in "the faulkner focus." after seven days of uncertainty, the congressional balance of power is finally coming into focus. just two hours from now, house republicans will hold their leadership elections. minority leader kevin mccarthy who i just mentioned is all but certain to get enough votes to secure the nomination for speaker. but things could get complicated in january. former freedom caucus chairman andy biggs of arizona has officially announced his plans to vie for speaker. that is unless kevin mccarthy agrees to certain demands. >> we have a new paradigm here. the country wants a different direction from the house of represe representatives. it's a new world. kevin has raised a lot of money and done a lot of things. it is not just about kevin. it is about institutional direction and trajectory and we'll see if we have enough

former utah congressman oversight committee chairman and fox news contributor. first of all, one seat away, your top line thoughts. >> look, it is a massive shift in washington, d.c. to be able to take that gavel away. nobody thought this margin would be this small but there is only one gavel so it will either go to nancy pelosi or going to somebody on the republican side. that's a monumental shift. >> harris: all right. this hour we'll cover it if we get to 218 votes there in the house for republicans. that would be that huge shift that you are talking about. we'll cover it live in it happens here. let's talk a little bit about what congressman elect from michigan john james told me yesterday was palace intrigue that americans really don't want to know about. they just want to take care of all the things that matter to them. you have to have somebody in charge. despite some republicans promising, you know, that kevin

mccarthy might have all the votes he needs, what is your thought on it? >> well look, in the house you just have to get the majority to be the so-called nominee. but the reality is you have to get to 218. our framers set it up such that what you have to do is on that day stand in the well of the house of representatives literally stand up and yell that name and i'm afraid there are a lot of people will stand up and have a hard time yelling out the name of the current existing leadership when a lot of people feel like it didn't achieve what it was supposed to achieve. now, i have no doubt that kevin mccarthy has the majority of the support. the reality is you have to have 218. and i don't think he is there yet. every single day there will be a drumbeat right up until january 3rd to figure out does he or does he not have that many votes >> harris: when you hear andy biggs, he is in arizona and we know him well.

when you hear him saying there are some things he wants to see. changes and if mccarthy is not willing to make them he would be go to make them. quickly do you agree with that? what are the changes that you would like to see? >> well, they are looking at the rules package. how many autonomy will individual members have. can they recall the speaker the way they did with john boehner or will they have that tool taken away? will committee chairman have subpoena authority? that has been taken care of. what sort of ability will they have to impeach somebody like secretary mayorkas? there is a list of a dozen things that they are really concerned about that they want commitments on. the other part of the conference doesn't want to give those. so again the battle, the number one question is how do they unify? right now nobody sees that path. >> harris: i'm glad you went that detailed. it's good governing, too.

if the promises on the border will be kept, secretary mayorkas is on the hill today. we've had the highest number ever. so we're going in the wrong direction. if republicans can't move within their own party to try to shore some of that up that's about governing as well. so thank you for that detail. let's get to this. president biden's massive student loan hand-out just suffered another setback. jason, i wonder if they knew this was coming and made a hollow promise to all of those young democrats to get their votes but knew they couldn't get it through? a federal appeals panel slapped a preliminary injunction on the $4 hundred billion plan affecting millions of young people who borrowed money for college. a judge in texas a few days ago said biden overstepped his authority in forgiving that. the white house appealed the first ruling and say they'll do

it again. democrat senator elizabeth warren loves the loan bail-out. >> to me this is one of the clearest differences between democrats and republicans. democrats led by joe biden are out there saying we hear you on what it's like to get crushed by student loan debt. we know what that means and so we're here to try to help. the republicans, they got nothing. they say the only people they are willing to fight for are billionaires and billionaire corporations and conspiracy theorists. >> harris: what is your reaction to that? >> i have a hard time listening to her in the way she tries to spin that. look, the president of the united states could have delayed this. he decided to forgive it in it's the tilths. that's an appropriation. every judge will look and say that requires an act of congress. that simple. elizabeth warren, put it up for

a vote and it will fail. it will just fail. >> harris: i had asked an open-ended question but probably has an answer. did they play trickery with their own young voters? >> a coincidence it suddenly comes out days after the election. a judgment ruling beforehand but i think there was a signal out there to millions of people that hey, look at all the goodies we're giving away. it's freebies. bumper sticker politics the democrats and republicans engage in it, too. they were putting out the bait all this free money. it affects elections. >> harris: a special gift they do on the left, though, their knack for doing that. >> they are rereally good at it. >> harris: the national education association, largest union in the nation, appears to be playing cleanup. the group tweet edmonton indicators love their students

and no better than anyone what they need to learn and thrive. the group turned off replies after 5,000 people poured on. one from former education secretary betsy devase herself with a jab. you misspelled parents. the nea clapped back but actually acknowledged the role of parents in their children's education tweeting i guess on the fix it. together families and educators are an essential team for advocating for the resources and opportunities all students need. out of touch billionaires, however, are not. that's their voice in my head. >> listen, i miss betsy devos as education secretary. people like senator tim scott and others are pushing the right buttons down the road. i think this is a pivotal issue going into 2024.

