investigators couldn't find him until after the murder. >> dagen: thank you so much for that. >> dana: a potential bombshell in the hunter biden investigation. a report federal agents believe they have enough evidence to charge the president's son with tax crimes and lying about his drug use so he could buy a gun. welcome to a brand-new hour of "america's newsroom," i'm dana perino. bill is off today. hi, dagen. >> dagen: i'm dagen mcdowell. the federal investigation into hunter biden started four years ago and for months investigators have believed that they have sufficient evidence to bring charges. the case now rests in the hands of the u.s. attorney in delaware. but he has been holding off on a final decision. jonathan turley earlier telling us the timing of the case could all depend on the mid-term elections. >> the concern really for some of us is whether this is being pushed by the mid-term elections, the republicans are expected to take over the house and announced they will

investigate the hunter biden matter. this could essentially close off that avenue for prosecution by reaching a plea agreement. >> dagen: the front page of the "new york post" saying it's time for the feds to charge him already. >> dana: fox team coverage shannon bream with a look at the timing of all of this just before the mid-term elections. first david spunt starts us off at the justice department. good morning, david. >> good morning to you. our sources are telling us that this investigation is at a sensitive and critical stage. it has been that way for several months right now as you mentioned it began in 2018. we're also told at fox news that the investigation has moved from the f.b.i. to the u.s. attorney in delaware and investigators are no longer actively collecting evidence in this case. this coming with a source with knowledge of the investigation. the "washington post" yesterday was out with this report that agents believe prosecutors have

enough evidence to charge the younger biden with tax crimes. a plural s right there. also a false statement related to a gun charge. investigation moved to the u.s. attorney in delaware. d.o.j. policy is not to file politically sensitive charges in the two months or so before a federal election. since hunter biden is not on the ballot, the rule may not apply. the grand jury in this investigation finished over the summer. d.o.j. is declining comment on this story. we have previously reported that hunter was being investigated for possible federal tax and gun paperwork violations as well as foreign lobbying crimes. the "washington post" says federal agents believe the tax and gun registration aspects could be the chargeable parts of this equation. fox news reviewed a 2018 fierp arm report where biden answered no to a question asking if he was an unlawful user or addicted to drugs. now biden's attorney in a

statement to fox news pushed back on the post article telling us it is a federal felony for a federal agent to leak information about a grand jury investigation such as this one. any agent you cite as a source in your article apparently has committed such a felony. we expect the department of justice will diligently investigate and prosecute such bad actors. now what's not clear, dagen and dana, the laptop that has been in f.b.i. custody for several years, will it be part of any charging decision? that's yet remains to be seen and also possible that david wiess kept on by president biden as the u.s. attorney in delaware may work out a plea deal with hunter biden before this even becomes public. back to you. >> dana: david spunt in washington for us on that. thank you. >> president biden: no one should be in jail just for using or possessing marijuana. ist is already legal in many states. criminal records for marijuana

possession have led to needless barriers to employment, housing, educational opportunities. >> dagen: president biden dropping an october surprise pardoning all prior federal offenses for simple marijuana possession urging governors to follow suit as democrats are trying to hold onto their slim majority in congress with just 32 days until the mid-terms. jacque heinrich is live at the white house with more. jacque. >> good morning, dagen. critics say the timing shows that the president is just buying votes for his party but the white house says the president is just fulfilling a campaign promise from nearly two years ago five weeks out from the mid-terms. biden signed the pardon aboard air force one for all federal offenses of simple marijuana possession including those in district of columbia. it will benefit 6500 people convicted federally between 1992 and 2021 and also thousands more in d.c. removing barriers to

housing, employment and education. officials admit it is not going to get anyone out of jail. there are no offenders in the federal system solely for marijuana possession right now, which is why biden urged state governors to follow his lead. tom wolf did almost immediately. i just could order naivetyed a one scale pardon effort for people non-violent marijuana convictions. under pennsylvania law i don't have unilateral pardon authority but righting the wrong of the failed war on drugs. the bigger impact may come from biden's directive to the attorney general and health and human services to review how marijuana crimes are prosecuted. biden says the policies disprop disproportionately affected black and brown people. >> president biden: it has it as a schedule one substance. it makes no sense. so i'm asking the secretary of health and human services and the attorney general to review

how marijuana is scheduled under federal law. even as federal and local regulations of marijuana change. >> critics on the right sounding off. in the midst of a crime wave and on the brink of a recession joe biden is giving blanket pardons to drug offenders, many of whom pled down from more serious charges. a desperate attempt to distract from failed leadership. there are reports that the president was skeptical about decriminalization and hesitant to direct any changes to the department of justice. but evidently he got over it. dagen. >> dagen: thank you. >> dana: joining us for more on that and the hunter biden case, shannon bream, anchor of "fox news sunday." let's start with the hunter biden issue. listen to tony bobulinski earlier this week. >> there are hundreds of data points that joe biden was acting in a capitalistic term the

