for the g.o.p. since the u.s. supreme court overturned roe versus wade in june. democrats lost four points in just one month. maybe that's because they are trying to make abortion bigger than eating and putting gas in our cars for voters. you saw it live this hour yesterday when the president got pretty snippy onesictrs on at all >> president biden: yes, there should be. >> what should they be? >> president biden: roe versus wade, read it, man. get educated. >> harris: the new monmouth poll released with these words, biden not paying attention to the most important issues. inflation concerns top the poll, abortion is down at number five with only 30% saying it's their biggest concern. higher on the list crime, illegal immigration, the president certainly not talking about that. senator john kennedy of

just spending less. now it seems he is focusing on everything else but inflation, which is the top priority according to the polls. you mentioned the monmouth poll. inflation is far and above the abortion issue. the abortion issue coming in at sixth on the list. political divisions number three. wouldn't fit on the screen with all the other topics where abortion was. people care about what affects them day-to-day. the president will go to delaware state university to talk about the student debt relief decision later on today which cost taxpayers billions. onto his vacation home in delaware. the poll numbers are sparking questions like this. >> tim ryan in ohio said he doesn't want you there, warnock wouldn't say. are they making a mistake? >> president biden: 16 i've gone and a lot more than that. another 20 or so. >> as the president goes on vacation it seems that inflation, according to

economists, may not have peaked yet. >> i don't see the turning point coming any time soon. but i do see the republicans stopping additional problems, additional spending and maybe even stopping some of the funding of the programs that were already passed. good news that we'll stop the hem acknowledging. >> the president told peter doocy the u.s. government can walk and chew gum at the same time do multiple things but on the inflation issue over the past 20 months under this president it has gone one direction, basically up, harris. >> harris: edward lawrence, thank you very much. we'll cover the president when he starts talking about inflation. that will be really interesting actually. it has been cooking like wildfire for quite some time. steve bannon was scheduled to be sentenced today. he has chosen not to speak inside that courtroom that you see there. however, they have now sentenced steve bannon on two counts of criminal contempt of congress and what they are

saying is four months. we have leo terrell, a civil rights attorney, standing by on the phone to talk with me right now. we knew this was coming, leo. i don't think there is any surprise that steve bannon actually would not want to speak on this. he pretty much has not said much on this. let's go to our reporter griff jenkins. >> yeah, just breaking four months. now, the prosecution was asking for six months jail time and $200,000 fine. now a much smaller fine of $6500 it appears from our court reporter inside as well as four months jail time. now, harris, you have to step back a little bit because the last time we saw anyone charged with contempt of congress was rita lavelle in 1983, an ab secure epa agency official from the reagan years.

that's why bannon's defense was arguing they should give him some probation because it is require that we see prosecutions for contempt of congress. but it was this prosecution's belief that mr. bannon was acting in this bad faith strategy of contempt in defiance. we also saw that mr. bannon on the way into court here, i believe we may have the sound bite continued to attack this prosecution in this case. take a listen if we have that sound bite of mr. bannon going into court before 9:00 a.m. we may not have the sound actually. he continued to say that it is a quote illegitimate process. now, what was fascinating, harris and what's really important is that the judge is going to release mr. bannon right now and if he comes to our cameras around the courthouse we'll hear what he has to say. the important thing is

>> harris: we were able to see that but couldn't hear it. i think we're having some technical difficulties here with audio in general. griff, thank you very much. we'll pull away now and leo terrell standing by on the phone. leo, civil rights attorney. break this down for us. we may hear from steve bannon and we'll take it live if and when it happens. what happened in the courtroom? normally we don't see ajudd indication of this sort of thing. >> that's for having me. you have an issue of defying a subpoena and the motivation behind it. you have to remember this subpoena was issued to steve bannon by the january 6th committee and you have to question the motivation behind it. and the idea of him being found guilty on this subpoena or failure to comply, contempt of a judiciary subpoena is something that will be appealed. he will appeal it. remember, he had an argument of executive privilege and on the

advice of his counsel not to testify and not to put up a defense. this case is far from over. the four-month sentence, he could have gotten 1 to 12 months. i think the judge gave him four months for the basis trying to understand whether or not he was remorseful. >> harris: we've seen process crimes, we've seen a lot of time spent on what i would call the constellation around the former president. >> yes. >> harris: speak to me about that and what potentially is coming. >> i will tell you right now remember the last thing the january 6th committee did was request a subpoena to be issued for president trump. harris, you can't separate the idea of the january 6 committee using the legal process as a weapon against trump supporters and trump. this january 6th committee, the journal was a show trial for the democratic party i've been

