was based on that. and then she came after us. we have been going over this for years. >> mike: president trump on "hannity" will show you what a former president has to say about the ongoing legal fight over the mar-a-lago document drama. and the white house explaining what president biden really meant when he said the pandemic is over, this is his covid-19 mandate suffers another legal setback. and on attacks with vladimir putin while seemingly offering another message on taiwan then he did a few days ago on "60 minutes." our panel is standing by live to break it all down. and 21-year-old lsu student alison rice laid to rest as police say they still don't have enough evidence to identify a suspect in her tragic shooting death. fox news investigates if this was more than just a case of being in the wrong place at the wrong time. but first, former president trump heading back hard tonight amid a slew of legal fights and that's where we start with chief breaking news

correspondent and a face we will see a lot more of, trace gallagher and our fox news room, good evening. >> the primary goal of the lawsuit appears to be a right to prevent the president from ever again owning a business in the state of new york. an attorney general letitia james believes that she can prove that he patted his network by billions of dollars in an effort to pay lower taxes and insurance premiums and give banks more favorable rates. the 222 lawsuit alleges more than 200 examples of misleading asset valuations including allegations that trump inflated the price of his apartment in trump tower and his mar-a-lago estate and palm beach. some legal experts called a civil lawsuit a long shot or an overreach and former federal attorney andy mccarthy says the case has something missing, watch. >> you know, the thing that you

expect to find in a massive fraud case is an array of victims. and one thing i think that is startling about this is that there are no victims identified. >> donald trump's attorney stated that "to the attorney general's office has exceeded its statuary authority by trying the transactions with absolutely no wrongdoing has taken place." tonight on "hannity" the former president called the case a continuing of the witch hunt and said that the new york attorney general is trying to protect banks that don't need protection because banks have this tendency to verify their assets. watch. >> it basically says to an institution, you have to go out and make sure that you get your appraisers and lawyers, everything, these are banks that have the best lawyers in the world, sean. this is the only -- by the way, they got payback. >> i'm remember along with letitia james lawsuit manhattan district attorney is working on

three-judge panel stating "we decide only the question presented at the united states has established it is entitled to a state of the district court order to the extent that it one requires the government to submit for their special masters review the documents with classification markings and it two, it joins the united states from using that subset of documents in a criminal investigation. we conclude that it has." interesting to note that two of the three judges on the 11th circuit panel that signed off on the order are trump appointees and the third was picked by former president barack obama. let's get some expert insight tonight into the latest legal jeopardy facing the former president from formal frederick federal prosecutor joseph moreno and john yoo, gentlemen, welcome. >> great to be with you. speak to the federal appeals court to lifting a hold on the justice department's ability to use classified records taken from former president trump's

mar-a-lago home. joe, how big of a development is that? >> it is significant, mike, not a great break for president trump, but not a great surprise either. the 11th circuit basically said, look, we are not that impressed with the former president's arguments that he declassified these records and in any event we don't really care so much because it is not disputed. this is government property. we are giving it back to the government for them to use as part of their investigation. so it is a small misstep i would say, but on the declassification point, that is something that could be a problem, because for president trump's case largely hinging on his effort that he declassified these efforts and the at the 11th circuit they were not too oppressed. >> mike: how do you assess tonight's development? >> i think there is one more setback for the trump team and this has not been a good legal day for them by any means, the main problem is that the appeals

court, the 11th circuit said that the justice department is allowed to continue a criminal investigation into president trump's handling of the documents. that is a really important thing, because what the district judge tried to do was say you could look at the documents to see whether national security has been harmed, but i am warning you to stop any criminal investigation using these classified documents. and they said that the district judge went too far by inferring in doj operations. this is significant because it recognizes that president trump might be on the hook criminally here because of the mishandling of the classified documents. and it allows the justice to use tools at its disposal to keep that investigation going. >> mike: to the legal issues in new york, former president trump offering his reaction to sean hannity ton tonight. >> i actually thought that they would never bring a case and she brought it. and of the impression that she wanted to settle, but i had a problem, because how do you pay

something even if it is a small amount of money if you are not guilty? this was just a continuation of a witch hunt that began when i came down the escalator at trump tower. >> it was a 220 page civil lawsuit and how damaging is it, joe? >> mike, there's a lot going on with former president trump right now and he has some exposure and some of these different cases that are out there. this is not one of them come of this case, i've heard analysts say during the day that this case is a stretch. i would go third or an say it is absurd. and if i were still in new york or i would be furious as a taxpayer that the attorney general's office spent three years investigating donald trump based on a campaign promise by the attorney general back when she ran in 2018 which itself is a terrible precedent to set and this is the best they came up with. it's not impressive at all. >> mike: here is letitia james sounding pretty anti-trump. >> i look forward to going into

