>> sandra: president biden promising action on saudi arabia. critics say he got played on the world stage. coming up, we'll speak to the top republican in the senate when it comes to energy. he says the president gave the saudis a fist bump. they gave him the finger. welcome back as "america reports" rolls into a second hour. i'm sandra smith in new york. hello, mike. >> mike: mike emanuel, midterms less than four weeks away, but new at 2:00, another issue hitting home for way too many families, crime. >> sandra: that was one mother's experience, a horrifying moment and it horrified a nation. how could anybody forget that mother mowed down while walking her little baby in a stroller. at the wheel, a teenager out on

probation who then fled the scene. that mother will join us in moments and she says she wants to put california in her rearview mirror for good. >> mike: headlines piling up in cities across america. murder, assault, rape, robbery, too much to keep track, even those who stand up to serve are themselves targeted. just this morning, three swat officers were rushed to the hospital after being shot while serving a murder warrant in philadelphia. authorities just now giving new information on their conditions. >> sandra: it's part of our team coverage of the crime wave continuing to plague cities from coast to coast. >> starting with the shooting in philadelphia, david lee miller has more. >> mike, growing anger and frustration in philadelphia over surging crime following a gun fight this morning that left three swat officers injured. two have been released from the hospital. another officer was shot in the chest. 29 year department veteran is

kept for observation. serving an arrest warrant for this man, 19-year-old rahim lee, wanted for homicide and a record of armed robberies. he opened fire and was shot and killed as he tried to run. the philadelphia controversial d.a. larry krasner is speaking out following the shootout. in a statement, he acknowledged his office approved lee's arrest warrant for a murder in august. a portion of his statement said the work of swat is crucial and extraordinarily dangerous. philadelphia's first deputy commissioner when asked if he was pointing the finger at krasner said everyone is to blame for the city's crime problem, including parents. some people should not be free to walk the streets. >> not everybody deserves to be in jail. but some folks that have a lengthy record, they deserve to be in jail because again, there are too many innocent citizens that are, their lives are at risk every day because people -- there isn't any accountability.

>> last year, 562 homicides in philadelphia and if the current trend continues, the number this year will be about the same. mike. >> mike: david lee miller starting us off this hour. thanks very much. >> sandra: violent crime is surging in the city of brotherly love but the big easy that finds itself as the murder capital of the country now. senior correspondent casey stegall has more on this. how bad have things gotten in our beloved new orleans? >> sandra, so bad the city's metro crime commission says the murder rate has jumped in that city 141% over the last three years. in fact, just as you said, new orleans now has the highest homicide rate of any other major u.s. city, with roughly 41 murders reported per 100,000 residents. that's according to data analyzed by the wall street journal. you compare the 41 figure to new york city 2.4, l.a.4.8, and

chicago 11.5 homicides per 100,000 people. critics blame in large part an overwhelmed and understaffed police department, something the police superintendent himself says they are working to address through things like new hires and reshuffling of resources. >> you know, we have canine as well as traffic out on patrol with our officer in the districts and then you have the investigators, we are talking about from homicide to svu to administrative positions in the now actively on patrol and responding to calls of service. >> the surge in violent crime is taking a toll on local businesses, a growing number say they will be forced to permanently close their doors. police data also shows shootings are up in new orleans this year, 100%, car jacksings have risen

some 210%. >> sandra: harsh reality for the residents of that great city. mike. >> in the south, a high school football star is dead after being gunned down while out on a date. jonathan is live in atlanta. jonathan, have police determined a motive? >> well, police believe the suspects and the victim were familiar with each other and they got into some kind of altercation before the shooting took place but yet to release details on what led to the argument in the first place while this investigation continues. the victim, elijah dewit, 18-year-old high school senior and star wide receiver in jefferson. a small town about 60 miles northeast of atlanta. friends say he had wanted to play college football but those dreams were cut short on october 5th. elijah was on date with his long time girlfriend.

