flights to martha's vineyard. chad wolf will react to the growing national security threat and the dire consequences of the biden administration's open border policy. >> sandra: but first, the battle for the house and senate ramping up with midterm elections just 49 days away. latest fox news power rankings revealing democrats may have roads to victory as republicans try to hold on to their advantage. hello, and welcome everyone, i'm sandra smith in new york. hi, john. >> john: good to spend tuesday with you. new data shows republicans are expected to take a 13 seat majority with the total of 231 seats. that is three seats fewer since august, giving democrats pathways to retain control. >> sandra: it's essentially a toss-up in the senate with races appearing very close in arizona, georgia, nevada and pennsylvania. power rankings show the senate is evenly split, republicans a

slight edge, expecting to take 51 seats with democrats taking 49. >> john: on the heels of the latest fox news poll showing what issues are driving voters to the polls. inflation topping the list with 19%, abortion falling not far behind, 16%, economy and jobs the number three issue, at 15%. >> sandra: house republicans put a spotlight on the kitchen table issues like inflation, democrats are energizing their base on the issue of abortion rights. tom cotton is on deck to sound off how republicans plan to take back control of congress. >> john: mark meredith is here in the studio and keeping track of it. >> midterm elections will impact every state and city in the country and there are a lot of races considering toss-ups, even though we are less than 50 days out. 30 seats of toss-ups. magic number is 218 for control.

republicans more likely to reach the threshold, even though the data shows a slight chance democrats could keep control of the house. the team writing the best case scenario for the left which assumes democrats will win all 30 of the most competitive races would give them a razor thin two-seat majority, 219 seats. in the senate, it truly is a toss-up. we have a 50/50 split right now, republicans going to november with a better shot to gain the majority. four seats are seen as toss-up us, in arizona, georgia, nevada and pennsylvania, and while ohio is not on the toss-up list, the race is tightening. j.d. vance with an advantage, his opponent, democratic congressman tim ryan has a powerful ground game. speaking of ohio, republican governor mike dewine expected to prevail, but seven governor's races are considered toss-ups, including arizona, maine and oregon, and republicans are

trying to keep the voters focused on education. whether or not that's going to play out in the final days, we will find out. >> john: they have to have a powerful message to crack the abortion issue. need to try harder, mark. you think that. >> sandra: arkansas republican tom cotton. let's dig in there and pop up on the screen the breakdown of the senate races, arizona, watching georgia, nevada and pennsylvania, the open seat there. so, what do you see happening here, and what do you attribute the loss of momentum for your party? >> sandra, i'm confident we are going to win control of the house and the senate. i would not say we have had a loss of momentum. look, the senate races are very competitive, they are going to go down to the wire in many states. the democrats have a very energized far left base that is happy that joe biden and democrats in congress have been

trying to deliver on their far left wing demand. can't do it through legislation, then through executive action. but most americans look at for instance his interview on "60 minutes" over the weekend and see the leader totally out of touch, saying inflation is flat, when it's at record high levels for the last year and a half since he took office. and democrats who are running on pro criminal policies have contributed to the crime wave across the country, to include the opioid epidemic affecting so many of our states, and open border we know have more than 4 million, maybe more than 5 million illegal aliens entering the country since joe biden took office. and the end, even though the races are going to be close, i think those are the issues voters will decide on in november. >> sandra: interesting, and the momentum point was that, it was predicted we would see a red wave, particularly in the house in the november election.