the office of attorney general every day, suing him, defending your rights and then going home. >> i say one name donald trump, that should motivate you. >> will you sue him for us? >> i will definitely sue him. you will know my name pers personally. >> mike: sounds pretty personal, john, how do you see the civil lawsuit? >> i think unlike the last suit we talked about where donald trump's vulnerability is increasing, gary think this may be the most vulnerable you will ever be on this lawsuit to the day the announcement goes and then as time proceeds it is going to be less and less, so i agree with john on that point, one other thing that can be attacked as the attorney general's neutrality and impartiality, she campaigned on prosecuting one person, that's a dangerous precedent. another thing that worries me is to ask if president trump had never been president, would new york and its attorney general have ever investigated him for any of this

before? that makes it seem like he is being punished and singled out because he was a president who happen to be popular in new york, do we want to set that precedent for future presidents? >> mike: two covid mandates, striking down a mandate from the biden administration the required staffers at headstart child care facility is to be vaccinated and to wear masks, joe, what about that one. >> mike, we are seeing a pattern. this administration is perfectly happy to take the authority congress has granted it and stretching it to the breaking point. we saw last summer with the eviction moratorium that was struck down by the supreme court. we saw the travel ban, the travel mask mandate struck down earlier this year and now we see this with a head start case and i fully expect the student loan forgiveness will probably be vulnerable in court to this administration has to realize it cannot take these emergency powers and play games with what is not a pandemic at the moment and expect that no one is ever going to challenge it. it so i'm glad to see the judiciary pushing back and

indefinitely or maybe he is going to lose. maybe he will lose, but i am worried this will be an extended war which will result in ukraine being destroyed for attrition and russian missiles, and i think that it was at a missed opportunity. >> mike: asking like a desperate guy, what you make of the president's effort at the u.n. today? >> he did what the world needed which was to rally support and steadfastness against a madman in the kremlin who has his back against the wall because of his own military failures and is now threatening the world with tactical nuclear arms or worse, this is a time when we have to stand up. we can't simply step in and negotiate away parts of a sovereign nation invaded by a madman in order to reach a false peace. we have to stand up and stand with the ukraine to stop this invasion. to stand up for democracy and freedom across the world. because if vladimir putin can

threaten freedom in ukraine, he can threaten it anywhere around the world. joe biden stood up for american values today on the world stage. >> mike: the president also spent some time on the u.s. rivalry with china, let's play it. >> let me be direct about the competition between the united states and china, as we manage shifting geopolitical trends, the united states will conduct itself as a reasonable leader, we do not seek conflict. we do not seek a cold war. we do not ask any nation to choose between the united states or any other partner. >> mike: should he have been tougher with beijing, fred? >> china is not a competitor, it is an adversary. it is an existential threat to freedom around the world to our security and economy and joe biden is playing down the threat from china not facing up to the severe human rights violations in china. i think that to the leaders in beijing must have been laughing themselves silly that they were getting away with such a soft

treatment by the present and in the united states after what they are doing in the south china sea, flying planes over taiwan lanning to invade. i was stunned at the soft treatment joe biden gave to china. >> mike: what do you make of russia and china skipping the speech? >> i think they skipped this speech because you have seen russia step away from these security councils and its role to bring peace and instead engage in these awful tactics in the ukraine that include human rights violations and vladimir putin vladimir putin is a war criminal. china has expressed their disapproval recently of russia's invasion of ukraine and where the world as an right now we need them as an ally to help rain in russia, and i think that the u.s. government and this administration has to strongly look at a speaker of the house in taiwan for the first time in decades and i think that the chinese government knows where we stand on the issues in the south china sea and i think that

joe biden did an excellent job of trying to bring china along as part of a coalition to reign in which russia is doing right now. >> mike: to inflation here is chase ceo jamie dimon on capitol hill. >> but since then we have spent a total fiscal spending has been $6 trillion, 30% of the gdp which is bigger than any time in history other than world war ii. they are taking the right action to reverse it, but i don't think you can spend $6 trillion and not expect inflation. >> mike: raising rates again by another .75 percentage points, nearly out of time but i want to get both of you guys a chance here. fred, you first. >> reducing the money supply this way will help with the real focus, it is reducing government spending and ending the biden administration's war on fossil fuel and gas elation cars, as long as we have this problem we are not queen to be able to stop inflation and stop the likely beginnings of a very serious recession.

evangelist capital church in peterborough for the funeral mass celebrating the lsu senior, shot to death in downtown baton rouge last friday. a small comfort for her father who tells fox news digital that he is grateful she wasn't struck in the face so he could see her one last time. rice was murdered around 2:20 friday morning as she sat in her car waiting at a railroad crossing and what law enforcement has called a random act. a makeshift memorial at the murder scene marks the place where the 21-year-old marketing student who was described by so many including her boss at a local restaurant as loving, kind, and ambitious was killed. >> she had such a bright future. she had an internship set up. she was so excited the last time she was here. >> sharing these photos with fox and tells us that their friends and family have been working on replacing the cross to honor at the scene of her murder after
