transports. breaking tonight, federal judge appoints a special master to review documents in the raid on the mar-a-lago home of former president donald trump. also denying a request from the government to exclude reportedly classified documents. what does all of that mean going forward. the panel breaks that down go plus with the fentanyl crisis, the attorneys general from more than a dozen states and urge the president to declare fentanyl a weapon of mass destruction to help protect americans from a mass casualty event. we begin with the fight over migrant buses and no flights. the white house correspondent kevin corke has the latest on what happened on the border and martha's vineyard. good evening, kevin. >> a border battle to be sure between white house and blue states against g.o.p. resident governors who supporters say are simply forcing the blue states to live with the consequences of their preferred border policies. if you live in a border town in

texas and arizona or california, this will not surprise you here the number of illegal border crossings and encounters has absently skyrocketed since joe biden took office. and now g.o.p. governors in places like florida and texas are sending them to so-called sanctuary cities. and yet for all the gnashing of teeth by democrat run cities and states about the recent burden of migrants being bused their way, by comparison to the southern border and border towns, there is no comparison. almost 2 million encounters from october to july and that doesn't include the number of got aways which arguably could be in the numbers of tens and thousands. almost 200,000 grounded in july alone. those numbers of those bused to places like d.c., new york, and chicago, you could argue that those are paltry by comparison. this is also playing out at the home of vice president kamala harris who, you may recall, called the southern border secured in an interview

on sunday. yesterday refused to comment on the two minor buses buses that arrived inthe residee vice president for that's the naval observatory here in washington, d.c. similar scenes happening out in the country where migrants shipped to areas where democrats talk the talk but having to walk the walk when it comes to sanctuary city policies. the white house still won't budge when it comes to his talking points that the border is "secure," despite all evidence to the contrary. >> do you think that americans believe that the border is secure? >> what i can tell you is the record in the process we have been using to make sure that we'll do our best to secure the border. >> voters might feel like they are being lied to? >> again, it's a broken system, the immigration system.

it was decimated by the last administration. speak of the problem is if you are the new head coach of a football team, they can't blame the old coach. you are the one running the team right now for the white house for its part and says the problem along the border still falls under the doj and the department of homeland security pair they also claim still might blame g.o.p. governors from playing politics with migrants who are in desperate need of help. asking the justice department considering kidnapping charges as a republican governors send migrants out-of-state. what's going on there? >> a real surprise and i think this has a bit of a 2024ism to it if you follow my meaning. i think gavin newsom would like to run for president. calling for the doj, rich, to investigate florida governor ron desantis to fly several immigrant families to martha's vineyard. newsom sent a letter to the attorney general merrick garland imploring him to investigate

potential criminal or civil violations including "charges of kidnapping" and "alleged fraudulent inducement." for his part, the governor of the great state of florida ron desantis said this in a tweet. we are not a sanctuary state and we'll gladly facilitate the transport of illegal immigrants to sanctuary jurisdictions. this is the key i think in the story at least now. the influx, it's a record number of them, the influx of illegal immigrants into this country, despite that reality, rich, the number of deportations actually have plummeted by about one fifth of what they were during the trump administration according to figures and that, they argue, is the white house and administration actually enforcing the law or ignoring it. >> rich: we'll see where this goes. thanks very much. >> you bet. >> rich: feeling the effects of texas governor greg abbott's

we have new poll numbers tonight showing what americans think about this docudrama. nearly two-thirds of those surveyed believe it was inappropriate for former president trump to remove sensitive documents from the white house. that includes almost two in five trump voters but when it comes to the fbi's search mar-a-lago, 21 supporters and the raid was proper. rebel communications eeo john yoo and townhall.com senior writer julio r julio -- s that the court does not find it appropriate to accept the government's conclusions on the important and disputed issues without further review by a neutral third-party in an expedited and orderly fashion. what does that mean for the president and the government.

>> this is definitely a win for president trump and a loss the justice department. no one should be surprise that judge cannon decided not to reverse the earlier order to appoint a special master. when she's doing and she wants a trusted judge, retired judge whose very familiar with classified information to help her figure out what documents should have been in mar-a-lago and which documents couldn't be. the justice department is unwise. going to appeal in florida. what they should do is work with the special master. try to get the review done quickly so they can satisfy the judge's order and proceed with the investigation. >> ascends on how a green play in the public eye, majority of americans according to the fox news poll believe it was important to take these documents back but do democrats

risk and overreach here, in the case of making the president looking like he's been improperly investigated. >> i think it's hard. americans know what classified documents are, all of those things are at risk and donald trump as we certain himself into the national conversation which we know helps democrats enliven their base and also persuade swing voters. this is a win for democrats being in the national conversation but it's not necessarily a win for america, finding out that we have our national security secrets unlocked. watching that be adjudicated how and when i let the legal experts talk to them but it looks like the doj is working to get in the peel and that's wise so they can continue to pursue this case, protect those documents, state sources and methods. >> rich: i want to get to some

of the migrant busing and planes that we've seen from red state governors to places up north. what do you think is next, is there a next step in this site? >> the next step is to continue what they have been doing for the past couple of weeks and months. the whole reason why this is an issue for a century cities is because the border crisis has been ongoing since january 20th of last year. really if there is any solution if there's busing or flights should be taking place is the border should actually be secured here but the biden administration has refused to do that, refused to take responsibility for the problems they have created. the border has been a problem for a very long time but the biden administration decided to make things ten times worse and this is the consequence.

