administration when it comes to the student loan forgiveness program. a federal judge in texas now says the plan is unconstitutional. and there's more. new report says most of those getting the student loan handouts plan to use the cash for travel and dining out. plus, good news/bad news for the economy. the inflation cooled down just a little bit. but that cooldown does not include the things we use the most -- food, energy, and wait until you hear how much your thanksgiving menu will cost this year, which does not include cooking the bird. but we begin with the ongoing midterms including the latest vottotals in arizona and nevada. kevin cork is live for us in the nation's capital with more. good evening. >> evening, trace. the balance of power taking shape as we get closer that will be finally called in nevada and arizona.

we hope so. let's take you to the grand canyon state of arizona where votes are being counted in the crucial maricopa county. officials are saying that the goal posts have moved for the vote count deadline. so, you may be wondering, what does this all mean? well, how about begin with the senate battle. we've been talking at length about blake masters and whether or not he'll have enough to overcome mark kelly in that race. last we just checked, maybe 15, 20 minutes ago, there's been another trove of votes coming in to the county. so, we wanted to take a look and see how things were going at this hour. let me see what i can share with you as we take a look inside the numbers. looks like kelly is still leading but first the balance of power in the senate, republicans 49-48. we're still watching all of the races as they continue to wind down in in particular interest in the races in nevada and arizona. over in congress? well, as you know, the gop is

expected to capture the congress right now with 209, make it now 211 as we adjust by the hour. 32 seats, however, have yet to be called. so, that's a very big surprise. frankly, i don't know what in the world has happened. i cannot recall a year where there were so many outstanding house races yet to called and yet here we are. take you back to arizona. i mentioned the battle there that was happening on the senate side. a lot of people very curious, trace, about the gubernatorial battle. kari lake in that particular battle battling katie hobbs. it's interesting because that's a race that for the longest time hobbs had this massive lead. but little by little, lake has been chipping away. we're getting fresh vottotals in. she continues to trail in that battle as well as we get more numbers, hard numbers, i promise to shafr that. how about what's happening in nevada. similar story. they're having vote count problems similar to what we saw in arizona. listen here --

>> we're working as hard as we can share in order to get the ballots counted. like it or not, there's no way to move any faster than we're currently moving. >> unbelievable. they can't move faster. a state like florida, more people than the state of nevada, they got them all counted in a night. i digress. not moving in lightning speed. 90% of the votes counted, we see a razor thin lead for adam lexalt. his lead is down to 8 00. that is very, very tight, considering he was over 22,000 at one point. so, you may be wondering, which party is going to control things here at washington? a lot of things wonder how things will shape up in the senate and the house. senate, 49-48 with the gop. in the house they lead with 211. they need 218 for the majority.

i'm watching them come in. i promise to bring you the latest as i get it. back to you. >> we'll get back to you as the numbers come in. thank you. tuesday is a good news for the congressman elect, the retired navy seal who served two tours in afghanistan, flipped the district to republican. let's bring him on to the show right now. congressman-elect, congratulations to you. it was a great race. you said all along, this was about gas and groceries and grand kids. boy, did that message resonate in your district? >> it really did. we put over 180,000 miles on our campaign vehicles in the last few years getting out the speak to everybody in every corner of the district. that's what people are talking about. they can't afford the first two. they're worried about the future for their children and grandchildren. we have a wide open border, a huge problem with fentanyl. crime rates are rising. parents are worried about what

they're being taught in their schools, things they don't agree with. the fbi is labeling parents going to school board meetings as domestic terrorists. yeah, there's a lot of issues going on. it rang clear and true to everybody. >> just to give you a temperature of what you're in for, you have been a winner for a short amount of time. they're going after you. "the new york times" wrote the following -- he focuses his campaign on the economy but leaned into the conservative culture wars saying the democrats are taking the nation rapidly down the path to socialism and railing on a podcast against what he described as the wokology seeking into the military. "new york times" calls these culture wars but they're also accurate statements, congressman elect. >> they are accurate. i don't have a caged bird, so i don't subscribe to that paper. they are accurate.

