>> hour two of america reports. nancy pelosi's husband fall attacked near their san francisco home this morning, brutdly we should add. we are waiting to learn more on the 82-year-old's condition and motive and any sign of nancy pelosi. we do know she was not there but was in washington, d.c. when the attacker broke in. america reports starts right i'm john roberts in washington. >> good to be with you. i'm sandra smith. we heard from the police chief on the investigation into the attack. his remarks were brief. no questions were taken but it does leave big questions about what went down and obviously there was was not an update on paul pelosi's condition. we have fox team coverage in washington and san francisco but
11:01 am
first to those remarks we just got from the police chief a short time ago we are going to play them out here. >> we will go ahead and get started. good morning. my name is chief bill scott with san francisco police department. at approximately 2:27 this morning san francisco police officers were dispatched to the residence of speaker nancy pelosi regarding an a priority well being check. when if officers arrived on scene, they encountered an adult male and mr. pelosi's husband, paul. our officers observed mrd pelosi and the suspect both holding a hammer. the suspect pulled the hammer away from mr. pelosi an violently assaulted him with it. our officers immediately tackled the suspect difficulties armed him took him into custody requested emergency backup and rendered medical aid. the suspect has been identified as 42-year-old david ded purrageous dyna -- david
11:02 am
depeppi. this is an active investigation currently being led by the san francisco police department special investigations division. we are look working close lid with our the u.s. capitol police and d.a. brook jenkins and her team. the motive for this attack is being determined. mr. depeppi will be booked at san francisco county jail on attempted homicide assault with deadly weapon elder abuse burglary and several other additional felonies. before i go any further i would like to thank the responding officers for their swift action this morning. those san francisco police officers are officer colbey wilmis kyle kag any and officer
11:03 am
edwin coyne. i would like to thank our emergency dispatcher heather grimes for a really amazing job. for inquiries regarding mr. pelosi an his condition we refer to you the statement issued by speaker pelosi's office this morning w. that i'm going to turn it over to our district attorney brook jenkins for a few brief comments and let me say in advance this is what we know advertisement we will update you further but we will not be able to take any questions after this statement. >> thank you chief scott and i do want to commend the san francisco police department for their immediate response to this home and for swiftly making sure that mr. pelosi was okay and that the suspect was apprehended. we are working closely with them right now with respect to the investigation and will proceed with the appropriate charges as
11:04 am
things unfold as well as work with the u.s. attorney's office and our federal partners. thank you. >> all right. thank you all for being here. i know you may have -- we will update you when be get more. >> do you know how he got into the house? >> that's it for now. we are not going to take any questions. our office will be issuing news release very soon but that's it for now. thank you. >> all right, that happened a short time ago in san francisco chief bill scott from san francisco police department the district attorney brook jenkins giving us minimal amount of information they we did learn the name of the suspect 42-year-old david depeppi what we don't know is his motivation at 2:27 in the morning looking for nancy pelosi. jonathan hearing that the second time clears up the timeline of what happened. it sounds like the alarm went out to police that they got
11:05 am
there, they found paul pelosi and the suspect wrestling over a hammer. we don't know who had the hammer first. then the suspect according to police grabbed that from paul pelosi and started hitting him with it so it sounds like the assault didn't happen until police actually got there. >> yeah, it's very interesting the timing on this, john. obviously some sort of alarm may have been automatically trig where the suspect broke into the house or perhaps mr. pelosi himself was able to call 911 before he came into direct contact with the suspect, having perhaps heard the window of the glass door that appears to have been broken during the entry breaking and perhaps he had called 911. but either way the police chief made it very clear that when officers arrived, the assault, the fight was actually happening. listen again to that part of
11:06 am
what the chief said. >> our officers observed mr. pelosi an the suspect holding a hammer. the suspect pulled the hammer away from mr. pelosi and violently assaulted him with it. >> that is interesting. we are not clear from that and what chief scott said in the rest of his remarks whether the sale and entered the house with that hammer or whether mr. pelosi took the hammer with him to defend himself when he heard somebody breaking in. either way, when police got there they were fighting, the two of them, over that hammer and as police were going into the house they actually witnessed the saurlt happen. what we do know is that mr. pelosi who is2 years old suffered blunt force trauma to the head and body and we are told he had significant swelling on parts of his body. we were also told earlyy by nancy pelosi speaker pelosi's
