7:00 am
if the d.o.j. doesn't cooperate, what means do you have at your disposal right now to get the information that they've uncovered on him? >> just on cooperation. first they haven't responded to any of the correspondents or letters or inquiries that came from ranking member comer. second they changed the suspicious activity report process and protocol and third, they've now set up a committee according to the reporter maybe in this room. the report in "politico" they set up a committee to attack us and come after us. you guess. they will probably not going to work with us. >> bill: washington has just changed. how far they get, what they can prove or not remains to be seen but you heard james comer, joe biden is the big guy. they've got photos on display that they say came from hunter biden's laptop. this is what happens when you reach 218 in the house and we just saw for ourselves live there from capitol hill. good morning to you, dana down in florida. beginning a new hour right now.
7:01 am
>> dana: that was like taking a double shot of espresso this morning, bill. a lot of news happening. a busy day on capitol hill. we're waiting for both house speaker nancy pelosi and senate minority leader mitch mcconnell to make remarks. after we were learned fox news can predict republicans have won back control of the house and bring remarks when they happen. big news going on right now. moments ago house republicans laid out their plans for future investigations into hunter biden amongst others. i don't know if we have the sound here. we don't? okay. also on capitol hill lawmakers set to question the director of homeland security over the escalating crisis at the border. judge's ruling blocking the title 42 policy that allows migrants to be returned to mexico due to illness. now threatening to open the flood gates for more migrants to cross into the u.s. i'm dana perino. i don't know how we'll fit it
7:02 am
in. >> bill: good morning. big patriot awards later tonight in florida. looking forward to that hence your presence down there. a beautiful room in -- on the east coast of florida. i'm bill hemmer, good morning. we begin now with president biden's growing border crisis. administration has five weeks to get ready for what some fear will be a massive rush on the border. there are thousands of venezuelan migrants waiting for the right moment to cross. "new york post" spells it out this way. there could be as many as 18,000 a day since title 42 is gone for good. dhs secretary mayorkas has a lot of explaining to do when senators ask about his plan to secure the border. here is what he told house lawmakers earlier this week about it. >> secretary mayorkas, do you continue to maintain that the border is secure? >> yes, and we are working day in and day out to enhance its
7:03 am
security, congressman. >> i think it is a position that denies reality. >> dana: mike tobin is live on the border with a look at how the situation is unfolding. let's go to aishah hosni on capitol hill with all the news we can expect today, aishah. >> good morning to you, dana and bill. secretary mayorkas can expect a barrage of questioning today from republicans and democrats about what he plans to do once title 42 has been lifted. he just walked into the hearing room. i asked him how he plans to secure the border as he walked in he said good morning and did not answer my question. but again republicans especially in this senate committee will try to ask that question. now mayorkas did face a group of lawmakers on the house side. house republicans earlier this week. he was grilled by them when he told them he believed the border was secure despite the fact that data shows a record 2.38 million
7:04 am
migrant encounters in the last fiscal year. texas governor greg abbott announced this week he is invoking his state's invasion clause with plans to build a border wall in texas counties and designate mexican drug cartels as terrorist groups. abbott is starting to bus migrants to philadelphia now, the first bus arriving at the amtrak station there on wednesday morning. meanwhile the democratic mayor of rio grande city, texas telling fox yesterday that title 42 was highly effective in managing the flow of migrants and once it is gone, he is expecting a rush into his community. listen. >> ending title 42 will create an influx of immigrants coming through port of entry and which is so unfortunate because congress has failed to address our broken immigration system. it is great to hear in
7:05 am
washington, d.c. at least they are having the conversation and rhetoric. will they follow up on that? i don't know. >> i can tell you there has been no movement at all on any comprehensive immigration reform on the hill. instead the democrat-controlled congress is prioritizing daca in this lame duck session. they will need ten g.o.p. votes and senator dick durbin admitted that title 42 has to be a part of those conversations. with all of that in the background, you can expect a very fiery hearing this morning. dana and bill. >> dana: we'll stay in touch. thank you so much. >> bill: want to bring in congressman mike garcia, republican out of california and joins us now. good morning to you. you are #218 because your victory is what put the gop over the top. why did it take so long? thanks for being here. it took eight days to get a winner in california. why did it take so long? >> it is still one quarter of the time it took in 2020.
