to get the job done? now, if the answer to those questions is no and i imagine it is for most of use, neither man is really capable of serving as a u.s. senator or the u.s. president. at least not without a lot of people making decisions for him, protecting him from scrutiny and hiding the truth from the voters. of course, this is what is happening in both cases. now, nbc news reporter dasha burns dared to provide facts that helped pennsylvania voters answer the question on their mind. namely is fetterman really well enough to take on the demands of the job of u.s. senator. >> because of his stroke, he required closed captioning to read our questions as we asked them. laster, in small talk before the interview without captioning, it wasn't clear he was understanding our conversation. >> mind you, this was the first

sit-down interview that fetterman had agreed to since his stroke. so pretty important, don't you think, to be transparent with the voters, correct? and the immediate react of the press poodles to that reporter's assessment of what she saw is to attack their own reporter. >> other journalists that dealt with fetterman came forward and say they had a different experience. >> our team was the first to be in the room with fetterman for an interview rather than via remote video conference. our crew did find that small talk before that captioning was difficult because of those auditory processing issues. >> laura: savannah, savannah. left wing websites joined in to promote the absurd on its face claim that that reporter was somehow fuelling bias against people with disabilities or as its called ablism. now, from the outset, the angle has expressed empathy and

sympathy for fetterman's condition. we repeatedly urged him to take the time at home to heal and recover. a stroke is serious. it's life threatening and a major medical event. recovery can be long and arduous. and outcomes vary. those are the facts. yet now the left is so desperate to hold on to power, its even enlisting wives to help hide the politicians true physical and cognitive struggles. standing by your man is one thing but propping him up when people need strong and vigorous leadership, that's dishonest and craven. enter gisele fetterman. >> what a disservice she did to my husband and anyone facing a disability. i don't know how there were not consequences, right? there's consequences for folks in these positions that are any of the isms.

she was like where is your training. it was a pauling to see. i haven't heard an apology. it hasn't come. >> laura: it was appalling to see? what exactly was appalling? the reporter is pointing out that the interview is unusual. it was unusual. that a candidate for senate requires a giant screen in front of him to answer fairly simple questions? look, as many of us know first hand, being even a part-time care giver to a sick family member itself is very difficult, very trying. but this doesn't give anyone any spouse the right to trash a reporter for actually doing her job. they certainly were all about protecting the press when trump was president. >> donald trump demonizes the press. >> he calls the press the enemy of the people. these reckless words have conse

consequences. >> it's a dangerous environment. >> laura: indeed last month, things got deadly when one democrat got amped up about supposedly negative reporting. >> police have confirmed the search warrant is in connection with the murder of 69-year-old jeff gherman. robert telles was the report of an investigation of bullying, favoritism and having an affair with a woman in his office. telles lost his primary and many blame the negative reports. >> laura: it's very disturbing. of course, this doesn't fit the democrat narrative. the democrat in this case is the accused killer. it's not just gisele fetterman's vendetta against a reporter, it

seems like she's the candidate. again, we're victims, so vote for us. >> what has it been like campaigning at a time in which there's this unprecedented wave of negative ads, b.s. attacks? >> i'm good. i cry a lot. but everything is fine. i teach my kids to be good people, right? then you have like an awful person running to represent them themselves. people thought like with trump this can't happen. it can happen. >> laura: this template for this wife shield husband routine is always playing out before our eyes a tractor trailer white house almost every day. >> spread the faith, folks. thanks so very, very much. thanks.

[laughter] second lady, the first gentleman. how about that? >> laura: if only it were funny. it's disgraceful. for men in positions of power to hide behind their wives. to hide behind phony victim status. it's equally disgraceful for the wives and the staff to stone wall and defame those asking legitimate questions. if the candidate can't submit to real questions or needs a family member or a journalist to play defense for him, then he doesn't deserve your vote or serious consideration. given what we're all facing here

in america and in pennsylvania, we can't take any chances. that's the angle. joining me now is jason chaffetz, fox news contributor and mike davis, president of article 3 project and former clerk to justice kneel -- neil gorsuch. mike, your react to this cocoon surrounding fetterman when we know what a day in the life of a senator at full tilt is all about. >> yeah, the 13 million people of pennsylvania need to decide that they have two home state senators. they need to decide if they want one who is going to be smart and effective and be able to work with his colleagues to get the 60 votes necessary to deliver for pennsylvania, do they want fentanyl treatment grants to go to new york and illinois or want the grants to go to

