"jesse watters primetime" starts right now. and we are one week away from election. ♪ >> jesse: fox news alert. paul pelosi's alleged attacker david depape appeared in court just moments ago where he is facing a mountain of charges from attempted murder to residential burglary to assault to elder abuse after allegedly breaking into the pelosi home and hammering paul in the head. san francisco isn't letting our cameras into the courtroom for some reason, so, that's not a good sign. depape, 42 years old, is pleading not guilty. that's according together public defender representing him adam lipson who just met with depape

for the very first time last night. >> we have very little information about this case at this time. there has been a lot of speculation. a lot of rumor. simply based on the nature of this case. but, as of right now, i haven't even seen the police reports. i met my client last night for a brief meeting for the first time. >> jesse: this public defender hasn't even seen the police reports yet. so he knows as much as we do. but adam is already planning on going with the insanity defense here. >> we're going to be doing a comprehensive investigation of what happened. we're going to be looking into mr. depape, his mental state. >> jesse: depap, is that the name? district attorney brooke jenkins holding the cap on no bail. finally somebody in san francisco gets held with no bail. she is saying depape is a danger to the public. >> absolutely i consider him to be dangerous.

not only is this someone who engaged in a pre-planned attack on the speaker in her home, but someone who was willing to enact violence that was politically motivated and so, yes. we certainly view him as a public safety risk. >> jesse: but the d.a.'s biggest concern isn't the thousands of other dangerous mentally ill drug addicted ex-cons. she is worried that there is too much misinformation out there i think what is clear this case is vulnerable to misinformation. we are seeing it spread across all platforms at this point. we need to make sure that the record is clear what happened in this situation for all parties. >> jesse: not attempted murder, misinformation that's the problem. san francisco is responsible for the misinformation. they gave this sloppy press conference where nobody could tell us how many hammers there were, remember and led everybody to believe that a third party opened up the door to police? we have a lot of basic questions

about this case. that san francisco officials won't answer like: why didn't the alarm go off when depape allegedly broke in? we are talking about the home of the speaker of the house here not only is san francisco experiencing a crime wave what if a chinese agent broke in and bugged the place? this house is so edges posed you could break into a house to a person who is third in line to the presidency that easy? do the pelosis even have an alarm system? >> whether or not they had an alarm is still part of this investigation, we have to make sure that what we release to the public is what we believe is necessary in order just to straighten out this record. and what we believe the public should have access to. it's not going to be every single detail of this case because that's not something we would ordinarily do any other case. >> jesse: you either see the alarm system in the house or you don't. that takes 30 seconds, lady. they call the perp red handed he

is behind bars with no bail mountain of evidence and eyewitness testimony that he smashed paul's head in hammer. the d.a. thinks she needs to hold back key details from the public? not like hammer man is still out and watching the news from his little hideout and police don't want to tip off the investigation. does anybody really believe the pelosis don't have an alarm system? their home? one of pelosi's former neighbors tells the daily mail that everybody in the neighborhood has alarms on the windows and if the glass was ever smashed an alarm went off. this neighbor remembers fleets of black suvs circling the pelosi manchin 24/7. she says they even had monitoring devices that would scram being electronics nearby this was a highly secured house and this guy shows up to the house, smashes through pelosi's back door and it doesn't trigger anything? and according to the fbi affidavit, the only witness was

a private security officer working nearby at a neighbor's house. the complaint says the witness saw a sketchy individual dressed in all black with a large bag on his back creeping near the pelosi house. and then he heard what sounded like banging. and then sirens within a minute? first of all, that timeline doesn't make any sense and second of all, why didn't he call the cops? if you saw a guy clad in black backpack. the person who called the cops referred to him as a friend according to the ther activity. that may be speaking in code we would like to hear the 911 call. the d.a. says she is not going to release that. >> with respect to. >> 911 call. >> the 911 call, no, that's not something we are going to release to the public. we are going to make a choice of whether or not it's something that should be played during the course of his preliminary hearing and, of course, a later

trial. but that's' when that would be made available. >> jesse: san francisco officials say in order to get to depape's criminal history "primetime" has to fill out a bunch of paperwork by hand and drop it off in person. plus, how is it that we don't have a mugshot by now? we know he was illegal alien from canada and we know he has been convicted of a slew of felonies. the police chief announced it on camera. so why are they hiding this? how bad is this guy's rap sheet? i mean, obviously, he should have been deported and if he was, paul pelosi wouldn't be in the hospital. his stepchildren say depape molested them when they were little and depape's ex say they filed a police report but fran screwed the case up and never charged him. way to go, san francisco. this guy should have been deported or in prison for child rape instead of preying on paul. and here's what his neighbors thought of him. >> they are just nudist drug

because no one cares about statistics. they care about how they feel. and what they're experiencing. and what you just expressed is being experienced by too many people because it is the reality all across the state. the issue of crime needs to be addressed much more forcibly. >> jesse: he never addressed it know, did he. does gavin newsom care now? remember, paul pelosi and newsom are relatives. paul's brother married newsom's aunt. can you only imagine how awkward it's going to get at thanksgiving. no wonder good afternoon is pointing fingers, this is all on his plate and his plate is full. turn to attorney mark geragos. mark, have you seen a lot of these types of crimes and criminal prosecutions. what strikes you with how this case has been handled? >> i'm very perplexed by and i was talking about this earlier

today. i don't understand what the basis is for not releasing the 911 call. not releasing the body cam because i have had cases. i have defended case that inexplicably they will release that when i'm arguing hey, don't release that we have got to protect the client's rights and they blah blah blah and no, the public has a right to know, it's transparent. i would like to have one standard for all cases. you either release it or don't release it. but, you pointed out also mug shots is another example. sometimes you will see mug shots. if it's a celebrity that mugshot is going to be out within -- before you are even released from custody in this case we don't have that. how do you complain about misinformation when you are the one -- the d.a. in this case who is not releasing information who is not giving the public the information that they need. mind you, i have said since this first happened that case is

