georgia. her going head-to-head in contentious senate and governor races. for more on this charles watson joins us live from atlanta, hate charles for. >> hey good afternoon griff. georgians are showing up to the polls in large numbers. according to the georgia secretary of state office those numbers are on pace with the turnout seen during the 2020 election per let's look at the latest data it shows that well over half a million people have already cast their ballots. more than 90% of those votes coming in from in-person voters. state officials say there have been some instances of long lines with those reports are quote unquote rare. republicans in the near record turnout is proof democrats and big corporations overplayed their hand and criticized provisions but george's new voting law calling it racist, criticizing some of the provisions among other things man handing out food and drinks at the polls and require proof of id to vote by mail.

could be the deciding factor in who was elected in this pennsylvania senate race which is actually pretty close, closer than some i have expected. right now dr. oz closed the gap as he convinces voters a fetterman is soft on crime, listen. >> people feel like the folks in charge of value the criminals more than the innocent. the families are in pain. no one seems to care. >> the philadelphia district attorney, you send your left next to fetterman was endorsed by fetterman. can now be impeached. critics are blaming his policies were a big surge in crime. one of the criminal reforms put into place was the conviction integrity unit which fetterman called groundbreaking and exciting. but that unit reviewed past cases where it actually helped exonerate this guy, 32-year-old harris. harris was convicted of murder in 2012 it. but under his direction he was released last year. now, the ex-con is us suspected of shooting killing a 50-year-old charles last month he's there on the right.

pennsylvania are the four tossup spirit let's pick up where alexis mcadams dropped off. that is the cause/fetterman r race. matt will start with you crime is become a top issue there. >> it has. and a lot i think fetterman has done a pretty good job of responding to those questions for the other thing to keep in mind about crime is republicans admit is a big issue everywhere and they try too. but when you look at the numbers actually there is a bigger murder problem and a red states and read it cities than blue states and blue cities. the idea that should be politicized is ridiculous. but i think fetterman has done well though, he has made the race less about ideology and more about identity. he talks constantly about how dr. oz is not from pennsylvania he is from new jersey present rich guy with ten houses, and roots for the cowboys. he is not really of pennsylvania think that's really helpful. >> fetterman makes it about authenticity but is not release his medical records but he tried

to his health for this and a lot of talk about us help but i believe with matt on the point this will be about crime. oz has been pummeling fetterman on this really lacks oversight of the border pardons. letting folks out of jail but it's really a question of how we punish and how we deal with these people who are arrested. think republicans feel very good about that race. oz has been closing quickly after really tough primary. griff: also to show our viewers the top issues that fox polling has found. matt, i think he worked with a guy named james carbo 12 cents about the economy, stupid. you can see right are the most important issue facing america "new york times" and cnn though our numbers are similar. you can see the rise from july to october now 44%. let's go in the case of georgia with the warnock race, what you think will be the outcome and will the economy and inflation and gas prices rue the day?

>> look i've been in this business 35 years. exactly one election 2002 after 911 the economy is not number what in every other election it always is. we need this to be the case. presidents and their party get more credit than they deserve for good economies, more blame than they deserve about economies. so inflation is certainly hurting democrats all over prince hurting warnock. i do think the difference of quality between these two candidates, warnock has multiple advanced degrees is incredibly and he is the senior pastor. the contrast to walker's pretty stark. also walker's personal problems are getting in his way. i think the balance between candidate quality on one and economic headwinds of the others white so close. griff: he has eight points. walker has had late in this race personal issues coming up, what you make of the state of this race? >> he has had some negative stories but is pulling us relatively unchanged but still up a very, very close race for

this will end up being the closest race in the country. but i'm looking is brian kemp's numbers if he runs by seven or more that will lift herschel walker without a runoff or to think were poised to have a runoff there is the again in georgia in december. but look it is also really important to note warnock cannot get above that 48% rate 50, $60 million in the democratic side and he still seems a pretty hard ceiling. i think it bodes pretty us. listen, democrats wanted to fight this on abortion through most of the summer. they're finally realizing voters want to talk about the economy. >> really interesting point matt boardman if kemp wins by large of margin will pull walker long? i think about when where the closest races for the skull to another and that is out in arizona blake masters, mark kelly. matt what he think of that race? that is a unique one to because the border playing in. mark kelly taking a more democratic, not progressive view of the board if you will.

