general of louisiana and missouri allege the white house worked with social media companies to suppress freedom of speech. how damaging could this be for the white house? constitutional law expert jonathan turley here to weigh in just ahead. >> sandra: begin "america reports" on this monday afternoon with a major wake-up call from our nation's report card. the fed revealing decline in children's test scores in the country, biggest drop we have seen in decades. it follows the devastating closures due to covid that kept millions of children out of the classrooms. hello and welcome, everyone. sandra smith in new york. great to start the week with you, john. >> john: good to start with you too. 15 days to the midterms, on average, fourth grader math dropped five, eighth graders plunged eight. >> sandra: reading scores dropped three points since the pandemic started, the decision to close schools and along with

parents' rights have made education a key issue in the midterm elections. just 15 days away. >> john: right to it now. mark meredith kicks off our coverage this afternoon. if people who advocated for it does not have black eye, this doubles up. >> details in the data and report that came out, and education on the campaign trail. likely will bring the issue to the forefront of voters mind. math and reading comprehension more than 446,000 students in fourth and eighth grade, the results as you mentioned show drops in mat and reading comprehension. education secretary says it's obvious the scores reflect the pandemic impact on kids and calls the results unacceptable. experts say the pandemic is to blame for the changes, the study's author says the drop-offs are not necessarily tied to remote learning. >> there's nothing in this data

that allows us to draw a straight line from remote learning in and of itself to student performance. it's complicated. >> republicans not likely to buy that argument. virginia governor youngkin who campaigned heavily on the education issue, says now is not the time to let up. >> this should be a call to action, moment for us to recognize the path we are on is the right path, we just have to run faster. our kids don't have time. we have to run faster. and so i hope we are all shocked because we should be. >> only one state where math scores did not drop off significantly, and that was utah. it was the one state we saw the scores hold steady but a lot of report here, not a lot of good news, instead showcasing, john, how much catching up americans have. it is a sobering report. >> john: and part of the problem

phenomenon. e.u., european union, u.k., the british have higher inflation rate than we do here. it's not -- the fight is not about inflation, it's about the cost of living. >> sandra: so as we have been reporting, what is now months of reporting on this issue, polls showing inflation and the economy are the top of the list for voters concerns, only two weeks to go, you saw it there, nancy pelosi urging her party to focus on something else other than inflation, and instead to change the subject. you just heard it there. charles payne joining us now. if anything it paints the picture of how out of touch these democrats are. i mean, nancy pelosi, one of the leader of her party. marc thiessen was on this morning and he said this is the -- the best example yet at just how out of touch they are with voters. listen. >> so when biden says the economy is strong as hell most people look at him and say what

planet are you living on. i choose between gas and food, heating my home and paying my rent. >> sandra: sadly it's a reality for too many americans today. >> nancy pelosi has been pretty brazen about the way she talks of these things outloud, a few years ago talking about giving people more food stamps and multiplier effect. a poor person $2 in food stamps, they would spend 2.50, so if we can get them out to the stores they'll spend even more and be even poorer and she has gotten away with it. to marc's point, last week the federal reserve has 12 regions and all go up, and for years month of the -- mostly to businesses. now they go to communities. he i found this fascinating. new york, community perspective, many residents have difficult affording heat and other utilities as winter approaches, sorry.

housing affordability and food insecurity is the ongoing concern. in cleveland, one-third of respondents said inflation contributed to a decline in the financial well-being, one saying higher prices cause family to make different decisions regarding expenses, particularly food. >> for that reason alone, that's why democrats messaging, if they don't have anything to run on that they say is going to fix the problem, they are saying change the subject, this is just -- >> you can't -- maybe you can get away with it. but how does president biden go on tv and say these are not problems when they are problems. how do you have confidence in your government that keeps telling you to shut up because, stop complaining about what you are complaining about. >> sandra: marc pointed out that does not work, you can't ignore voters' top concerns. this is just a little sampling of what we heard over the weekend of more and more, not just democrats, but those in the media downplaying this very real