you've seen the potential margin of victory shrink for republican victory, republicans do have the advantage. so you are talking about the top issues. obviously democrats has been able to in many cases energize their base with abortion rights. so, how do you champion republican messaging on some of these key issues which are clearly still inflation, the economy, crime, immigration, are republicans getting their messaging straight this close to election day? >> well, first, sandra, the democrats want to portray republicans as extreme on abortion, but it's the democrats extremist on abortion. take new hampshire and nevada, the people in the states have chosen to have abortion permissible up to 24 weeks but impose reasonable restrictions on late term abortion. that's the choice the people of those states made for their own state. but democratic senators are so radical and so extreme that they

would override their own state's laws to mandate and require late term partial birth abortion funded by taxpayer dollars. that's not speculation, that's not a hypothetical, that's what democratic senators like kathy co cortez mastro and others voted for. democrats are extreme on abortion, in addition to being extreme and out of the mainstream and things like simple border security or tough on criminals or trying to stop the run away inflation that is harming so many families. >> sandra: has lindsey graham's messaging on a federal ban on abortion got in the way of that? >> i don't think it has because lindsey graham has proposed something the senate has voted on in the past, which is reasonable restrictions on late term abortions that was simply would bring the united states in line with much of the developed civilized world. france, not a conservative

country has earlier regulations on abortion. we don't have to speculate about hypothetical bills that a republican congress might pass. we know what a democratic congress would pass, it's what they tried to do earlier this year, mandating things like late term partial birth abortion paid for with taxpayers dollars, in some cases like nevada, new hampshire, the people have made their own choices for regulating late term abortion. >> sandra: quick final question here, i know you have written a letter, more than 30 senators have, including yourself, house oversight committee voting on a hunter biden resolutioned to, after 30 senators sent a.g. garland a letter, you say given the politization of the doj under your watch and avoiding appearance of impropriety, a special counsel, one important action that you can take that

would go a long way to restoring faith in our governmental institutions. real quick, where do you think this goes next, senator? >> sandra, i don't think we can trust attorney general merrick garland not to politicize the investigation the way he has politicized the department of justice. last year he sicked the feds on parents attending school board meetings or when he refused to enforce the law and arrest protestors outside of supreme court justices' homes in clear violation of law. we are not asking for the special counsel, we are merely asking to provide special counsel protections to the u.s. attorney who is already investigating hunter biden's many crimes. a necessary step to ensure that investigation is not politicized. >> sandra: appreciate you joining us, thank you so much. john. >> john: sandra, less than an hour the special master appointed to review documents seized during the raid on mar-a-lago will hold his first

hearing. he will meet with federal prosecutors and former members of trump's legal team and rule on what documents he believes fall under attorney/client or executive privilege. david spunt is outside the federal courthouse in brooklyn where the hearing is taking place. why is this happening in new york city, david? >> david: the case originated out of florida but named special master, raymond deery, who works in this building in brooklyn, called both parties to his chambers to have an introductory meeting today at 2:00. the former president's attorneys, four attorneys walk into the building. no comment as they walked into the building. but the judge, the special master in this case, john, has his work cut out for him. he has to go through around 11,000 documents by november 30th, he's the special master, a neutral person who will look at the evidence and decide if some should potentially be returned to the

former president under executive privilege or attorney/client privilege. expected to be an introductory meeting of both sides where he will set the parameters of this investigation. judge aileen cannon making former president trump pay for his billable hours and his team. as deery does his work going through thousands of documents, merrick garland and the doj are appealing the special master appointment to the 11th circuit court of appeals in atlanta, many different jurisdictions and cities. the reason judge cannon told the federal prosecutors she would not reverse her order that told doj to stop examining roughly 100 classified documents taken from mar-a-lago. doj argues time is ticking over ongoing national security issues. doj appealed to the 11th circuit is risky. the reason, six of the 11 are

trump appointee. deery was the judge that signed off on a surveillance fisa warrant against carter page. he was not working for russia but those believe deery may be skeptical of the fbi. the bottom line, john, we are in unchartered legal waters here, no one knows what's going to happen. we expect it to last about an hour. well bring you updates and sigh in about an hour and a half, john. >> john: see you soon. david, thank you very much. interesting to see how deery rules here. >> update on that and bring that to our audience as it comes in. meanwhile, the live pictures, explosion at an apartment j in chicago has sent at least six people there to the hospital. it happened in the south austin neighborhood on the city's west side. it appears the building's top floor was completely blown out. you can see debris lining the

