before. welcome back as "america reports" rolls into a second hour. john roberts in washington. big day, sandra. >> sandra: and here we go. i'm sandra smith in new york. kicking things off with fox looking live across america and we'll start in arizona. we are expecting to see republican candidate for governor there, kari lake, casting her own vote in phoenix. that is a live look at the lines there. she changed her voting location after word from officials in maricopa county that some tabulators were having issues. we will keep an eye out for lake and update on that situation. >> john: next door in nevada, some people could have trouble voting for a different reason, snow is forecast to start falling around reno, potentially keeping voters off the roads. but at the moment, long lines and no snow yet. >> sandra: and moving west, midwest, governor whitmer fighting to hold on to her seat

but making headlines after her apparent audio malfunction meant she did not answer a tough question on covid lock downs. her republican rival is calling foul on her. you can decide for yourself. >> john: one of several hot governor races. a live look at miami-dade county, republican voters outnumbering democrats at the polls by around 7,000 as of this afternoon. >> sandra: that's welcome news for republican governor ron desantis, fighting off charlie crist who is now a democrat. >> john: the race in georgia. >> sandra: stacey abrams in a rematch against brian kemp she long claimed she beat the first time around. >> john: as far as president biden is concerned, all comes down to the senate. the president's agenda and his legacy is on the line tonight.

we have fox team coverage of the races that will make all the difference. bret baier will be at the helm later on. for now, standing by to be with us. bryan llenas on the keys in the keystone state, and hillary vaughn on new hampshire senate candidates closing message. >> sandra: the tabulation problems out of maricopa county, what's the update from there, alicia? >> hi, sandra. still working on getting more details from the county. timing could not be worse, especially when you consider that this is arizona. 20% of the tabulation machines in maricopa county are malfunctioning, which means the ballots are not being counted at the election sites, how it would work if the machines were working correctly. now, the county says that the back-up system went into effect immediately, the ballot drops into a secure box and then sent to central phoenix to be counted tonight. here is republican maricopa

county supervisor bill gates explaining how that process mirrors the process already underway in other counties. >> in a majority of arizonhow t. they don't have the option to actually see the vote counted right there at the vote center or the precinct. instead goes back to central. >> they also say that they have workers trying to get these things fixed and you'll be hearing a lot about door number three on the machine. according to the county election officials, that's the slot the malfunctioning machines will drop the ballot into, it's secured. and again, that box will be transferred to the central downtown location to be counted tonight. everyone is watching that count closely as control of the senate could come down to whether or not republican blake masters is successful in his bid to replace incumbent senator mark kelly. almost as tight, republican kari lake and democrat katie hobbs.

sandra, 300,000 people are expected to vote in-person here in maricopa county. 80% of the voters here in this county have already voted leading into today. it's going to be a long night. sandra. >> sandra: alicia, thank you. >> john: from the grand canyon to the granite state, don bolduc is hoping to pull off an upset victory against democratic senator maggie hassan. hillary, a lot of republicans are hoping that bolduc can pull this off, considering how democrats tried to get him in the position because they thought they could beat him like a rented mule. >> exactly. democrats outside of new hampshire, john, poured millions of dollars to boost him in the primary because they thought he would be easier to beat. this race has narrowed down to a dead heat and now republicans actually see a shot to flip this seat. republican candidate retired

general don bolduc has chipped away hassan's lead. hassan said it's no surprise, she knew the race would be close. both candidates casting their votes today. her closing message to undecided voters is democracy is at stake. >> are you concerned if you win by a very small margin he won't concede? >> you know, he has been working to cast doubt on today's election which is an insult to the people of new hampshire. don bolduc is casting doubt on today's election integrity is really disturbing but we are going to keep standing up for the people of new hampshire and standing up for democracy. >> today caps off a two-year campaign marathon for general bolduc, we caught up with him today. he tells me he has put in the time, confident it will pay off. keeping the focus on rising costs of heating and eating and

he tells me he will respect whatever new hampshire voters decide tonight. >> set the record straight, if you were to lose tonight, would you concede? >> well, yes, of course. this is just another example of her being out of touch. she's worried about something that has not happened yet. i'm worried about stuff that has happened and affected the livelihoods and future of our children, grandchildren and our great grandchildren. she doesn't even talk about that. that's the fundamental difference. >> and john, the new hampshire secretary of state telling me today they are expecting record turnout for a midterm election. so far, strong and steady. 90% of new hampshire voters show up and vote in-person on election day and john, for a lot ever them it's a game day decision. john. >> john: that's what i love about new hampshire. it's old school all the way to the bone. hillary vaughn, thank you. sandra. >> sandra: john, now to

pennsylvania, dr. oz and john fetterman heading to the polls. more than a million people had already cast their votes in that stays. so, how is turnout looking, bryan, hello. >> hey, sandra, good afternoon. turnout is good and steady and every vote counts in a close race between oz and fetterman. not only is it close, it could take days before we know the winner. this is a live look, a web stream showing mail-in ballots being processed in philadelphia. that looms large here. under the law, counties had to wait until 7:00 a.m. today to begin sorting mail ballots and must work overnight until the count is done. initially philadelphia said they could be finished counting mail ballots by wednesday morning but now it could take days to complete after the board of elections voted this morning to reinstate a security procedure to try to catch double votes.