chairman. a figurehead. shows up at meetings, shakes hands, advises, has faith in his team. that was joe biden's role in the biden family business ventures around the world. >> dana: what we know based on the leak is possible charges for hunter biden would deal with tax fi filings and lying on the gun form. that won't be satisfactory to a lot of people. do you think that there is a possibility that he might try to plea this out before the election? >> it's possible but remember as david spunt so rightly reported the d.o.j. holds off on taking major action that could have implications on federal elections in the 60 days before but hunter biden isn't a candidate on the ballot. neither is his dad at this point. what happens with democrats in this conversation is important. it is such a turnaround to two years ago, the last major federal election we had when his father was elected president that we were told this was

misinformation, disinformation. there were social media outlets that blocked you being able to share the reporting broadly that was coming out of the "new york post." here we are two years later and it is interesting timing to all of us that this leak comes out that there could be federal criminal indictments coming against the first son. so wow, how things have changed in two years. >> dana: the gun charge if that were to come to be, lying on the form, that's a serious crime. i thought that democrats wanted to enforce the gun crime laws, right? >> right. that's always been the criticism that they faced when they want to pass new laws is current gun crimes and current penalties with those laws are often not enforced. you don't see prosecutors take up all the gun cases they could that would go after the bad actors other than passing laws that would also penalize or restrict people who have been

law-abiding citizens. a great point and interesting to see especially as we have this conversation about who is better on crime, the rule of law, enforcing the law, where this case goes and the conversation goes now that the tables are turned a little bit. >> dagen: i mentioned this earlier the rapper kodak black got three years in federal prison for doing the same thing, for falsifying information to purchase four guns down in florida. don't expect hunter biden, my opinion, to be held to that standard. >> now we wait to see. it is interesting because this conversation you are having about the marijuana laws, the president talked about in part of getting rid of some of the federal penalties he said that the black and brown community and minority communities are more deeply affected by some of these penalties and the incarceration. so it is interesting when you do the contrast between the gun laws and how they could be enforced against his own son versus somebody who is a

prominent member of the minority community. will we be selectively enforcing laws who could be charged? >> dana: you bring up the marijuana pardons. john fetterman, lieutenant governor of pennsylvania, the senate candidate for the democrats and that's a very tight race up there with that open seat. he wrote this about the announcement yesterday. this is a bfd and a massive step towards justice. when i heard president biden be in pittsburgh a month ago i knew if i had a chance to sit down with him i would use that opportunity to talk about the need to decriminalize marijuana and that's exactly what i did. he gets what he wanted, right? democrats say biden said he would do this two years ago. it is happening five weeks before the election, fine. interesting that you hear the president of the united states coming to your state and that's the most important issue that you want to bring up with him? >> it is interesting. that whole race has been very quirky. i think that's fair to say of the candidates, of the issues and everything that is happening in pennsylvania.

it is interesting when there were people saying oh my goodness, i'm having a hard time paying my bills and filling my gas tank and getting my kids two and from school and to work, finding a good job. the economy, inflation, meeting your grocery bill and paying rent are all things that would be more prominent for a discussion with a president. it doesn't poll well for him and it is difficult and as gas prices tick up again it looks like we'll be in for some tough readings on inflation next month. why decriminalizing marijuana would be your number one issue i'm not sure. he is one of the first ones to say i think pennsylvania should do the same thing. >> dana: what is coming up on sunday? >> we are going to have stacey abrams with us. she ran a very tough race against governor kemp. he was with us last sunday. they faced off in 2018. we'll talk to her whether she conceded that race. she says she has been misconstrued on that and defunding the police. abortion and the hot senate race and former secretary of state

>> dana: america's energy crisis is greating worse. crude oil prices are 10% higher than a week ago. drivers will soon feel it at the pump unfortunately. the cost of filling up your tank getting more expensive for two

weeks and it may well keep rising. grady trimble is live in chicago tracking it for us. what do we need to know? >> unfortunately the falling prices from over the summer seem like a distant memory now that it's fall. the national average today is 3.9 about $0.13 higher than a month ago. $0.10 higher than just last week. refinery problems out west and to some degree in the midwest started the surge. now the parts of the country enjoying relatively low prices compared to other regions could see pump prices go up. gas buddies says in the south and east coast in particular they could see prices increase between 10 and $0.30 per gallon. it's largely because of opec's planned production cut of $2 million a day sending oil prices closer to $100 a barrel. >> what is your reaction to the opec? >> president biden:

disappointment. we are looking at what alternatives. >> one of the alternatives is taking more oil out of the strategic petroleum reserve. >> we don't have to be in this situation. we don't need this opec+ confrontation. if president biden would have gone to the gulf coast and let's do domestic production. now we beg for oil from the persian gulf. a horrible situation to be in. >> we're keeping an eye on diesel prices. the national average for diesel is up $0.03 since just yesterday getting quite a bit closer to $five for a gallon of diesel. >> dana: it has a huge impact on people working for the living. thank you very much, grady. >> dagen: speaking of working the monthly jobs report out earlier today could be bad news-/good news for the economy and fight against inflation. the u.s. added a better than expected 263,000 jobs last month. but the unemployment falling to

