control of the senate? it is up in the air. democrats at 48, republicans 49. action in three states. nevada and arizona and you have georgia that will not be decided for another month. newt gingrich knows that state very well. control of the senate hangs in the balance potentially and georgia's governor will play a key role in brian kemp. >> a lot will come down to governor kemp. he won a decisive victory with a big statewide organization. i think that he can be the margin to make sure that herschel walker comes from behind to win. it is ironic the two psych knells a row it comes down to runoffs in georgia for who controls the senate. that will make this a very, very intensely competitive race. >> dana: fox team coverage jonathan hunt in nevada. bill mccarne with analysis. let's get to alicia acuna in phoenix, arizona votes are still being counted in two big races. give us your update.

>> good morning, dana. as the count was updated last night into today we saw the margins increase in favor of democrats. but we still have a long way to go in both sides no that. i will get to that in a second. why is this taking so long? according to the arizona secretary of state's office the estimated number of uncounted ballots in the state is 619,000. maricopa county it is more than 407,000. maricopa is the second largest voting jurisdiction in the nation. 80% of voters here were early voters. under arizona law folks are also allowed to drop their early ballot off on election day. on tuesday 290,000 voters did just that. that's a huge jump from 2020 when 170,000 walked them in. >> once they go through signature verification and deemed good signature and audit queue they can sent to the board for tabulation. this number is immense.

but it does inhibit us from having a higher percentage of returns available within the first 24, 48 hours. but it is important that we do signature verify all of those because it is how we confirm your identity. >> then they process the early votes ballots first and then get to the day of voters. folks who walk in to cast their ballot. we haven't seen those numbers from all those people who stood in line to vote. if tradition holds, a majority of those vote republican. when you look at the race boards here first to the senate race, democrat mark kelly is leading republican masters and democrat katie hobbs holds a lead over kari lake. keep in mind you have two tight races here, record turnout and a law that determines the order in which the ballots are counted. yesterday we were expecting a higher number of results coming out of maricopa county and it did not happen.

>> dana: we packed our patience for this week and looks like we need it. >> bill: in nevada the senate race between cath rick cortez masto and the republican challenger laxalt is up in the air. laxalt has a lead but more than 100,000 mail-in ballots still to be counted. jonathan hunt is live in las vegas. what's the movement as of today? good morning. >> well good morning to you, bill. here we are again waiting on the slow and methodical counting of ballots in nevada to perhaps decide the balance of power in the u.s. senate. we were here back in 2020 quite literally in my case for days and weeks for the presidentall election. here we are again for the critical senate race. cortez masto is two points

behind her challenger laxalt. there is an important governor's race here, too. democrat incumbent trailing his challenger joe lombardo but four points. the senate race is now down to the counting. we believe as you mentioned there may be as much as 100,000 votes left to count. they are concentrated in the north and down here more than anywhere in the south. clark county with vegas at its heart. 75% of the nevada population lives in clark county so the vast majority of the votes are cast here. and as we got some fresh numbers from clark county last night, it appeared that they were breaking, as they usually do here, in favor of the democrats. catherine cortez masto, her campaign manager says he is

confident she will win and laxalt said the rural votes may outweigh clark county in terms of the final result. the registrar is taking their time. it is their job to do it right, not fast. listen here. >> the timeline is statutory. we expect the timelines will be what it is. i think turnout was good for a mid-term. we definitely got more election day turnout than we did in 2020. the dynamics are so much different now that we have mail ballot going out to all voters. it will be some time. >> now remember the name adam laxalt, republican challenger in the senate race, bill. he, of course, was the leading republican voice in claiming that there was, quote, widespread fraud in the 2020 presidential election. he has not raised any such objections as yet. that is logical given that at the moment he is still in the lead.

