you have to understand how rare a motion like this is. i don't know if i've seen a prosecutor say not only do we want this conviction vacated but asking he be released without any conditions. they must have strong evidence on the suspects. they won't put all their cards on table for us to see. >> bill: thank you for your time running it down for us. we'll see what happens. something will give, we know that. thank you for your time. >> thank you. >> bill: bye-bye. >> dana: after weeks of debate about debates in the pennsylvania senate race john fetterman agreed to a televised face-off against dr. oz. welcome to a new hour of "america's newsroom." i'm dana perino. >> bill: i'm bill hemmer. good morning. a lot of these big debates coming up in the senate races, the country will be watching them. >> dana: they have become national. >> bill: so the date for the big debate in p.a. is october 25. two weeks before election day. thousands of voters will have

already cast their ballots by mail. by the time fetterman and oz finally meet face the face early voting will have been going on for more than a month. it comes as fetterman faces growing attention for not releasing medical records after a stroke in may. brit hume making some interesting points last night with bret on special report. >> he has agreed to one. he will be pressed to agree to more, whichever way it goes, there is a risk forfeiterman that he will get in the debate and not do very well because he is not well and the other side the expectations for him in any debate will be very low and media will see to that. >> dana: the anchor of special report and chief political anchor bret baier. you have that and response from the oz campaign. let's get your thoughts. oz said after being hit with massive criticism from state and national editorials for ducking fetterman agreed to one

debate. he insisted be delayed until two weeks remain in the campaign to keep voters in the dark as long as possible. a debate which fetterman insisted on accommodation for his health conditions, accommodations not permitted on the u.s. senate floor. if you are going to do something where you have a preview, the questions that you are asking in the preview to test the equipment and everything cannot be related to the debate. will oz win on that, bret? >> well, it's an interesting point. i think that the fetterman campaign came back after a lot of pressure including the op-ed we referenced from the "washington post" saying you have to debate. he said i will do the debate october 25th but stipulation. closed captioning. he wants to practice with the moderators where they go through the system and he wants the ability to have extra time to answer. the oz campaign said yes, that's fine. but we want a moderator that says this is what he asked for.

two, the questions they practice can't be the questions he gets asked on the night of the debate and three, it should go from 60 minutes to 90 minutes because all of the time involved here. it is interesting to see how this falls out. would any candidate be getting these accommodations? i don't know. i think that is analysis that the oz campaign will jump on. >> bill: meanwhile it has been nasty, right? social media is the avenue today. here is fetterman on oz a few days ago. roll this. >> i truly hope for each and every one of you, you didn't have a doctor in your life making fun of it. making light of it. or telling you that you are not fit to serve. no? but unfortunately i do. >> bill: i think this really changed when you saw editorials a week ago saying fetterman has to get in the ring. you have to show the people of

pennsylvania what you are capable of or not. >> i agree. and he answered that to an extent but you pointed out october 25th is very close to election day and there will be tens of thousands of pennsylvania voters who will have already voted as of two weeks the ballots go out. this race really, if the oz campaign had their way, would come down to the policies and they would be talking about crime and taxes and the way forward as far as how you could be a senator and what you could effect. now it is really into whether fetterman can be a senator because of his condition. >> dana: news fox news poll you revealed last night on special report, biden's performance approval not good on pretty much everything. on climate change he is at 44% approval. inflation, the issue people care about the most he is at

29% approval. immigration, 60% disapprove and we ask on the five. why doesn't anybody seem to care about this issue? maybe they are, bret? >> i think they do especially border states. but all over. actually, there will be a lot of debate about this tactic of sending migrants all over the place as you look at the president at the detroit auto show. if you send migrants to the vice president's house and martha's vineyard what is the fallout from that? it does bring attention to the issue that these border states and towns are dealing with tens of thousands of migrants coming over every month. i think immigration is a silent issue that's higher than the polls give it because of the concern about the border and national security. we've talked to a number of experts who have had a number of different groups of voters around the country who have said it's an issue that is

higher than people think. crime and immigration. >> bill: we hear so much about abortion. maybe that's significant or not. in michigan where the president was yesterday there is a referendum on the ballot in michigan and four toss-up house races in michigan and some are starting to think they -- it could have a serious impact on the outcome in those four. two of those democrats in the four districts chose not to go to michigan yesterday with president biden. final comment on that, bret. >> representatives kildee and slotkin didn't make the trip saying they had to stay in. other michigan democrats did make the trip. it didn't hold water. there will be some campaigns that put a heisman award stiff arm to biden and others will embrace him. that will be the battle coming to november. >> dana: the white house will say it's okay, we understand they have a scheduling conflict and not be offended. >> the heisman awards stiff arm you understood.