31/2%. as the government tries to cool the economy with interest rate increases and jobs reports and higher wages could mean more rate hikes to come from the federal reserve. let me bring in steve moore former economic advisor to president trump and robert wolf, fox news contribute for and former president obama administration economic advisor. gentlemen, great to see you this morning. steve moore, the jobs report was strong enough that the federal reserve will stay course to fight inflation. if you look at what the market is doing this morning, that's why you get the negative reaction. >> yeah, look, on balance it's a positive report. the one thing i think a lot of economists like me and i think probably robert are concerned about was another decline in the labor force participation rate, which means the reason the unemployment rate fell is fewer americans are looking for jobs.

we need 4, 5, 6 million more americans working in this economy. i don't like the idea, by the way, dagen, that is so common in the financial markets that somehow people working will mean higher inflation. that's a good thing. in the 1980s and 1990s in the trump era we had low inflation and low unemployment at the same time. we have to get back to that. one other quick point wages up only 5%. inflation up 81/2%. that's a big problem for american families. >> dagen: according to the federal reserve in dallas it's worse than that. they came out with a report earlier this week that found that the median decline adjusted for inflation is 81/2 percent and there have been other periods where workers lost

ground relative to inflation but the current time period is unparalleled in terms of the challenge employed workers face. inflation is a pox, a sickness. what do you make of this report and maybe the biden administration continue to fuel inflation say with the moratorium on making student loan payments? >> dagen, we've been speaking about this for a while. inflation was not transitory, it never was. it reared its ugly head during covid and then into the ukraine war and it has continued and proliferateed. it is not good for our economy and we're seeing a lot of the pain from it. what steve said earlier we're completely aligned on. wages did not go up as much as we want. inflation is here and here to stay for a while. i've been saying it for over a year now. but we've had the perfect storm, dagen. we have talked about it. we have partly in the embargo with russia oil similar to the

70s, the persian gulf war type of situation of the 90s and then we have post covid reopening with incredible demand with supply problems. so we have everything coming at us at once with respect to oil and then all of a sudden yesterday out of nowhere our friend cut production by 2 million barrels, which is just absurd. that's literally handing a gift to russia during the worst time from a geopolitical basis. >> dagen: robert, why doesn't president biden. why don't they come out and say we'll do everything in our power to make sure that our energy companies here in the united states get every ounce of oil out of the ground, extract every available bit of natural gas? why can't they just say that? >> dagen, i'm complete agreement. we should have an all-in energy

approach and doing everything we can for more fracking. you know there is a ton of permits available not being used. when i was -- we had enron, we boughten ron. i know the energy sector well. let's be clear. with this volatile environment it is not like everyone is looking to invest in energy infrastructure with this volatility. if the war ended we would see prices come way down. >> dagen: steve, you won't invest if you know that the administration might -- >> kill you. >> dagen: final word, steve. >> robert makes a lot of sense. i wish he were in the white house. he is a lot smarter than a lot of the economic advisors biden has. we estimate we would produce 3 million more barrels a day if we had just stuck with the trump pro-drilling policies. if that had happened we wouldn't have to worry about whether

saudi arabia was increasing or reducing their oil output because we would be the number one producer in the world. we have more oil and gas than any other country in the world and i hate to say this, dagen, but you were reporting close to $four a gallon gas. in california they pay $6.50 a gallon and i think we see over the next couple of months higher gas prices around the country hurting middle class quite a bit. >> dagen: gentleman, thank you so much. energy sector, it is power and prosperity and economic and national security. say it with me. steve moore and robert waltz, thank you. >> why a crime at a level it hasn't been in 20 years? they elected woke d.a.s who don't believe in putting people in jail. >> dana: republicans looking to turn the mid-terms into a referendum especially on public safety and democrats try to erase their ties to the defund the police movement. we'll ask lawrence jones.