if he ends up on the losing side here, it will be interesting to see if he follows the same 2020 playbook. >> bill: do you know when is the next dump of ballots? do we have a time on that? >> the north county has been a little uncertain on the times. clark county, the most critical bill, they have said they will give us fresh numbers at around 6:30 local time every day. that's 9:30 many eastern. we're also getting a news conference from the registrar at 11:20, 2:30 your time. >> dana: let's bring in bill mccarne. a member of the "wall street journal" editorial board. "wall street journal" headline today. the gop mid-term's failure. the party wasted a great opportunity but it is gridlock in washington. why is gridlock a good thing,

bill? >> better than the last two years with all the spending and so forth. so i think it's progress. just joe biden really can't get more progressive, at least on the spending side. there is a check there. i think that's an achievement but, of course, not the same as actually putting good policies in. we're blocking bad policies but we don't yet have enough people to force good policies. >> bill: dana and i are big fans of your editorial page because you seem to go after issues that sort of intersect with our jobs and lives here. we log on the night before to read what's coming up. last night there were so many editorials going after donald trump. now here is one from your newspaper. trump is the republican party's biggest loser. he is now flopped in 2018, 20,

21 and 22. a paragraph, now mr. trump botched the 2022 elections that could hand democrats the senate for two more years. policy successes as president including tax cuts and deregulation but led republicans into one political fiasco after another. where do you think this is going knowing that next tuesday at least on the calendar there is an expected announcement? >> well, i think that the mid-terms changed all the calculations about 2024. i think that president trump's attacks on ron desantis, calling him ron desanctimony yeas right before he got a huge win in florida, i think that was badly timed. i think it is badly received by many people who supported donald trump and voted for him both

times. it is unclear how that helps republicans. the other issue is donald trump backed a lot of candidates in the primary but one thing, he didn't do much for them. mitch mcconnell. i know people revile him in the republican party some places, but he went full stop for these candidates, raised lots of money and helped drag them across the finish line. and i wonder what would have happened in donald trump did that. i will be curious to see what he does in the georgia runoff, if he just says oh, he got my endorsement, that's enough or if he really puts the money there and helps herschel walker. >> dana: i know you watch and observes president as communicators. yesterday afternoon president biden gave a press conference. he seemed upbeat. he didn't lose as much as he thought he would.

he is looking to change washington. the house is going to change for sure. we don't have that announced yet. and then the senate is still in play. but regardless things are going to change. he said he doesn't plan on changing anything. what did you think about his message yesterday? >> i think he started out okay, you know, saying i hear you, bread and butter issues are important. but i think the mid-terms were bad for him in just the sense you talked about. he is now inclined not to change anything. and you know, a lot of democrats don't want him on the ticket in 2024. i think this makes more likely he is on the ballot or he decides to run again. so i'm not sure the message is going to be the best one for joe biden. i mean, he could be even more unpopular in a few months if inflation continues to rage and

other things don't get better. so i think it -- if you compare what joe biden said yesterday to what bill clinton said in 1994, there is not even feigned humility. clinton faced a much bigger republican win. i would have thought joe biden would at least pretend to have heard the people and talk about moderating his thinking. he couldn't even pretend. >> dana: it was interesting because they are facing a very changed situation. we'll see what happens in the future. always good to see you. thank you. >> bill: thanks. in the meantime you have the progressive group linked to bernie sanders already looking toward 2024. the organization known as roots action launching a don't run joe campaign pointing out that biden's age and low approval ratings should dissuade him. the president was asked about his next election.

>> president biden: my intention is to run again. i'm a great respecter of fate and this is ultimately a family decision. i think everybody wants me to run but we'll have discussions about it. and i don't feel any hurry. my guess is it will be early next year we make that judgment. my plan to do it. >> dana: so yes. >> bill: talking thanksgiving to christmas making a decision. >> dana: he turns 80 the end of this month. >> bill: one quick thought we were watching the reports from arizona and nevada and california. you see how fast georgia did it this year? >> dana: and florida. >> bill: florida learned 22 years ago. they weren't going back there. i think georgia learned two years ago. they weren't going back there. either. >> dana: i have a proposal that the national governors association should have all the governors together at their annual meeting make them pledge to get it done in a faster way