11:07 am
spokesman drew hamill that mr. pelosi was expected to make a quote full recovery but our understanding at the moment is that he remains in the hospital. the pelosi family has asked for privacy there. are some reports out there about mr. pelosi's condition. we are working to confirm anything with the hospital itself and we are not going to speculate on his condition until we hear directly from those responsible for it or from the pelosi family themselves. but, as for motivation, you heard the chief say we don't know. obviously there is a political element to this at lead because this was apparently a specific target, the pelosi home and the assailant was according to law enforcement sources speaking to our david saying where is nancy, where is nancy so there is a political element. what we don't know is we don't
11:08 am
know the suspect's 42-year-old's political views and we also don't know they if there was any sense any element of mental health crisis involved in his decision to go into the pelosi home apparently seeking the speaker and ultimately brutally attacking the speaker's husband 82 year-old paul pelosi. >> is there anything we do know about the assailant at this point? >> nothing we know for sure other than what the police told us john that he is 42 years old. we believe that he is from berkeley, california. we believe that he has been involved in some previous protests in san francisco. we are working to confirm anything that we believe we know about him before we put it out there. there's all sorts of speculation as you can imagine as always in these situations on social media. we are not reporting anything until we've got it confirmed but
11:09 am
there appears to be a social media trail and once we had can confirm those social media outlets are directly linked to this specific 42-year-old we will get them to you as soon as you can. >> we will let you get back to work jonathan hunt. >> team coverage speaking of david live from the justice department what's the update there? >> sandra john first of all we talked the last hour if paul pelosi had security with him any type of security detail. parently we know the answer now. it seems to be know no because the police chief made it clear that when the san francisco police came to the home they found as jonathan hunt just reported paul pelosi and the suspect wrestling over a hammer and the attack ensued in front of police so maybe that's how paul pelosi was able to call
11:10 am
police before he was sfeerdly tankman by that hammer. right now just about every federal law enforcement agency taking part in this investigation although it's being led by the san francisco police department but they're all essentially working to together. several law enforcement sources are confirming to fox news that david depeppi when he went inside shouted where is nancy where is nancy. not sure if maul pelosi was able to tell police when they arrived but we know the attack happened in front of the police which is remarkable. >> david according to the charges the police in that news conference a short time ago said they're bringing forward against this attacker including attempted homicide you have to think there was a whole lot seen there while the police were
11:11 am
present and obviously talk about the exchange with the hammer taking place when the cops entered the room. >> it does not appear sandra and john as i said before that there was any kind of security there. you know we may not be right about this but at this point it doesn't seem like that's the case because the chief didn't say that. the chief said the police walked in and they found paul pelosi and the suspect and it doesn't appear there was anybody on the scene. unfortunately the police chief didn't take questions so we are waiting to see and find out more but it sounds like it was paul pelosi who actually made the call to authorities. >> okay. david spunt we will get back to you. >> jason is a former congressman and now fox new contributor. when were you in congress you did a deep dive into security for members of congress and you've got information that can probably give us some insight
11:12 am
into what may or may not have been present at that time pelosi's house this morning at 2:27 a.m. what do you know about amount of security to members of congress and their families? >> it's sparse at best for leadership the majority leader whip for the majority the minority and the house an snaet get a security detail. what is almost non-existent is the homes of those people and it's inexcuse until my book. january 1st last year nancy pelosi's home was vandalized spray painted with graffiti. there was fake blood spewed across it a dead pig's head hat the door. it makes you wonder even if the speaker herself is not there how can that happen and why were precautions not put in place an responded to from the attack
11:13 am
last year? every member of congress has their information their address their home even their telephone numbers are published. you have to disclose these so anybody in the public can go look these up and it creates a very vulnerable situation for members of congress but especially leadership. she's the highest profile person in all of congress. >> you wonder if security extends to members of the president's family and their children and the vice-president's family and children that might be involved why wouldn't security for the person who is second in line to the presidency be extended to family members as well or at the very least if not u.s. capitol security detail like the speaker gets not why not just a marked san francisco police car sitting in front of the house. >> well, members when there is a viable threat will actually get some sort of security detail but i can tell you somebody who has been threat end several times i've had two people arrested one