when the fbi uses the same coding for parents that are at school board meetings that they do for domestic terrorists, that's a real issue. when you're talking about tellically cast rating and physically cast rating children, removing healthy breast tissue from children, that's wrong. it just is. it's not going to get right. if you want to say those are conservative culture wars, i disagree. that's not a republican or democrat or independent or libertarian issue, those are real things that should be deeply concerning to every american citizen, especially parents. >> and people on the far left are not disputing this. they're proud of this. i mean, that's what's happening here is it's not like there's a major dispute like, oh, he's taking this out of context. no no, they're proud of what they're trying to accomplish. msnbc host hassan tweeted the following -- derek van orton was

photographed on the grounds of the capitol on 1/. he denies any role in the violence, he would be serving as a member of congress inside the capitol. absolutely amazing, america, 2022, what they don't realize is there were thousands of people at rallies on that day who did nothing wrong. what are your thoughts on these kinds of comments. >> yeah, well, as i said, we put 180,000 miles, the vehicles in our campaign. and the only people who brought that issue up was the guy i was running against, and activist media. i wasn't running against that guy. so, you do the math on what he is. and we're moving forward, people are worried about the future of their children and paying their rent. the farmer's almanac, it will be a very cold winter and heating prices are through the roof. that's what people are concerned

about. >> that's what people are concerned about. diesel fuel is in short supply up and down the eastern seaboard seeping to the midwest as well. you get in, you start work. hwa is job no. 1 for congressman advantage orton. -- van orton. >> it's making sure that we don't have 87,000 new irs agents. that's the stated goal of the future speaker of the house, kevin mccarthy. i'm onboard with that. my plan is to get on the agriculture committee if they'll have me. i represent an agricultural district. it's important people understand how critical -- food security is national security. people need to figure that out. nine meals away from anarchy at any point. and quite frankly, trace, i'm going to make farming sexy again. i mean, people really need to understand, it's a critical part of our economy. >> it really is.

a struggling economy. the weather, though, i should mention, is great, here. well, breaking tonight, president biden's plan to forgive hundreds of billions of dollars of student loan debt has suffered a setback. a trump-appointed federal judge in texas has ruled the program is unconstitutional and said it should be discontinued. mary ann is live with the latest. good evening. >> a federal judge in texas is striking down biden's plan to cancel student debt saying the president does not have the power to do it without congressional approval. mark pittman writes, it's, quote, an unconstitutional exercise of congress' legislative power. no one can plausibly deny it's one of the largest delegations of legislative power to the executive branch or one of the largest exercises of legislative power without congressional authority in the history of the united states.

the president of the foundation that brought the suit reacting saying, quote, this illegal student loan bailout would have done nothing to address the root cause of unaffordable tuition. greedy and bloated colleges that raise tuition far more than inflation year after year while sitting on $700 billion in endowments. we hope the court's decision will lay the ground work to real student loan crisis. you might be surprised how the debt recipients plan to use the savings. acourting to a report, many will use it for thins they don't really need. >> the recipients of president biden's student debt plan can see their monthly payments drop $300 in the coming weeks. 70% say they plan to spend that cash on travel and dining out. >> it could be, according to -- but, it could be easy as well for some people to enjoy travelling and eating out rather than worrying about the future. one financial coach tells

cnbc.com that you should not only use it for long-term goals, the short term self might get frustrated and give up on planning all together. >> the department of justice has already filed an appeal in this, trace? >> go out, go to dinner. it's good for your soul. good for your soul. mary ann, back to you. thanksgiving is two weeks away. the cost of the holiday continues to go up. now the consumer price index had a up.7% rise in october. that's the lowest increase since january. unfortunately, food and energy are not included in those numbers, and the price of both of those are still increasing. ashley stromeyer in new york has got a look at the costly turkey day. >> i could be -- not only is it going to cost you a pretty penny to get to where you're going for thanksgiving. but thanks to the high gas prices, it's going to be more expensive to eat the food. one headline reading it's going