from nicaragua. large groups continue every morning. take a look at the video we shot earlier this morning after sunrise in texas on the outskirts of eagle pass. a large single group of several hundred migrants that crossed ille illegally. 300 coming across at the same. smugglers continue pushing groups across around sunrise every morning. very large majority were single adult men and continue to be largely in nicaragua, columbia, cuba and dominican republic. a big drop in the number of venezuelans showing up following the new dhs policy to expel them. then take a look at these photos from right here in maverick county. texas dps telling us they found and arrested 34 illegal immigrants who were hitching a ride on a train in the area. we often see this, migrants get on the trains in an effort to evade law enforcement and get deeper into the interior of the united states. they found 24 men and ten women all from mexico all of them

taken into custody and more smuggling. the tucson, arizona sector where border agents noticed a pickup truck crossing into the united states illegally in the desert. they stopped it and find 16 illegal immigrants being smuggled in one pickup truck being driven by a mexican national. hard to believe that many people were able to be crammed into the truck. they were. that mexican national was arrested and charged with human smuggling. look at these images out of the rio grande valley. border patrol agents continue to encounter large groups of migrant turning themselves in hundreds of them like we witness in the del rio sector. interesting about this occurrence with these photos. they found one migrant riding on an atv and smuggling large bundles of marijuana at the same time. that happening again in texas's rio grande valley. we have the rio grande over our shoulder right here and directly

over here a couple hundred yards away is downtown eagle pass. numerous times yesterday groups of illegal immigrants crossing the river. no border patrol agents around and walked into downtown eagle pass without ever being apprehended. those are gotaways. border patrol are getting more than 3,000 gotaways every single week. send it back to you. >> dana: remarkable. >> bill: you were thinking it would change? it is not so far. closer look at the border what agents deal with every day. rodney scott is here. good morning to you. just to reflect on what bill was reporting there. these agents don't know who is coming their way, do they? >> no. these agents are totally overw overwhelmed. cartel controls everything that crosses that border to include when and how many at a time. the agents are just being completely overwell mid. last year over 429 assaults. agents don't know who they are encountering until they are

face-to-face whether it's migrants, somebody claiming asylum or criminals trying to get away. a dangerous situation. >> bill: we just had an election. i'm sure you heard. our analysis of the voters told us the following. do you favor or oppose increasing law enforcement at the u.s./mexico border was a question we asked. 77% favor that. okay. so that would suggest that voters care. if the voters care do you think anything changes now? >> unfortunately it didn't transition to the ballot box. some of the best advocates for border security seem to be struggling in the election. there are a few things that still need to be sorted out. however, border security, as long as this president and his policies stay in place, cannot be solved by assigning more law enforcement to the border because border patrol is being forced to process and release

people into the u.s. and the flow will continue. the cartel has an endless number of people to pour across the border to overwhelming the agents. we need to have consequences in place. we need to enforce the law, which says it's illegal to cross the border other than the port of entry and until we do that you can't solve this with just more agents or more law enforcement. >> bill: one more question. where are you today, sir? >> oklahoma city. >> bill: so in texas governor abbott launched the operation lone star. does that help or is it just so overwhelming that operation lone star will have limited impact? >> so you have to look at the intent. the intent of operation lone star is to protect texas and america from significant threats. so while texas does not have the authority to enforce immigration law, every single person that texas dps or national guard come

focus on the drama in washington. we're going to get to work for the hard working families who gave us this majority. >> conjecture conservatives could seek an alternative to mccarthy. mccarthy may have overpromised. freedom caucus members could extract guarantees from mccarthy on spending or impeachment. that's in exchange for their votes. then lord that over mccarthy. >> they will want to have the ability to take him down if he becomes -- that's a sword hanging over him. it has thwarted other speakers and caused speaker boehner to resign. that's a larger problem now with the narrow majority for him. >> democrats are cautioning republicans against pushing too hard on investigations or extreme bills about the border and abortion. >> we picked up races that we shouldn't have picked up, either, because there were razor thin margins.

