a little baseball, made a call to the bullpen, summoning president biden's former boss, barack obama in the hopes of averting a g.o.p. red wave in the midterms coming up next week. former president said to make remarks today in the grand canyon state of arizona where key races are definitely tightening. and the g.o.p., without a doubt, has momentum. let me first show you the arizona senate latest survey from fox news. as you see right there kelly leading masters but it is within the margin of error and by the way i should point out libertarian candidate mark victor has dropped out of that race and throwing his support behind mr. masters who you probably know was down by 6 points in the very same survey conducted back in september. that should tell you a bit more about the g.o.p.'s momentum. speaking of momentum. let me show you the arizona gubernatorial race. kari lake out in front of ms. hobbes. 47-46. there some polling out there, i

average of all of them. steve: all the polls, indeed. >> ainsley: barack obama is going to arizona today blake masters and mark kelly are tied in that third party libertarian candidate dropped out of the race and endorsed masters for senate. >> brian: huge. >> ainsley: that could be big for him. he is going to be on our show u.s. senate candidate coming up at 8:00 a.m. >> steve: in the meantime you i am sure you were watching last night. if you tuned in 6:00 it was a special "special report" he and martha mccallum were holding a town hall from the great state of ohio. what they did have both the candidates. tim ryan long time politician and j.d. vance a political newcomer. they were not on the stage simultaneously. they spoke to them one at a time. mr. ryan was first. j.d. vance was second. and they talked about all the things that were of interest to folks in ohio because ohioans would ask about crime and the economy and abortion. >> 22 weeks is the law in ohio

right now. that's more than four and a half months -- it's five months pregnant. i mean five months is a long time of being pregnant. so that's not an okay time to -- 22 weeks? you don't agree with your state law. >> no, i don't agree with our safety law at all. because, if you get raped in ohio, it is state mandated pregnancy. >> martha: you have five months to have that abortion in ohio. >> well, you would. but sometimes -- sometimes if there ask a medical necessity, if there is a medical problem, you don't know that until the end. i'm pro-life. i am pro-life. there is a very, very important question about whether this should happen at the federal level or at the state level. i hand to think it should be a little bit of a mix. how far is going to want to have a different abortion policy than california. every person in ohio whether you are pro-choice or pro-life like i am absolutely should be able to make that decision. >> steve: they asked -- they followed up with mr. ryan about abortion. wouldn't have you any limits? he said he would go back to roe, which really didn't have any limits because, essentially what bret and martha were trying to

get out of them was, you know, shouldn't -- isn't 22 weeks enough? but mr. ryan felt like well, let's go back to roe. which we have heard a lot. >> carley: inflation is the number one issue because everyone is feeling that you know, senior citizens, a lot of them would care about abortion. some of them are saying that's not something that i'm going to have to deal with in my life but inflation is because you go to the grocery store and we are paying more for everything. >> steve: everyday. >> ainsley: once a premier battleground state in 2004 george w. bush won. 2008 and 12 president obama won that state by less than 5 points. 2016 and 20 the state went for trump. vance is the best-selling author. he was a former hedge fund executive and he was endorsed by president trump. and trump was there at a rally with him in september and said ryan is just pretending to be a moderate. he's not. he is radical left. ryan says he differs from president biden on the border security and student debt relief. >> brian: yeah, i mean, that's the frustrating thing is that

are you the person who your vote says you are or are you saying who you are now? without admitting i have changed my mind. one thing about tim ryan, you cannot find the word democrat in any of his material. he says it's a poison news, toxic mix. why did you vote with nancy pelosi the entire time? i admit tim ryan, when he first came out of the box he said i'm going to be a moderate. took on nancy pelosi. he refers to the old tim ryan, not the one that ran for president who seems to be pro-criminal, light on crime, never voted for the border wall. never voted to crack down on things like we saw yesterday with the storming on the border. never expressed any outrage about that. so, then he is saying i'm a moderate democrat which is reflective of the people of ohio. fine. but, where were you when manufacturing was leaving. where were you over the last few years taking on your own party? you were invisible. so, unless you are going to admit i have changed my mind on everything, i think you are