a lawyer for 30 years and see how the legal system is being used by the democratic party and department of justice you have to ask yourself a fundamental question. was this subpoena for steve bannon something legally motivated or politically motivated? i would submit it was the latter. >> harris: i feel like we come back to that point quite often. thank you for being here for the breaking news and, of course, again if steve bannon comes out and speaks as he did on the way into the courtroom we'll show you that. leo, good to have you help us break it down. thank you. charles payne fox business anchor and host of making money. we'll talk about where the president is today and what exactly is happening. so we'll need to get this off the screen and come back on set. thank you. we'll talk about what the president is going to focus on. the way i'm reading it is he will talk about the historic ways that have been used to

deal with high inflation. why am i preparing myself to cover the president give me a lecture today and not speak directly to americans about the pain that they've been feeling? >> he is trying to deflect. he will also start talking up the student loan program. he will talk about it today. next week he will really push hard on it. >> harris: it's already up. people can apply. this isn't as popular as they thought it would be. >> here is the point with respect to the inflation question. how did we get here and to this point? one of the biggest -- you could say what tipped us and sparked this runaway inflation what they call a wage/price spiral. you can't afford to hire anyone. a major speech by the philadelphia fed president and he laid it out. we already knew this but good to hear from someone who is now in charge of trying to tamp down an inflation. federal government pumped in $6 trillion. here is what was really compelling. the number significantly larger

than the aggregate decline in gdp triggered by the pandemic in the first place. so it was so much money. it was way more money than we lost particularly the money that president biden pumped in. >> harris: why would you do that? >> politicians buy votes. the old chicken in every pot. >> harris: this is the chicken, the pig. >> but you pay a price for that. we're all paying a price for it. he also went on to say what i thought was fantastic. largely untargeted, mortgage forebear answer, student loan forebear answer. direct stimulus payments to households. high levels of demand were still seeing it because of that money. so all this free money from the government. now let's add in the student loan stuff he is bragging about. that is stoking inflation even more. >> harris: cbo said it stokes it in a certain way that also crushes us in the markets. where so many people aging in

america have had everything wiped away. heartbreaking. the cbo said that it makes it completely unpredictable inflation by adding in that student loan. >> how high it will go is unpredictable. you are throwing ker seen on the fire. it will get hotter. you add in the inflation reduction act to spend more money. >> harris: we wanted to check in because it looks like steve bannon may talk. his attorney right now. as soon as he wraps and we get to steve bannon let's see if he will step to the microphone now. he got four months for contempt of congress a little while ago as you saw we had breaking news. >> entered a decision he thought was appropriate. we certainly respect the judge's decision but we'll be filing a notice of appeal as the judge indicated. very grateful to the judge for

thinking through the issues candidly and it is an extraordinary move to permit a stayed pending appeal. the appropriate move. whether the case raises substantial issues that reasonable jurists differ over. an appeal to be suck s*esful. i have said before and confirm it. i believe the appeal in this case is bullet proof. the constitutional issues involved in this case are very important but mr. bannon never got to tell the reasons for his actions with respect to the subpoena. never got to tell his story. the government insisted from day one on prohibiting any mention, any evidence or any discussion to go before the jury as to why mr. bannon reacted as he did to the subpoena on the advice of counsel. thank you very much. look forward to adjudicating the appeal.

his silence is at my direction. by the way, i want to say one thing. i respect the judge, the sentence he came down with today is his decision. i fully respect it. totally respectful the entire process on the legal side. also want to make one other statement before i talk about a broader topic. more than any person in the trump administration, i testified before the mueller commission for more hours, i testified in front of schiff and the house intelligence committee more than any other person in the trump administration. i testified in front of the senate intelligence i think more than all about the issues related to russia gate and all of that, okay? the same process every time. i had lawyers that were engaged, they worked through the issues of privilege and at that time i went and testified. this thing that i'm above the law is a total lie.