to be so expensive this year, you'd be better off eating an it a restaurant. turkey prices jump 23% from just a year ago, but not only is your bird going to cost you, so are your mashed potatoes and your cranberry sauce. and if you think you're going to get off cheap with dessert, think again. flour and butter are both up between 24% and 26%. eggs, a whopping 4 %. and, milk almost 15%. that's of course according to the u.s. bureau of labor stats and though it's likely families not be skimping on the big meal. it is likely they'll be shopping an it the discount stores to cut their budget where they need to. >> if i had to feed a family, it would be quite difficult to provide fresh vegetables and tb things that i like to cook for more than my husband and myself. >> and if you are banking on inflation coming down any time soon, think again. listen to this. >> what i can't do i can't

guarantee that we're going to be able to get rid of inflation. but i do think we can. we have already brought down the price of gasoline about $1.20 a gallon. >> speaking of gas, gas is up 17.5%. electric up 14%. utilities, 20%. and get this, fuel oil is up 68.5%. now, the average cost of a gallon of gas is still up 40 cents from what it was a year ago, according to triple a, trace? >> ashley sromeyer, get to that in a bit. thank you, president biden is flying to egypt in this hour. leg one of the trip includes an international climate summit in the north african country and meetings with a group of 20 industrialized nations. in cambodia and indonesia, the president is scheduled to meet with his chinese counterpart on monday on the sidelines of the g20 summit.

the first face-to-face talk since biden became president nearly two years ago. now to the nation's crime crisis and a police chase that you had to see to believe in southern california. a man stole a white van, repeatedly rammed it into police cars until it got away and he drove like a maniac through numerous intersections until one tire blew out. he got out, ran to a nearby neighborhood, and into a house where he stole the keys to a landscaper's white truck. and the landscaper and his mom were at home at the time. then, while the man was trying to escape, he nearly ran them down, but the reckless high-speed chase continued. the suspect blew a tire and sprayed sparks all over the highway. he sideswiped several cars, crashed into a jeep before making his way to a gas station where police cornered him, shot into the truck's windows. and stood and waited before finally arrested the driver who is now being held without bond.

in california, that's rare. now listen to the landscaper whose truck was stolen, watch. >> i saw the truck, i i knew it was other. from looking at him, i could tell he didn't care about it anymore. i saw the truck, it was over, it broke my heart. we had gotten in that truck three weeks ago. >> also in los angeles, a different mode of transportation, a fight caught on camera in the subway. the guy in the green shirt tased the other man as commutered tried to get out of the way. eventually fists flew. the fight lasted at least two stops before moving out on to the subway platform. the guy who took this video said he never saw security show up. that's the l.a. we know. meantime, a disturbing crime up the road in san francisco when thieves robbed two convenience store workers and shoved one to the ground at gun point. then the thief told the worker, stop moving, as he searched his pockets. all three robbers made off with cash after less than a minute in

the store. and they are still on the run, likely not being chased. meanwhile, "the new york post" says the man convicted of murder released on parole less than three months ago tried to kidnap an 8-year-old girl in new york city. the girl's stepfather pulled the girl back and flagged out a police officer once the convicted killer let him go. by the way, that convict has a rap sheet dating back to 19. and in philadelphia, a masked man broke into a gas station through a broken window in the middle of the night and stole the store's atms. dragged it out the door. and made off in an unknown vehicle. it's the sign of the season. a certain tree begins it's journey to new york. and why this proposal means even more. after the couple lost so much. the day's best viral videos, next.

future, the president of the conservative leaning national christian conference sees a bigger take away, the huge hispanic turnout. >> the hispanic community is the voting bloc that will determine the outcome of the elections to come in the next 10, 20 years. >> the nonpartisan, nonprofit my faith vote sees christians as the proverbial sleeping giant, able to sway elections. it sent out 100,000 letters to christian pastors encouraging them to educate members on the ballots issue. abortion -- five states had reproductive rights ballots initiatives, all passed. in win column, three of five rejected marijuana recreational use. for the democrats, it's not -- >> jesus is not on the ballot. your choice is going to be between two flawed candidates.