pennsylvania. when these home state senators are picking federal judges, do you want a home state senator that will be independent and provide and independent check on president biden or do you want a home state senator that will be biden and schumer's puppet in this is a critical decision for pennsylvania voters to make. do you want someone that they're going to wheel in and vote and vote for biden and vote for schumer or do you want and independent-minded senator that will represent pennsylvania. >> laura: i think the problem here, guys and jason i'll direct this at you, no one knows who is making the decisions. i think people every day, once a day, come up and say, who is really in charge at the white house? this will be the case in a senator's office as well if this goes fetterman's way, correct? >> yeah, you need to know who the puppeteers are. the american people hire these people. these people work for the american people. if you don't know who the

puppeteers are, you don't know what's going on there. i served in congress. that's a 14-hour a day job. you have to think on your feet and think quickly. fetterman is not up to that since his stroke, he's had one interview. he can barely get through a debate. we haven't had the debate. it was a debate as to whether or not he could debate. the senate is supposed to be the most deliberative place on the place on the planet. and the bidens are doing a real disgrace. >> laura: tom, the polls in pennsylvania have tightened up significantly. you think this defense of fetterman that the attacks on him or the scrutiny as ablist or a bias against people with disabilities, will that work? >> i don't think so. i think his health is becoming an issue in this race. you know, as we get closer to election day. it's not a partisan republican

talking point. the pittsburgh post gazette, "washington post" and others have called for him to be transparent about his health issues. he was asked in the msnbc interview if he's been transparent and why he hasn't released his medical records. he said his doctors say i'm fine. so we have to take his word for it. why not put your doctors out to talk to him. they have not done that. that transparency issue is coming to bear in the final weeks of the campaign. >> laura: this is fetterman's wife again, gisele. this is in may on the kind of campaign that they expected and would run. watch. >> i think his argument has been about our experience, right? what he has accomplished, what he cares about and what he views. he's never been about attacking other opponents. it's been about his record and his vision for the state. that's what we'll continue to see. we believe in running kind, clean campaigns that focus on the issues and not on who our

opponents are. >> laura: mike, looking back on that, that seems like a preemptive comment to preempt any scrutiny of his condition after the stroke perhaps, but seems like she's the one that is the proxy candidate here at least in comments like that. >> it's amazing the same democrats that were fainting indignation about legitimate questions about a senate candidate's mental fitness when he wants to represent 13 million pennsylvanians were the first people to throw dianne feinstein overboard when she was set to become the senate judiciary committee first female chairman. dianne feinstein hit chuck schumer and dick durbin's glass ceiling. now they're pretenting like mental fitness for the job is not important. >> laura: i want to talk about

this ballot. republicans were up 4%. now the new rasmussen poll has that lead up to 7%. again, you can balance out the various polls. but at least in one account, it doubles in a week. what is this portending? >> well, people are focused on the issues. democrats really don't have a core issue to run on. they've had the house and senate in the presidency, implemented all of their projects. joe biden brags about the legislation that he passed. that's why we have record high inflation. the economy is souring. immigration is out of control. crime is getting worse by the day. all of these things are going to wrong direction. they don't have any policy that they can point to that they've been successful and they've had every lever of power. >> laura: tom, i want to move to the white house spin on the economy speaking of what jason just said. ron klain, the chief of staff, tweeted "i trust that meet i can't coverage of jamie dimon's

view of the economy will be extensive". then he quotes this. "consumers continue to spend with solid balance sheets and jobs are plentiful and businesses remain healthy." but left off of what jamie dimon said was the following. however, there's significant head winds in fronts of it's, high inflation leading to higher interest rates. he said similar things earlier. now, klain is misleading americans about the true state of this economy. why do they think that will work when it's a simple fact check, tom? >> because they have to. they're putting the best spin on the economy that they have. they can't -- biden did this earlier this week in an interview. he acknowledged a little bit of reality but said he doesn't believe we're in a recession and if we go in one, it will be a little bit. the economy inflation is the number 1 issue across the board for the vast majority of voters across the country. we had the final inflation reading before people go to