now more importantly, the judge -- today was my judgment day by the judge. he stated for the appeal and we'll have a very vigorous appeals process, i have a great legal team and multiple areas of appeal. but as that sign says there. can we have a vote sign? on november 8th, on november 8th, on november 8th there will have judgment on the illegitimate biden regime and quite frankly nancy pelosi and the entire committee. we know which way that is going. either they've already been turfed out like liz cheney, right, or have quit like kinzinger and other democrats or they are about to be beaten, or they will lose their power and become a minority and nancy pelosi and all of it.

this is a -- this is democracy. this is democracy. the american people are weighing and measuring what went on with the justice department and how they comported themselves. weighing and measuring that. hang on. they will vote -- they will -- can i go ahead and finish? can i? on november 8th -- on november 8th the american people will bring judgment and the biden administration ends the evening of november 8th. one other thing. the department of justice, merrick garland will end up being the first attorney general that has brought up on charges of impeachment and he will be removed from office. thank you very much. >> harris: steve bannon former advisor to president trump.

his attorney there moments before he spoke said he has been quiet at my direction. well, we haven't heard from him throughout this process and now we've heard from him. he professed he respects the judge's ruling today. four months for contempt of congress. but you watch that there. he said at the very beginning i have a wider message. he talked about the case against him and then he delivered what that wider message was. that's the first time that we have heard him throughout this process really speak in detail about what has gone on and the targeting that he says he feels he has had more than anybody having been close to former president trump. the breaking news continues this hour. we'll await for the president to speak on how he is going to tackle inflation. just out of the blue he is going to go after it now. charles payne fox business back on set with me. first of all, i want to pick up right where you left off. how we got here.

we're clear that what you call just unbelievable political spending got us here. >> right. >> harris: the president, what should he say today and what will we hear? >> we'll hear more blaming, the blame game. >> harris: he is out of people. he has blamed everybody. >> you go back and blame again. between -- it's ironic. when he brought up putin and the war gasoline prices are lower now than before putin invaded ukraine. geting back to what harkin said yesterday. i think the white house is really just in a pickle. this inflation, household wealth is declining. purchase power is deklaing. this is desperation time. >> harris: we're missing a month's worth of pay. we would have to work 13 months to pay off 12 month of 2022

bills. >> you start saying middle class folks and poorer folks, here is the thing. you have the monmouth poll. inflation is number one. way down on the list is climate change. how ironic is it that president biden has put climate change first and that's one of the main reasons inflation is running away and destroying household wealth. how ironic. the white house knows these polls. >> harris: is it irony or predictable. >> it was avoidable and it was did despicable. climate change before everybody watching this show and always come before everybody watching this show for this president. if you are in pain, if you can't buy a home now because they cost so much. mortgage rates are over 7%, you know, that's it. even the student loan thing will backfire. in a few years the same level of student loan debt would be where it is but tuition will go higher. what you are doing is saying to

colleges you never have to worry about this because nowhere do we hear about colleges janning up tuition sky highway ahead of inflation for well over a decade. they always get off scot-free. harvard has $50 billion. they should fund their own tuition and be the bank. more of the same but i tell you what, the american public is waking up. they have no choice. every time the cashier rings a register is a wake-up call. >> harris: we'll cover it when the president gives us the lecture on inflation. can't wait to learn. blame versus responsibility is what i took away from what you were saying. he will blame. he needs to take responsibility. >> at some point, please. >> harris: it is a voting block democrats absolutely need to have in order to win tight races. they may not be getting that support now. a poll shows nearly one quarter of latino voters say neither

party is swaying them currently. only about a third say the democratic party better represents them and we've seen a shift toward republicans over the past several years. this has been a ramp up, 28% now say they feel neither party, particularly cares about hispanics and latino voerts. the poll stefr who conducted the survey says the left should be the side that should break because they are losing the people. the quote, i think the top concern for democrats is that latino americans think the republican party by a small margin is better on the economy. 25% to 19%. florida republican congresswoman maria salazar says it plays out this way. >> this year is going to be -- 2022 will be the year of the hispanic republicans. we have the same values of the republican party, god fearing,

law abiding, tax paying, low taxes and family oriented and small government. that's what we are. thank god we're waking up to the fact that for 30 years the democratic party has been playing political football with us. >> harris: mercedes schlapp cpac founder, senior fellow and former trump white house communications advisor. kevin walling former biden campaign surrogate. great to see you both today. mercedes, i'll start with you and the decline of support from latino and hispanic voters and where that now will go. where that energy, that impact, that intensity, those votes. >> i've worked on hispanic outreach in media for over a decade and one of the biggest challenges that i think we've seen is that the hispanics are moving more into this independent swing voter type of status, which actually is problematic for the democrats because they've always claimed

