and you are watching live a courtroom in fort lauderdale, florida. our satellite feed froze. as it continues to progress we'll go back to it. here is what's happening. cruise now 24 years old is being sentenced by the jury. he had previously pleaded guilty to 17 counts of murder. 17 counts of attempted murder in connection with the february 2018 shooting. it is important to tell you today that the reason you are seeing the sentencing so quickly is because the trial phase was skipped when he pleaded guilty to all of those counts. so as quickly as we can get you back to the courtroom to tell you what the outcome is for this jury. this is going to happen in a couple of phases. one today they're reading out all of those guilty plea counts and they are judging in the courtroom the jury is judging

whether or not that would be punishable by death or by life in prison. so all of this is being read. they have already considered it but now the public will find out what that is. the judge in this case, however, can take whatever they say in all of this. if they say the death penalty. if they say life, the judge can act independently from that to make a final decision. we'll at least see the jury portion of that verdict today on sentencing. it will take some time and i cannot tell you how much time, whether it would be immediate, days, whatever it will be. we'll bring you the judge's decision as well. could be more immediate than not. so we are covering this this hour. let's go back right now to the sentencing of cruz and the parkland school shooting. >> the existence of the aggravating factor that the first degree murder of alisa was

i say that to fill in the gap of why it could happen. doesn't mean it necessarily did. you may see people getting up and down for that reason. where we are right now is on the 11th count. remember, there are 17 counts of murder and 17 counts of attempted murder for the victims, the 14 students and three school staff members who were murdered by cruz, he previously pleaded guilty to all those counts. they skipped the trial phase and got right to the sentencing. it will be a while longer while they go through what the jury has looked at to reach that final verdict, which is coming. and the moment the judge engages here in this courtroom at the end of what is being read, we will immediately go back to the courtroom. we want to pull away from this in fort lauderdale, florida, for news that we're continuing to cover on this day but we keep

8.2% compared with last year. at its core, when you take out critical categories like food and energy, inflation remains at a record level, up 6.6% from a year ago, the highest since 1982. after denying a recession would happen at all, this week president biden said in quotes, a very slight recession is possible. yikes for the white house team. you know they have to clean that up. here they are in an epic dance of walk back. >> the president has been pretty consistent and said multiple times in the past while recession is possible, he does not think there will be a recession. and so that hasn't changed. he has been very consistent about that. >> harris: with those rising prices and recession concerns all eyes turn to the federal reserve and more interest rate

hikes meaning everything we touch or borrow will cost more cash. americans are feeling it. >> i was doing really good and now we're not. we make decent money but it does make a difference. >> i don't think the administration gets what the average person has to deal with. we live paycheck to paycheck. >> it is outrageous. it is like every week i go out for groceries and another dollar, another dollar, another dollar. >> harris: so is gas. fox business anchor david asman. we were watching out of the corner of our eye and continue to monitor that case in parkland, florida. these things that people hurt over are things that the administration is not acknowledging. they may acknowledge something that involves immediate pain but this is long-term pain. a lot of people are getting crushed. i make no comparison between the

two other than they're happening simultaneously today. we'll cover it all. >> this president came in as the empathetic one. biden was seen as empathetic. the old expression i feel your pain from the clinton years but repeated with joe biden. there is so much pain. when people are spending a third of their income for food alone where they were spending five years ago spending maybe 1/10 of their income for that. they have to decide between eating meat or soybeans. whether they can have enough milk for their kids. where is the empathy from a president who says i don't anticipate a recession, which is what he said the other night. >> harris: you said the importance of empathy. at least acknowledge the problem. >> if you acknowledge the problem, they say if you've got a problem the first step is

acknowledgement. he is not acknowledging or anticipating. if they were anticipating a recession, they could do certain things right now to stop it, to increase the private sector. you don't have to have a crushing recession in order to cure inflation. yes, you have to stabilize the dollar and that's what the fed is doing. the administration could do a lot by innocent viesing growth in this country. some people say the only way to cure inflation is to have a recession. we don't buy that because of the fact that we've done it before in the reagan administration. we had a terrible problem with inflation, the fed came in and caused a recession by raising rates but the minute that the tax cuts and the regulatory cuts to incentivize the private sector kicked in from the reagan administration in 1984 we had a growth rate of 7.4% with

inflation coming down. the more goods you provide, the more productivity you have in an economy the lower inflation goes. you increase the number of goods and inflation comes down. >> harris: they're printing more money. now you have more money, worth less and chasing too few goods. a cycle that's very difficult to break. >> in 2020 you had 3.4 trillion spent because of the pandemic. this was understandable. but when the economy began to improve instead of cutting back they doubled down on that and biden has increased spending $4.6 trillion. it is crazy. >> harris: many economists are pointing to the massive spending as the main driver of record inflation. some of the largest outlay of taxpayer money. $3 trillion less than two years

ago. you add all of that up and, you know, please, i don't know why we are still calling it the inflation reduction -- that should be in quotes. that stuff is just not true. that's a lie. >> the president is touting inflation reduction today in los angeles. you can't make this stuff up. it's the most obvious political mistake the administration made. calling something inflationary. that's the important thing about the numbers today. it is accelerating. not just moderating or the same. it is accelerating. that's the problem. he is going in exactly the opposite direction which he said we were going to go. i don't know how anybody can believe anything he says anymore about inflation. frankly, much else. >> harris: i haven't met anybody who is really waiting for the drip, drip of his words on inflation when they can't even call it what this is. it was a spending package of

