4:00. >> or a little earlier, 12:00 to 2:00. >> thank you to the band. ♪ >> bill: good morning, everybody. only took a week, america. but fox news can now project republicans will regain control of the house. what does that look like for the next two years? we're about to find out over the next two hours. good morning, i'm bill hemmer live in new york. dana, good morning. >> good morning, bill. i'm dana perino and this is "america's newsroom." today i am live from the fox nation patriot awards in hollywood, florida. quite a festive atmosphere. tonight this gathering will be incredible. like the good citizenship award for adults and so inspiring.

all these people we are going to honor tonight deserve it and it is an honor to be here. >> bill: it looks great and we've only been doing it for a few years. the amount of growth in this event is extraordinary. we'll share a lot with you throughout the show today from florida. >> i have loved the marching band that "fox & friends" put together. house republicans hitting the magic number of 218. the size of their majority is still in question. half a dozen seats are left in play. >> bill: we'll show you on the board in a moment. nancy pelosi will no longer be speaker. it is not clear as to her future as either minority leader or whether or not she leaves congress all together. she holds a news conference in an hour and 45 minutes. >> we expect to get the news. historic indeed. republicans will be able to set the house agenda with their new-found majority and means we can expect investigations into afghanistan, handling of the

pandemic and hunter biden's business dealings. >> bill: 28 minutes from now house oversight republicans james comer and jim jordan will hold a news conference. we expect them to lay out their plans for investigating the biden family at that point. >> check this out. kevin mccarthy shedding light how the republican party plans to proceed. >> one party democrat rule in washington is finished. we have fired nancy pelosi. on day one in this house we will repeal 87,000 new i.r.s. agents. we want to know the origins of where covid begin so we never have it happen again. we want to know what happened in the last 60 days of afghanistan. why did the d.o.j. go after parents and called them terrorists. how can we have a homeland

security saying our southern border is secure? >> karl rove on deck. we begin on capitol hill where chad pergram is standing by. good morning, chad. >> good morning. a big morning on capitol hill. as we speak now house speaker nancy pelosi is meeting with members of her whip team. we're told she is expected to tell them her decision about whether she would stay in congress, continue perhaps as the minority leader or perhaps retire from congress. i was told a couple of weeks before the election, before the attack on her husband, that she was probably out the door. one source said she is 82 and would not stick around as minority leader. other sources said if it was going to be a narrow congress, a narrow minority perhaps she would stay. then came the attack on her husband and some democrats here on capitol hill say that she began to recalibrate her position. listen to what she said a couple of weeks ago. >> will your decision be
6:04 am
impacted by the attack in any way? >> yes. >> it will? >> yes. and impacted by -- let me just say this. i have been blessed by my colleagues, whip first, then leader and then speaker of the house for four terms. that's a great honor. >> the thought on capitol hill is that nancy pelosi would not want to show weakness, would not want to show she was intimidated and run out of office so long as her husband was on the road to recovery. and repeatedly throughout the fall before the election myself and other reporters pressed her about her future plans. listen. >> do you intend to be here in the new congress as the speaker, minority leader? >> i'm strictly focused on winning the next election. do you want to talk about that? >> the reason that pelosi has made her decision is because she knows the contours of the next congress and knows for sure that republicans will be in control and narrow minority.
6:05 am
if she moves on, what happens to house majority leader steny hoyer, jim clyburn. others warming up in the wings. hakeem jeffries, kathryn clark. a mad scramble. keep in mind how long nancy pelosi has been in the leadership here on capitol hill. it would be a seminole moment in congress. another big story happening today in just about 25 minutes or so we'll have a press conference. jim comer, republican of kentucky who will be the new chair of the oversight committee, jim jordan of ohio who will chair the judiciary committee. they will lay out the contours of their investigations into the biden administration and his family next year. listen. >> it's not america if you have a justice department that's political and not treating people equally under the law. that's exactly what we have. we're committed to getting the truth out there because only when you get the truth out do you have a chance to actually hold people accountable and change the behavior that is now

