>> trace: the man accused of last week's hammer attack on paul pelosi has pled not guilty to several state charges in connection to the assault and is also facing. serious federal charges that could carry up to 50 years in prison. on the docket tonight legal discussion of the case against 40-year-old with criminal defense attorney brian claypool. i want to play this from adam lipson who is his public defender, watch. >> we have little information about this case at this time there's been a lot of speculation a lot of rumor simply based on the nature of this case. as of right now haven't even seen the police reports. >> trace: a lot of people haven't seen a lot of stuff, you think they are being transparent? we don't know if the body cameras going to be released, we don't know about the 911 call. >> i think there's a lot of unanswered questions. for example to the alarm go off?
9:50 pm
i think they would have a serious alarm system at the house and also what baffles me is during this exchange, why the assailant would just allow pelosi to go to the bathroom, the whole thing is bizarre. at the end of the day with the public defender was talking about today is that the defendant was in a mental health facility being examined. i expect they're going to raise issues of what's called diminished capacity in california which means this guy had some kind of mental issues defeats the intent. it reduces the crime to a lesser charge. i'm sure that's what his lawyer is going to do. >> in ohio is going after dollar general which is the dollar store saying they are allegedly selling things above the advertised price. they say the acceptable rate you got to be within 2% they are thinking dollar general range between 16 and 88%. and other words they are charging you a couple of bucks on things they say is a dollar, they got a case?
9:51 pm
>> i remember this going on with doordash during the pandemic, you're talking about how they are ordering something and it's $5 more you look at the print and if it's after 6:00 at night -- clearly this is deceptive advertising. get somebody to take it off-the-shelf for a dollar -- i know i'm not going to be popular for this but i have a defense which is -- drumroll, if you see it for a dollar a negative the cash register and they say two then say i don't want it, don't buy it. >> trace: it's one of those kings, we are charging you a dollar for things and it's actually two at the counter, it is bad practice on dollars fault. somebody needs something they go to dollar and they think there's two bucks you like i have $1.20, i don't have $2. >> no kidding aside, we are in the middle of a terrible
