shannon: the president admits there is more work to do to rein in the migrant crisis. but economists say they were concerned that signs at home and abroad point to inflation. new numbers this week as we discussed back in july. they are still at 40-year highs. market watch puts it this way saying don't be fooled by falling gas prices. inflation has spread throughout the country. medical care, food, all of those things.

>> easy inflationary pressures is the president's number one top domestic priority. gas prices didn't surge up. they have been falling for 96 days in a row. we are talk about a durable trend down $1.96 a gallon. for the average driver that's $70 savings per month. and it's half a billion per day. the inflation reduction act is in the mix to reduce the cost of prescription drugs, healthcare, energy. but prices remain you be comfortably high, that's why it is the top priority. that's why we are doing everything we can whether it's release of oil, our work in the ports, ocean shipping costs to bring those costs down. we have a lot more work to do.

numbers, i was reading the article on foxnews.com that had the following sentence. there are small but clear improvements in biden's ratings. the facts that over the past two months inflation has been effectively flat. i'm talking about july and august. shannon: 40-year high. >> just in those two months we had flat prices. but over the year inflation continues to be high. but when you think about investing in the future, empowering workers, building it here in america, building more resilient supply chains, those are not parts of an imaginary blueprint. those are parts of a blueprint that are actively in play.

is going to cut jobs. and hire freeze and playoffs at big law firms. >> we are willing to acknowledge -- we are have much a fact based economic scene when sitcoms to all this. but i have to give you facts on the other side of that coin. 3.7% unemployment. there are 15 states with unemployment at 3% or below. it's about the tightest labor market on record. we have been talking about inflationary pressures, the federal reserve is in a hiking cycle to dampen those cycles. those are all dynamics in play. but in the background is one of the strongest labor markets americans have ever experienced.

gone to people in president trump's main circle. the immediate problem from president trump's perspective is the investigation of mar-a-lago and the seizures there. that's the one that's ramping up with a bullet. shannon: judge cannon said the appointment of a pegs master is fully consequence assistant with foregoing principles and to insure the need for fairness under the circumstances. she is taking lot of heat. they are saying she is a trump-appointed judge. >> the department of justice filed a motion pending appeal that didn't ask to stay the entire appointment of the special master but only asked

for access to 100 documents. documents. the word is aim small, miss small. this is your best bet on those 100 documents. the special master may be already making progress on that. he's expected to prioritize those 100 documents. there is a chance they will be released or given access to the department of justice. it will be interesting to see if the administration goes further to litigate the thousands of documents reviewed by the special master. the department of justice admitted it may have taken attorney client material. admitting its taint teams made some mistakes. but probably after he looks at those classified documents, he

could drill down on it. shannon: justice kagan is out there discussing those criticizing the court for being too political. >> i think extensions of the political process. when people see them as trying to impose personal preferences on a society, irrespective of the law, that's when there is a problem. shannon: what do you make of these public conversations about the integrity of the court, pushing back on decisions they made, and whether you agree or disagree going to the heart of what the justices are doing. >> if you are going to worry about the public perception of the court you are doing politics instead of law. the reason we insulate the court

from politics. the minute you start to take the position that the court needs to worry about the public perception of its decisions, unless what the public thinks is the court is making the decisions because of politics rather than because of what the law says. then i think you get away from the business of judging. they can't worry about the public perception and what the media is going to say. that's why we insulate them from politics. shannon: the wall street editorial board says justice kagan now knows how justices thomas and scalia felt. they never attacked the legitimacy of the court. >> chief justice roberts took offense at these attacks on the

on flatbed trucks before being driven across. there was a visual reminder of what's happening at the border. >> it's the human story. the politics it seems to me is you use these people to make them into political props and you say wait a second. republican governors are upset. but these people just walked thousands of miles, they are fleeing violence, political oppression and poverty. each us as americans understand, we have family history. we understand where we came from. to see them used as props is offensive. you stop and say the republican governors have a point. they are on border states in some cases and their communities are being burdened by the surge of people. people who came legally seeking some kind of legal step --

asylum that would consider their standing. but the reality is the federal government gives added aid to those states. it doesn't give it to martha's vineyard. you want to start playing games we'll pull our funding. shannon: two of the governors, governor desantis says about the letter to the doj that newsom sent. he said i think your hair gel is interest fearing with your brain function. governor newsom said all you want is attention. i will bring my hair gel, you bring your hairspray. there are real people in the middle of this. >> i think gavin newsom is desperately trying to get everybody's attention to run for president in 2024.

let me address the humanitarian aspect of this. i don't remember a lot of concern out of progressives out of this administration when during the campaign they he sent an invitation to people. that has caused a two-year hue man tearian crisis at the -- two-year humanitarian crisis at the border. whether we send them to martha's vineyard or not is not the question. there are people being trafficked by coyotes. horrible reprehensible things being done to women and children. progressives everywhere in this administration, they are very generous spending everybody

shannon: our new fox news polling shows republicans held the advantage in july but now it has shifted to the democrats. >> i will say the president is getting a boost this week. it's a surprising boost given the fact that fundamental voter building blocks in this election cycle will be the economy and the political reality that most americans blame the president for not lowering historic inflation. and he's getting a blame for historic factors. the fact that president trump is back in the headlines. the scotus decide overreturning roe versus wade -- overturning roe versus wade.
