sure that judges and prosecutors charge appropriately. >> dana: fox team coverage. griff jenkins covering the election battle for new york. lee zeldin is closing the gap in his campaign to unseat hochul. karl rove bringing in his insight. david lee miller has more on hochul's response to the murder and the growing crime crisis overall. good morning, david lee. >> despite growing controversy new york governor hochul is not backing down from her support of the state's bail reform law. opponents of the law saying it is to blame for the death of the young mother of three shot to death by her estranged husband. i the attack was caught on video. it appears to show her being beaten and punched by her estranged husband last month. adam was charged with third degree assault and other miss demeanors. that required a judge to release

him without posting bail. his previous criminal conviction of attempting to kidnap a former girlfriend could not be taken into account. the only thing the court did to protect the woman was issue an order of protection. addae after the man was released he shot and killed his wife as three of their young children looked on. he has since been arrested and charged with second degree murder as well as three counts of endangering the welfare of a child. the dead woman's mother blames new york's law and one of its most outspoken supporters governor hochul for the murder. hochul says she understands the pain of a grieving mother and she is willing to consider changes to the state's bail law. >> i'm always willing to take another look again to make sure we protect the citizens of the state. my number one judge and what i'm focused on that obligates me to look after their safety and

because their wallets, safety, freedom, quality of their kids' education is under attack. when you have to wake up to video pictures and stories of people being pushed in front of a subway or a green goblin gang. people beaten on a street not just inside the city. you are seeing stories from across the state. >> as for where the candidates stand on what they'll do about crime if elected hochul pledges to toughen gun laws. zeldin says he will declare a crime emergency and suspend cashless bail. while hochul has the vip rally today zeldin will also hold a rally with congressman stefanik. >> dana: the final favor days of the campaign. a new poll shows voters prefer republican control of congress by four points 48 to 44, 8 point swing from just august when democrats held the advantage 47-43.

we'll bring in karl rove former white house deputy chief of staff and somebody who wrote this in the "wall street journal" today. what to expect in the 2022 mid-terms. you said the gravitational forces inflation, economy, crime, border security, mr. biden's approval rating. voters feelings about the country work to the republican advantage. do we need to have -- for the republicans looking at this saying great, good, everything is wrapped up, do they need to have a little caution? some of these races are so super close. >> they better not sit on their hands. they have to push through to the end of the campaign. democrats have a lot of good candidates, a lot of money and they have the power of the white house. the republicans should prevail in the race for the house and i think the senate as well but only if they push hard in the remaining days. lots of races are up for grabs and lots of race rest undecided. >> bill: you tell us, karl. what are you watching for on

tuesday night? >> well, i actually i have -- there are touch points. we begin with the closing of the polls in indiana and kentucky at 6:00 p.m.enter there are no seriously contested races in these parts of the states that close only part of kentucky and indiana close. i will be looking at those congressional districts to compare the results from 2020 to 2022 results to find out how much of a swing there is against the democrats which we're likely to see in these races. this swing is going to be very important throughout the entire night. if there is a 2 or 3 point swing against the democrat performance in 2022 a certain number of losses. if it's 4, 5, 6, 7, 8 point swing there will be a lot more. i'll be looking at that. followed at 7:00 by georgia and virginia. georgia a big senate race, big governor's race tied together. if kemp wins re-election by a serious margin we're likely to

see herschel walker doing better. virginia will give us an indication what will happen in the house there. three highly competitive races. if the republicans win one a good night. two a great night. if they win all three watch out, it will be a slam dunk for the republicans. >> bill: virginia counts quickly, too. why do you compare it to 2020, which was a presidential year, and not 2018, which was a similar mid-term? >> well, for two reasons. one is you're right. 2018 is a mid-term, this is a mid-term as well. mid-terms are a judgment, a referenda on the incumbent port. the downward pressure on 2018, the people walking into the wind were the republicans. this year the democrats are in charge. they have the white house and the congress, so the downward pressure will be on them. so if you go back to 2018, you will see not much change. you will see a lot of shift

against the party in power but it is going to be confusing with regard to the outcome of this election. i'm looking at 2020 because that is the baseline for this election. that's when the democrats won the house races that they won, that's where we got a sense of what the democrat ceiling might be given the presidentall vote, and so i'll be comparing there to see how much risk the democrats are in compared to the 2020 number that they received. >> dana: i know you look through a lot of numbers but you also have strong antenna. you are there in las vegas, a couple of big races there especially the senate race. what is your feel on the ground? >> well, talking to people, the locals, first of all i was having lunch yesterday and literally the midday news, i didn't -- i think i saw one commercial out of 40 or 50 commercials that ran during this