epic proportions for climate issues that they want. all right. let's get to this. i mentioned core inflation. if you take out food and energy. let's put that all back in because who is living without food or energy and it's getting colder out in most places in the country. overall food prices are up by 11.2% over last year. it is cooking faster than the overall rate of inflation. staples like cereal, baked goods, dairy, meat, fish, eggs up 16%. the cost of breakfast has gone up over 40%. you have a lot of different ingredients for that that are the most expensive now. eating at a restaurant is 9% more. in most cases a big chunk of the tip. now the people serving you the food are not getting what they used to make. this is a chain reaction that breaks your heart. and your wallet. >> and that means that people are going to have to adjust and

people won't be eating out as much. a lot of restaurants will be closing down. we talked about the buffer from the recession by all those extra jobs out there because -- >> harris: where is that? >> it's coming down. we had 11 1/2 million jobs open last month. it is now down to just over 10 million. yes, we still have the 10 million jobs for which we don't have labor but those jobs will disappear as companies disappear. companies are going to be disappearing because of the inflation costs because people aren't going to buy stuff that they make or come to their establishments if they are a service industry. when companies shut their door you will see very quickly dramatic drops in the number of job openings that we have in this country. that's what a recession is. >> harris: it is really important for people to know what you just said. the way the administration will spin it.

the employment rates are epic low. there is nothing to apply to and they can't prove their doing that to get unemployment pay and they just sit. >> we have a month before the election. let's face it. this is going to be front and center. the inflation i think is number one. if effects of the recession will show themselves more clearly by november. we'll see job closings. we'll see a number of jobs that now exist that will just disappear. >> harris: all right. 26 days. we always count on "the faulkner focus." white house economic advisor bernstein defended the president and his efforts to fight inflation. >> the policies that we're doing to help mitigate and ease price pressures are having effect. i think the question is are policymakers doing what they need to do? the president released oil from the strategic reserve and 100 days of gas declean. our work on the supply chain. inflation reduction act.

lowering prescription drug costs and lowering the cost of clean energy. they are moving in the right direction and take time to factor in the price indexes. >> harris: they think we're stupid. some of the main analysts and experts in this lane have said by the time this would even approach deficit-aided lower inflation, 2031. and it would be a flat line. it wouldn't be positive. >> to hear jared mention the inflation reduction act. if the president's advisors are smart they'll stop him from doing it. it reminds me of a monty python film where the knight was chopped to bits on the floor and lost his limbs and he is saying i can still do it. i have you beat. jared, it is not working. the inflation reduction act is misnamed. it's the inflation acceleration

act. the numbers don't lie. >> harris: the problem is the president wants to mix in additives and print more money for school loans. he got a little quiet about that but we don't know. maybe it will come back on the table. cbo said it would put inflation at a questionable amount. it would throw uncertainty into the mix. the opposite of what we need. >> it is also unconstitutional to say the least about it. it's another half trillion dollars at left. penn wharton says it will be a trillion dollars. this is executive spending because of a pandemic emergency that the president says is over? forget. a lot of misinformation. >> harris: you and i could go on for a long time. we will get together for some good news but they have to generate it now from the white house and his administration. we'll hold our breaths or try to. david, thank you. the second day of the danchenko trial has taken an unexpected turn this week.

special council john durham grilled his own witness, an f.b.i. superviseee counter intelligence analyst asking him why he used the steele dossier against carter page during the campaign of 2016. leo terrell breaks it down. >> the f.b.i. is on trial. the defendant is not important to the extent that our justice system has no credibility. six years, six years to validate the fact the steele dossier was a hoax. it's undisputed proof that they lied. the f.b.i. lied and the problem is, bill, who is responsible within the f.b.i.? it's just shocking. >> harris: how high does this go? accountability, responseability. outside the federal courthouse in virginia our david spunt. >> hi, harris.

danchenko is the man on trial a russian national living in northern virginia. john durham is heavely involved in this case. as you mentioned, yesterday was day two. today day three. we had the second witness dolan finish on stand a few moments ago. a democratic operative providing political gossip to danchenko. that political gossip made it into the steele dossier used to investigate former president donald trump. we're hearing a lot about the steele dossier. danchenko is charged with five counts of lying to the f.b.i. primarily about his work with the ex spy christopher steele. dough lon admitted on the stand was nothing more than gossip he got from television news. it made it into the dossier. danchenko told the f.b.i. according to the government he got it from a trump official, not democratic operative. the first witness was f.b.i.

intelligence analyst, a government witness. john durham turned on him several times in an effort to go beyond this specific trial and take the f.b.i. to task on a grand scale. he was involved into looking into potential connections between the trump team and kremlin in 2016 it was dubbed crossfire hurricane. durham asked him you didn't have corroboration from other intelligence community agencies or from christopher steele and it still went into the fisa application? correct, said the witness. the fisa application deals with spying as the trump campaign would say on the 2016 campaign aide carter page. what john durham is trying to wrap it up in a bow is trying to show the f.b.i. still was hell bent and getting the fisa application with information that came from all these different sources and they believe danchenko lied. we'll hear a different story from his team.