>> the focus now is on the 2024 presidential election. trace? >> trace: despite the midterm performance widely acknowledged as lackluster, the gop sees silver linings to take away from this election day. fox news voter analysis found 40% of the hispanics nation-wide voted republican this year narrowing the advantage to the key voting bloc to 16 points. bring in white house deputy assistant to the president, latina political strategist, jenny savilla. we're just a couple of days past the midterm elections. i wonder if you think the democrats realize they cannot take latino voters for granted. >> we're so glad you're in l.a. i was really encouraged by tuesday's election results. i think people were disappointed because of the expectations were so high. as someone who works on campaigns for living, i'm always cautious but republicans have a lot to celebrate. first and foremost, we're going

to take over the house of representatives, which will stop biden's horrible policies that led to the high infla leagues, to ridiculous gas and grocery prices, to rising crime and out of control border. so you add that to lots of other things to celebrate with successes in florida, texas, georgia, wisconsin, probably in nevada and a lot to celebrate even in california. and what i'm watching is latino vote. latino vote was a significant part of that -- of those republican gains. >> and it's amazing how it's moved. when you go back to fox news voter analysis, this is from 2020, it shows % backed president biden, 35% backed former president donald trump though jenny says 38%. you uh see where we're at. a 28-point margin. among latino voters, democrats held a lead of five percentage points over republicans in the choice of congressional candidate in the journal's october survey, a narrower lead

than the 11-point lead in august. in the course of a few years, a couple of years, it's really narrowing. >> we have to look into the states. right, so florida, governor desantis, who won by .05% in the last four years, won by 20% in florida. and then he won miami dade county, which is blue county and 72% hispanics. and what i was told by some of my friends down there is the miami young republicans elected 19 hispanics to different offices from local to state levels in just florida. that's one state. and don't be fooled either. it's not just cubans, it's puerto ricans, san salvador rans, we're a diverse community. of. >> a huge surprise to everybody. the numbers were so robust. i want to play this sound bite. this is the reaction from the miami mayor frances suarez, watch. >> the democrats are in denial. they're in denial because they tried to brand all hispanics as

latinx, that doesn't work. people don't like it. and they tried to go nuance. the first lady said we're as unique as san antonio tacos. now, they're trying to come up with more excuses my republicans keep gaining with his pan ins. >> you see the labels -- latinos here, black voters, suburban women, you have these. the truth is, we're americans. people want the issues to be focused on. >> my abuelita is not latin x, my mama is not latin x, nor am i. you can't pander to us. that's what the democrats have done. republicans said we're going to get serious, go out to communities and talk to people on the ground. talk about texas, governor abbott got 40% of hispanic vote. he won uvalde county and star county and we picked up awe latina republican in congress, monica de la cruz. we're talking about the issues

>> hurricane nicole is now a tropical depression but it continues to drench much of the southeastern united states. before it was downgraded, it toppled several homes in the atlantic ocean and now threatening buildings in places where the sea walls got washed away by hurricane ian just weeks ago. the senior correspondent is in atlantic, florida tonight. >> category one hurricane nicole howled through the fl coastline after midnight causing significant damage like this erosion up and down the state's beaches. it made land fall between vero beach and ft. pierce. this is the first november hurricane in nearly 40 years. that's how rare these are. anywhere between and le inches of rain poured on florida throughout the day at the shore when wind gusts reached 90 miles per hour, the worst damage