11:14 am
person sentenced to jail because of the threat they gave to me but there are more members going through. this every single member of congress is thinking about this because it happens on a daily basis. john it was just a few months ago that the capitol hill complex actually got calleder identification. something you could have got at home for the last decade. they don't even know where these threats are coming from and the capitol hill police as much as i like what they do at the capitol hill complex outside that bubble there is nothing. you're expected to call your local law enforcement and work for them. what they should do, what was out there, is to do what the us the prosecutors and federal judges deal with and that is have the u.s. marshals goad and do a personal assessment. a federal judge in san francisco is getting far more security than the speaker of the house. there's no reason why the u.s. marshals cannot have some sort of presence and video monitoring
11:15 am
capability some visible deterrent so that any yahooo walking the street can go out there and say probably not a good idea because this looks likes it's not going together wednesday for me. >> jason hello, it's sand ramp we are looking at live pictures. they've taped off the area. it's amazing how very little was revealed at that news conference the charges that are being brought against the suspect who is in custody, but no actual clear statement how this intruder got n. we are waiting for an update on paul pelosi's condition. we don't know if he's in the hospital. that hasn't been confirmed but we know that paul pelosi's according to nancy pelosi's office was attacked severely beaten by this assailant entered their home middle of the night 2.
11:16 am
30 a.m. confronted him shouting for the speakers's whereabouts authorities say the motive for the attack is being determined the suspect has been identified david depeppi is in custody and idle read from the police chief moments ago because this is the only update we've received. our officers observed pelosi and the suspect both healing a hammer. the suspect pulled the hammer away from mr. pelosi an violently assaulted him with it. our officers immediately tackled the suspect difficulties armed him took him into custody requested backup and rendered medical aid. and that is what we know so far. >> yeah, i hope he's okay. nobody should have to go through this. it sounds like these police officers put their lives on the line every single day. they showed under and took their business, but there should be some more deterrent out there. you would be think half the tack on gabby giffords, the attack on steve scalise the violence that
11:17 am
was strewn across the speaker's own home you would have thought they had would do something else but doesn't appear they could because even gaunt to get in the door you shouldn't be able to get in the door. i don't know if there was a telephone call. there may have been an emergency monitor maybe a panic button, maybe a door motion the police responded to but it doesn't appear as if based on what i've seen in the past there are other types of deterrents to people who might want to do these type of things not just against the speaker and other members of leadership but other members of congress as well. >> okay, jason. well that is what we know so far. these are live pictures continuing to come in from san francisco. we are hoping to get an update shortly from authorities on the ground, massive investigation underway, capitol police local police in san francisco and the fbi investigating and we are waiting an update on paul pelosi's condition. as it happens sometimes you get
11:18 am
a lot of information right away sometimes a little. we don't know next update but we are tracking it. >> police continue to process the crime scene as they look for more clues why this assailant went into the pelosi home 2:30 this morning look fork nancy and got involved in violent altercation with her husband. we are going to take a short break hand be back after this. at newday usa we give veterans the va cash out loan with no upfront costs for an appraisal or termite inspection. no upfront costs at all. let us get your family security of cash in the bank. woman tc: my a1c stayed here, it needed to be here. doctor tc: ruby's a1c is down with rybelsus®. man tc: my a1c wasn't at goal, now i'm down with rybelsus®. son tc: mom's a1c is down with rybelsus®. song: a1c down with rybelsus®

11:24 am
home at 2:30 a.m. reaction pouring in from members of congress both sides of the aisle. asha is live at capitol hill. what are you hearing? >> people are putting politics aside and coming together to condemn this horrific attack. i note the capitol hill team is trying to track down wherehouse speaker nancy pelosi is at this hour. her office does not normally share her travel information because of security concerns but we do know she was in washington overnight and that she had an event here in washington over the weekend so we are trying to trying to figure out if she's already left to go to san francisco or is in san francisco currently but i get to that reaction pouring in from both sides republicans also condemning this attack. let's start with senate minority leader mitch mcconnell. this is what he tweeted today.