the sanctuary cities shouldn't be surprised when they are being taken up on their offer and now i'm seeing that it turns out that a lot of this was just virtue signaling. >> rich: critics have called this a stunt when you look at what the governors have been saying they are saying, look, we are just sending a fraction of who is coming over the border to your sanctuary city. but now you've got these states and these governors, the governor of texas setting up right in front of the vice president's house. does that begin to undercut this a little bit here? do they risk going too far in this? have they already gone too far? >> i'm disappointed this is become a political issue in the sense you are using migrants to make a political point. but i think it's a small number compared to the biden administration's using the same people to make a political point. they aren't policing the border, they are also using it to

enforcing immigration laws. the president is not carrying out his constitutional duty and instead is just essentially conducting no immigration po policy. they are using this to make a small political point about the contradictions in the biden administration's programs. the real answer has got to be congress has got to conduct more oversight of the biden the administration and make this an issue in the midterm elections. >> rich: florida governor ron desantis chartering flights to martha's vineyard for the state senator, marco rubio, had this to say about that today. >> i think it's perfectly reasonable for a state to assist them so that these places that claim to be century cities and the leaders who oppose every immigration enforcement measure out there sharing the burden. >> rich: this one to you. what do you think of that?

>> the voters just paid million dollars so marco rubio and ron desantis just made a press conference. what we have here is not solving a problem. simply trying to play politics with people. there's something fundamentally fun about that and there's a secret lining and as you watch these migrants be received in places like martha's vineyard's which is known for its hoity-toity exterior and the rich people who live there but that town and island is run by working-class people and they came together without notice to embrace those migrants and that's the american spirit. that means they are rolling up their sleeves with no notice working to find food and shelter and care for these folks while they await further education and their claims were that's all make the responses of them we can all be proud for. >> rich: thank you so much. for tonight's political panel. the attorney general for more

than a dozen states are urging president biden to declare fentanyl a weapon of mass destruction. the request comes as college and university students return to school amid an ongoing opioid crisis. correspondent matt finn has that story tonight. good evening, matt. >> good evening, rich. the bipartisan attorneys general from 18 different states are asking president biden to meet at lee declare fentanyl and weapon of mass instruction arguing the number of people the legal dog is killing increased x financially every year for the past several years. wrote a letter to president biden reading in part, we ask classifying a legal fentanyl as a weapon of mass destruction. or if you conclude if you do not have the authority to do so, urge congress to pass legislation to do so. fentanyl is considered the most deadly drug in america. the synthetic opioid is coming

through arizona. in a 12 month period ending last year, there were 105,000 drug overdoses and 66% were related to fentanyl. 2 milligrams, a few specs, can kill a person. attorneys general wrote to president biden the classifying the drug is a weapon of mass instruction could save tens of thousands of lives, writing in part that enough fentanyl has been seized in the last year to kill every man, woman, and child in the united states several times over. indeed, giving fentanyl's lethality, the amounts being interdicted and seized are inconsistent with what one would suspect from drug trafficking activity and purposeful conspiracy to kill americans or an effort to stockpile a dangerous chemical weapon. fentanyl recently has been blamed for student deaths on campuses across the country including ohio. one student recently died and three others were found

so jason, this is from the attorney general, the statement from this office saying, "refuses to hire gay faculty and staff, staged a sit in and called for a removal of the board of trustees after they voted to keep and play school policies that prohibit employees from engaging in same-sex sexual activity. who has the argument, the students or school? >> the legal perspective this school. a moral perspective, the students bear this is a private religious school. this is a school that's affiliated with the free methodist church. they have beliefs on lgbt issues and they have the right to have policies that uphold them. if you don't like this, you shouldn't try to apply for a job there and it's not like this is a surprise for this is not a new policy, this is not a new

religious affiliation. students and staff members who either enroll or apply knew this going in. a lawsuit i think is wrong even though i agree that the policy is not the right move but that's for the school to make and if they suffer consequences as a result of it, the lack of an ability to attract certain kinds of staff members that are qualified, that's the consequences they are going to have to live with. >> you could major in accounting, chemistry, psychology, all the hits here. is it proper to say that someone who is, let's say gay and teaches english or literature or history or whatever can't teach at that school. >> from a legal perspective -- i did watch all the good seasons of "the practice." i would say legally speaking i believe they have the right because of their religious affiliation. when we are talking about religious situations, they do

problem. addiction is a disease and we keep forgetting that that an addict will finally say, i'm ready for help. that's not exec we how it works and we are talking about fentanyl, the over dose can happen easily. 400 fatal overdoses. simply saying here's some narcan. not putting money into treatment is the wrong decision. >> rich: how much would that take special where you are in the seattle area? >> it's going to take a lot but at the end of the day there are societal benefits and a moral obligation. societal benefits because a lot of the homelessness crisis is being driven by drugs and they're putting a ton of money, hundreds of millions of dollars, into housing when they could be doing it into drug treatment. >> rich: jason rantz, our man out in the pacific northwest. thank you so much for joining