>> dagen: an attacker with a large kitchen knife stabbing two people dead, wounding six others on the las vegas strip. suspect taken into custody by security guards and police. christina coleman with more. >> yeah, talk about crime. las vegas police say a man used a large kitchen knife to quickly and brutally attack residents and tourists on the vegas strip. authorities say the unprovoked stabbing happened yesterday in broad daylight 1130 in the morning at a busy intersection. witnesses say a few of the victims were show girls who take pictures with tourists on the strip. police say it is an isolated incident. two people were killed and six

were injured. >> the police -- because i don't know. he is crazy, so i feel bad >> very upsetting. we saw another gentleman stabbed. lots of blood and it was just a shock for everyone, i think. >> authorities identified the lone suspect as 32-year-old barrios addressing him yesterday and doesn't appear to be from the community and working to further identify him. he is charged with two counts of murder and six counts of attempted murder with a deadly weapon. >> stabbing occurs quickly and suspect subsequently goes southbound on the sidewalk area and stabs additional victims. >> as for the murder victims, they were identified as 47-year-old brent allen how wits and 30-year-old maurice.

>> it's frightening. i feel very bad for the people involved. and their families. i mean, this is a nice part of the strip and you wouldn't ever think about being afraid to walk along here. >> again police say this was an isolated incident and so far no word on a motive for the deadly and senseless violence in this case. dagen. >> dagen: thank you. >> dana: new f.b.i. report shows murders are continuing to spike across the usa. data shows the murder rate spiked by 4.3% in 2021 following a record 30% increase in homicides the year before. but the situation is even bleaker in the nation's large he have cities. several of them didn't even roar their stays to the f.b.i. lawrence jones is the host of lawrence jones cross-country. you have been cross-country and talked to some voters about this. i want to play a little bit of what you heard about voters on crime. let's listen.

>> soft crime policies, with the way the situation is, people are forced to make certain decisions and when there is no accountability for these actions, people are more likely to just commit them. >> there needs to be a path of rehabilitation. when they are repeat offenders and continuously break that i'm for harsher sentencing. >> dana: tell us a little bit more. crime is now the second most important issue for voters, inflation at 82%, crime right there at 72%. >> i haven't seen that poll but i would make that point. i've been going to all the swing states and you hear people talk about the economy and how it is impacting them. inflation, but you hear people very frustrated with the crime happening every where in the country. i think when you look at the democrats they kind of took advantage of the compassion of the american people because the american people were ravedy to have a conversation about criminal justice reform and people that may have been behind

bars that shouldn't be behind bars. they have served their time and, you know, rehabilitated themselves. but this is just chaos. and i continue to make the point that it is only a matter of time before citizens want the take the power in their hand not because they want vigilante justice but because if the cops are on the street and the cops feel afraid to do their job, when you have the d.a.s that don't want to properly charge people and have judges that say listen, i wish we had some flexibility but we have legal standards and have to release them back on the street, what else is going to happen? we just can't continue to have citizens that are victimized on a day-to-day basis. you show the criminal, long rap sheet and they never turned their life around. why are they back on the streets so society has to deal with them? the criminal justice system was designed for one reason.

to protect society from the criminals. and when you have the d.a.s that go into court in front of a judge saying i'm representing the state, the people, and then on the other hand they release those people back to offend, it doesn't make any sense. >> dana: we got this brand-new news in and wanted to talk to you about immigration and new york city the "new york post" public schools overwhelmed with migrant kids. mayor eric adams has declared a state of emergency because of the number of asylum seekers. >> i got back from arizona. i'm also going to be doing an interview with a mom that has been impacted in new york city. it's a tough issue. it is important to make this clear. the people that we talked to are not anti-immigrant and not anti-children but they also have a duty for the best education for their children as well and the mayor caused this problem. he taunted the governor of

texas. he taunted the red states and he said he was a sanctuary. i think it's very inhumane to say bring me your people and then slam the door in their face. >> dagen: he ran on we are going to offer this variety of services. >> have a plan once the people got here. >> dana: he can declare it a sanctuary state of emergency because that's what it is. the other thing is if he thinks this is an emergency, what do you think the mayors of those border towns are going through? >> democrats by the way. i'll end with this. this is constantly what the democrats do. they offer this big plan when they really don't have a plan, a big policy position and once they are faced with the policy position they can't move from it. and so we have to deal with the consequences of their bad experiments. crime is one. immigration is one and inflation is another. that will decide the next election. >> dana: great to see you. >> dagen: i was going to add

the republican challenger in a closely-watch house rah race is taking the side of a mother and her child's school district. she is running to unseat a congressman. a manchester mom filed a lawsuit against the local school district when she learned her child had asked her teacher to call her by a different name. the school should follow the student's request and keep that from parents. >> that's your child and you are the one raising that child, not the school. >> a round table with parents talking about the issue. the congressman did not return a request for comment. the democratic party chair responded to a critic on twitter who took issue with the school keeping information from parents. the party chairman wrote you are purposely going after children
