winner of california's 27th congressional district. democrats sit at 211 seats, there are now six house seats left in play and focus shifts to who will be the republican speaker of the house. on tuesday republicans nominated california congressman kevin mccarthy as nominee for speaker beating arizona representative andy biggs in a boat 188 to 31 but in order to become speaker, mccarthy will need 2118 votes when the entire 435 member house is seated in january. if republicans only win a few more seats past 2 to 218 and republicans are split, he might be in for a headache. on sean hannity he said republicans losing senate and gubernatorial races, the g.o.p. has to come together in the house. >> we are the last line of defense, so we can't take this personal. we can't go out and make our own

individual ideas. we need to work with the team for the sake of this nation. >> switching over to the senate where democrats have gained a majority on wednesday senate minority leader mitch mcconnell was reelected, he defeated a challenge from florida senator rick scott in a 37 to 10 vote. >> i voted for rick scott -- that was significant. in the ten years have been in the senate we've never had a contested election for leader. >> with mcconnell's nomination for senate minority leader he's now set up to become the longest-serving party leader in senate history. >> back to a bit later. in the meantime less than 24 hours he jumped in the 2024 races generating big time reaction, good, bad and downright ugly. kevin corke is live with more on that. >> not surprisingly not everyone

arena, not a big surprise there. >> not a big surprise at all. it's beginning to look a lot like 2016 with republicans set to retake control of the house and donald trump running for president. let's bring in the panel former new york state senator david carlucci and press communications director for trump's 20 campaign, thank you both for coming on. republicans finally have control of the house and you look at the states that are bluest, new york and california and republicans did pretty well in both of those states. the democratic party chair in new york said the following "we lost four competitive congressional seats that we very much would have liked to have won, that wouldn't be so unusual except for what happened in the rest of the country. so it looks like we underperformed." your thoughts on that. >> i think overall, democrats did much better than expected

now with the announcement of donald trump running for president, this is a gift for democrats. you are right, democrats underperformed in new york and i think that is a rebuke on some of the local politics in new york. i think the lesson here for both parties republicans and democrats is you have to be very careful about the extremes of your party taking you over a cliff. i think this is where president biden has done well. he's been able to show results, he's trying to bridge those differences as far as he can but i think that shows in the national elections, most americans are saying we want to be in the middle. the extremes are not working it leads us down a broken road and we need to be in the middle and that's what people are saying. >> trace: do you agree? >> i do agree that the american electorate is looking for a moderate individual, we are a center right country we have been for decades.

if you look at new york you saw a strong message the economy and crime, we put forward a message of prosperity one where republicans contrasted and not just saying democrats had a problem, they put forward policies that created problems and here are the solutions. that gains seats in new york and california we know what a winning playbook looks like it's up to republicans whether or not we executed again. >> trace: last night president trump says he has some of the solutions we are looking for but you listen to a lot of republicans including the former vice president mike pence -- let's listen to him on special report and i'll get your take on this. >> just listening to you, you wouldn't vote for him. >> i honestly believe we are going to have better choices. >> there is a theme g.o.p. why that's maybe it's time to take a different path, what do you think? >> i think that's what the entire primary process is for, putting forward the candidates looking at the differences

between them, looking at the difference of record of success or failure and what that looks like what we want as a party. our direction is one that wants a strong economy, strong border, strong military, strong families, safe communities. that's a winning republican message and whoever the republican electorate chooses coming out of the primary, that is going to be our nominee and we will have a slate of strong, credible, incredible candidates with records, if you look at governor ron desantis and look at mike pompeo, look at nikki haley, tim scott, greg abbott i can keep going, we have a record to run on and that will be the message we take into 24. >> it's interesting because you have the florida governor ron desantis saying just chill, this thing is a long way off and i think we tend to lose sight of that, this thing is two years down the road and he's being talked about as a primary 2024 candidate -- listen, chill out, it's nothing to worry about.