people and injuring dozens more in that tragedy. he has made the choice to represent himself in the courtroom. criminal defense attorney brian claypool joins me now live to help us break down what is thus far been a fairly bizarre trial. thanks so much for being here. brooks had previously pleaded not guilty by reason of insanity. then he pulled that defense ultimately deciding to represent himself at trial. he shouts, he cries, he is conducting cross-examination to himself. is he putting on a show? is he making a mockery of his own trial? >> hey molly great to be with you. this is an absolute disaster for brooks. he is basically a narcissist. he realizes he's going to go to jail. what he is doing is upstaging the trial. he is making about him as opposed to the families, the horrible families who lost loved ones. and he made a colossal mistake, molly. he should not have argued

insanity. if i was representing him has two major defenses one is called diminished capacity. it is in wisconsin it is in most safety of some type of mental illness that defeats the intent to break drops it down to a second degree murder. he did not have the intent to kill it's the mental health got in the way. on the second when he had competent legal representation is called heat of passion. he was in an argument with his ex-girlfriend just before this happened. and shortly after that he runs through a crowd of people. he could have made that argument as well. but he didn't. he is headed for jail. -year-old boy, several grandmothers that have been marching in a dance group together but several of the witnesses have been called this far have given very emotional accounts of what they witnessed, what they experienced. brooks has been cross-examining them. he is not the first defendant to do this, ted bundy very notably representing himself growing

some of his surviving victims. how could this play before jury and a judge? this is playing off on private judge. you should some of the eclipse he gets angry, boisterous even threaten to throw something for it for a moment i thought gerry springer was going to commit to be the judge of one of these days. it is that bed with him. i will tell you, being a criminal defense lawyer if you've got a client charged with these heinous crimes you do not want them talking party want them sitting there, right? and becoming more of that mystery to the jury to try to evoke some type of sympathy. conversely when he stands up he is threatening people. he would on a 50 minute rage the other day, right question at the jury sitting there thinking this guy is nuts. we do not have any sympathy for him. he is completely ineffective as well. his alleged opening statement was absolutely pathetic. at one point molly he said i'm not going to argue the facts.

that's the whole case that's a point of a trial to argue the facts. so he has no facts in his favor. ask the judge does appear to be giving them quite a bit of leeway in the courtroom despite these antics you were mentioning the pretrial, prosecutors have also noted the judge is being fairly lenient, take a listen to this this is part of the exchanges we see in the courtroom. >> your belief that that is the law does not make it so mr. brooks. >> i do not like your tone and the way you're talking to me, i don't. i don't appreciate it. >> it down this court has absent has the ability to tell you to sit down and be quiet. and you have not done that. and i know why you haven't done that your honor and we appreciate that. he is not in control this courtroom, you are. >> a little frustration expressed there. is there concern about a potential mistrial here?

>> great point, molly per just so your viewers all defendants are entitled constitutionally to effective legal representation. it is dramatic when a defenses know i'm going to pass on a lawyer pretty going to defend myself, why? because that elevates the chance of an appeal. so this judge, she is old job. the reason why she is giving brooks so much leeway is because if she doesn't then an appeal is going to be filed but he said i didn't have a lawyer i should've had more time to talk about this. the judge was biased. so she has to do everything possible to avoid a mistrial or an appeal on this case. but i've got to tell you, molly, and the real world if that was me or another lawyer talking to a judge like that, we probably would've been tossed in jail. but before these victims of days of trial of this ahead of them. thank you so much for joining us