happening at the highest level of our justice department. >> republicans, because of that narrow majority, will have smaller committee ratios and they will continue with these investigations and hunter biden and the laptop and the withdrawal from afghanistan and the origins of the pan emotion dick but they won't be able to be as aggressive as they hoped. a lot of news coming out around 9:30. einstein always said time only exists so everything doesn't happen at once. he never worked here on capitol hill. we'll find out about all of it about 9:30 this morning. >> big things happening on capitol hill. >> bill: that's a good line. here is the magic number, 218. they reached that last night around 6:30 east coast time. there are eight races to be decided. take you quickly through a couple of those especially this one in colorado. let's start there. boebert is hanging on right now. huge district right here in the
6:07 am
southwestern part of the state. she is up by 1100 votes. we have estimated vote in 99%. she is hanging on. that's one that may stay in the republican column. a few others in california. several of them. let me start here. this is california three, a huge district that borders nevada. we've been watching this all week. the republican lead is hanging on by 9,000 votes. the central valley. california 13. the republican has taken the lead over the democratic challenger. this race in particular has been a couple votes here and there and split many times. the republican has a lead of 963 votes as of this moment. pop down here to the south david valadao is in a fight for his political life hanging on right now. a lot of democrats in his new district. he is 4,000 votes higher than his democratic challenger.
6:08 am
this is a change, too. we've been watching that number at 54% yesterday, five days. now 67%. and so if republicans were able to take those four seats that i just talked about another race up in alaska that democrats are going to take based on rank choice voting. this number from 218 would go to 21 or 222. i know there is a guy with a big brain waiting to come up right now who will tell us what's that about. >> it's karl rove. you are no stranger to divided government. from your experience what does it mean for washington and what can people expect? >> first of all, i think bill is absolutely right. we've been on a trajectory where the republicans would take 221 seats. last night there was a lead in california 13.
6:09 am
two democratic counties that have a little bit out. if those counties come in at the rate they're coming in to date, the democrats will pick up 400 votes but there is one republican county that still has vote out. if it comes in off sets that by 225 and if that's the case, the republicans would get to 222 seat by 700 vote margin. and wouldn't that be ironic? the democrats have controlled the previous congress by 222 to 213. and wouldn't be ironic if the republicans took control by the same margin? >> bill: right back where we started. a couple of things here. we'll learn a lot over the next two hours. republican plans and investigation, nancy pelosi's future. a week ago as the president asked whether or not he would change anything. watch. >> do you intend to do differently to change people's opinion of the direction of the country particularly as you contemplate a run for president
6:10 am
in 2024? >> president biden: nothing, they're just finding out what we're doing. i'm not going to change anything in any fundamental way. >> bill: what's interesting of this moment in time. no one is wrong because no one knows what will come of it. if you had a crystal ball, how would you forecast what they're doing. >> he is right. everybody is finding out more about what he has done and the republican congress will stay stop. there won't be a gigantic new build back better build. there won't be an expansion of the american rescue plan. the trillions in additional spending won't be supported by the house of representatives. my hope is that there are ways to find committee chairs in the house will start to work on some bills that would have a positive incremental improvements in structures of government in various parts of our lives but the republicans are going to start off by saying no more big spending programs, no gigantic expansion of the government and
6:11 am
for the president of the united states to say he doesn't need to change is simply astonishing. of course he has to change. he no longer has a democratic house that will roll his agenda through. he has divided government. if he wants to get anything done he better recalibrate and figure out how to work with republicans saying not going to change the thing. keep doing what i'm doing. >> karl, it's inevitable people will finish one mid-term and look toward the next election. we know former president trump announced already this week and governor desantis, everyone is looking at him to see what he will do. you are no stranger who is a governor who won re-election and eventually decides to run for president. your take on that after you hear from ron desantis when asked about it yesterday. >> look, i think we just finished this election, okay? people need to chill out a little bit on some of this stuff.
6:12 am
seriously. we just ran an election -- [applause] we have this georgia runoff coming which is very important for republicans to win that georgia runoff. >> whether desantis or anyone else do they have to decide now and jump in the race this early? >> no. in fact, desantis and glenn youngkin have the best of all possible worlds in a way. they can say look, i'm thinking about it maybe or i'm willing to give it consideration but i have to pay attention to my legislative session back home. both have the legislatures coming in in january and both of them want to accomplish some things. they can focus on that and let people come to them and have intimate discussions with party leaders and party donors and party activists about what if they decide to run, what it might look like. they can begin to do the ground work for a presidential campaign without having to formally
6:13 am
announce. once you announce you have to keep it going. to my mind a little strange president trump announced. what will he do to keep that going? the fact that there are other contenders out there who are possibly thinking about it. nikki haley, mike pompeo in addition to the two governors i mentioned and senator cruz of texas and others. this race will take a while before it begins to firm up. as a result it will be hard for the first guy in there to sustain it. we saw this in 2007 and 2008. remember the polls showed the leader at that point was rudy giuliani and hard for him to begin early in that case 2007, let alone 2006. it was difficult for him to sustain that momentum and it eventually petered out. smart move by the governor to say everybody chill out. we have time. we have a couple important things to get done. the georgia runoff and he will say i need to attend to my business at home using the magic of the telephone and airplane