bailey readling says she came out of the women's room to find her boyfriend on the ground in the parking lot. she heard him ask for help before he lost his pulse. the alleged attackers fled to anderson county in south carolina where they were arrested and brought back to georgia. two appeared before a county judge this morning. both defendants are being held without bond on charges of malice and felony murder. the victim's girlfriend tells fox news digital elijah would forgive them, i'm going to, something in my heart telling me to, i haven't got any hatred towards them. anger, yes. a funeral service for elijah dewitt, 6 o'clock this evening at jefferson high school and they are going to hold it in the arena. mike. >> mike: heartbreaking story. thanks very much. sandra. >> sandra: l.a., the city council considering replacing police in certain situations with so-called unarmed service

providers. kelly o'grady is live in l.a. so, tell us about these service providers and what they will do. >> yeah, good to see you, sandra. so, this would be a new task force where these providers would respond to what's classified as a nonviolent or a noncriminal situation, and the idea is to deescalate those low risk calls by removing the armed police presence. they would work with 911 dispatchers to address calls addressing mental health and homelessness, but law enforcement shares the situations can quickly turn dangerous, posing a threat to the responders and the community. >> you'll find out too late when it not nonviolent, and there's no magical way to know in a situation when it escalates. it could happen at the drop of a hat, call it reimagining public safety. but they don't ask their own constituents are they interested in this or not.

>> well, we did ask residents and there's lots of questions around how you can determine if a call is nonviolent and a lot of skepticism whether that responder would be effective if a weapon gets pulled. >> i don't think it's safe, because you know, mental health situation can turn violent. >> it gets volatile. i mean -- what's a person to do, just try to talk him out of it? come on. they are not trained for a situation like that. >> and the sheriff also said he feels this is just another way for them to defund the police so sandra, we'll certainly be watching to see if this task force is effective. back to you. >> sandra: kelly o'grady, really something to watch there, we will keep track of it. thank you. mike. >> mike: now up the coast to san francisco where it's gotten so bad that fed-up residents are taking matters into their own hands. claudia is there with more. literally taking matters into

their own hands, right? >> that's right, mike. they are pulling out their cell phones and tweeting out images that they hope will lead to change. erica sandberg is one of the many who are taking to twitter calling out local politicians for allowing the streets of san francisco to be overrun with homeless tents, drug addicts, and trash. she says she knows her pictures and videos are graphic and disturbing. she says that's the point. >> they she people suffering, dying in the worst imaginable states who are not getting the care that they need, that they deserve, that they were promised, and that there is money for. what they are getting instead is nothing. >> advocates for the homeless slam these posts saying they are insensitive and amount to public shaming, but this citizen journalist does not plan to stop. she goes by jenny, girl from fourth world. she says conditions in san

francisco are worse than in third wourth countries. >> some of my twitter polls i get a lot of angry feedback, how dare you film whatever, and it's a public street. if they can be sleeping here and i'm walking here, why can't i film it? >> these twitter users say the future of their city is at stake and by showing the unedited, unyou filtered truth about what's happening their thousands of followers will be better informed and engaged. mike. >> mike: live from san francisco, many thanks. >> sandra: our next guest says she wants out of california completely after her own harrowing experience, you probably remember this video. it's surveillance video, shows a mother pushing her 8-month-old son at the time in a baby stroller when a teen driver in a stolen vehicle plowed into her driving the wrong way down that street. the teen behind the wheel was

out on probation at that time. he got sentenced to only a few months in juvenile detention center and last week probation officials dropped their push for an early release by some miracle, mom and baby did winds up ok. but the little boy was left with tread marks on the back of his head. the mother rachel joins us now. thank you for joining us today. you are a huge part of the unfortunate crime we are seeing far too often in once great american cities. tell us what happened that day. our viewers are very familiar with that video. >> yeah, you know, i was just pushing my child down the street, morning walk, business as usual, and it wasn't uncommon to see somebody driving the wrong way down this particular street. we are right near the beach, you know, you get people from out of town, don't see the 1-way street sign so got as close to the wall as i could even though there was plenty of room to pass and he swerved into us.