streets there. chicago fire says at least ten ambulances were sent to the scene and adjacent buildings were being evacuated at last update. no word yet on the cause of this, but right now the local gas company there says there is no reason to believe the cause is related to gas or any of their equipment. we are going to bring you more information from this scene as we get it. john. >> john: wow. puerto rico reeling once again as hurricane fiona continues to churn. on top of power and water outages, the entire island is at a flood risk. live on the ground there. >> sandra: and despite record setting border crossings, a texas sheriff is laser focused on the 50 migrants sent to martha's vineyard. is an investigation into governor desantis a good use of resources? we'll ask chad wolf, he's here to react to that and the staggering new numbers at the border. >> they accuse the governors of

terrorists that were stopped at the border. >> sandra, good afternoon to you. the numbers are startling. right into the graphic and show your viewers. take a look. cbp reporting in the month of august alone, there were 12 individuals arrested on the fbi terror watch list. we apologize, we have a border patrol boat coming by right now, but that brings the total for fiscal year 2022 to 78 of these terror watch list arrests. that is a stunning number, triple the previous five fiscal years combined. 17 through 21, there were 26 of the terror watch list arrests. we are now at 78 so far this year. other numbers to take a look at, look at this graphic. cbp reporting in august alone, more than 203,000 illegal crossings here at the southern border. that brings the fiscal year 2022 total to more than 2.1 million so far, the highest number ever

recorded in a single fiscal year and we still have one month left to go, and shattering last month's record of 1.7 million. bill, let talk about the go-aways. cbp reporting that in the last year since the beginning of fiscal year 2021, now more than 900,000 confirmed got-aways at our southern border, a population bigger than the city of san francisco. as you take a look at this video in recent days here in eagle pass of mass illegal crossings, cbp is reporting what we have been seeing on the ground. predominantly cubans, venezuelans and nicaraguans crossing. numbers are up 175% over last year. and migrants flown to martha's vineyard, controversy erupting as the democrat sheriff in bexar county, texas, by san antonio,

he is officially launching a criminal investigation into the state of florida efforts to fly migrants from texas to martha's vineyard, accusing florida of luring migrants on to the airplane and saying he's not being political. and governor desantis says every migrant signed a consent form, on the flight voluntarily, they were homeless, sleeping on the streets in texas and they were given hotels and accommodations before the flights. what the sheriff and governor desantis are saying about this. >> at this point i'm not able to say here is the statute that they broke, either federal, state or local but what i can tell you is it's wrong, from a human rights perspective, what was done to these folks is wrong. >> those were people basically destitute and then put in a situation they could have succeeded and not only did they not welcome them, they deported them the next day with the national guard. give me a break.

>> and governor desantis's office fired back at the sheriff pointing out that it was june in this year in that sheriff's jurisdiction bexar county, 53 migrants died in a horrific human smuggling incidents where they baked to death in a trailer just outside of the san antonio area. we'll send it back to you. >> sandra: stunning new numbers at the border for us, bill, thank you. john. >> john: sandra, bring in chad wolf, start with bill ended off and that's the bexar county javier salazar saying i'm investigating him for potential criminal activity, it might be wrong, he does not know what statute he would charge him under. >> i think it's startling, the law enforcement officer saying i think it's wrong, i have no idea what statute it violates, he's weighing into what he believes is a political issue and trying to put his marker in the ground.

i think what he needs to focus on being so close to the border, a couple hours away from the border, is all the human trafficking that is taking place, not only in the city of san antonio but in his county as well. a lot of things that sheriff can be doing at the local level and not weighing into the larger issue at play here. i'm pretty sure that's what the residents of san antonio would like to see as well. >> john: and as bill pointed out, that's the county where the 50 tragically practically baked to death. >> we know a lot of work to be done. i know from being in that position, there is a lot of smuggling, a lot of human trafficking through the san antonio and houston corridor. that's where the sheriff needs to focus on. >> john: ron desantis's office put out a statement saying the immigrants were more than willing to leave bexar county after being homeless and left to fend for themselves. and what desantis said at a press conference a short time ago. >> abused by the cartels, drowning in the rio grande, you had 50 that died in some shed in