vote. it was 8.2%. it's the highest in four years. it's a drag on the democrats all across the country. the administration is trying to deflect and put the best spin on this they can. the problem is there is no good spin because the american people are seeing this in their daily lice when they fill up their tank and go to the grocery store. >> laura: mike, i think the phrase "inflation" is transitory is really going to be the one that comes back to bite these democrat candidates. maybe not in this election but going forward as well. given what 8.2%, just devastating for american families. >> this is destroying the budgets of american families. this is a biden tax hike with this inflation. the american people get to decide in three weeks, two weeks, whether they want to continue this destructive -- these destructive policies from president biden or put in a republican congress to put in a

committee chair, jim banks and one of the state treasurers, curtis loftis that pulled money from blackrock. you were way ahead of this. what did you see that others took awhile to catch up on? >> a member of the general assembly gave me a homework project. he asked me to research this. i said sure. it was a rabbit hole i couldn't escape from. we started in 2016 or 17 we bid out the incestment services for our largest portfolio. that portfolio last night was about 41 billion. you can see it's a lot of money. blackrock, they're a fine investment firm. they were the top two that i utilized my exemption privileges not to choose blackrock. i can see where they were headed. it wasn't tenable for us. since then, the few remaining funds in blackrock, we removed them and now down to the last 200 million and that will be out by december. >> laura: i love this.

is that a sign that they're worried about the public pressure campaign that you and congressman banks and a lot of us are helping to launch? >> well, sadly i don't think they're too worried. i wish they were. the left is ten years ahead of us. they're moving past esg. we need to worry about esg. we need to fix the problem with esg but they're moving past that. esg as been a big hit for them. successful in changing the way governments and corporations act from state governments, local governments, all sorts. now they're looking at how they press further down. when states try to become active in economic development. they're using those wealthy companies to come to the states and say we need you for green infrastructure and guarantees that the staff that you'll send us is racially and minority appropriate. they're now getting to that level when they come to states. so we're effectively asking the

veteran owned bar in washington d.c. mayor bowser shut him down over covid violations costing the owner his life savings. now the bar is hitting back. fox's matt finn is here with the details. matt? >> that d.c. burger bar, the big board, became a nationwide symbol of resistance. the health department shut down the big board fining the owner and stripping the liquor lions for repeated violations. the burger bar garnered support from republican congress members and a go fund me raised $34,000. well, now the burger bar owner is suing d.c.'s department of health and its former director arguing d.c. mayor bowser violated the home rule act by enacting emergency executive public health orders without congressional review.

this lawsuit? >> it's a lawsuit for me and for everybody who is out there who has had their rights violated and stripped by government overreach over this time. it's really time that we hold our government officials to account. >> laura: how did it feel when this first really came down on you and your bar? as a entrepreneur a small business owner given everything you've done to get this going on the ground. >> it's crushing. you were there. every day somebody was coming in harassing you, telling you you have to do this. i was labelled as a threat when i never pose add risk. >> laura: what do you think about the posture of this case going after the d.c. government itself? >> d.c. has special law. the constitution designated that congress has the authority to regulate in the district of columbia. mayor bowser and the d.c.

council over two years did everything that they could to evade congressional review. then they did something even more. they locked the courthouse doors. they put a provision in that people like early injured by the rules were not permitted to go to court to challenge these provisions for over two years. it's outrageous, it's a violation of the constitution. i'm ever so pleased to be representing eric in court. >> laura: on january 27 of this year, mayor bowser was asked about this case in particular and this vax mandate. watch. >> i like the business to comply. we don't want to shut anybody down. we want to give people support, advice, supplies, help, whatever they need. >> laura: did you feel like you got a lot of love and help from mayor bowser? she wants to be emotional to your plight. >> absolutely not, laura. there's no way that d.c. was reasonable. like robert said, they stripped

me of my due process rights. i wasn't allowed to appeal the decision to anybody. you can't be that in the united states. lawmakers have to be held accountable for what they are. >> laura: in august, a judge struck down bowser's mandate for government workers to be vaccinated against covid. does that help you here? >> sure. you talk about getting lost on this. of course you did. because they passed over 16 different emergency orders. they passed over 15 separate d.c. council -- >> laura: is it still in effect? the emergency order in d.c.? >> there's some provisions -- >> laura: it's a never-ending emergency, by the way. >> no, no. and that of course is part of the problem. that goes to the fact, if it's a never-ending emergency. take the vaccine mandate. how much of an emergency was it? we live under the rule of law. they needed to comply with that basic rules of law even during a pandemic, especially during a