i'm certain it was intentional, he says i popped out of nowhere, that's his only defense. i think it's kinds of, you know, ironic he did not hit the wall, that did not pop out of nowhere. so you know, it was intentional, he's a bad apple, you know, like you mentioned, was on probation when he hit us for spiking a girl's drink in his high school and sexually assaulting her, and the d.a., george gascon thinks 5 to 7 months in a summer camp is enough for that. >> sandra: stricter than summer camp and less severe than military school, what was your reaction when he was sentenced to a few months in a juvenile probation camp. >> kind of -- i was in disbelief, you know. we were coached when this happened that we shouldn't expect anything to happen to this kid, so i guess 5 to 7 months, we are some of the lucky ones, because he is being held

accountable to some extent for his actions, even though, you know, he's really just going to school from what i understand he's getting in fights and getting bad grades, so you know, there's no rehabilitation taking place. >> sandra: and he is set to be released november 22nd of this year, obviously that is just a few weeks away. the really struck me when i saw you speaking out, you initially spoke to fox news digital about this, and you said the light sentences sought by d.a. george gascon for violent criminals with the push to get all minors regardless of crime out of detention facilities has created a terrifying and dangerous climate for the good citizens of los angeles. i know you are now saying you can't live there anymore. you don't want to, at least. >> no. no. no, we -- my family, we have actually left. we have left l.a., i'm in san francisco right now, not much better, but -- we are out of l.a. >> because this is a story that we are hearing from so many. they see this crime, they are

part of the crime, they experience the crime and they want to flee urban centers, they are soft on crime, the criminals walk freely after doing horrific things like this. we have a picture of your baby's head on the screen. is your baby ok? >> yep. he is. he is great, a happy toddler now, and active, and we are all in good shape, thankfully. >> you know, it's a promise by many that can, to move these cities after they experience this crime but not everybody has that choice. i know you are probably familiar with other parents in the area, they can't flee, they can't leave and they have to live through the crime and it's sad and horrifying. >> yeah. the state of l.a. is, it's very sad at the moment. i'm sure everybody is aware of the drama we have with the city council at the moment. the entire system is pretty corrupt from george gascon to

the city councilmembers. a push to help everybody that's going wrong but all of the good citizens are being punished simply by just living there. you know, it's terrifying to walk your kid down the street, you go to parks, there is homeless poop, waiting to find a needle half the time and walking past homeless encampmentes, is somebody going to freak out, the push to defund the police is ridiculous. i was watching debate last night and caruso, and if people don't elect him it's game over for l.a., i think. you have to get somebody in there who knows what they are doing to fix the system and be honest and transparent and hopefully the recall effort to get gascon out moves forward because i think the city sdefrns to feel safe and it's never gonna happen as long as he's in

office. >> sandra: i want to make sure i get in his own words, a tweet he put out on his handling of this case saying after reviewing the evidence our office charged the minor with the most serious offenses possible under the law, two counts of felony assault, one count of felony leaving the scene of an accident that caused injury without exchanging information, a hit-and-run, if you will, the minor pleaded guilty. we are so sorry you had to live through that, and you've got a loud voice in this, being a mother with a baby that was part of a horrific crime. for the person who got a very light sentence that will be released soon. thank you for telling your story and we wish you all the best. and glad that you are doing well. >> thank you for having me. >> sandra: brutal what she went through, and caught on surveillance video as he drove in that stolen car down the wrong way street, and you just cringe every time you see that happening with her little baby in that stroller, mike. >> mike: yeah, so glad to see

her looking well and her baby is doing well. every time you see the video, it makes you sick to your stomach. >> sandra: yeah. and by the way, we have a new york post headline we want to put up on the screen. this is something. a story we have been watching closely. remember that bronx man, he smashed up a manhattan mcdonald's. he -- it was with an axe, just terrifying everybody in the restaurant at the time. he's been busted again. this is what is happening in this city, right? these criminals are let out almost immediately after they commit crimes like this, and they go off and commit another one. mike, and it's hard to see this happening over and over again. >> mike: law enforcement officers say he was writing graffiti and stole an expensive bicycle to flee the cops, allegedly, so new york city put him back on the street and some folks do it time and time again, sandra. >> sandra: tough to see. >> mike: crime a focal point,

