. we all knew this was going to be a problem. we don't know how many afghans are in this country who pose a

national security threat but we know that there are a few dozen based on what the fbi has told us. and we just hope that they are being monitored. we don't have an issue with that. so that's why the i.g. report today was so important and really will be surprising to a lot of people having followed this many. >> brian: surprising? just walk off the bases without security. where are they now? we abandoned the country after 20 years in a ridiculous and responsible fashion that's going to damage our reputation if we ever want to ally with on the ground again. we let people in that don't deserve it. mean us ill harm. we have no idea who came here. and the president and his administration and the state department have got a total pass on this. and think about scott mann and others just here talking about the process and trying to explain to the state department i got the right people, help me. and they wouldn't. they wouldn't even give them a third country to land in after

they paid for their own plane. >> carley: g.o.p. report said 800 u.s. citizens. 800 u.s. citizens were left behind in august of last year. and there are still siv holders that are in afghanistan living and hiding for a full year because they know that if they come out of whatever secure situation that they are semi secure situation that they are in, taliban is going to come, hunt them down and those are the people that help the u.s. government. those are our allies. >> steve: so who are you going to believe? the watchdog or the administration that was trying to sweep that botched evacuation under the rug? >> brian: pretty good authority that the president never even read the after action report on everything that went wrong on the evacuation. then he was offered a verbal briefing and they said it was too long. knock it down to 30 minutes he just refuses to make time to hear it. can you imagine that? >> steve: it's tough. all right. about a quarter after the top of the hour. and ashley joins us today with news and you start at our southern border. >> we are going to start at the

crisis at the southern border, steve. nearly 750 migrants who died trying to enter the u.s. this fiscal year. this grim new record topping last year's border death toll by nearly 200. the crisis showing no signs of slowing. dhs officials say the actual migrant death toll is likely much higher because local agencies in mexico will also recover bodies. an elderly man is slashed in the head with a machete and then pepper sprayed by a disturbed woman in new york city. the suspect was walking free despite a long rap sheet. she reportedly has seven priors, involving a machete or other weapons. her most recent arrest was the end of august. meanwhile chilling video shows the moment a man is stabbed in the stomach walking on a new york city street. the victim was in the hospital in critical condition but is stable. that suspect is still on the loose. a republican committee is selling a biden survival kit to help americans cope with the president -- as he hits the

>> steve: sunday marks 21 years since the september 11th terror attack and we are remembering those who responded and lost their lives like new york firefighter karl asar row died that day leaving behind his six kids. four of the six have joined the new york fire department inspired by their father's ultimate sacrifice the oldest sibling carrying on his father's legacy is karl asaro jr. and he joins us live today. >> how are you doing, steve? >> steve: hard to believe 21 years ago. we were here in the studio that day. you were at home watching the news. is this hard to do to talk 'your dad? >> yes and no. today not so much, you know, maybe when i was a kid a little bit more. i'm proud of him and i'm proud of everything that he has done i wouldn't be sitting here if it wasn't for him. >> steve: obviously proud of him because you and three of your siblings became firefighters too, why?

>> as a tribute to him my dad was a superman. he could do no wrong. we were part of the fire department when we were kids at the christmas parties and all the events, the picnics and stuff like that. it was just -- my dad was always happy. my mom was always happy and life was good. it was kind of an easy choice. >> steve: was that one of the reasons you wanted to be a firefighter because you knew the fire department from your family growing up and now you are part of the fire department family as well. >> yeah. like i said it was easy choice and helping people out as well a lot of those guys my dad's friends they have always been there throughout the years for us. >> steve: how often are you out on the job as a professional firefighter in new york and somebody will see your fame on your jacket and they will go, carl, i knew your dad, i worked with your dad, i was on a big

>> brian: more americans feeling the brutal impact of inflation. we are just not talking about it. recent survey say 66% feeling hardship. forcing 70 billion households to cut back on vacations, driving, groceries. stephen moore. does this surprise you? >> no. in fact, you know, you are seeing people cutting back. for example, this summer vacations driving was way down. in fact, that's one of the reasons, brian, that the gas price is down. it's actually because people couldn't afford to pay $6 a gallon. >> brian: they adjusted their lifestyle. >> exactly. the bottom line on inflation, brian, sings joe biden came into office, what, 20 months ago, the average family has lost $4,000 of purchasing power. that's a huge decline when you

think that the median family income is about 75,000. so people have had to cut back. no question about it. >> brian: about 12% say they are experiencing severe hardship right now because of it the inflation dropped 8.5%. still enormously high. the other big one of which mark cuban a self-made billionaire takes risks with his money and hires thousands of people through his career is tired of being vilified and pointed the fingers where it belongs right at elizabeth warren, watch. >> i don't mind being taxed more. i wrote a blog saying most patriotic thing you can do after military service is pay your taxes because that's what allows everybody, you know, to live and to prosper. but, yeah, the idea of just soak the rich, billionaire tiers that sell that cup, screw you, elizabeth warren, you are everything wrong with politics. >> okay. >> brian: also, the attitude vilifying successful people. what's your reaction to his emotion. >> let me just say this.

i would correct him on one thing. his most -- the most patriotic thing that people build businesses do and are successful is that they employ people. that's been his contribution. you look at these people whether it's fred smith that built fedex or a person like mark cuban, they are the people who put, you know, the people to work. my old boss dick armey used to say you liberals love jobs but they hate employers. you can't have a war against businesses as biden is having and think you are going to create a lot of jobs. >> brian: the attitude of not lauding success is problematic. >> exactly. >> brian: where are the politicians go out there and be successful and take risks and be saluted for doing that we lost that mindset that he has. >> i couldn't agree more. that's why, for example, people are so angry about this idea of forgiving people for student debt. what a are you doing? rewarding people acted irresponsibly and punishing people who did the right thing and paid their loans back. >> brian: some say in that story

♪ >> carley: one alabama family facing pushback after installing a flag pole in their front yard for a quote bigger display of patriotism. more than a month after it went up the homeowner's association sent a letter no flag poles other than those mounted on the home or no longer than 4 feet are permitted. immediately upon receipt of this notice, please remove the flag pole. our next guest who comes from a proud military family is refusing to tear down her american flag. dr. jill hudnell joins me now. what was your reaction to being told to take down your flag pole? >> good morning to you. well, my reaction was, hmmm this was a month and about two weeks late. and then also we did everything

that we could to try to determine what we needed to do to get this flag pole up but our hoa just refused to return phone calls or return messages. so my reaction was, no, this is going to stay right where it's at because my family is military and this is a representation of how i feel about their service. >> carley: it's still waving proudly, have you heard from the homeowner's association? >> i heard from them yesterday in an email in which they sent me an email saying that they received my request regarding the flag pole and they said it could take up to 30 days for them to respond as to their approval. >> carley: there is a reason why you are so patriotic and has to do with your family. tell us about them and why the american flag is so important to you. >> well, i will start off with my dad. my dad is a marine. he was in the vietnam conflict. and he lost his leg to that war.

when he came home, he did everything he could to get the degree that he has today. he is now an aeronautical engineer and he is also the inventor of the recoverable rocket booster for the space shuttle. my brother was in the navy. my husband was in the army for 14 years. his dad was in the navy for 30-plus years. my husband's brothers were in the military service. so, this flag means a lot. not only do we have old glory hanging from that flag pole but we also have the army flag because that is the representation of my husband. and those two flags will stay up there. old glory is still waving this morning, mind you. >> carley: your family is just as beautiful as that american flag that is flying in front of your house so proudly. we know you checked in with your neighbors. they don't seem to have a problem with it as well. we hope you are allowed to keep that flag up.