>> i think that's some good advice we should all take, let's chill. former president donald trump hasn't gotten that message and this is the gift that keeps giving to democrats in a time when we are expecting because history tells us the president's party loses they lose governorships, they lose seats in the house, they did really well because donald trump has been front and center and he has shown the extremism of the party. this is something that republicans will have to work out but it's a gift to democrats especially heading into the off cycle where you have local elections across the country that are so important -- what donald trump does is he bolsters turnout for democrats. this is good news going forward. >> trace: he's proven he can win and democrats as much as they think bring it on, they are also thinking i tell you what's, this could be a very competitive

race. president biden was supposed to talk about the explosion that hit poland and he went to this news conference and i thought he was good to answer questions, he said this instead. >> reporter: can you tell us what you know so far about the explosion in poland? >> no. >> trace: it is highly unusual in that kind of circumstance for the commander in chief to say no, no comment, got nothing for you. >> there is 1 of 2 instances that happened here. the white house communications team didn't tell the president he would be giving remarks and they failed to prep him. the other instance is they did tell him and his briefing materials and he forgot or he didn't care to give the answer. either instance isn't great for the american people it's not great and geopolitically speaking one yet again joe biden goes abroad and fails to step up, step in and show american leadership on the world stage we just saw it yet again. >> trace: i got ten seconds want to wrap us up?

every single registered voter, all 22 million of them. if those ballots are postmarked on or before election day they have to be accepted for up to seven days after the polls close, meaning up until late last night. the results don't officially have to be reported until december 8th -- it gets worse. some california counties only have one ballot counting machine, then there is the issue of ballot harvesting, something that is legal in california and illegal and the other 49 states. it's a law for those people who cannot make it to a polling place or drop box and are unable to walk to their own front door and dropped the ballot in the mailbox. in that case california allows anyone you don't know to pick up your ballot -- anyone, even a campaign worker. in fairness the law says they are not supposed to help you fill out to the ballot but common sense also reminds us that you're not supposed to walk into a cvs drugstore and walk out with armloads of stuff.

if you really want assurances here it is, california says it gets rid of fraud by matching every signature on every ballot -- you ever try to match signatures? it's often like trying to tell polka dot ties part. very difficult. the city council of washington, d.c., has voted unanimously to overhaul the criminal code in our nation's capital despite the fact that the district has one of the highest rates in the country. it eliminates mandatory minimum sentences meaning a lot less jail time except for first-degree murder. and also nearly eliminates penalties for public and, something d.c.'s progressive mayor muriel bowser has expressed reservations over but even if she vetoes the bill it appears the council has the votes to override her. a bus full of migrants from texas arrived in philadelphia this morning, two dozen men,

i don't know if they were the evil party this time but they were wickedly smart and we were dumb. lot of people asked me how does john fetterman get elected to the senate? he may start with three or 400,000 mail-in ballots, this happened all over the country. they are doing is harvesting in the mail-in ballot stuff much better than we are. we seem to be an election day party, that's what republicans prefer to do when they prefer to vote. but we can't ignore what's going on on those days before. i voted in north carolina, great state wonderful state, they went for my i.d., they just said what is your name and what is your address. the exterminator's assistant could've come to my house, knew my name and got my address, no i.d. required. we got to get smart about this stuff, that means getting control of some of the mechanisms in the state. we have to play the game smarter. >> trace: that's a good point. you talk about what happened

last night from a president trump throwing his hat back in the ring. i know you were a big trump supporter, your thoughts on that. >> i'm sorry to see him do it, i had hoped he wouldn't. i hoped he would embrace his legacy which was he ran a great country. things were humming, the border was secure, our enemies feared us, the economy was roaring, we didn't have these fentanyl deaths, we were thriving. now we are in decline because of this administration. that is his legacy, president trump is a good one he should've embraced it. at this point i couldn't recommend that he run because he won't win. there are too many people who will never vote for trump. those independents come of those moderates was people in the middle who decide elections, there does not want to vote for donald trump. we all know people who might have voted conservative this time and last time, they will just tell you i could never vote

to support donald trump. it's unfair, the sky was treated more unfairly than any president in history but it's a fact. >> trace: interesting i want to move on to education. eric swalwell responding to tim scott who said parents should be put back in charge of their kids education's. he says "please tell me what i'm missing here, what are we doing next, putting patience in charge of their own surgeries, clients in charge of their own trials? when did we stop trusting experts? this is so stupid, what would your response to him be? >> first of all, we stopped trusting so called experts we realized some of what they were doing was nonsense and that was during covid when we got the peak over the shoulder to see what was going on and a lot of the schools. parents will trust teachers, they will trust the math teachers in the english teachers in the history teachers if they feel the teachers have earned their trust, then they will give