another key factor is undated or incorrectly dated mail ballots. the pennsylvania supreme court ruled these ballots should not count. yesterday the fetterman campaign filed a lawsuit arguing that they should. it's not clear, though, how many ballots the court's order will invalidate statewide but it could be thousands and that would most negatively impact fetterman, since 70% of the 1.4 million mail-in ballots sent were to registered democrats. both dr. oz and fetterman voted this morning, and this was their final message to voters. >> i'm very proud how i've run the campaign. pennsylvania sent a clear message to washington. we want less radicalism and more balance. so i encourage everyone to vote. it's your duty. >> every day i feel better and better. by january i'll be even better. [cheering] but, but, dr. oz will still be a

fraud. >> bottom line, if it's a razor thin margin tonight, buckle up. remember, dr. oz won his primary here by fewer than 1,000 votes and that took 17 days to sort out. sandra. >> sandra: bryan llenas, thank you. >> john: bret baier, co-anchor of our special coverage tonight, a very, very big day for you and martha. if you get to bed before 6:00 a.m., i'll be surprised. so, what do you think the vote is going to turn on? inflation, will it be the economy, abortion, threat to democracy, what do you think voters are deciding today? >> john, i mean, if we believe the polls and that's a big thing, believe in the polls going in, inflation and the economy drives the day across the country. really every state where there is a tight race, that has been the message. which is why republicans are well poised going into tonight, especially in some of these

races that are really tight. i would be surprised if we have all the answers tonight, but we will have some. and it looks like you are going to know more about the house situation earlier on than we will about the senate. a lot of these senate races are really, as you know, on a knife's edge. if it turns, we could have an answer. if it doesn't, we have to wait for the states that start counting this morning as bryan just mentioned and go into tomorrow or the next day. >> john: as we were talking with salina a little while ago, the vote in pennsylvania she thinks it's going to come in faster than we expect. a good chance we may not know for days and with the tabulation problem in maricopa county, as close as that was in 2020, how is that going to affect the vote count as well. one of the big questions, bret, we have been mulling over, who has the edge on messaging here? was it the democrats or the republicans, when it came to resonating with voters.

hillary rosen thinks the democrats blew it big time and she did not hold back in saying that. listen here. >> i'm a loyal democrat but i am not happy. i just think that we are, you know, we did not listen to voters in this election, and i think we are going to have a bad night. when voters tell you over and over and over again that they care mostly about the economy, listen to them. stop talking about democracy being at stake. >> john: when it's your president who is getting a lot of the blame for the bad economy, it going in the wrong direction, the nation in the wrong direction, and inflation in the mid 8, sometimes hard to run on the economy. did they pick the wrong issues to run on? >> i think now a lot of those pundits are turning around and saying listen, this messaging was not one that got a lot of independent voters or voters fired up. they are dealing with trouble at the kitchen table, making the bills come together. i think van jones said something similar on cnn, james carville

on another station who said no matter what happens tonight in these close races, the messaging needs to change for democrats going into 2024. i do think the abortion issue still has power, and the overturning of roe v. wade in some corners, especially suburban white women, suburban women in general, but also plays the other way, and you know, there are hispanics and african americans who have a problem with abortion, period, but abortion after 15 weeks, you know, it does play a different way in a part of their base. >> john: so one of the big questions after tonight will be if republicans take control, what does the future look like for a glimpse behind that curtain, we went back to 1994 and the architect of that big house victory. newt gingrinch and he told us how he and bill clinton came to an agreement to work together after that, and we wonder if biden will do the same thing. listen to what he told us. >> and bill clinton's case, he

had to overrule his staff. his staff wanted him to stand firmly for the left wing and fight us every day and he said to them, if i do that, i'll get defeated. he said i've got to cooperate with newt or i'm not going to get re-elected and then he comes into the state of the union and says the era of big government is over, he signs welfare reform, the biggest capital gains tax cut in history, you know, pretty hard at that point not to find some common ground. >> john: a few seconds here left, bret. do you think biden might look at a republican sweep and say ooh, i've got to go with the bill clinton model from 1994, or will he just stick with what he's been doing so far? >> i would tend to believe biden would go into more negotiating mode, if that's the case, dealing with a republican senate and house. we don't know for sure. but we do know that's how washington sometimes works best is when it's split government. we have seen it before. >> john: all right. looking forward to your coverage