happened around daytona beach, major beach erosion threatening homes. some precariously perched on what's left of their foundation. a curfew is in effect tonight to prevent any looting. governor ron desantis activated 600 national guard personnel as well as high water rescue teams and today he expanded the state of emergency to all of florida. >> winds have been the main concern, but we've seen heavy rains that have resulted in three-to-five foot of storm surge in some areas. you've seen potential flash flooding. impacts have opinion basically what's been expected. you do have downed trees, power lines, you have road washouts. combined winds and storm surge. >> downgraded tropical storm nicole proved deadly. a live downed powerline electrocuted two people in conway, florida near orlando. three others died including one

in brevard county. the storm going to georgia, the carolinas after that. and another significant concern tonight as well as through tomorrow will be the threat of hurricanes. trace. >> well, thank you. tens of millions of residents from the mid atlantic to the northeast are wondering what to expect from the remnants of nicole. meteorologist marissa toriz is live with more. what's the outlook exactly? >> we're expecting another advisory and update from the national hurricane center in the next 20 minutes or so. we'll see if there are any changes. the information i'm seeing here, the 10% advisory as it was downgraded. weakening, bringing it out more. expansive system. the winds dropping, that's a big thing. no longer a tropical storm, no longer seeing the tropical storm strength winds. you can see it churning trying to make it's way out of the panhandle of florida. through georgia, a soaking of

rain. it's continuing through the carolinas, mainly becoming a rainfall event. more than likely, flooding, flash flooding the. we watch remnants of nicole getting swept up from a system carrying it from the west carrying it to the northeast. we do have a tornado watch coming out of georgia, places like savannah and charleston south of the charleston area, we have a tornado warning at this point and heading to north carolina. that will expire through the next 20 minutes. you'll see if that gets extended in the overnight hours. there are threats here. as we show you future track to overnight hours, eventually, this depression becoming more post tropical as it heads up through the appalachian mountains. but as you continue to see some heavy thunderstorms and heavy rain, flooding in places like ashville, north carolina, you get the mountainous terrain that intensifies the amounts. rain still to come, yeah, some areas three-to-five inches in the mountains, stretching to

virginia, one to two inches there. even higher local amounts. take it to the northeast. look at friday morning and through the afternoon. you get a soaking from ohio in through pennsylvania, upstate west new york, new york city dealing with the rain through connecticut to maine. so, really friday looking like a little bit of a washout. by saturday, you can see it trying to sneak away and pivot off to canada. so, it will be windy in the wake of it. in fact, saturday morning, gusty winds out of new york, albany, boston, 40 to 50 mile-per-hour gusts there to nantucket. you can see it weakening, there's a threat of intense winds, tropical storm strength at time exceeding that 40 mile-per-hour threshold leading to some power outages. so, lots of rain coming in through western portions of pennsylvania, west new york. so, west of i- 95, two to three inches easily. new york, boston, one to two for the most part. it will be a soggy 24 to 36

so, thank you for your service, marines. >> you got to get it together. that's the whole thing. you talk about military and you talk about first responders. there is this united front. >> there really is. i think, you know, the big thing with us is -- you know, i served for 20 years both as a green beret and the cia. so i served at iraq, afghanistan, southeast asia, kind of all over. we to say, it's not pr, it's who we are. we do this for the sub culture. try to entertain, inspire, roast great coffee, build a bridge program, pull veterans from the community directly into the company. help with that transition and build a positive ecosystem that constantly reenforces psychological and physical health for veterans. it continues to encourage and build that ecosystem as we build momentum. hopefully we can influence other companies doing the same.

>> you talk about momentum. i work a lot with the wounded warriors foundation. i read your website. this jumped out at me. i'm going to tell you about it. the experiences of war leave a lasting impact on our defenders when they returned to civilian life, the challenges they face are often difficult, bringing awareness and supporting these heroes is a responsibility we all must participate in and share in. what are your thoughts on that? >> well, you know, i think what we do is we try to translate that directly to the ecosystem. and what i've done is tried to create a positive encouraging culture of support around all of the veterans, roughly 50% of our 900 plus employees here at black rifle coffee. what i like to tell people is we have an entirely different context of conversation and support. our hr is completely and 100% run by a former navy veteran. our hr department is built to
