suggesting the president's playing politics are urging oil producing nations not to cut production until after midterms. but we begin tonight in north carolina where at least five are dead, two wounded, and a suspect finally in custody. ashley strohmier has the breaking information p.r. go what we know exactly? >> police have a suspect in custody. the mayor said a man with a long gun started shooting on a walking trail around 5:00 p.m. officers blocked off streets and surrounded the neighborhood and an hour long manhunt well telling residents to shelter in place. 8:00 p.m. the mayor said that the suspects contained but it wasn't until two hours later he was described as in custody. the officer was transported to the hospital but has since been released. another person remains in critical condition.

you as the new brakes. ashley lived for us in new york. another mass shooting that gripped of the country as a florida jury has recommended a sentencing of life imprisonment the possibility of parole for parkland high school shooter nicholas kruse who murdered 17 people in february of 2018. the jury could not come to a unanimous decision on the death penalty. as you can only imagine, the jury decision in the case left the families of those that were killed outraged and many legal experts also stunned. let's bring in the man who prosecuted the colorado movie theater shooter and fox news contributor robert jeffords the pastor at first baptist church. i want to play the sound because it's compelling and from a father of one of the victims at parkland saying this about the verdict. >> in prison, i hope and pray he receives the kind of mercy from

wrath against evildoers. i know the argument instead capital punishment isn't a deterrent to crime, well maybe if we executed criminals more quickly, frequently, publicly it would be. when you execute a murderer, you have deterred him from forever committing another crime. >> trace: it's interesting to me to say that you're stunned by the verdict and you prosecuted the shooter in the aurora theater shooting. i would think that you would not be surprised by this. why are you stunned? >> a couple different things. one, or case really had significant and long-term document and mental health issues. we knew it's going to be a hurdle and we got within one juror here. this is not a colorado jury, it's a florida jury on a case involving 14 students and three teachers while premedicated c

case. he didn't seem what they put up was the kind of mitigation that would not be outweighed by aggravation. the real question here is is this the act of a single juror or two or six or all 12? that's the part of the story we do not know yet. >> trace: that's a fair assessment and we want to put it on the screen because this is a gallup poll back in october last year talking about the penalty and it says 54% are in favor of it and 43% not in favor of. picking up on what you are saying is the concept that some of the jurors believed in kind of buying into the narrative from the defense that in fact nicholas cruz had some childhood issues he had to deal with. does not change the perspective at all sir? >> we all had childhood issues that we had to deal with, but that is no excuse and i heard the mental illness argument. anybody who does what nicholas cruz did has to be mentally ill, but that's no excuse.

so civilization and country we have to decide whether we will follow god's way or a man's way. what we are doing right now is certainly not a curve in crime, we are seeing the incidents more and more and i think it's time to start dealing with that god's way and that's by instituting and practicing capital punishment. >> trace: what do you do to fight this? you are in this so you know better than anybody, is there a new strategy, is there something or is this kind of the way of the future? you just plain mental illness, some kind of childhood adversity. if the jury kind of plays on that. what's a new strategy? puck >> i don't no if there's a new strategy, i've heard people talk about like should we go to nonunanimous verdicts for death? other procedures we should put in place and should they be involved in supreme court's? i believe it should be very difficult for the machinery of government to be started to take the life of a citizen but i

into nights crime crisis round up, two more police officers killed in bristol, connecticut, after apparently being lowered to the scene on purpose by a fake 911 call. it happened last night and according to state police the hail of gunfire was captured by a nearby camera.