to release his medical records. his health is a huge concern after a stroke in may and now more questions after he did an interview with nbc that left even the reporter talking. bryan, this was a rare in-person interview for fetterman. >> rare, considering here at everybody at fox are trying to get interviews with him, fetterman said he's getting better every day, he can do the job of senator and insists he's been transparent about his health. >> in front of thousands of people and having interviews and talking about issues with people and going around all across pennsylvania. i believe -- i believe that's transparency. >> what about voters that say that's not enough, we have more questions. >> well, that's, i guess, will be decided on election day. >> but we have not heard from your doctors in six months. >> but you've seen from me every

day, and you've seen our campaign going, you know, all across pennsylvania and having -- >> that interview was done using closed captioning because fetterman is still having trouble understanding what people say. but it's what the reporter said happened off camera that's really capturing headlines. she said it seemed to her that having small talk with fetterman without the closed captioning was difficult. now, new york magazine editor at large kara swisher who suffered a stroke herself wrote back and sorry to say, i talked to john fetterman over an hour without stop or any aids and this is just nonsense. maybe this reporter is just bad at small talk. the oz campaign is reiterating a call made by the editorial board of the pittsburgh post gazette and the washington post for fetterman to release medical records. >> sandra: what did he say on crime? >> he embraced his record on crime, his role on the parole board, pardoning some who were

convicted murderers. >> on crime, i believe in second chances, and i've run on that record. >> fetterman continues to attack oz as being out of touch with pennsylvania. his campaign, sandra, bought two billboard, characterizing oz as a dallas cowboys fan just outside the philadelphia eagles stadium. oz denies this, and says he's rooting for the eagles. >> sandra: big race, important state. thank you. >> mike: president biden addressing the news his son hunter is facing potential federal criminal charges. >> i'm proud of my son. this is a kid who got -- not a kid, he's a grown man, he got hooked on like many families have had happen, hooked on drugs. he's overcome that, he's established a new life. i have great confidence in my son. i love him and he's on a straight and narrow and has been for a couple years now, and i'm just so proud of him.

>> mike: andy mccarthy, former u.s. attorney and fox news contributor. you heard president biden's comments about the possibility his son could be charged with tax crimes and lying on a gun application. should the president be more worried about hunter biden? >> he should be worried, i think, obviously should be worried about his son who has had a very troubled past, but in terms of the investigation, i think the talk that we are hearing now about the possibility of a disposition of the case with tax charges and maybe the full statement that you refer to could be a cory choreography event, what is swept under the rug is of consequence to the country. foreign regimes, some hostile to the united states, such as china, poured millions of dollars, millions into the coffers of the biden family and we make a mistake as we talk

open or ostensible that might affect elections. they try to put things off they can put off until after that. i expect that will happen here and indeed, i think what's going to happen here, we better have coverage on christmas eve because it will be, you know, one of these events where they quietly bring him into court and you know, he pleads guilty to trivial counts and they hope that the rest of the investigation goes away. i think if the republicans retake at least one house of the congress, it's not going to go away because i would expect they are going aggressively investigate the thing that's of interest in this case, which is not hunter biden's tax matter and not the mishandling of the gun and the false statement that he filed in connection with that, that's small potatoes. what matters here is the foreign money that went into the biden family coffers. >> mike: what about the news the fbi offered a million dollars to christopher steele, the former british intelligence officer to see if he could corroborate the

information about former president trump in his dossier. >> outrageous thing about that, mike, when you make an offer like that, that's tantamount to saying the information is not verified and yet they went under oath, not once, twice, or three times, but four times relying on information that could not be verified and that they concede was never verified. and you know, to the extent they did investigation to try to corroborate it, they went to danchenko, steele's main source who is on trial who told them the dossier allegations were a bunch of nonsense and then what they did two more times, they went back to the court and said they talked to the principal source and he was cooperative and forthright. what they did not tell the court was the fact that the dossier was complete nonsense. they went back two more times and got surveillance warrants.