tickets to have people come and see him to begin to lay the predicate for a potential run. >> bill: politics is a four-season sport in america now. we'll speak soon. live in austin. >> we do need to be aware the individual is still out there, right? we need to be vigilant and we need to watch out for our neighbors. >> why has there been such limited information? why so limited? >> i would have been standing here a day or so again but i'm here now. >> idaho police walking about the notion the public should be cautious. they don't know who the suspect is after the murder of four college students. we have more in idaho and where we think we are today, dan. good morning. >> police chief finally said what people have been feeling ever since the four students were murdered on sunday. with the killer of those students on the loose, this community is still in danger.
6:15 am
there is still a threat to the people here and they have to be vigilant about their safety. we have video of two of the victims. madison and kaley at a food truck hours before they were murdered and a shocking detail from that news conference. there were two other roommates in the rental house during the murders and they have been cooperating with police. >> the other two roommates were there at the time of the attack. >> all the information we have from our investigation is that yes, they were. >> okay. they were unhurt? >> that is correct. >> police say there was no sign of forced entry and no evidence of a robbery. they would not say if the roommates slept through the slayings or were tied up. nothing else on that. the university of idaho president spoke and got choked up talking about the victims. >> my deepest condolences to the families.
6:16 am
and friends of ethan, kaleigh, and the others. excuse me. their loss has been devastating and they were bright lights in our community. >> the autopsies are done and the coroner saying it was a homicide for all four victims. they were all stabbed to death. this is important, the coroner told me it is likely the same weapon was used on all four of the victims leading to us thinking it was just one person in that house doing all this carnage. >> bill: brutal stuff. more from idaho as we get the headlines from there. >> stunning new video of the russian assault on ukraine. take a look here. rockets raining down as we get new details on the missile

>> bill: your first look at the new congress on the house side. james comer talking about investigations into hunter biden. >> with his family about their business dealings. that was a lie. whistleblowers describe him as chairman of the board and personally participated in meetings and phone calls. documents show he was a partner with access to an office. to be clear, joe biden is the big guy.
6:33 am
this evidence raises troubling questions about whether president biden is a national security risk. and about whether he is compromised by foreign governments. despite the president's claim that he wasn't involved in biden family business schemes, these photos show joe biden meeting with his family associates while vice president. committee republicans have identified over 50 countries the biden family sought businesses in on the international side of the biden family business. deals were often led by hunter biden. it shows all the countries where the bidens had a footprint in international business dealings. the investigation reveals a family that engaged with some of america's most powerful adversaries planning to sell one of the largest areas of cobalt for the chinese. they became millionaires by sampling offering access to the family. among the dozens of shell companies the bidens set up

there were millions of dollars of wire transfers, flights on air force two to conduct personal business and meetings with heads of state while joe biden was aware of what was happening. all the while he turned a blind eye. many transactions related to these businesses have raised red flags at u.s. banks. suspicious activity report is a document a bank must file with the treasury department when a transaction is suspected to be money laundering, fraud or other types of criminal activity. according to media reports the biden family accumulated over 150 sars. one saar generated by an american bank connects hunter biden and his business associates to international human trafficking, among other illegal activities. the money that was being made from foreign principles in the same room as joe biden was spent on furthering illegal activity. the sars show hunter biden was conducting business with suspected human traffickers.
6:35 am
the money gained through influence peddling was funneled to a suspected criminal enterprise one linked to human trafficking. we have called on the biden treasury department to release additional financial documents to committee republicans but thus far treasury has refused. we want to know what they are trying to hide from the american people and why they aren't being transparent and also found evidence hunter biden sought to evade the sars using his financial advisor, a clinton administration official. we'll continue to pursue all evidence and specifically the sars and bank records in the new congress. as part of our investigation we have evidence the finances, credit cards and bank accounts of hunter and joe biden were co-mingled, if not shared. on some accounts at least red flags were raised by bags to the owners indicating suspicious or illegal activity. one of hunter's closest associates was accessing joe