texas. i heard no outrage about any of that. the only thing i hear them getting upset about, you have 50 that end up in martha's vineyard, then they get really upset. if 50 was a burden on one of the richest places in our country, what about all the other communities? >> john: what about the points he's making there. >> a lot of activity on the border that there's a lot of attention not being paid to it. there's over 700 deaths this fiscal year, 700 in the desert and on that river. and i don't think it's being talked about, right. there are more apprehensions at the border, we just talked about the numbers, not only in this fiscal year, but ever. if you combine the two past years. there is known and suspected terrorists getting across the border. a lot of outrage that should be focused on what's going on at the border but yet the only time we hear from big portions of the left is when they were "whipping

minors" or bussing individuals to major cities where there is democratic mayors and the like. i think a lot of hypocrisy here. >> john: through the control room, call for number 5 here, total for fiscal year 2022 so far, 2,150,000 people, got-away, 900,000, and add in the previous year. by the time the fiscal year is over on september 30th, some 5 million people will have come into this country illegally, and it's created a difference of opinion among some democrats. listen to kamala harris and two of her colleagues. >> the border is secure. >> it's wrong, she's dead wrong on that. anybody says our border are secured, that is not accurate, i've been there. >> the border is not secure, with due respect to the v.p. we get thousands along the border, 6 to 8,000 people a day. >> john: reiterate the numbers. last two fiscal years, including estimated got-ways, at the end

of this month, some 5 million people will have crossed the border illegally into our country. is the border secure or is it not? >> absolutely it is not secure. i hear the vice president and i hear the dhs secretary and others say it's secure, how much does it take for you to say it's not secure. is it 8 million, 10 million, where does it stop. they need to be honest with the american people and all the numbers, the 5 million coming across, they are coming across in south texas and arizona and other places. where do they -- not all of them are here in the u.s., some are being deported, but where do these big city mayors and others think they are going to reside. capacity along the border is beyond stretched. it's stretched thin. there is no more capacity. and so the fact that you have to move them, if you are not going to deport them, move them to other parts of the country, why is it ok to have 50,000 stay in a community that's maybe 30,000 on the border, but if you send

>> sandra: top story as the battle for control of congress heats up, the latest fox power rankings released this morning showing republicans still favored to take control of the house, 30 competitive races are being closely watched and considered toss-ups. on the senate side, republicans have a slide lead but the balance of power could shift to either party. jessica, from "the five," and james, fox news contributors, energy just having you here. james, you've been able to dig through the latest power rankings. any surprises here for you? we have seen, you know, we have seen momentum on the side of democrats, but it's still republicans favored in the house and the senate. >> i think the power rankings are on. when you look at history, and

this is where i think there's been some debate, some confusion, people thinking the biden momentum, the democratic momentum is going to continue, perhaps it will, but if you just look at the fact he's down 11 approval, disapproval in the clear politics average, that translates historically to a very bad year in the midterm election for democrats. so i think that's probably what you get and that ranking reflects that. >> sandra: jessica, any surprises for you? >> not really, it was always going to be super close, the last few months were good for democrats, talking about a red tsunami, up to 60 seats and now pollsters say it will be close. this is the first time i saw a mention of the dems holding on to the house by a couple seats, that's not my expectation. i hope it would be a slim majority in the gop favor to

hold on to the senate. mitch mcconnell a few weeks ago said he was not particularly optimistic about that, that has shifted and we have seen the races in nevada and arizona and ohio get closer and closer and georgia, a few polls with walker up over warnock, so expect a close race. >> sandra: and james, when you put up the best case and worse case scenario how to play out for each party, democrats # 89 seats to 219 and their best case scenario still a slim margin, potential victory for them in the house with the key number 218, you look at republicans and a best case scenario, 246. that secures a pretty wide margin for what could be kevin mccarthy, speaker of the house. >> i think they have a lot of up side on the republican side. it's gotten closer as people have said, the republicans have the edge on economic issues, maybe the democrats on social