11:25 am
ted cruz also tweeting. and then sandra, i want to take a note of senator rand paul's tweet interesting condemning the attack saying:and adding:of course, this is about pelosi's daughter christine who said, quote, rand paul's neighbor was right in apparent reference to when the senator was assaulted by his neighbor two years ago. now u.s. capitol police have seen a huge huge spike in threats made to members of
11:26 am
congress over the past couple of years. axios reported that threats went up by 144 percent from 2017-2021. so that's a huge jump. and reminder we have said over and over again members are not guaranteed security. you remember a report about congress come iona presley that was spending $60,000 in private security, this is why. leadership does including speaker pelosi but not their spouses so paul would have only enjoyed speaker pelosis security when she was with her. this year the house sergeant at arms gave house members about $10,000 to install security systems in their homes. we don't know if the speaker
11:27 am
used those funds or where because she does have a residence in washington as well. after this we could see u.s. capitol extend temporary security to paul pelosi and lawmakers perhaps will start talking about calling for security for members and their families. >> okay, live on the hill. thank you. >> sandra let's bring in special report anchor bret baier who will be covering this on his program. we don't know what the motivations of this fellow were. we don't foe if it was political, if he had some other beef with nancy pelosi or he was just an unbalanced person who was trying to some sort of bizarre statement. >> we can't make that determination. law enforcement has not said there. there are all kinds of people digging into his social media profile online, what he's done before, what he's listed as having been in protest before.
11:28 am
and it's a mixed bag but we don't know until authorities dig that twhuchlt we do know is the specifics of the attack. we also know the capitol police and we have reports and they're going to confirm for us that they have a video of this attack. now, whether that's from a security camera there that was tripped when the house was breached. we are trying to get to the bottom of that. >> it could also be a body cam. >> it could be a body cam. >> according to the police chief the attack didn't happen until who have certificates got on scene. >> right so trying to get to the bottom of what that video is or what it shows. it seems like the police arrived very soon and it was when the entrance happened at 2:27 a.m. they went by for a welfare check and it seemed like they were there pretty quick. >> bret we have been able to
11:29 am
look more closely at some of the video footage of the home. these are live pictures. i can't exactly zoom in myself but we've seen some of the cameras very visible. you can see them top left of the grauj we were able to zoom in and see cameras. this is video. it's been in some of the sometime images. you would assume there's cameras out there. when the police said that they responded to a 2:27 a.m. call, they didn't say who called how they were called tomorrow. your point it could have been an automatic security system phone call which people who have that know that that will happen if somebody breaches the house. it can trigger a phone call to police and they will arrive. so we still don't have that information as well, bret. >> that's right. the quote was a welfare call at 2:27 which could have been tripped by an alarm and i just
11:30 am
think that that back and forth about the suspect holding a hammer the suspect pulling the hammer away from mr. pelosi and assaulting him with it was the quote that the chief you'd. to the aisha's point there is a lot of concern about security both sides of the aisle. they have received money allotted by the sergeant at arms but there's more concern as threats go up an this is an example trying to get to the bottom what was behind this althiqa. we are going to learn more about this guy but we should also in the same way that we cover school shootings or anything else not glorify this guy one way or another. >> so we are just geting a little bit of information about who this fellow was. apparently he lived in san francisco. there were reports that he was in berkeley although he possibly
11:31 am
resides in san francisco as well. according to his stepfather, depape grew up in powell river, british columbia and left canada 20 years ago to pursue a relationship that brought him to california. social media posts including transphobic images linked to web site claiming covid vaccines were deadly, the death rates promoted or what they want. so, it looks like we potentially have somebody here who embraced conspiracy theories. >> yes, and there's a list of them that are on the social media footprint that we are looking at so far and i think can you get from one point to another about where is nancy but
11:32 am
