greg you had a column on this earlier today. you went into specifics on the law and precedents and the fact that bannon was listening to his lawyer and had every right to listen to his lawyer and executive privlage is donald trump's and it was invoked. that should have been resolved first. >> that's right. the judge invoked the wrong legal standard on willful defiance of a subpoena. relied on an outdated circuit court case that was reversed by the u.s. supreme court. the problem standard is that prosecutors have to prove the defendant knew his actions were unlawful. if he believed on advice of counsel that his actions are lawful he can't be held in contempt nor convicted.

it was folly for the prosecution, the department of justified to say there is no executive privilege because bannon at the time was not an employee. if a president can waive the privilege of a prior president that renders it meaningless. we encourage presidents to consult with people not in their inner circle but seek good advice outside. i think this case will be tossed. >> sean: i would bet a significant amount of money, joe concha, what we have outlined here in terms of the law, and what we have been talking about with the politics

and what lara trump and i were saying, eric holder they didn't prosecute him or janet reno. this is the first time since 1983. will any media outlet ever talk about that perspective? >> one would think that you sud suddenly -- have to look at the precedents. holder and reno defied these subpoenas. you would think that would be mentioned but it won't. the american people, they look at the rests of the president's allies and his former cabinet members and see the civil suit from the new york attorney general who declared she would do this before she was elected and see the january 6th beyond partisan. would not allow for the

cross-examination of witnesses and say this doesn't look like america. while the "new york times" and the "washington post" will treat had has a huge story, americans are focussed on the cost-of-living reaching unsustainable levels and a country without borders. the media is concentrating on trump and bannon and people out of power for sometime. it will come back to bite them 18 days from now. >> sean: last legal question for greg. he will win on appeal? >> yes, he absolutely will. bannon received a letter from the president's lawyers saying the president invoked executive privilege directing him not to testify. the president holds that privilege. bannon can't waive it. i think the supreme court will take a look at this and say we are tossing the conviction.