7:06 am
it is california. they allow for universal vote by mail whether you ask for it or not. same day registration, no voter idea and wait for the owls and pigeons to bring in the scrolls. they haven't hired enough people to do the counting. we're proud to be 1 of 218. i'm one of a majority chartered to fix this nation and undue the ills by the legislative brafrng and the exe executive branch. >> dana: when you think about the first thing you want to tackle how does it change? you have divided government and you had the house oversight committee saying they will investigate hunter biden and joe biden. they made that very clear. >> i think all of our committees are ready to go and hit the ground running. we've established our leadership as a party. what i've seen in our conference
7:07 am
in the last few days is different than what i've seen in three years. more unified than ever and we have the same priorities and strive to be the no drama option, the no drama solution for the nation. as an appropriateor my focus is on making sure we get back to regular order and stop the bleeding on the spending side. stop the bleeding and aggravating our nation's debt. get lower taxes, less spending. return the dollars back to the american taxpayers rather than bureaucrats in washington, d.c. that's my focus as well as all things national security. we have 218 now votes, maybe 220, 221. whatever it takes to go do their jobs and appropriate committees. you will see a stark contrast between our majority and the last majority. >> bill: one more question for you, sir. i know you look toward tomorrow what you are talking about now. one question about yesterday. what would you say as to why there was no red wave, red
7:08 am
tsunami, no high tide? how come? >> i will tell you this. this may not have been the big wave that many -- i think some folks overpromised the results. look at what we've done in the house. we went from a weak minority to now having the speakership, majority. pelosi will be gone in january. the results do matter. we'll get the white house back in 2024, i'm confident we'll get the senate back in 24 as well. and just having the majority is a massive feat. the bottom line is we need to run harder as candidates and run for two years, not two months. we have to communicate to the middle third in districts like mine where i have 29% registered as republicans i can't win the minds of voters i need to win their hearts. we'll look at that and spread the strategy and tactics across the swing districts and do better in 2024. >> bill: we'll be in california in two weeks. maybe we'll see you.
7:09 am
thank you for your time today. >> dana: thank you. >> this is a question i think everybody has to ask themselves. why didn't he raise any eyebrows at the s.e.c. when he was buying all this stuff when everybody was losing money in crip to? what was the secret sauce that allowed him to make so much money when the whole crypto universe is getting toasted? >> so this significant story. don't know where it goes or ends. the questions are endless now. the collapse of ftx. investors filed a class action lawsuit against the founder and el celebrity endorseers. the lawsuit seeks repayment of $11 billion in damages for misleading customers. with me now is a plaintiff in the lawsuit out of oklahoma and his attorney. good morning, gentlemen, thank you for your time today. i want to lead with this headline from 90 minutes ago.
7:10 am
the new ceo of ftx was quoted as saying that he has never seen such a complete failure of corporate controls. i know you are not the attorney, but what do you need to prove in this case do you believe now, sir? >> that they were misleading us and encouraging people to get into their system and invest in the company. >> bill: how much money did you invest, how much money do you think you lost? >> i'm not -- >> bill: simply put? >> we're putting that together right now on the damages. >> bill: hang on one second. i am just trying to -- edwin, do you care to share with our audience? was it a substantial amount of your net worth or how would you characterize it? >> it was some savings i had.
7:11 am
>> bill: adam, i imagine there are many others like edwin. make your case, how do you win? >> there are thousands of them, bill. it is an emergency and it is a real crisis here in miami. there is over $30 billion which have been lost by investors in voyager, in ftx and all the other crypto currencies going bankrupt. how these cases are organized from the very beginning will be crucial. it could take decades to go through billions of dollars in the bankruptcy court and litigation courts. we can't let that happen. there has to be an organized fashion for all these victims who relied upon these celebrities and never disclosed from any of the commercials that they were getting personal motivational stock and money from going to people likeed and convincing them it is a safe and simple investment. we need to organize it now.