you have to -- it does not look like an organized attack number 1. number 2 what was he trying to do. i think police have a lot to tell us in this next briefing. >> right. >> beer all digging through this most recent information we are learning about the suspect just to reiterate the charges that why announce nounsed at the briefing a short time ago. he's been booked on attempted homicide assault with deadly weapon elder abuse burglary and other additional felonies. this is what we know at this point but obviously a lot of interest finding out who exactly the suspect s. we are starting to get a little bit more information about him. >> apparently he's a person he house sat for named linda schneider said she got to know depape a few years ago. when they met he was living in a
11:33 am
storage unit and told her he was struggling with hard drives hand trying to make a new life for himself. she said she stopped communicating with him because it seemed so dangerous adding she recalled him using biblical justification to do harm. >> i don't think we have to say anything else. we are going to learn more as the hours and minutes go by. i think the police will come to a conclusion about what this guy was trying to do. >> again, how do you connect all of that with nancy pelosi? that's the missing trail of dots here. >> to add to that there's a co-workerer also who has gone on the record saying, who lives in california saying she worked with him a few months roughly a decade ago making hemp
11:34 am
bracelets. she said he stole the bracelets as a business saying he was odd, didn't make icon, quote talks to angels and there will be a hard time coming but she didn't remember any seriously threatening comments hand didn't think much of it because it's berkeley a place where evening centric characters are not uncommon. >> apparently he grew up in british columbia. he seemed to have an extensive social media profile out there which could give insight into his frame of behind overall, but again knob specific link to why he allegedly showed taught pelosi house. >> facebook posts taken down most of those from 2021 but long screeds on there about religion,
11:35 am
public posts that appeared to mention pelosi and a couple. >> right. you also have to be careful scouring the social media because people can go out there and spoof social media sites so you have to be careful you know what you're looking at before you report. >> well, you've got to imagine bret that asha said they're trying to track down nancy pelosi whereabouts. you have to imagine some point since she learned this happened got on a plane heading wells to go visit her husband who was sent immediately to a hospital so as far as getting any update we got an update from her office. the statement said they expect him to make a full recovery but obviously they know the country is watching an update on his condition would be good but we haven't gotten one yet so we don't know much about his condition whether or not he's in the hospital or left the hospital at this point. >> yeah, and you know, there are
11:36 am
some reports varying degrees of seriousness of his condition but as far as we know according to the hospital he had bruising an significant swelling but all indications are he's going to pull through this all right. but again bret when you come down to it the fact that somebody was able to get into the home of the speaker of the house despite the fact she wasn't there is pretty terrifying. >> it's troubling. the security expert you had on earlier was troubled just by the positioning of the house and the fact there didn't look like there was any security outside or present and obviously there's an alarm system. that may have been what tripped the police to get there. the police chief says this guy has an history and elder abuse an other felonies but these records haven't been found. he's not a u.s. citizen. >> it's interesting on social media you're looking in, there's
11:37 am
obviously a lot of speculation out there. that's what happens when the information doesn't come quickly, right bret? >> we would like some more definitive words. if fact this is what we are digging up and does paint a picture. >> let's bring in bret if you could stand by let's bring in fbi investigator bill daly. can you give your thoughts this hour as we await more information? >> yes sandra. a couple things. first off is about the actual break in. it's certainly miraculous i would say the police were able to arrive for whatever reason whether it was mr. pelosi having heard or light were triggered or something indicated he needed to investigate or whether it was the breaking of maybe a glass door triggering an alarm. whatever it was it was certainly miraculous they were able to arrive while the incident was ongoing. it's not something typically that police will arrive upon. it's something that if it's a
11:38 am