>> john: fox news alert, arizona gubernatorial candidate and former news anchor kari lake casting her vote there, just outside of phoenix. she changed the place she was going to cast her vote after a lot of those machines in maricopa county had problems with tabulation, so she arranged, we understand, to go to a different polling location where there are not problems with the machines. again, as alicia acuna has been reporting on, about 20% of the machines in maricopa county are not counting the vote once it has been filled out, so election officials are use and back-up system to either let people use a different machine to tabulate the vote or put it into a drawer

which will be taken securely to a vote counting place tonight and be counted either tonight or tomorrow morning, according to election officials. kari lake was leading going into today. see if she can pull it off later tonight. georgia's elections once again in the spotlight as early voting saw record turnout. this as republican herschel walker looks to unseat incumbent rafael warnock. aishah hasnie live in akworth, georgia. >> good afternoon to you. turnout has been pretty steady and smooth. we are not seeing very long lines at all, about a 12-minute wait is the longest we have heard of in the entire state. you talk about early voting, i have to tell you that both of the u.s. senate candidates went ahead and voted early. so neither were voting this morning. i want to break down what we are looking at here in georgia. more than 36% of the state's

nearly 7 million active voters have already cast their ballots. that is huge. that includes 2.5 million of those early voters. election officials do hope to report early voting results around 7:15 p.m., around 15 minutes after the polls close because georgia's new voting law says they can start counting those early ballots before polls close. the new law also scales back some pandemic era things like drop boxes, those are no longer outside, it also limits provisional ballots to only those who show up to a wrong precinct after 5:00 p.m., and hearing georgia democrats complaining about that today. both camps are hoping for high voter turnout to break the 50% threshold and avoid a runoff. the pressure on the gop to prevent a repeat of 2020. georgia handed democrats the senates back then, and they say it's more about the issues for

them. >> for me the election was a one-issue election and it was about abortion rights. >> and really motivated you. >> i would have voted anyway but this kicked a punch. >> the importance is to get this inflation under control. >> yes. >> how bad is it for you? >> it's pretty bad. >> it's bad. >> money don't go anywhere anymore. >> and john, we are also watching another sort of issue, election issues here in cobb county, the aclu won a big lawsuit over 1,000 absentee ballots never sent to voters because of a human error. and the judge ordered to overnight the ballots to the folks. as long as they are postmarked by 7:00 p.m. tonight they will be counted. john. >> john: the county joe biden won by 14 points two years ago. see how it goes tonight.

>> sandra: thank you very much. the first polls close in less than four hours. what early clues will help us understand. let's break it down, josh is joining us, your first spin on the touch screen. appreciate you doing this with us. first set this up for us. obviously looking at the balance of power in the house with our power rankings putting 186 seats to democrats, 223 to republicans, but with 26 house races in the toss-up, anything could happen tonight. >> this shows both how big the political battleground map is for the house. but look, republicans already with the lean republican seats pushing their way. already would have a small majority as things stand, as we are expecting these house races to break. so democrats have a big, big uphill battle to hold on to the house. >> all right. that being said, 218 for the

majority in the house, 26 toss-ups. you are looking into a couple key races, and also one that leans republican. set this up for us on how it could go for either party tonight. >> look, this does show the best case scenario for the democrats still has the republican party with a slim majority. but sandra, the size of the republican majority matters as well for kevin mccarthy, for leadership. if it's a narrow majority, 223 republican seats, kevin mccarthy will have a hard time getting things done. democrats could get it back in two years. >> sandra: if republicans have a great night and they win this sizeable majority, that makes a big difference. >> that is a tsunami, a political wave we have not seen in a long time. it would give republicans historic majority and mean that

republicans win districts that joe biden dominated in. >> sandra: set it up for us, three key house races that you are watching. first the east coast, virginia. why is virginia 7th one to watch. >> virginia is one of the first states, the polls close at 7:00. returns in fairly early. spanberger, a district that got redrawn closer to northern virginia, prince william county, culpepper county. >> sandra: you mentioned culpepper, presidential election results of 2020, president trump won almost 60% of the vote in culpepper. >> if republicans turn out their base, and there are a lot of conservative counties in the outer washington d.c. area, if they show up and democrats are not enthusiastic, that's the formula for an upset. yesli vega, also running for congress. >> sandra: middle of the country, ohio, obviously, you are watching this closely