people are coming here. the takedown of one of the human smuggling rings in the u.s. including in states like mississippi, alabama, louisiana, and texas. take a listen. >> we are here to announce the unsealing of indictment charge eight defendants for smuggling. >> impacting our border communities. >> joint task force encountered thousands of migrants smuggled across the border since 2018 involving border patrol says are some of the most dangerous conditions they've ever borne witness to. migrants stuffed inside wooden cargo crates and piled onto flatbed trucks before being transported across the border. others in suitcases and emptied out water tanks. the takedown comes as the biden

administration faces increasing criticism on the southern border. the white house is saying is former president trump's fault this week. >> we're taking unprecedented action. we had to fix something that was broken especially by the last administration. >> right now we're awaiting the official august border crossing numbers. cbp sources have told us the total number of encounters this fiscal year is surpassed the 2 million mark with more than a month to spare. >> bill: it's unbelievable. line 2 million people up on a sidewalk and see how far it goes, wow. gillian turner, thank you, washington, d.c. >> dana: my grants continue to flood el paso texas as the city reaches its limits. new video shows hundreds of migrants under a bridge there. bill melugin is in eagle pass, texas with the latest. >> here where we are in the del rio sector there have already

been more than 450,000 illegal crossings, double the number this same time last year. human smuggling out here is rampant. look at this video we shot as we embedded with texas dps troopers in uvalde chasing a human smuggler. a high speed pursuit over 100 miles per hour. he was running red lights and pulls off to the side of the road and everybody bails out including the illegal immigrants. troopers run after them and some are jumping over fences. they take the smuggler into custody and go deep into the brush and pull out the two other illegal immigrants who were hiding there. they eventually find everybody who was in that vehicle, everybody arrested and taken into custody. take a look at this piece of video again embedded with texas dps troopers in uvalde looking through the private ranchs in the area for runners. they find 11 honduran men hiding in the dense brush, some dressed in camouflage. very deep brush in certain areas. it took troopers a while to get

them. texas dps does not hand these guys over to border patrol. they arrest the men and take them to jail for criminal trespassing. they have made over 1,000 of these arrests since operation lone star first started. take look at this video in el paso. the huge numbers there. el paso is seeing on sunday upwards of nearly 1,500 illegal crossings in a single day. the video you're looking at we shot from mexico showing the el paso side where hundreds of migrants have started camping out underneath a bridge. border patrol facilities are total every capacity. border patrol has started street releases having to just release migrants to the streets of el paso near shelters, near bus stops as the city there is now sending its own bus loads of migrants to new york city. the major stash house bust in the laredo, texas area.

they find almost 100 illegal immigrants crammed in this single stash house there. what happens is the cartels and smugglers move people across the border and they keep them in the stash houses until they are ready to move them deeper into the united states. back out here live concerning news out of arizona. border patrol reporting they just arrested a convicted child rapist from mexico with a previous conviction for third degree child rape in the state of washington that tucson, arizona sector has the most gotaways, 160,000 so far this year where we shot the video of the guys in camo scaling the border wall the other day. >> dana: the videos that you did not fake as some people on twitter suggested that we staged those, right. the border deniers as we're saying. thank you. appreciate it. >> bill: new suspicions about foul play in the death of a california teen found submerged in a reservoir. why one of the divers who found her say it was no accident.