domestic dispute but other incidents it's usually after the fact so the fact they were able to be there intercede and stop him from being assaulted certainly i think was if there is any bright spot in this, it is the fact that that occurred. it went on longer and they didn't arrive you can moon unfortunately what may have happened. so, you know, it does tend to tie into what bret was saying about security and there are and things that could be done around a residence, whether you have more burglary resistant glazing that would prevent somebody from getting in easily whether it's additional lights that come on whether it's alarms whether it's a safe room in the home where someone can go hide and be secure until police arrive. it would be interesting to know why some of those things weren't in place or if they were in play you know to what extent were they you'd in this incident. it is something also interesting as i hear all of this and to
11:39 am
hear right now the perhaps the background of this individual coming out in bits and pieces an trying to read some of the tea leaves which i hesitate to do at this point without beg fully informed. it something the fbi and the behavioral analysis unisit very adept at and i know this is something they'll be called upon to do to put the person in focus pulling together elements trying to understand what were some of the motivations, was this person in any way in their right mind out of their mind, was there any particular point at which was the impetus behind this attack or something that was fegs tering for a while, we don't know that but it does go to show you back to what we were just speaking about the threats that individuals in prominent positions face an it also goes to show you that peoples homes, whether it's the political
11:40 am
representatives or even people who are in corporate positions as if their home location is only a couple of mouse clicks away from someone showing up so for people to be constantly aware of that the not taking more demonstrative measures when we just don't know where they're coming. one final thought i have on this this individual when he showed up at the found it doesn't sound as though he came equipped with any weapons thank goodness and it sounds as though, riding the tea leaves, the hammer was pulled pelosi had it and he took it away from him. i would probably say that and another way is a small bright spot in a very sorry sad story here that this individual didn't come armed, didn't come with some other type of weapon which may have resulted in a much
11:41 am
different outcome than currently is said. >> you don't know what the prominence of the hammer was whether the assailant used it to break a window and open the door or if paul pelosi was we willing the hammer as a means of self-defense. we just know when the police got there they both had a grip on the hammer and the assailant allegedly wrestled it away and started talking paul pelosi with it. speaker mccarthy is weighing in on saying speaker mccarthy reached in to the speak tore check in on paul and is thankful they caught the assailant. in terms of the psychological profile here bill and your experience with the fbi there are plenty of people in this country who engage in the same sort of thinking as this fellow appears to have. but they never make that leap between thinking these thoughts potentially publishing these thoughts and acting out in a way that this fellow allegedly did.
11:42 am
how did they make that leap? what flips that switch? >> you know, john, that is always the question and my experience in this area probably has been more on the corporate side post my fbi experience and it has been constantly looking at these things, what the thing that may take someone from being a kind of rattling their sabre so to speak kind of making sounds about a threat and actually carrying it out? there was had a study done a few years ago and i don't have an update where it demonstrated a normal bell curve of things that occur, including threats and most of us fit within the fact that if the threats are made they're mostly going to be voicing expression releasing it through making some verb ally they are threat or demonstration of their thoughts. and but, as you get further down
11:43 am
on the end of the bell curve there's always a small tail of that where people go from maybe making threats or maybe not even making threats and then committing an act. and i think over the years as i've looked at this is that that tail has been enlarged for a number of reasons whether it's mental health issues whether it's more demonstrative talk about threats an people being irritated about what's happening in the broader society about things. so it is something that's out there, what really goes to have someone commit one of these acts is still one of these questions i think the analysts will help us better know in the next few days. >> all right. >> bill, if you could also stand by, we could get any new information in a matter of moments. we are waiting on that. thank you. >> thanks very much. shannon breen fox legal correspondent you'll be covering this on your program sunday. we don't know what his
11:44 am