duping the american public. last night he was pretending that he didn't have a track record on all of this. >> steve: well, it was very telling when he was asked by a won about, you know, you voted for the inflation reduction act. how is that going to reduce my inflation now? and he said, truthfully and said in the short-term it's not going to then he said people need tax cuts to help them through this time. 40% of the country doesn't pay federal tax. so they don't need a federal tax cut. what they need is they need cheaper energy. and his party refuses to expand domestic oil production because if they did that would bring the price down and ketchup wouldn't be 8 bucks, mayonnaise wouldn't be $9. a box of cereal wouldn't be $10. >> ainsley: some of these newcomers are going to do well because hermine are saying in that state, in ohio, well, you had your chance tim ryan just like they are saying in new york you had your chance kathy

steve: let's talk a little bit about what happened on our southern border. ainsley just brought up a great point. remember when it was alleged that those bad border patrol agents on horseback were whipping the migrants from haiti? turns out that never happened. >> ainsley: number one top story. >> steve: in the whole wide world. fast forward they for the most part have been exxonner rate offed. there was no whipping. now there is a story out of el paso where there was violence but it wasn't directed at the migrants, it was directed at border patrol. >> ainsley: that's right. so what happened these massive group of illegals crossing in on monday over into el paso, texas, they were waiving this large venezuelan flag. >> steve: there it is. >> ainsley: they attacked the border patrol agents before being pushed back into the river. the agents had to use the crowd control measures like the pepper balls. they assaulted one of the agents with a flag pole and threw a rock. >> brian: wouldn't it be great to get a statement from the administration how they support the overwhelmed cbp who are

threaten tariffs on mexico president trump in order to get them crack down on own border instead of giving a pass through and train to ride on top of it. now we don't do. it doesn't seem like we engage mexico in some type of cooperation. >> steve: if mayorkas defenders them, we will let you know. speaking of washington, d.c., it turns out capitol police security cameras did capture the break-in as speaker nancy pelosi's san francisco house. the guy with the hammer, the problem is nobody was looking at the cameras. >> brian: little by little we are getting the facts. that shocking revelation comes as paul pelosi's hammer suspect is charged in court. >> ainsley: todd piro joins us with details. >> todd: d.a. brooke jenkins was pressed on whether there was a security alarm system in place at pelosi's home at the time of the attack and here is how she responded. >> at this time the only thing i will say is that there was no security present. there was no capitol police. there was no private security present at the time.

>> todd: that answer comes as sources tell fox news that capitol police officers were not monitoring surveillance at the pelosi residence. instead, they were watching a live feed of many cameras around d.c., including the capitol complex. an officer finally realizing something was up after seeing a feed with police lights flashing on a dark street outside the pelosi residence. in court yesterday, david depape pled not guilty to a slew of felony charges including attempted murder, residential burglary and assault with a deadly weapon. court filings reveal he told police, quote: i have didn't really want to hurt him you know this is a suicide mission. i'm not going to stand here and do nothing even if it costs me my life. house speaker nancy pelosi did visit her husband yesterday as he continues what is expected to be a long but full recovery from that attack. back to you. >> steve: all right, todd, thank you very much. >> it's frustrating to know that had somebody been looking at the monitor and seen the guy break into the house, mr. pelosi might not have gotten whacked in the head. >> ainsley: i wonder if maybe

steve on this wednesday morning, there is a manhunt in new jersey for the suspect who shot two police officers yesterday. they were trying to serve a warrant to kendall howard who allegedly opened fire on them. the fellow officers in blue reportedly rushed them to the hospital where they are in stable condition this morning. adding to the more than 280 officers shot so far this year in the u.s. of a. retired new jersey police department detective lieutenant steve rogers joins us now. steve, initially there was some confusion, there was a story out, okay, it was newark. there was some on a roof top shooting at cops, that was not right, was it? >> no, it wasn't. it was a close range shooting. there is still some more information that has to come out as to how this occurred. but it was close range. there was no one on a roof. and, unfortunately, these police officers and they are heroes, believe me, every cop is. you never know what you're

walking into. they tried to execute a warrant and, unfortunately, it turned out to what we are talking about this morning. steve: sure. you know, and just across the river here in new york, we know, famously, that the d.a. is soft on crime. this happened in newark where, for the most part, the prosecutors and the d.a., they are tough on crime. >> well, i will tell you, newark is a great city. it's growing. i have spoken to some residents in newark after the shooting. they love the cops. they feel the cops are doing the best they could to protect them and the mayor there is doing a terrific job with the police department, the sheriff's department, the prosecutor's office a great team there trying to prevent crime. but, if i may, what we are seeing is a ripple effect from washington, d.c. these policies coming drown from the federal government causing criminals to be loose on the street. remember the say going you commit a crime you will do the time? the new saying is commit a crime and you won't do any time. >> steve: unfortunately that