almost a rorschach test for what people's political beliefs are. but the fact remains this guy, by all accounts appears to be unhinged. and there was an article i read the other day that said he is more john hinckley than john wilkes booth. let's understand california has got a serious, serious mental health crisis. >> jesse: i mean, there is tens of thousands of guys just like this wandering around california who could be preying on anybody this minute and never know. look back they probably should be in jail or deported or institutionalized by now. how do you explain police show up and all of a sudden witness paul get hit in the head with a hammer? >> well, that's one of the problems you have got. you can't complain about the misinformation and then have it come out in the affidavit. mind you, this is sworn

affidavit that they filed federally. in the sworn eighth they say when he arrived, mr. pelosi was not injured. they say when they arrived there was a struggle for the hammer and that's when he got injured. well, that obviously is going to beg all kinds of wild conspiracy theories because what were the police doing when they arrived that allowed this guy is obviously unhinged to then take a ball mean hammer or whatever it was to paul pelosi's head. you create the situation by not -- by kind of scolding people about the misinformation when you're part of the problem with the information and the flow information. >> jesse: clear this up body cam, surveillance footage, mugshot. the criminal history. it's that easy and we don't have to fly all the way to san francisco and have your producers hand write a request

flagged or blocked for disinformation, it was because the government didn't like it. and told big tech to kill it. home land security was targeting inaccurate information about everything like covid origins, vaccines, afghanistan and u.s. support for ukraine. which is interesting because all the stuff the government censored ended up being true. turns out covid did come from a chinese lab. and vaxxed people can still get covid. and hunter's laptop was real. and we do have boots on the ground in ukraine. and the list goes on and on. so the government just got caught red-handed censoring free speech to help the left and then lying about it. so what are we going to do about it? josh hawley ask a missouri senator on the judiciary committee and he he joins me n. what are we going to do about it senator. >> we are going to hold the

people accountable that lied to us. and that includes lying to my face. i sat there and listened by alejandro ma mayorkas who said s boboard is a working group. never met, that's not true. not actually monitoring american speech, that is not true. do you know what really is disinformation, jesse. what's really disinformation is that the biden administration believes in democracy because here's what they think. if you will do what they tell you to do and believe what they tell you to believe and vote the way they want, then they are for it. but if you want to have your own idea or speak your own mind, or look into things for yourself, then they will monitor you, censor you and use the government against you. jesse, that, right there, that is a threat to our democracy. and we have got to do something about it. >> jesse: i'm hearing there was a rumor control board. they are interested in controlling rumors. i mean it, sounds like a little teenage girl to me but, senator, the president of the united states is going after rumors? how about inflation?

>> yeah. i mean, how about abiding by the constitution. why don't we just start with the basics. is it too much to ask that joe biden actually get up and say yeah, i believe in the first amendment. it's right there in the constitution. yeah, i think that you have a right to make up your own mind on these issues. but he doesn't believe that, jesse. this is an administration, let's never forget, that took a list of people in to public who and read their names who they wanted deplatformed. kicked off of the major media platforms and social media platforms they are open about it. they are censors, they believe in censorship. they think the government should have the power to do it and of course to collude with big tech. i tell you nothing would be more antithetical to the first amendment or dangerous to free speech in this country. i say again republicans have got to do something about it. republicans need to pledge right now that if and when we come back into control of congress, we are going to go protect free speech, we are going to hold these people accountable. if we need, to we are going to have impeachment hearings for

huge single group of 450 crossed illegally into normandy, texas. a tiny little town on the northern outskirts of eagle pass. and as you can see from the video, almost all of these people are single adults. a large majority of them are coming in from countries that, for the most part, are not subject to title 42. that means a lot of the people that you see in this video here will be released into the united states after they are done being processed. those migrants know that that is why they show up and give themselves up and they are willing to turn themselves in. then, take a look at these photos out of the san accede degree area. border patrol out on control. four heavily armed suspected human smugglers who bailed from the area and left the weapons behind. some of the weapons we this were four ar-15s were several high capacity magazines government was notified and recovered.

you will see migrants crossing the river. several of them are carrying foreign flags. one guy has a massive venezuelan flag. then you are going to see a line of border patrol agents arrive and try to push them back. those agents are armed with paint ball guns and they start firing pepper balls at these migrants. why do they do that? cpd say these migrants got physically combative and started assaulting agencies. one agent hit with a flag pole and one migrant threw a rock at a border patrol agent and injured him as a result the border patrol agents fired those pepper balls as a crowd control method and were able to push all of those migrants back into mexico. the activist who shot this video tells us she did in fact see some of those migrants throwing rocks at border patrol. and back out here earlier today, cbp commissioner chris magness released a statement on this where he pointed out that it

initially looks like some of these migrants did get physically combative and assaulted his border patrol agents and as a result, those agents had to defend themselves with those pepper balls as they are trained to do. he says cpd will now officially launch an new mexico, jesse. >> jesse: americans are afraid of crime but the left is in denial. >> the republicans coming up to the next election which is next week by the way. all they do is talk about crime, crime, crime. i looked it up. murders in major cities have fallen by 4% so far in 2022 compared to the same period a year ago. so, crime is not on the rise, it's actually going down under joe biden. >> jesse: well, that's not true, joy, murders may have trickled down from extreme highs. but violent crime is up in all the major cities. so, crime is not going down under joe biden. while the media continues to