a tragic accident of kiely rodni found last month submerged in her car in the reservoir. the dive team now suspects foul play. christina coleman is live in los angeles to tell us why. hi, christina. >> good morning, dana. 16-year-old kiely rodni was last seen alive on august 6 at a party in northern california after an expensive search by law enforcement her body and s.u.v. were found in a reservoir 15 days later less than a mile away from that campground by a civilian dive team called adventures with purpose. they help solve cold cases. the dive team's lead investigator says rodni's death wreaks of foul play for two reasons. one, the remains were found in the cargo hatch of her hon today crv and two blown outwindows. it doesn't make sense she would scramble over the back seat to

the back of her s.u.v. and into the hatch's confined space while this vehicle was quickly sinking and based off where the s.u.v. was found, bishop also says it had to have made a sharp turn to the left onto a dirt path about a quarter mile from the main road and he does not believe that that was an accident. but it is still unclear exactly what happened at this point. autopsy and toxicology reports haven't been released and authorities are not giving an update on this investigation until november. >> dana: thank you for the update, christina coleman in los angeles. >> bill: so this happened. florida governor ron desantis sending two planes carrying migrants to the island of martha's vineyard. part of his promise to relocate illegal immigrants to far left states who say they are sanctuary cities and some sanctuary states. tom shillue is here to talk about it.

you get the feel of it. it seems like it is a bit of a stunt but you need to bring attention to this situation. >> bill: they blame these states for the border crisis and the ones giving the incentive to make that trip all the way through central america or wherever they come depending on the part of the world. hunter biden says i can't afford the monthly payments for the child support. his court filing says a substantial material change in his financial circumstances including but not limited to his income. what could that be, tom? fewer deals in china, fewer art sales? >> instead of going to court maybe whip up a couple new deals and see what he can -- there is a real person involved. a little girl. it is sad. she doesn't have a dad. >> dana: she doesn't have a grandfather, the president of the united states. this infuriates me. i can't believe that the president and mrs. biden would allow this to happen.

this is one of their grandchildren and she doesn't have a place in their life and the mother regardless of the circumstances for how she came to be conceived, this little girl should not be having to beg the biological father for child support. that's outrageous. >> she has a lawyer, the child's mom has a lawyer and he said we'll have to get to the bottom of this and do a deep dive on hunter's finances. wouldn't it be ironic if this lawyer was the guy that ends up breaking the hunter biden case that our politicians and media could not? >> bill: irony indeed. you were a rock-n-roll star. >> back in my day with my barbershop quartet. when i was in high school, this is a story we want to get to the story. america hasn't heard it yet. teens are wearing rock-n-roll

in the november gubernatorial race. in 30 minutes inside this baptist church we'll hear from the republican nominee and the sheriff of clark county, nevada and focus a lot on different education issues. as the democratic governor in the state continues to face questions about education things like the teacher shortage and important statewide results. democrat slightly ahead within the margin of error. nevada democrats say they plan to campaign heavily on education, too. >> republicans may feel energized. democrats feel even more energized because we take these things seriously. >> now today virginia governor glenn youngkin who campaigned heavily on education will make two stops for lombardo, one in vegas and one in reno this afternoon. see likely to lend credibility on the issue making sure the

spotlight is on education. you have to wonder how much this may fuel further speculation that youngkin may consider a run in 2024 for the white house because after all, nevada is an early contest state. >> bill: it's getting hotter. nice to see you in las vegas today. >> dana: general don bolduc defeated establishment favorite chuck morris and maggie hassan wasted in time blasting him as too extreme. general bolduc joins us now. a lot of these primaries have been hard fought. a lot of things are said but this morning i understand there was a unity breakfast in new hampshire. what was it like for you? do you think everyone can bury the hatchet and move forward together? >> that's exactly what we saw. thank you for having me on and my best to your viewers, the unity breakfast was the largest unity breakfast they have had in a very, very long time. all the candidates were there. the governor was there. everybody was there and unity

is the word. we are going to come together as a strong republican party. we are going to move forward. we have -- on the theme on enough is enough. it is our time. it is time for change. and that's the messaging we're getting all over the state from granite staters and all political parties. >> bill: republicans think maggie hassan is vulnerable, your democratic opponent. she barely won six years ago. she is going after you on abortion. >> done bolduc say we should rejoice at the ruling denying women access to abortion. they're taking away your personal freedoms. >> bill: now you have the chance to respond to that. >> so, you know, not sure where she is getting her information but, you know, if it's the same way she has been making decisions all along, it's no doubt she is wrong.