say they will investigate his son hunter's business dealings should they take back the majority. let's bring in byron york. it has been building since 2020, the month before the election when the hunter biden laptop story was suppressed by big tech and 51 national security officials said it was disinformation. this hearing is going to happen. >> absolutely it is. the president tried to sound kind of cavalier about the whole thing. good luck with that. but the fact is if republicans do take control of either house of congress, there are going to be hunter biden hearings. you know, a lot of democrats will say hunter biden is not the president of the united states. he is not even a government official. why are you doing this? well, congresss investigated the children of presidents. a few years ago in 2019 the house subpoenaed deutsche bank for the financial records of

donald trump junior, eric donald trump, ivanka trump and earlier trump junior had testified in the russia investigation. this sort of thing happens a lot. what republicans will be looking at is hunter biden's business dealings specifically his foreign business dealings and more specifically how those may have intersected with his father. it will be a joe biden investigation more than a huntser biden investigation. >> dana: we'll see how that goes. the president gave the press conference yesterday. you have watched many presidents and observed them as they usually do lose seats in a mid-term. president biden's reaction yesterday. >> president biden: i will do everything in my power to reunite the country. hard to sustain yourself as a leading democracy in the world if you can't generate some unity. so i'm not going to change anything in any fundamental way. >> dana: he said he wanted to compromise and heard the american people and not going to

change. how will that work? >> it was very odd. he started off fine saying he would compromise. he threw some bones to his base and said there are some things i am absolutely not going to compromise on like abortion and social security. on other stuff we can compromise and work together with republicans. then asked this simple question what do you plan to do differently and he said nothing, which was just a real surprise. i think what it means is if again republicans take over eats house of congress, more likely the house of representatives. if the president has a legislative agenda for the next couple of years it is dead. not going to happen. so what you see sometimes in these situations where there is no real hope of the president passing any bill that he really wants is they put forth called messaging bills. bills that appeal to a party's base. they know they will never get passed but get to say we're trying to do this and the terrible republicans are stopping us.

that can be valuable in a campaign. the president has made it very clear despite his advancing age, he wants to run again in 2024. >> dana: he says he will talk to his family between the holidays but seems to me their minds are made up. i wonder, byron, if the minds of the democratic party are still undecided. >> i'm not sure they are undecided. we have seen a lot of polls with significant majorities of democrats who say they want somebody else to run for president as a democrat in 2024. now somebody else is a broad category, not a specific person they would prefer over joe biden. so perhaps if the choice actually came down to a joe biden versus a specific democrat, biden would do better. but there is no doubt he will be 82 years old at the end of this term and if he were elected he would be 86 at the end of the second term. this is completely uncharted territory in american history

around the front side of the vehicle to assist him and we got into a struggle with him for it seemed like minutes but just seconds and i just -- you could -- i barely even heard watch his hands. at that point the grenade detonated. i went flying into the stone wall behind me and dunham had hugged the grenade and all i saw was his upper torso lift up and flop back down on the ground. kind of at that point where things got real intense because we started taking enemy fire and from my perspective my ears were ringing, i had black spots in my vision. you could feel the bullets flying by so i was just kind of trying to get behind some cover and do some self-assessing. >> bill: the way i read the story, he saved your life and that's the reason why you are able to tell the story about him

today. from the state of maine. >> absolutely. >> bill: remarkable stuff. to sergeant dean, he was your best friend. what was he like? >> a frozen picture. we'll try to get an answer from sergeant dean on that. >> bill: you put together a hell of a film. it is gripping. what did you learn about these men through the process? >> you know, i've known these men for over 18 years now and this whole thing started when i met corporal dunham before he deployed to iraq. we were sitting next to each other on a flight, 2004 i found out he had passed and then i found out what he had done and his mom actually reached out to me and that started the relationship for the past 18 years with the dunham family and the marines at kilo. the trust that was built in

those 18 years i learned a lot. these guys, i wasn't really prepared for what they were going to tell me and i just wanted to tell the story and, you know, they told it. they told it. >> bill: you met him on an airplane. remarkable. his mother got in touch with you. that's a story in itself. i got sergeant dean back while the satellite holds. sergeant dean, tell us about dunham. what kind of a guy was he? >> yes, bill. he was -- he loved everybody. it didn't matter if you knew him or not. he was always holding the door open for everybody, letting them go first. letting all his marines eat first. the last one to always eat. just a love your neighbor kind of guy. love your neighbor as yourself and it was an honor to know him. >> bill: i bet. he was awarded the medal of honor and also given a guided