chinese that they used in working with the chinese. let's think about this for a second. at a time when americans are suffering from high energy prices because of this administration's terrible energy policy, we find evidence that hunter biden and joe biden were involved in a scheme to try to get china to buy liquefied natural gas and try to get their foot in the door with china purchasing an interest in natural gas drillers. people are in outrage over china buying farmland in the dakotas. what about china starting to buy into our american energy industry at a time when we have an energy crisis because of the bad policies of the biden administration? let that sink in. hunter brought in millions of dollars from this deal from entities tied to the chinese government. and emails obtained by committee republicans hunter wanted keys

that's what we're interested in getting to the bottom of. the only way you can hold people accountable and hopefully stop the behavior is to present it to the country. that's what we have to do. so we're committed to doing it in an aggressive fashion in a way consistent with the constitution. >> thank you. we know that the department of justice and f.b.i. have been investigating hunter biden since 2018. how do you know that these claims that you are laying out in your remarks today and some of the examples you have here are claims that have been fully investigated by those federal prosecutors? >> maybe they have, we don't know. >> the math that you were referring to. when was that powerpoint from? >> powerpoint was from what year, do we know exactly? i think it's in your packet. 2017. >> so my follow-up there is if this is from 2017, what is the connection to the current energy
6:50 am
crisis now? that was years ago. >> joe biden says he will stand up to china. joe biden says he is going to rewrite our whole energy policy. america first and he was are a 10% equity owner in a company whose sole mission was to purchase liquefied natural gas from the united states and trying to take over the natural gas industry of america through natural gas wholesalers and drillers? i don't think joe biden has been honest with the american people about that and that's a question you need to ask at the next white house press conference. we didn't know about your involvement in a chinese energy company. does that in any way, shape or form impact your energy policy that? every american needs that answer and faced with high energy prices because of biden's energy policy.
6:51 am
yes. >> will your committee call hunter biden or anybody in the biden family to testify? >> we would love to talk to people in the biden family specifically hunter and jim biden. i think the most important thing for us right now is to get those bank records. we have two suspicious activity reports in hand now. not because of the biden family and certainly not because of janet yellen at treasury. these reports are very detailed and these aren't from little banks like in my part of kentucky. these are wells fargo, j.p. morgan. these suspicious activity reports i don't think from day one a lot of people in the media understand what a suspicious activity report is. just so you know, suspicious activity reports were created after september 11th for the government to track foreign transactions into american terror cells. over time it has expanded to include things like money
6:52 am
laundering and other types of criminal activity. in september 11th remember, the banks knew that these terrorists were getting wire transfers from saudi arabia but the federal authorities didn't. that's how these were created. under president bush, under president obama and trump, any committee in congress could have access to those suspicious activity reports. but when joe biden became president, he changed the rules. now, does anyone here doubt my suspicion that he changed the rules because his son and possibly himself had 150 suspicious activity reports? are we the only ones that find that odd that joe biden would change the rules when he became president? in fact, maxine waters had legislation to change the rules back. she didn't know why she changed the rules and she had a bill and part of the language in the bill was to override that rule and give congress the access to those suspicious activity
6:53 am
reports again. i actually voted for maxine waters bill and i don't vote for a lot of her bills. >> question for both of you. i wonder if you might be able to confirm your committees will be investigating speaker pelosi and the department of justice for the treatment of defendants jailed in connection with january 6th, a promise that potentially speaker mccarthy made to the house freedom caucus earlier this week? >> he is the department of justice guy. we are focused on. you saw our report. maybe you didn't. i hope if you didn't you take time to read it. we're focused on how political our justice department has become. not a question of if they're political. if they are. they are making decisions on a political basis. we'll look at all that. >> what about pelosi and january 6th. >> political operations at the justice department back to the first whistleblower came to us
6:54 am
over a year ago. about a year ago regarding the school board issue. we're concerned about anything that is being done in a political fashion at the justice department because remember, you have to step back. it is supposed to be in this great country, the greatest country ever is equal treatment under the law. when you have a justice department not following that fundamental principle that sets our country apart from all others, that is a major problem. >> do you think the january 6th insurrection has kept -- >> i didn't say anything. i said we are going to look at the politics of the justice department based on the fact that we have had 14 different -- more than 14 now whistleblowers talk to us and that's what we'll focus on. >> what are the grounds? >> if we can keep it about hunter biden. if we can keep it about hunter biden that would be great. >> i want to take you back to what she said january 6th what is your plan with the january 6th investigation? >> i think that's a question for