issues, i think that latter part is going to come into question because you do have a lot of races where senate candidates especially made comments in 2020 and perhaps in the years leading up to it about law enforcement, about crime, and those comments are going to be tough to defend as we go forward. >> sandra: case in point, john fetterman in the tweets from last year could come back to haunt him. he said we have a comprehensive review of the lwop population, if you think morgan freeman should have died in shawshank, don't waste your time reading it. otherwise that metaphor is the face of lwop, especially second murder in pennsylvania. mercy must be a partner to justice. so, lwop stands for life without parole, jessica, could those comments haunt him in a race that is very much about crime. >> i think crime and policing is going to be an issue in all of

these races, especially as they get closer with the city like philadelphia, that's obviously having huge crime issues and that's something that's historically been the case there. it's going to be a focal point. and talking about john fetterman pulled a shotgun on a black man in 2013 and the man said he wants him to be the senator from pennsylvania, but all of these things will come back. it does not mean it's a lost cause for democrats on this point or in general, and when you said, james, whether the social issues will matter, the issue of abortion is going to be a huge piece of this puzzle. we have seen it creep up to sometimes the number two issue in a state like pennsylvania. republicans are doing themselves no favors. i was watching lindsey graham this morning, totally reverse himself. he used to say it was a state issue, but now he wants heartbeat felts, no exception for rape or incest and not just

women angry about that. the dads are angry. >> sandra: and not just democrats. it's a big issue for republicans trying to keep this about the inflation, real quick final, put it on the screen. fox news poll on voter concerns. jessica, abortion policy for those who rate it extremely or very concerned about it, that's the bottom of the power rankings list out of those six items, top is still inflation. quick, james. >> and it is still at roughly a 40-year high, so that's the landscape as early voting is beginning very soon in a lot of these jurisdictions. >> sandra: 100%. great to have this panel. thank you to you both. >> john: hurricane fiona a category 3 storm, downing trees in the dominican republic, flooding will continue throughout the day. after fiona pummelled parts of

puerto rico without electricity or water. bill is in ponce. >> the rain has finally stopped, giving the break so many emergency workers need. a state of emergency continues with rescue operations underway, more than 1,000 people already rescued. in shelters, more than 128 shelters open across puerto rico, and could be open for days if not weeks. we have seen entire neighborhoods underwater, mudslides in the mountain region, washing homes from their foundation. and the energy company here, says they've about 280,000 customers back online. still a long way to go, 1.1 million needed to be back online. it's a category 3 storm heading to bermuda. >> john: amazing to look at the photos there, the pictures from puerto rico.

plaguing the state as a state panel moves forward into an investigation into district attorney larry krasner soft on crime policies. the highest number of homicides on record. krasner could be held in contempt for refusing to supply information for a subpoena. let's bring in senior fellow at the manhattan institute, ra fall mangual. so you've got the republican-led pennsylvania house trying to take out larry krasner, krasner claims it's all dirty politics in an election year. your thoughts on that, rafael? >> i think that's a bit of a disingenuous claim. what else would the legislature be expected to do in the face of record homicide numbers. they ought to be interested in response to the people that they represent in what is one of the

most pressing public policy problems of our time, particularly in the city of philadelphia, as you know, all time homicide record last year and on pace to break it this year. larry krasner has presided over significant homicide increases every single year that he has been in office. the idea that he doesn't have anything to do with that phenomenon, you know, the republicans have every right to investigate the degree to which krasner has contributed to what is one of the most serious public policy problems of our time. >> john: 2016, before krasner took over, all cases that were withdrawn or dismissed just 30% by 2022, that number had jumped to 66%. violent crime cases in 2016, 48% were withdrawn or dismissed. 2022 under krasner, jumped to 66%. drug cases, 2016, just 16% were either withdrawn or dismissed. that number jumping to 62% by