program that was unconnected to the election. the rest were a steady stream of attacks on -- by republicans on democrats and democrats on republican. a lot more democrat ads than republican ads. my sense is talking to people they think the republicans will take both the senate and the governor's seat and also think the republicans will take at least one if not two and maybe three of the state's congressional seats that are based in southern nevada. las vegas has slightly more than 2/3 of the state population. one is in the north based on reno with a lot of territory in the north but the other three are located in the southern part of the state and at least two of them are thought to be really contentious with republicans ahead in both. another one is a toss-up. so this could be a very amazing night for republicans in nevada. remember, biden won this state by just over 2%. so this was a tight state. wasn't as close as georgia and

mexico we're the second most violent state in the country. we catch and release with no bail. we have a border situation that continues to pump up fentanyl into the state of new mexico and not only that we're a sanctuary state, too. right now what we're seeing is a spike in violent crime. in the same time this governor has lowered our total number of prison population by 26%. so she is letting people right back out on the street as crime continues to spike here. homelessness is out of control with no plan and then you are absolutely right on education. that's even worse, bill. we're 51st in education now that they count washington, d.c. only 13% of new mexico kids can do path to proficiency. >> bill: you have work to do. the border was on there. you have a slim border with mexico. donald trump endorsed you. what does it do for your campaign? >> we're excited to have a lot of support across the board. when you look at where we are as

a campaign we have had support from youngkin and people across -- democratic sheriffs in the state of new mexico. we're trying to get a coalition of people together that realize the government in sante fe and this governor no longer listens to the people of this state. i don't care what party you are from. people in the state of new mexico have had enough and even though it was a biden plus 11 state it's the reason we'll win it. >> bill: two minutes, two questions. energy is big in new mexico, huge potential in that state. what would your policy be? >> i think right now we're having all of the above policy. we're the number two energy producer in the country behind texas right now. no one produces oil and gas more cleanly and efficiently than we do. if people look at their energy bills they continue to skyrocket. new mexico will help fill the gap. we'll be not only an oil and gas state but huge renewable and

invest in nuclear as well. if you look at what is happening in europe now with natural gas prices, when they stopped producing energy, they became a real target for what was happening throughout a big part of europe and throughout russia. i think we have a real opportunity to help fill that gap in the state of new mexico. >> bill: i haven't seen a ton of new polling out of your state head-to-head. how close is this race? >> we're up one and emerson has us down two. this is right there and right where it needs to be. we need help from everybody across the country right now as we get ready to win this race. we were back a little ways i think earlier in the summer. we have gotten rid of that gap. every town we go to in the state is fired up for change and we would love help from anyone go to our website. we'll win this race, bill and be won because we have a governor who stopped listening to the people of this state and started serving herself. >> bill: it could be a late night or early morning. >> it probably will be.

there? >> that's right. 64% are highly motivated to vote and we found that 80% don't feel that their interests are well represented in government right now. >> dana: what are the issues that they are most concerned about? >> top issues our survey found were economy, affordability and education and voting rights. more than 90% believe all of those are motivators to vote. behind that are abortion rights as well as gun safety reform. >> dana: tell me more about the education piece of it. what part of education? >> the survey looks specifically at things like ethnic studies, inclusion of asian american stories. an overwhelming majority believe there should be more inclusion of asian-americans and people of color stories within our curriculum. we're voting on the state board of education, tomorrow is the last day of early voting.

tuesday is election day. they'll continue to look at the update of the social studies curriculum in texas that impacts not only texas kids but because of a lot of publishers take texas curriculum and use them for students across the state. what we teach in schools in texas impacts the entire country. >> dana: asian texans for justice. do you lean conservative, liberal, either way or nonpartisan? >> it's a nonpartisan organization. we found around 40% of asian texans identify as democrats and 30% as republican and 30% as independent. >> dana: additional outreach here this is from the apia vote survey. they found the democratic party had reached about 52% of the time. republicans had reached out 60% of the time. does that tell you anything about what the parties are imagining especially because as we said in the opening, as a

voting block, super important and possibly decisive especially in texas. >> uh-huh, yeah. it was the democrats were doing a slightly better job of reaching out across the country to asian voters than the republican party. one of the interesting things we found in our texas survey is asian texans who identify as republicans lean to the left on a lot of issues such as supporting medicare for all texans, freedom of choice for abortions and most or all cases and gun safety and gun reform. >> dana: what about -- how do the texan ashian americans compare to the rest of the country? is it regional? >> we're far outpacing the growth of asian-americans even nationally. the asian american community is the fastest growing community in the country. in texas we're outpacing that