them leeway. right now there's a lot of worry about what's going on in those classrooms. you don't let the doctor operate in less you trust that doctor to be true to that analogy. he's got it backwards, parents are the first teachers in the indispensable teachers. they give their approval to the other teachers to do their work. >> trace: i think that is a fair assessment and lastly i want to get your take on the "l.a. times" which has for months and years been saying there is no crime here, nothing to see here, they came out saying about fentanyl -- more young people are dying from fentanyl than ever before, teen fentanyl deaths doubled from 253 and 2192 max 680 and 2020. last or the number jumped to 884 and fentanyl was the cause of 77.14 drug deaths in last year. that's for los angeles in the "l.a. times" is realizing we have a problem on our hands. your final thoughts. >> you may remember i was the

stabbing her more than 50 times and stuff in her body and her son's duffel bag sentenced to 25 years in prison. c and correspondent laura ingle has more. >> 25 years in prison for david manolo he is the handyman to admitted to killing the mother and stuffing her body in a duffel bag in a nearby park. he was awaiting trial on second-degree murder charges for the april 2022 killing for when he pleaded guilty to manslaughter as part of the deal with the district attorney, investigators say during that time he became involved in the on-again off-again love affair with the victim. in the early morning hours of april 16th, they argued and he eventually stabbed her as many as 55 times all while her son was in an upstairs bedroom.

think this thing is getting big. >> this is going to be as big as enron, that's the last time i was a prosecutor when enron came forward to. this is the tip of the iceberg i think crypto will never be the same. i think ftx has not only the issues you brought up with a class action but the issue with the contributions to members of the party, issues in ukraine, this is just the beginning, this is going to be a huge story. >> you say it could be as big as enron i'm just wondering how in the world you prosecute this? a lot of people don't understand what exactly happened, how do you prosecute something like this? >> enron was based mainly in texas in the united states, the difference and the difficulty here is you have victims all over the world. this is a prosecutor's nightmare, generally what happens in cases like this you go to an individual at the very highest levels and you get them

to cooperate with the government and they give it to you. >> you had some former prosecutors who told axios the way to do this is to plead incompetence. the following here typically in a fraud case the person at the top argues he was inattentive, delegated to others and wasn't focused on the details. the point is to argue he was sloppy or inattentive, not a fraudster. is it a fair defense? >> i think that is a smart defense but that's why you go to the number 2 of the number 3. if the guy at the top of the chain makes that defense they look for the people, the cfo, the other individuals -- there will be someone the government will look to to exert pressure on to get them to turn state's evidence so they can bring their initial round of subpoenas. >> you mention the political fallout from this i want to play a sound bite to. this is from the g.o.p. rep barry loudermilk and i will get your response.

>> this is something that could be highly criminal activity. was this whole operation just to funnel more money to democrats? that's the big question, what did they about it? >> he talks about funneling money to democrats and you break it down more than 90% of the money that was bipartisan money -- 90% plus went to democrats and i'm wondering what the political fallout might be for this. >> $38 million in the midterms. he was the second largest donor to democratic candidates aside from george soros. i can't say at this stage it was a funnel to help democrats but there needs to be serious investigation and i would imagine now that republicans are in control of the house, one of the first committees they will be forming will be to investigate this issue. >> trace: i wonder in these types of cases this anybody get their money back ever? does he have money to get back is there some way to claw any of

this back from victims? >> he may or may not have assets in general in these types of cases the government tries to immediately seize assets. a lot of his assets were overseas. i think that's why you see lawyers suing these celebrities because in these types of cases when you've had a bankruptcy the lawyers make the determination that they have to seek any and all avenues to get money back for their client. i think the lawsuit against tom brady is a little grasping at straws, meaning they have to know tom brady, larry david had to have known that this was a fraudulent activity and if they are mainly advertising or acting like a surrogate, they didn't know. >> trace: that's like saying if tito's went bankrupt and tom brady did a commercial for tito's he somehow liable. >> are they found out later that she does were bad for the waistline and tom brady is at