because there is a big house race in ohio's 13th district. why is this key? >> two millennial candidates running against each other in one of the biggest swing districts. biden narrowly carried in 2020, but you've got the akron suburbs, the cleveland suburbs. >> sandra: and summit county, that is important why? >> this is the suburbs, if republicans have a really good night, they are going to be doing very well in suburban areas that joe biden won by about ten points. that would be a sign you can look at some areas that republicans lost in 2020, but are making back in. >> sandra: head out to the west coast, oregon as 5th why? >> progressive candidate for the democrats, jamie mccloud skynard. democrats may have gone too far to the left on crime, on the

economy, and it's a chance to get a big upset. >> sandra: the northwest corner of the state, wine country, one you will be watching for turnout. >> all democratic areas, all areas that democrats should be winning but are struggling right now. >> sandra: got it. you would think you have done this a million times before. thank you very much, sir. good to have you here. >> john: another report of more problems with voting machines, this time in mercer county, new jersey, includes the state capital of trenton. apparently when the board of elections opened some polling locations, machines were not working so the people are being asked to fill out a ballot. the ballots will then be securely taken to the board of elections office and counted there later on today. according to officials, every ballot that has been cast will be counted, no voter will be disin franchised and the integrity of the election is intact and secure. so add that to problems with maricopa county, arizona, keep

>> sandra: two high stakes races in arizona where the border crisis is very much a key issue for voters there. president biden skipped the border while he campaigned in new mexico last week. fox news is on the story as it has been as we have been for months now, i should say. bill melugin is on the ground in eagle pass, texas for us. bill, what is the latest from there? >> sandra, good afternoon to you. under this administration, we have now seen back-to-back years of the highest numbers of illegal crossings every recorded at the same time the lowest

i.c.e. deportations in history, and now over 1 million known got-aways. and today voters have a chance to sound off on that, it is not slowing down. take a look at the video earlier this morning, a big group of 250 migrants crossed illegally at the same time. the border patrol reporting they had nearly 10,000 illegal crossings, that is obviously stretching their agents thin. and here is what happens as a result of that. take a look at the second piece of video. we were recording as groups of migrants started wandering on local highways here, cross illegally, don't know where to go, they are looking for border patrol and something locals often have to deal with, and how easy it is for some migrants to get away if they want to. border patrol here reporting more than 3,000 known got-aways in the last week alone. then the rio grande having, a human smuggler chased by texas

dps, crashes his truck into a gated community. he breaks the front gate, eight illegal immigrants bail out of the vehicle, this is in hidalgo county and they run into a private residential neighborhood where people live, and texas dps found them and took them into custody, but what's what people have to deal with. and lastly, the fentanyl. an absolutely enormous fentanyl bust made by cbp at the point of entry in nogales, arizona yesterday. stopped an 18-wheeler big rig truck and found 776,000 fentanyl pills, 289 pounds of meth, and 55 pounds of heroin. back out here live, not the only bust. on sunday, stopped two carloads, both had fentanyl in them. one car, 204,000 fentanyl pills, another car, seven pounds of pure fentanyl powder. all of that two days and one single port of entry on our southern border.

they see over what a politician says. had the democrats had a stronger closing argument about inflation, crime, education, immigration, the economy, all the major issues that voters have been screaming for over a year are vexxing and perplexing they may do better tonight, too little too late. better off than two years ago, some will say yes, we are not in covid, but you have to be more specific, physical and financial security, national security, border security. now, the piece that sandra just showed with bill melugin is important, joe biden has spent 174 days of his presidency in delaware. 0 of his presidency at the southern border. that's another fact that people know. they know that there is a problem of over 4 million people

walking over into our country illegally, fentanyl pouring in, and a commander in chief, a president of the united states who won't even show up, stand up, put up and speak up about that key issue. and ohio, like every other state is a border state, and tim ryan, run a great campaign, the best democratic candidate this cycle, because he's a fraud. he's bear hugging donald trump in all of his ads about trade and trying to distance himself from the democratic party he votes with 100% of the time. >> john: many people would argue because of the fentanyl crisis and illegal migrants, across the border illegally, are shipped all over the country that every state is a border state. on that point, your former boss has teased that he is going to make a big announcement on november 15th which means people will be talking about donald trump instead of it being my birthday. much to my chagrin. he is expected to run on a platform of fixing the economy, closing the border, and ending crime.

john, a note we are getting some updates from the white house about how the president is spending his day today. we did see a lid was called by the white house at 11:20 a.m. this morning, before the noon pool call time, no public events on the president's schedule today, not a briefing either. but apparently he did do a radio interview, as well as the vice president, and he's making some phone calls from the oval office is what we are hearing. >> john: calling the folks from the dnc, dnccc, dscc, democratic governor's association chair as well and you have to wonder what are those conversations. because when you are talking to the dccc, talking to sean patrick maloney, he may be losing his seat, important governor's races like the state of oregon could go to republicans. i'm sure by and large those were not particularly happy phone calls.