>> that's the ceo of mcdonald's telling business leaders in chicago last week that rising crime in tough economic conditions have made it harder to attract employees to the windy city. he added the city does not have an adequate plan in place to address his concerns and prevent companies like his from fleeing peer mcdonald's is betting on chicago in the long term. emphasis backlog of unprocessed rape kits made public nine years ago. as a city continues finding a lawsuit, the problem persists. senior correspondent laura ingle unpacking all of that tonight and the connection to the mertmurdereliza fletcher. >> returned to court to face charges in another violent case which involved a kidnapping in rape from last year.

involvement in both cases continue. other rape victims whose sexual assault kits are still waiting to be tested are fur furious. >> that story is not uncommon for the city of memphis. it's just so glaringly obvious there is a fundamental breakdown within the sex crimes unit. >> 38-year-old henderson back in front of a memphis judge to face another round of serious charges thursday including aggravated rape and kidnapping for a crime that happened in 2021. the timing of his reported dna match to the case was devastating. memphis police collected samples for a rape kit last september and submitted to the tennessee bureau of investigation. without a suspect the suspects were added to a backlog of kits and were not tested until augus. investigators say the results came back a match the same time

memphis teacher eliza fletcher was found after being violently adopted days earlier while she was on a run. dna evidence collected from that crime scene matched the samples collected in 2021 linking henderson to both crimes. memphis attorney daniel loftin who represents 80 rape survivors who never had their kids tested filed a lawsuit eight years ago which is still pending citing what he calls reckless infliction of stress. brandon mcnally lieutenant governor tells fox news digital, the back log has been the continuing problem and one that is extremely troubling. mcnally says the state is working to improve the tennessee bureau of investigations request for more hires adding this, these new employees will need time to train. i'm hopeful that wait periods will increase dramatically once

these positions are filled online. as for henderson, remains in custody without bond will be back in court on the fletcher case monday. >> rich: thank you. let's continue this conversation and discuss some of the stories making legal and law enforcement headlines tonight with criminal defense attorney bob junkie and retired las vegas police lieutenant randy sutton. i'll start with you for this backlog we are seeing in memphis and other places, doesn't this just say to victims of sexual assault, of violence like this, they are just not a priority? >> i'm going to go back on my experience when i ran a prosecutor's office in charge of 44 law enforcement agencies. this is really outrageous. this is not hyperbole appear this is a serious situation that has been going along for a long period of time and has not been rectified. let's go back to the day where we didn't have access to dna. one of the crime-fighting tools we have right now is if you are

convicted for a crime, you have to give a dna sample. so we have a whole database of dna and many times these are repeat offenders. essentially what they have done, no prosecutor doesn't want a stale case. the older it gets, the worse it is for the prosecutor. the victims of these crimes deserve justice. the answer is right in the database. number three, you want to make sure that you catch somebody so they can't re-victimize somebody down the road because these are typically repeat crimes and we have the case here. there is no excuse of when i was in charge of the law enforcement agency. heads would've rolled. i would not have stopped eight years later saying we need to do something to correct this. you don't need to go to law school, be a law enforcement committee or a judge to know that this defies common sense. it's an outrage. >> rich: how common is this?

>> unfortunately it's much more common than we want to admit in law enforcement but this is a massive failure of law enforcement leadership and also of governmental relationship to funding the law enforcement needs of this agency. the fact of it has gone on for so long with a lawsuit, it's absolutely unconscionable. i have to agree with bob. this is a massive failure. they revictimization led to the death of this woman and it's shocking that should be addressed immediately. forget the lawsuit. put the money in. do the job. do what you are supposed to do. let's take care of these vic victims. >> rich: i want to take us to chicago now and the story from the mcdonald's ceo saying it's in an hospitable environment when it comes to the crime, when

it comes to business environment but they do say they do plan on making a long-term play in chicago. illinois is ending cash bail in the beginning of 2023 a few months from now. addicts say it's going to make the problem worse. what do you say? >> people have ciccone and decisions on both sides of the equation. when i first came into office. waiting to happen three years because they couldn't make a $50 or $100 bail and wound up spending a year or two years waiting for a trial where after they were convicted they got time served because a sentence they got spend waiting for jail. those type of defenders need to be out in the street if if they don't pose a danger to the community. jersey bail reformed in 2017. they have a public safety score to see whether or not based on

the charge that they are charged with, whether it's a crime of violence, domestic violence, whether a weapon was used. a factor that heavily into the score. they make sure people who are in danger or continuing danger to the community are not released and that's what a lot of these states that are doing "bail reformed," if they are not including that public safety risk assessment, they are basic allowing people to go back into the community to re-victimize the people. the bottom line is do i have a problem with the no cash bail system? it's working in jersey. if you don't take into consideration the nature of the crime, the violence and the possibility of re-offense which many are creating legislation which does not have that in the equation, that's a problem. >> how does the needle threaten the system here? >> let's talk about the safety act, which is what this monstrosity is being called.