the hispanic vote. now it's a huge opportunity for republicans to bring them home to say this is a place you need to be because we stand for a strong america, we stand for strong border security, we stand for strong families. for the hispanic community, it is not monolithic but these issues that are penetrating these communities is about inflation as we see across the board, economy, it's about don't indoctrinate my children. let me teach and raise my children based on my values. and also you are seeing such diverse candidates running on the republican side. many strong hispanic latinas running in key districts. they have incredible stories and also connecting to their base. >> harris: you know what's really interesting, kevin, we've seen so many covers with alexandria ocasio-cortez, the congresswoman out of new york and what mercedes is quietly pointing out you may not know the names of all the diverse

lane women and men on the side of the right because they don't get that kind of love from the mainstream media. your quick thought on that and we'll move forward. >> it's an interesting point. i agree with mercedes. any party that views them monolithic won't have success elector ali. as democrats we have to treat this core group of our base not necessarily as a turnout group but persuasion group. we need to meet them where they're at. cortez is running a campaign in spanish language and replicate that. they will make up the difference in key senate, governor and house races. >> harris: you are losing and you don't have the media that's helping the other side. there is a bit of irony there. you are losing voters because you aren't doing the right thing. you can start to tweak all of

that but you are already behind the 8 ball. people left irrespective what they knew about people across the aisle. here is what happened when swing voters rejected a president biden 2024 run. their response is so swift and so blunt it seemed to surprise the moderator. >> should joe biden run again? >> no. >> that was quick, wow. my goodness. why shouldn't he run again? >> too many people will not vote for him. >> you don't know if he is really in class. >> you could put anybody next to him and they'll get it. >> a lot of people think he is mentally unwell, dementia or whatever. if we had a doctor telling us that it would be a different story. >> harris: anybody could go up against him, kevin, anybody? i mean that was really interesting. that was not a small group. they are not monolithic.

from all -- i watched that. it was fascinating. what's going on? >> it's not good for the president obviously. as a democrat on this panel truly will admit that. when the president said in the interview he will figure out whether he is running again. the mid-terms will weigh on that decision process. he will huddle with jill and other advisors and make that decision for himself. as the president has said, he has majority support among democratic voters. that's important to secure the renomination of his party. and polls show constantly consistently that he is beating trump. that's the key metric for the president. >> harris: support among democratic voters, why is it in national polling now and not just fox news the gop in general are something that people would choose over democratic leadership right now? he is at the top of the food chain. he decides the ingredients and the flavoring nationally.

>> i think for joe biden it's very problematic in the sense you have the democratic party several of these congressional members saying i don't know if i will back joe biden. the problem is, harris, what is the alternative? kamala harris, the most unpopular vice president that we've seen that can barely put together a sentence like her boss? this is a challenge that you see the democratic party facing. i really believe and love to get kevin's view on this. it will be president obama deciding who will run in 2024. i think he is the one that is the stronghold of that party so far. >> harris: 10 seconds, kevin. she called your name. >> news to president obama he is a king maker within the party. the president's decision to make whether he will run again. i support him if he does. >> he is the king maker in the party. a long weekend for the president after he drops this historic inflation idea on us later today. possibly even later this hour.

together. sean duffy former wisconsin congressman and fox news contributor is with me now. just to give you a taste. inflation has been really -- there he is, sean, stand by. let's watch together. president biden. >> president biden: good morning. i ran for president to rebuild the backbone of the middle class, this country. that's the backbone. build and economy to make sure the economy was stronger than it was before the pandemic. since i came to office that's what we've done. historic vaccination efforts that saved lives, helped our economy recover from the lost jobs during the pandemic. 10 million jobs created, a record for any administration at this point in a presidency. 3.5% unemployment, 50-year low, 700,000, nearly 700,000 manufacturing jobs created with companies investing billions of dollars to build industry in