seems true, particularly in the town i'm sitting in. you know, it's extraordinary, they know the name of the guy they are looking for who allegedly shot the cops. kendall howard. there's a manhunt underway. it's just a matter of time until they find him, right? >> oh, they will find him. yes, they will find him. again, i cannot over emphasize the fact that the prosecutor office in essex county, newark communities working together 24/7. they will find this guy and find him soon and hopefully they will bring him to justice soon. >> steve: ultimately, steve, what this does is frames, once again, how important the police officers are and how very complicated and dangerous their lives are. and, you know, dan bongino, famously has said on this program before, you know, when he was a cop and he would put on that kevlar vest in the morning, he didn't know for sure if he was coming home that night.

and that takes its toll not only on the officers but on their families. >> yes. 's times when i was on the job i gold i remember calling a car over for inspection sticker and there was a gun in the car. you never know what you are walking into. we have learned in the police academy the person you are approaching knows who you are but you don't know who they are. so, we need to have our government agencies from washington to local government back their police, stand firm with elm. this give them the ability to enforce the laws and do their job. in newark they have been doing that. i mean, it's turned into a city that's really being run well. and i don't believe this is going to turn anything around. it's permanently hurt the city of newark. you the fact of the matter is it starts in washington. it ripples down to our local communities we need to back the blue and our local communities all the way up to the federal government. >> steve: you know we certainly do on this program. lieutenant steve rogers, we thank you very much for joining us today from new jersey. thank you, steve. >> my pleasure.

new york. >> brian: voice of the people. thanks, will. >> ainsley: let's check in with janice dean for fox weather forecast. good morning, janice. >> janice: severe weather on the way. take a look at the maps. very warm across the central u.s. and that cold front is going to crash into those warm temperatures. getting into the 80's across the midwest today. so we do have a system that is moving over, you know, tennessee, kentucky, a weak system there our next big storm is moving from the rockies into the plain states in the next 24 to 48 hours. bringing a lot of snow to the higher elevations here. and then the severe threat for parts of the central u.s. thursday evening. so, as this develops, watch what happens, it gets more widespread, large hail, damaging winds and tornadoes. heavy rainfall could cause some flash flooding. so that's going to be occurring in parts of texas, into louisiana and arkansas as we get into thursday and friday. so that's the big story as we get into this week. and then the heavy rain will cause flash flooding as that system moves slowly across the plain states.

the oil industry is not doing the right thing. one by one major oil companies have reported their profits for the last two quarters. i mean profits so high it's hard to believe. >> brian: president biden making his message clear as he continues to hammer into oil and gas companies as if they are the problem. americans facing soaring costs ahead of the winter and they're the problem. the average price the diesel gas is up more than 40 cents a gallon. almost $2 sings this time last year. michael mansfield hears all this rhetoric. the ceo of mansfield oil and energy. michael, is the problem oil companies like you guys making profits? is that the problem? >> brian, there is simply a shortage of products as compared to three years ago. you know,. >> economy has come back a great deal since the pandemic, but our refining capacity in the united states is about 1,000,300 -- a

little over a million barrels a day of less capacity than we have had in the past of these -- been several refinery shutdowns, these refineries won't come back online and the product is not as available as it once was. we have to import more or just simply pay higher prices. >> brian: get ready, your prices are going to go up and not because you want to make maximum products because you can't refine. diesel gas today is 5.31, last month 4.87, last year 3.63. michael, why are these refineries taken off line? >> there's a number of reasons. for example, the big refinery that was located in philadelphia had, you know, was a very old refinery but it had a lot of maintenance issues and there was,s a you may remember, a big fire. that one is gone. there has been refineries in the u.s. gulf coast that had hurricane damage. they have come offline. others have simply closed just

because the cost of the regulatory costs of running the refineries has gotten to the point that they simply can't do business anymore. so i believe there is about seven less refineries in the u.s. today than there was in 2019. >> brian: michael, do you resent, people in your business all aspects people that deliver the oil to people who pump of the gas, being vilified like this? >> well, i think there's a lot of misinformation about how this industry works and, you know, where profits are created or not created. i do think this industry does an extraordinary job and it's very innovative in trying to keep the country supplied. moving products around as efficiently and quietly as possible it is worrisome it. would be helpful to pay more attention dynamics and less