cuts just days ahead of the opec decision to do just that. cut production, and of course, after president biden's now infamous fist bump with the mbs. wyoming senator john barrasso, joins us now. great to see you, thanks for being here. so, i don't know, is this a president that is showing that he means business when it comes to bringing down oil and gas prices in this country, senator? >> no, this is all about affordable energy, what the american people are concerned about and travelling and the state of wyoming and running into people who are, too many living with this nightmare of having to choose gas they can't afford, groceries they can't afford, heating their homes they can't afford, gas is 1.50 a gallon more today than the day that joe biden came into office. but when you take a look at this radical climate agenda that joe biden and every democrat is for, if they are allowed to continue and control in washington, we

are all going to be left cold, in the dark, and hungry. so people are suffering, they are falling further and further behind in this joe biden economy, and what we just need to do is to make sure come election day we get the republicans in the house, the republicans in the senate if we want energy that is affordable, available, and reliable, the democrats are against that. they like to see the price of energy up, forces more people to electric vehicles. >> sandra: ok, so that was the president earlier this morning vowing consequences on saudi arabia, but i want to play this of president biden, a brand-new interview aired yesterday. also promising consequences. listen. >> there's going to be some consequences for what they have done with russia. >> what kind of consequences? one says suspend all arms sales. is that something you would consider? >> i'm not going to get into what i will consider and have in mind but there will be consequences. >> sandra: so that's the

president, i don't know, we'll see. he's got members of his own party saying the saudis can't be trusted. he says i would just advise the president if he asked that, we have all learned a lesson from saudi arabia in the last week or so that they cannot be trusted. he tried his best to reach out to him and it did not work. said dick durbin, i think he's having second thoughts about a relationship and i think i am, too. bottom line, why are we turning to saudi arabia in this capacity when we have so many of our own resources right here at home? >> you are 100% right. it's not saudi arabia that's holding a gun to our head or opec, it is joe biden holding a gun to the head of the american people when it comes to energy. we can never expect opec to provide us energy that is affordable, available or reliable. we have it here in the ground, sandra, today we are producing 2 million barrels a day less than we should be and it's because the democrat policies, which are not allowing us to explore for that energy, not allowing us to

use the infrastructure, and when opec came up with their decision and the white house was so panicked, as you said, it was not because they were going to cut, it's because they were going to do it now when the elections are coming. they didn't say don't cut, they said hey, wait a month to make the decision because they knew it was going to drive up prices. and this group, opec+, the plus is russia, that means russia is in the huddle when they get together and call the plays. the president was once again, no surprise to the viewers, caught flatfooted. >> sandra: and ro khanna, the democrat from california was on with us earlier in this program and we thanked him for coming on, but it's hard to see the constant blame everywhere but the white house policies that are driving these emergency prices higher. in fact, i wrote it down as he said it, he placed blame on saudi arabia, federal reserve and vladimir putin, but not the current white house policies. let's listen to ro khanna.

>> first i blame the saudis. they are totally outrageous and ungrateful in cutting production. i do blame the fed. they were buying back corporate bonds and mortgages for way too long, and putin's war, that has aggravated supply chains and of course the pandemic that did that. >> sandra: if we have an administration that can't acknowledge what got us here, how can we expect them to fix it? >> you are right. the democrats have ignored the fundamental truth that we are better and stronger as a nation if we are selling our energy to our friends than having to buy it from our enemies. but that's the position the democrats have put us in by basically taking us from energy dominance that we were before joe biden came into office to energy dependence today and american families are suffering when they go to the gas station, and try to pay for gas and i think the prices are going to continue to go up all the way through elections and you are right, we need to be using american energy, we have it