america proving that made in america is no longer just a slogan. we are rebuilding roads, bridges, ports, airports. we're delivering clean water, high-speed internet to every american. the price of gas at the pump is coming down. it's down $1.20 since this summer and just this week, last week it has fallen another 10 cents. today we have further proof that we're rebuilding the economy in a responsible way. today my administration announced this year the deficit fell by 1.4 trillion dollars. the largest one-year drop in american history. 1.4 trillion decline in the deficit. let me repeat that. the largest ever decline in the federal deficit. let me be clear. this record deficit reduction includes the cost of my student loan plan and everything else we are paying for. the deficit is down 1.4 trillion dollars this year even after accounting for 30 years

of debt relief paid in advance. you know, this follows last year's drop of $350 billion in the deficit. because we're making sure the largest corporations pay their fair share, cracking down on billionaire tax cheats and giving medicare the power to negotiate lower drug prices in the future beginning -- just getting underway which lowers one of the biggest costs that government and families have to pay, we'll reduce because of that the deficit another $250 billion over the next 10 years. you know, we're going from historically strong economic recovery to a steady and stable growth while reducing the deficit. building an economy where everyone does well. where the poor have a ladder up, middle class does well and the wealthy do very well and not hurt by it. this is the economic vision i have had for america and the reason i ran, one of the reasons. republicans in congress have a very different vision.

listen to me closely. congressional republicans love to call democrats big spenders. and they always claim to be for less federal spending. let's look at the facts. the federal deficit went up every singleier in the trump administration. every year he was president. it went up before the pandemic. it went up during the pandemic. it went up every single year on his watch, the republican watch. in fact, in three years before covid hit, the deficit ballooned by another $400 billion. those are the facts. one big reason for that is republicans voted for 2 trillion tax cut, a trump tax cut which overwhelmingly benefit the wealthy and biggest corporations. that racked up the deficit significantly. on my watch things have been different. the deficit has come down both years that i've been in office.

we'll reduce it even more in the decades to come. republicans in congress are doubling down on our commitment to explode the deficit again. just this week it's hard to make this stuff up, just this week republican lieders said if they get their way they will extend the trump tax cuts which are due to expire in a couple of years, extend them. they said they will repeal the corporate minimum tax of 15% that i just signed into law. 15%. they will allow the largest and most pos perous corporations in america to go back to paying zero in federal income tax, 55 of them today d that in 2020. repeal the lower prescription drug costs and it will take effect next year. which -- the major reduction in drug costs don't kick in until next year. republicans if repeal it, it will raise costs to millions of seniors and the cost of the federal government -- to the

federal government will be billions of dollars. put it all together the republican add would $3 trillion to the deficit. $3 trillion. that's their plan. that's what they did under my predecessor and what they intend to do again. add another $3 trillion to the deficit is reckless, irresponsible and would make inflation worse. for americans, the deficit could not be clearer. we don't have to take their -- my word for it what they are for. they've laid out a plan, very clearly, congressional republicans say and you all know this, their number one priority is repeal the inflation reduction act. here is what that means. if they get their way and the power we just gave medicare to begin to negotiate lower prescription drugs goes away, gone. if they get their way, the $2,000 cap on prescription drug costs that take effect next

year. any senior would have to pay no matter what the drug costs are of $2,000 goes away, gone. the $35 a month cap on insulin take takes effect next year, folks on medicare, gone. the savings on healthcare premiums of $800 a year for millions of americans under the affordable care act gone. and, of course, they are still determining to repeal the affordable care act which means an end to the protections for tens of millions of people who cannot afford health insurance because they have a pre-existing condition. let's remember that. talking about millions of people will lose their health insurance because they do not have a way to get it because they have a pre-existing condition. that's gone as well. they're doing everything they can to get gas -- we're doing everything we can to keep gas prices down and republicans are against it all. it's all part of a trickle down mentality that says it doesn't

matter what is happening on main street as long as wall street is feeling good. one more thing, if you are worried about the economy you need to know this. the republican leadership in congress has made it clear they will crash the economy next year by threatening the full faith and credit of the united states for the first time in our history putting the united states in default unless -- unless we yield to their demand to cut social security and medicare. you heard that one, right? you all heard them say that. that's what they are saying. let me be really clear. i will not yield. i will not cut social security. i will not cut medicare no matter how hard they work at it. folks, we know what the republican congress will do if they regain power. they're telling us and being straight up about it. repeal lower prescription drug prices i signed into law and raise drug prices, cut social