>> harris: democrats and republicans are flooding georgia with support into their respective candidates in the upcoming senate run off december 6th. the gop is all walker. it has raked in $11 million since the mid-term elections next week. the party plans to go door-to-door across the state canvassing. this ad hit the airwaves yesterday. >> herschel has a heart of a

servant leader because he wants to give back and to help the people of georgia and to benefit georgia. he is a good man. one of the best. he is cut from a rare cloth. >> harris: the georgia runoff election still matters. here is a quote. even for the next two years the difference of only a single seat would help the democrats, the majority party would not have to split committee assignments evenly with the minority meaning democrats would have less need to negotiate with the gop and there would be less chance of republicans defeating biden administration nominees in committee. so it's important if herschel walker has a victory, it brings it back to 50/50 having the vice president break the tie but you hear and see there all the bonuses politically on the hill, too. so herschel walker is in "focus" now. i wanted to get all that out so people really understand what's at stake in the bigger picture on the hill. what's at stake for you?

>> what's at stake for me is i want the georgia people to have a voice in washington. i think the last two years they haven't had a voice. senator warnock has done everything for joe biden and not for the georgia people. i think people see that in his voting. he has voted for the open border. he hasn't said anything about it. you see the way the economy is right now. you see men and women, crime on the streets and this is less than two years. that means the people of georgia haven't had a voice. right now i speak for the georgia people and i will always speak for the georgia people and the reason i decided to run. i tell everyone i'm not a politician, never looked or acted like one. right now what senator warnock has done to the georgia people is not correct. they're better than he has represented us in washington. >> harris: it was a blue seat when you went for it. what you trying to do is flip it red. why do you think it got so close down at the end?

a lot of people were saying herschel walker can't do it or do it by a mile. what drove it so close and so tight? >> it's so tight. this is the united states of america. everyone has a voice and that's what is so wonderful about it. everyone has a voice. right now i want everyone's voice to be heard and vote counted. one thing that we have to get back to is we can agree to disagree. we've gotten away from that. one of the things when i decided to run i want to be a guy to bring people together. i don't believe in separation. warnock believes in separation what he makes statements that america needs to apologize for whiteness and the problem america has in racism. he wants to separate and the muscling he is doing now. people want to know about the policies. the policies he has done, he has failed georgia and failed this country and he will continue to fail. this is less than two short years. right now we need new leadership in washington. we need people in washington

that foreign leaders will respect. right now i don't think the foreign lieders respect some of the leadership we have in washington because of what happened in afghanistan. warnock didn't hold joe biden accountable for that. we need leadership to be strong and there are good people here in the united states of america and good people in the state of georgia. >> harris: a piece on the hill argues it will hurt you without governor brian kemp on the ballot this time around. kemp outran walker by 210,000 votes putting the gop senate candidate behind the eight ball heading into the runoff. what's your reaction to that? >> my reaction is when i first got in the race they said i wouldn't be able to do it. you see where i'm at now. i speak for the georgia people and they spoke for me. i have more sheriffs that endorsed me than anyone else running because they knew i would have their backs. they knew i would always stand up for them. the georgia people know i will

stand up for them and i thank governor kemp for winning again. he has done some great things for the state. governor kemp is helping me run as well. there are a lot of people that believe in this country and believe in the people and that's what i believe in. i believe in the people. from what i've read in the constitution we the people. not we the government. senator warnock wants the government to control your life. that's one of the things i do not want. i think right now the government has shown they will spend your money, they will raise your taxes and give you more crime and open the border. they are doing things that are not american. they are doing things that is not georgia. as i told people, i'm georgia born and bred and when i die i will be georgia dead. i love this state and country and always fight for the people and this country. >> harris: i had election night live audience voters voices. some of what you are saying would cut across both aisles. that political aisle, even the independents that would resonate in terms of its we the people,

covid and its origins but how it killed millions of people around the world. i don't think they talked about fentanyl putting every community in america at risk today. everyone knows someone affected by fentanyl. when you think the meeting itself is the goal and objective and check the box it's a mistake. no action plan. nobody made a credible deterrent statements to xi jinping. even his comments in the press confronts on taiwan i couldn't tell you what our policy is with respect to taiwan today. if xi jinping doesn't know it will think it's green light like main or incursion in ukraine. we're confused on tie with a. that will be interpreted as a go signal. >> harris: i've heard you say on different topics when you show confusion you show the enemy. china is not our friend here.

secure and now mayorkas says goodness, that's gas lighting. it is untrue and it is dangerous for the united states. terrorists, fentanyl. all the things that cross our border present real risks to us. >> harris: i have been to both hubs. the human smuggling hub and the fentanyl south of my home when i'm home in arizona in nogales. i don't know what he is talking about when he says things are under control. let's get to this. the crime crisis continues here in new york city. two men are now suspected in at least seven necklace robberies. remember, crime is so rampant it feels like it is random. we aren't talking about they went to a jewelry store. we mean they ripped stuff off women's necks including this crime involving a 12-year-old child. two men drove up next to her and

grabbed the necklace and grabbed her off the street and grabbing the necklace away and fleeing on foot. a study finds nearly 24,500 americans were murdered last year. if that rate continues the study projects one out of every 179 americans will eventually be murdered. that number should be millions. that means that at least someone you know potentially will be harmed in that way. will be killed. we can't settle for this. >> harris, this is staggeringly bad. the american people feel it. the candidates who made this case and offered solutions, folks like lee zeldin in new york and some others convinced the american people to move in our direction. it is not a political issue. this is about basic security. basic taking care of families so your kids can play in the streets. when you have district attorneys and governors who aren't prepared to prosecute these