6:55 am
kevin mccarthy. we are focused on a lot of investigations are transparent with the media on it. that wasn't one of them. yes. >> okay. can you preview how this is going to play out? it sounds like your focus initially will be on the suspicious activity reports that you endeavored to receive somehow. will it be from subpoenaing a bank. once you receive those, are you expecting a smoking gun from that or will it lead to more avenues? finally, what -- what are you expecting, another report or terminating or referral. how do you see it playing out? >> obviously with the two we already have. >> how did you get those? >> we can't reveal our sources but the two are on the internet so you can dig and find them. they are out there.
6:56 am
we verified that he are 100% factual. >> i'm not questioning that. if you got that from an individual why would that individual have two? >> that's a great question. i'm glad you asked. i don't think a lot of people in the media and congress understand a suspicious activity report. a financial expert does, i had the honor of being on a bank board. when you get a suspicious activity report it flags every account that has had a transaction within a certain time period, am i right? so the suspicious activity report that we have shows where hunter biden purchased whatever with an escort service. the escort service paid the prostitute. the bank implies that the escort service is under suspicion for human trafficking. we see where the prostitute is from. not from the united states. i don't want it to be about the prostitute. here is the thing.
6:57 am
hunter biden isn't this innocent guy that just got a bad rap because he had a drug problem and the republicans don't need to waste time on it. we're not trying to prove hunter biden is a bad actor. he is. if anybody wants to disagree with that there is nothing we have to talk about. our investigation is about joe biden. and we already have evidence that would point that joe biden was involved with hunter biden. we want the bank records and that's our focus. we are trying to stay focused on was joe biden directly involved with hunter biden's business deals and is he compromised. that's our investigation. >> so if you found that, if you found that through the report, what would be your deliverable? another report or would you refer those charges or do you foresee this resulting in some sort of impeachment process? >> we will issue a report.
6:58 am
we will hand over the -- any potential criminal activity to the appropriate authorities and that's what we do. we investigate. >> we're a legislative body. we may need to change the disclosure laws. there was concern with big tech, f.b.i. talking to big tech, big tech suppressing information that we the people should have had access to when we get ready to make the most important decision we make on who will lead us. do we need to change section 230? it is all about the legislative purposes. supreme court has been clear that's where we have to focus. i would just argue it is about the first amendment. the idea they were suppressing critical information that the country should have had access to and they did it 15 days before -- tell me what in the report that mr. comer and the team has put together is russian disinformation? that's b.s. and everyone knows it and should have known it at the time and did know it at the time but did it anyway.
6:59 am
that's the legislative purpose. we don't know where it will go and that's what we're trying to do. >> some republicans have questioned the timing of this. why make this your very first visible order of business investigating president biden and his family? >> look at the commitment of america. hold the administration accountable is the job of the oversight committee. some have said this is what the republicans sole focus is. this is the focus of the oversight committee. i know kevin said the first legislation we're going to vote on is to repeal the 87,000 i.r.s. agents to reduce the size of government because it is tackling inflake and we have inflation because the democrats have spent too much money. we have a legislative agenda and focused on a lot of things. from the oversight committee we're in charge of investigations and feel it is important. >> to follow up do you expect cooperation from the biden administration when it comes to the justice department which is also investigating hunter biden?
7:00 am
if the d.o.j. doesn't cooperate, what means do you have at your disposal right now to get the information that they've uncovered on him? >> just on cooperation. first they haven't responded to any of the correspondents or letters or inquiries that came from ranking member comer. second they changed the suspicious activity report process and protocol and third, they've now set up a committee according to the reporter maybe in this room. the report in "politico" they set up a committee to attack us and come after us. you guess. they will probably not going to work with us. >> bill: washington has just changed. how far they get, what they can prove or not remains to be seen but you heard james comer, joe biden is the big guy. they've got photos on display that they say came from hunter biden's laptop. this is what happens when you reach 218 in the house and we just saw for ourselves live there from capitol hill. good morning to you, dana down in