when you've got people in the northeast, we have had on this program here saying that they are having to decide between putting food on the table or heating their homes, in some cases a second or third job to pay for the inflation, that's a very real inflationary environment people are suffering through. >> john: and the point charles was making, hopefully it was not a written talking point that somebody had thought about and just a spur of the moment piece of verbal vomit that came out. moving on, a fox news alert. deadly shooting at a high school in st. louis. police say a gunman opened fire and killed two people, one an adult, the other a teenage girl. several others were wounded in the shooting and rushed to the hospital. shooter was a 20-year-old man who was shot and killed by officers on the scene. central visual and performing arts school in st. louis. video shows students leaving the school single file with their hands above their head. images that are familiar since

columbine. students were in front of doors and huddling in classrooms. this is a magnet school in st. louis. apparently, according to police, or at least a school spokeswoman, there was a massive police response. this gunman was confronted by police the moment he entered the school and was quickly neutralized. so unlike some other incidents recently, this involved massive police response to the threat against the school. we are waiting for more details from police. we'll continue to monitor that story for you. >> alarming new data showing an evidence of a nationwide classroom crisis. reading and math scores dropping across all grade levels. did the lengthy school closures backed by democrats and teachers' unions play a role in the decline. >> sandra: and new records at the southern border. will the numbers play a role in

officers encountered nearly 2.5 million migrants in the fiscal year that ended last year. reaction to that, but first bill is live in eagle pass, texas. bill, cbp released these numbers at a time that races eyebrows, didn't they. >> sandra, it certainly did. look, we have been waiting weeks

for the federal government to release these september border numbers and they finally did it on friday night at 11:00 p.m. eastern time and the numbers are pretty remarkable. let's take a look at this graphic right here. number of known or suspected terrorists arrested in september, 20 here at our southern border. that brings the total for fiscal year 2022 to 98 people on the fbi terror watch list arrested by border patrol here at our southern border. just to put that number in perspective for you, that is nearly quadruple the previous five years combined. when president trump was in office, the most he had was six in 2018. we had 98 in fiscal year 2022. then take a look at the video earlier this morning on the north side of eagle pass as the record numbers continue. this is the large group that crossed illegally this morning, mostly single adults as you can see, but cbp sources are telling us fiscal year 2023 off to a hot start. the first three weeks of october

here in the del rio sector, more than 29,000 illegal crossings already. that is up 50% over the same time period last year. then take a look at this remarkable footage by a source out of the rio grand valley, several shirtless drug smugglers, they are running up to a waiting vehicle in broad daylight where they load that vehicle up with those bundles of drugs, they then go back into mexico and the car drives away. well, texas dps tells us they got into a pursuit with that driver and they eventually arrested him. take a look at these photos here, they pop open the trunk, ten bundles of drugs, it was marijuana, more than 240 pounds of marijuana. the driver of the vehicle, 18-year-old u.s. citizen as you can see is smirking at the camera. and back out here live, law enforcement tell us they are

grade math down eight points, reading down three points. mercedes, who are parents going to blame for the decline and how might it be manifest on november 8th? >> the fact the children are not able to recuperate from what we have seen happening due to the covid lockdowns. i think they are going to blame the teachers' unions, blame the democrats and we talk about inflation and crime being top issues but education and the parents who were never involved politically have been standing up, being more vocal and saying wait a second, democrats and the teachers unions have not taken us in the right direction. i think they went way too far when it came to shutting down these schools and not opening them up on time. especially when you had catholic schools, my daughter's schools, they were actually open during the covid lockdown, they still had to lower their standards, but at the end of the day we knew there was a way to get the kids back to school safely yet

the government became too draconian. >> i think the blame game is fruitless. i am worried about the children, but i think it's important to understand here, john, and mercedes, that this is a nationwide decline. it's not as if you say oh, yeah, we can isolate it and look at democratic areas or areas where schools were kept closed, no. you look at california, a democratic-controlled area, and look at texas, look at florida, the same thing. the decline is nationwide. there is not one state where the test scores went up. so, what we are dealing with is, there was a pandemic in our country, and the kids were out of school. people were worried not only about the kids, but if you are in the teachers' union, you are about the teachers, the bus drivers, the crossing guards, everybody. there is a legitimate reason for concern and legitimate reason now to say we have do something to help our children.