it is no secret i am pro-life but i am a no to any federal interference in what the supreme court just decided. it goes to the states. new hampshire has a law. that law gives women the freedom to decide on abortion up to six months regardless of the reason for pregnancy. that is consistent with how granite staters view the issue. women on both sides of the issue will get a better voice at the state. what senator hassan wants to do is what she does with every issue. she wants to control it. she wants to create uncertainty. she wants to create fear. she has done it with the economy, spending and the safety and security of americans. so this ad is just par for the course for them. they lie, they mislead, they point fingers and they fail to take responsibility. that's the way it goes. that's my position. >> dana: all right. there was another thing. chuck schumer the senate democrat, of course, he spent

through his pac 3.2 million dollars against morse, the more establishment republican candidate because they were saying that you are so extreme they think you are more beatable. one of the things that maggie hassan the senate incumbent will say is you are an election denier and you deny that president biden won the 2020 election and there is this from august 14th when you had a debate. watch here. >> i signed a letter with 120 other generals and admirals saying that trump won the election and damn it i stand by that. >> do you stand by that today? >> so, you know, we -- we live and learn, right? i've done a lot of research on this and i spent the past couple of weeks talking to granite staters all over the state from every party and i have come to the conclusion -- i want to be definitive on this. the election was not stolen.

was there fraud? yes. is that a concern of granite staters all over the state? yes, there is. is there a responsibility for public servants and elected positions to insure that our citizens have faith in their voting system? yes. but elections have consequences. unfortunately, president biden is the legitimate president of this country and he is ruining it, along with maggie hassan. that's the takeaway here. they want to bring us back to 2020. i want to move us forward to 2022 and 2024 and say enough is enough. let's cut the cord on this. your actions have hurt people. they have hurt people economically. your spending is out of control and you hurt people with your open borders and illegal immigration, high crime, you know, drugs. you've empowered criminals in

this country. human trafficking. what they've done to this nation in weakening it has empowered china, russia, north korea and iran and facing threats from inside and outside this country. we couldn't be in a worse position as a result of their lack of leadership. it's time for change. >> bill: back to this question about the election. you said that just a month ago. so this appears to be quite a change. mike pence was there with you last night in new hampshire. did you talk about this? did you explain your conviction? >> no, we didn't talk about it, bill. we talked about moving forward. we talked about this election, you know, we all have time to make up -- to make up for mistakes or things that we've said that aren't accurate and that's part of learning. that's part of listening. that's what is wrong with the party system right now. that's why people want an

outsider, someone who reflects on what they say and believe regardless of the time and space in which they did it. looks back to move forward with a more positive, more accurate assessment of things. if we continue to reinforce failure, we're never going to move forward. if we can't accept people fall ibility and mistakes we won't be able to move forward. that's what i stand for and what senator hassan does not stand for. >> bill: one to watch. >> dana: i understand you did 50 town halls and you are going to be outspent. they'll put money into the race. the democrats want to keep hassan in the seat. is your approach to continue to try to meet voters where they are and will you be on the ground? >> yes, we will be on the ground and continue this bottom up approach. we are going to have town halls over the next 53 days and this

is going to be our strength. she is nowhere to be found in and among the people of new hampshire. she hasn't been over 5 1/2 years. i have over 1,000 volunteers, area coordinators, county chairs. everybody is connected. this is a space that i dominate. she cannot dominate. so she will continue to try and put out ads and, you know, be as inaccurate as she can. she can't look people in the eyes based on what she has done. moms and dads who are worried about feeding their children. it was a cool 50 degrees when we got up this morning. that's cold when you can't heat your home and cold when you aren't on a good diet and cold and it will get colder. i held these moms and dads hands and hugged them and seen tears in their eyes and looked at our retirees worried what they will do to heat their home and she is talking about all

cannon if she ignores this ruling from the justice department, the deadline. they've promised federal prosecutors will go to the 11th circuit court of appeals hoping for a different ruling from them. last week the judge issued an order for a third party special master to come in and look at the documents seized from mar-a-lago on august 8. she told the government to stop using those documents seized from mar-a-lago until a special master is finished. the problem according to federal prosecutors, the process could take months for a special master to go through everything. prosecutors asked cannon to issue a stay and allow them to continue going through roughly 100 classified documents from mar-a-lago. if she doesn't issue a stay by today d.o.j. promised to go to the 11th circuit court of appeals as soon as tomorrow and ask a three-judge panel to allow the documents to be used in their investigation. a gamble for the d.o.j.
