>> carley: listen to this from one democratic strategist who says oregon is going to be a battleground state for a whole host of reasons and it's definitely not a role that oregon is used of billing. joins us now. good morning to you. oregon, the oregon governor's race is neck and neck which is why the president is heading to your state tomorrow and you say that from a perspective, the midterm election could be a turning point when it comes to crime in your state. can you explain that to us? >> the last few years we've had a bunch of bills from the senate that the current governor has signed that has just made law enforcement more difficult in oregon. linn county in particular is a conservative county and we want our criminals to go to jail. we just had senate bill 48 past and get signed by the governor that basically takes away our local control to keep who we want and who our community expects in our jail.

additionally we recently had senate bill 15-10 that we can no longer pull over cars and have a single headlight or taillight out. that takes away our ability to get drunk drivers off the road and make stops where we end up finding people with warrants and other criminal things that they are doing. >> todd: instead of seeing it for the horrific and as it is, we need to copy that per here is senate bill 48 as you mentioned. released without bail for low-level crimes like that come across passing, while people can be granted conditional release with pretrial monitoring for crimes like driving under the influence, assault charges, and certain felonies. what has that done to your ability, sheriff, to actually do your job and protect your pe

people? >> again, it gives us the ability to take criminals that we'd normally keep in our jail and we have to release them. even something as small as a trespass, we had one person who committed several trespasses within a month's time and it wasn't until a probation officer, the person was on probation, put in a probation violation before we could actually take that person off the street to see a judge. we have a male, his 1-year-old baby tested positive for cocaine here that's not somebody we'd normally release back out the public before they see a judge. >> t>> todd: unreal. >> carley: president biden going to oregon like we said tomorrow and he's going to be joining democratic up in the tar heel candidate tina cho attack it's a really tight race. do you expect them on the

campaign trail in oregon to benefit? how do you feel about that? >> i'm sure that's part of his purpose. i think people in oregon, especially rule oregon are tired of the portland mentality. you are hearing a lot, even portland is tired about some other things going going on in portland risking their safety and i think that's why you are seeing the numbers were christine drazen that you are and there are a lot of people in oregon that are hopeful we get some reasonableness back into our government, especially from me, from the public safety aspect. >> todd: fbi data indicating violent crime up year over year, when you look at the state of oregon over all. an increase in violent crime. carley mentioned, is joe biden going to have any impact to bring people out?

we question joe biden's utility to any candidate much less a democrat that struggling against the republican. but our voters in oregon, specifically in portland, finally waking up to the negative impact that far left policies have on crime, on homelessness and the like, and prepared to vote those people out of office in 26 days? >> i think you see the results in the polling. you've never seen a republic in in, what is it, 40 years that has been this close to being able to win that seat, and, you know, we've always been less fortunate here in linn county. we haven't had the ability to have much of a say when it comes to the governor's race. you have to have the people in portland and the bigger cities in the area who are tired of it too. >> todd: we thank you so much for your time. looking forward to seeing what happens in a couple of weeks.

over to pennsylvania where the state says it could be counting undated ballots going against this week supreme court ruling. didn't know you can do that but i guess you can in pennsylvania. top election officials say the commonwealth might not be following new guidance on disregarding mail in ballots for typos or incorrect dates. court of appeals ruled that undated envelopes must be counted. that was reversed by the supreme court on tuesday. every counted is expected to includes ballots for the november election. the order from the supreme court does not affect the prior decision of the commonwealth court of pennsylvania. we'll see if that's challenge. this all comes as pennsylvania senate race kicks up a notch. democrat john fetterman defending his record on crime despite setting at least ten murderers free.

>> regardless how you feel about doctor's, i do not know how it in good conscience you can pull the lever for john fetterman after we saw this week. forget policy. you have to look at the health situation in its entirety. it's unfair to the people of pennsylvania, the citizens of the entire country, this is one of 100 seats and its impacts the entire nation and this is unfair to that guy, the man john fetterman. he's obviously not improper help to do this job. i did not know why the democrats keep dragging him out there. >> carley: obviously pennsylvania is one of the states that could really decide the balance of power in the senate and according to the real clear politics average, oz is closing in on the race. used to be up by double digits. he's only up by 4%. and i was reading that one of the reasons that could be is because oz is solidifying republicans around him after a really contentious primary season. also his outreach to black voters has been successful.

on the other hand, fetterman says he raised a million dollars in the last 24 hours and there is a poll that shows that people in pennsylvania are concerned about fetterman's health but more concerned about claims that dr. oz is not from pennsylvania. it's a really mixed bag and there is some good news for both candidates. >> todd: i think it's okay to break down policy and the strength of the candidates there. i think it makes their earth. even getting in the policy when it gets to john fetterman, we don't need to go that far. you have to ask yourself the question, is this individual healthwise suited to be in the senate? and i think the answer to that based on everything we've seen just this week alone is not. >> carley: policy is always important. in one of the policies sets is crime. you heard that he successfully supported the release of ten people convicted of first-degree

murder and last year fetterman appeared to support the release of all second-degree murderers in pennsylvania. his campaign is walking that back. his campaign recently scrubbed support for your "black lives matter" or defund the police because crime is such an issue in the state. one thing i've found adjusting about john fetterman, an article in "the new york post" about his political career. he was the mayor of a town called roddick pennsylvania. a once booming town of about 20,000 people in the '50s or 60s but that number is down to 1700 people. he won the mayoral race by 149 votes in 2005 which is one more vote than his opponent and the job only paid $150 a month. which i guess is why his parents supported him until he was about 49. how do you go from the mayor of that town to within governor to now possibly the next senator of pennsylvania depending on how

program. good morning. >> i had to do a double take when i read that too. this new large-scale border operation with mexico is an effort to combat the crisis at the southern border. it also comes just a month before the midterms. it's a post-increase checkpoints, resources, and crackdowns on human smuggling operations and also send venezuelans back to mexico unless they apply for unlimited parole program as there were more than 25,000 venezuelan migrant encounters in august, up from only 4,000 back in april. not every venezuelan will qualify. those eligible to enter the u.s. safely and lawfully will have to have a supporter in the u.s. who can provide financial support, pass rigorous biometric, biographical national, and public security screenings as well as complete vaccination and public health requirements. however those who have been ordered removed from the u.s. in the last five years, crossed without authorization between ports of entry after the

to that. but i've been hitting brick walls. so. >> todd: you are the parent to came forward about the books and library. what happened when you ultimately raise the issue. >> what i wanted to do is get divinity awareness and i've been trying for at the board meetings for about a year. the problem is in 3 minutes time which is what you are allotted to speak calmly i didn't have enough time to get my message across so i decided one day did go do a video outside of one of the high schools and all of a sudden it went viral and i had... we had set up a book rally, just trying to let the parents know. it would've been happy if there was 50 people that showed up. instead, we got a crowd of over 800 people. if that tells you anything, parents are sick of it. >> todd: the board intimidated by that number use the fire code as an excuse to disperse that meeting.