>> john: crime is a big issue in the midterms as well and affecting the governor's race in the state of new york. from a quinnipiac poll, 4% between kathy hochul and the challenger lee zeldin. hochul just started talking about crime, is she a day late and a dollar short? >> i think people have to talk about crime effectively. it has been used by zeldin and others to try to gain politically. and i don't know if you can say it's somebody's fault. i think when you look at violent crime, violent crime is up in new york state, especially new york city, but guns are often seen as a republican issue because republicans back erosion of gun control, so i think it can play both ways. but she has not addressed it as aggressively as lee has -- as congressman zeldin. >> could it cost her the governorship? >> it could. new york is a tough state, like

new jersey, but what was the last time -- pataki in 1994. we don't have a great track record when it comes to new york republican governors. however, i think lee zeldin has been very focused on this message of crime, which i think has obviously helped him. you are seeing the democrats and hochul, they have miscalculated on the messaging strategy. they made the decision it was about abortion and hone in on. guess what, not everyone there are women, not everyone there are child bearing age, that is not going to work for the democrats, and so that's why you are seeing the last minute shift from the hochul campaign team. and zeldin, and a shooting in front of his house, and his daughter, and he almost got hurt as well, there is a reality happening in new york and independent voters are saying wait a second here, i think lee zeldin could be the one to deal with the crime issue, especially pushing bail reform and weak on

prosecuting the crimes. >> quick final thought from you. could democrats lose some democrats over this issue? >> yeah, i mean, if you look at the most recent polling, swing voters are pushing a lot of the republican momentum that we are witnessing at this moment. i don't know that they are independents, a lot of time people say they lean, they lean republican. but in action to your question, right now republican messaging on the economy, what i think is a little bit of halloween fright on the economy and it's working for them. >> john: big turn around from the summertime, 15 days to go, a lot to talk about. >> good to see you. >> sandra: president xi of china making big moves to lock in his spot leading the communist country years to come. is he more likely to move forward with an invasion of taiwan. >> john: and vladimir putin

for using by their side some kind of nuclear threats. >> the types of threats against ukraine are changing. we have seen now iranian-made weapons on the battlefield. what do you need in order to stop these drones from targeting ukrainian cities? >> the priority number one for ukraine is air defense systems. with the different types, short range, middle range and long range. >> there are reports that iran has military personnel in crimea. >> yes, it's true. >> what about belarus? >> i'm sure that they have also in belarus because iranian drones they use from two main direction, from the south, from the crimea, and from the north, from the belarus. they use belarus like -- >> do you know how many? are we talking dozens? >> it's an issue of our intelligence. it doesn't matter, 10 or 20. just one is enough.

people that have it are the russians. ukrainians don't have one. and when you see what their defense secretary was calling to other nato defense secretaries, and lloyd austin, talked about the potential of a nuclear weapon, i think it's delaying tactics. we are in drift right now. i think they are trying to delay until they get to the winter. the russians are having major problems on the ground fighting, units have been mauled badly, ukrainians are fighting good especially in the south and the russians are hoping for a delay. and if they can prevent more arms coming in by using the dirty bomb scenario, they can delay into the wintertime to reinforce, reengage, get ready to go. both sides have to slow down during the winter. it's terrible to fight in the winter, especially in that part of the world. >> john: the ukrainians are getting better to shoot down the drones, they are targeting

infrastructure and civilians, you are not allowed to in a war deliberately target civilians. could it be that russia and iran could be hauled before the tribunal at the hague on war crimes? >> do i think that's going to happen, probably not. but what they are doing is clearly in violation of the laws of war. they are using them against civilian targets, deliberately, not infrastructure, they keep saying infrastructure but it's not. to me an apartment building is not, you know, economic infrastructure. and they are using them as primarily a terror weapon and we know the iranians have given them incredible amount of drones and advisors as well are doing that. >> john: talk about china, an interesting scene yesterday at the chinese communist party congress in which tao, the premier of china, just prior to xi jinping was led out of the party of congress there, the official reason was he was not feeling with, needed to leave,

but it kind of looks like xi jinping was sweeping away all vestiges of the past because tao was more into opening up china, global trade, that sort of thing. but along with sweeping out him, does xi jinping sweep out the last remaining vestiges of reason and what does that mean about taiwan? >> i think -- when they took out president tao, two terms, now xi has his third term and i think he's been very, very hard core now, he's basically replaced everybody that he had and with his own people. so what i think it means for the future, you are going to see a china that's much more strident, and hard core, and in 2024, it's going to come to a head. >> i was in beijing with president george w. bush when he was visiting, the man was not a