7:12 am
>> bill: understand that and you are going after big names. one more question for you and i'm sorry we're short on time. a lot going on in washington, d.c. adam. it is my understanding that anyone who invested in ftx. there was no paper trail or nowhere to log on and find out what your investment was doing. is that not some part of the responsibility of the investors him or herself? >> well, it could be but it doesn't matter when what you are doing is a fraud. this was just a house of cards that was waiting to fall apart. the voyager crypto is the same, a house of cards waiting to fall apart. so we are going to prove that the people like mark cuban that told these investors to trust us, we have done our due diligence and checked it out. it is safe investments. they were not telling the truth. >> bill: thank you for your time. edwin, i am sorry about your loss. thank you for your time today. thank you, gentlemen, 12 past now.
7:13 am
to this. >> dana: launching renewed assault as ukraine. what will it take to end the conflict? we'll ask a u.s. marine who fights there. it is deadline day at twitter. new ceo elon musk giving workers a strange ultimatum. stunning video as officers respond to a car crash. a woman was trapped inside a burning vehicle and we'll show you what happened next. >> stay with us. we've got you. can we lift at all? taken with a statin, leqvio can lower bad cholesterol by over 50% and keep it low with two doses a year. side effects were injection site reaction, joint pain, urinary tract infection, diarrhea, chest cold,
7:14 am
pain in legs or arms, and shortness of breath. with leqvio, lowering cholesterol becomes just one more thing life throws your way. ask your doctor about leqvio. lower. longer. leqvio. are you a veteran, own a home, and need cash? you need to know about the va cash out loan from newday usa. it's called the newday 100 because it lets veterans borrow up to 100% of their home's value. not just 80% like some typical loans. that extra cash can make a huge difference in these times of skyrocketing prices. here's more good news: home values have skyrocketed too. that means even more cash! take out an average of $60,000 to pay down your high-rate credit card debt, consolidate your second mortgage, personal loans, and car loans, and lower your payments by $600 every month. best of all, there are absolutely no upfront out-of-pocket costs with this loan. and even if you have credit concerns, give us a call. the va has granted newday automatic authority to make our own approval decisions. when lenders say no to a veteran, newday can say yes.

over the past two years, jersey mike's fundraiser for feeding america has been a huge success. their efforts helped provide more than 75 million meals, when people needed it most. but there is still work to be done. thank you, claire. this year, we'd like to invite you back to jersey mike's for another special weekend. come in this saturday and sunday, where 20% of all sales will be donated to feeding america, helping families in need. together, we always make a difference. my name is joshua florence, and one thing i learned being a firefighter is plan ahead. you don't know what you're getting into, but at the end of the day, you know you have a team behind you that can help you. not having to worry about the future makes it possible to make the present
7:17 am
as best as it can be for everybody.
7:18 am
7:19 am
>> kicking the russians out of all of ukraine to clue what they claim is crimea, the probability of that happening any time soon is not high. there may be a political solution where politically the russians withdraw. that's possible. you want to negotiate from a position of strength. russia right now is on its back. >> dana: pentagon says the u.s. is ready to support ukraine for as long as it takes. our next guest is a marine veteran helping ukrainian troops fight for freedom since russia's invasion. he has seen the front lines and knows what they need in order to succeed. let's bring in a u.s. marine veteran fighting for ukraine and here seeing family stateside for a little bit. you retired from the marines and working at google. russia invaded ukraine. you decided to go to ukraine. why?
7:20 am
>> i had already quit my job at google when the war started. i didn't feel like i had a choice. america is letting a smaller, less equipped country fight its big war for it right now. if you consider the last 60 years, russia has been our main if not enemy, then nemesis, i guess. and we're letting the ukrainians do that fighting for us. i didn't feel it was right. >> dana: so the american people have been quite generous, you would agree, in terms of finances. the biden administration asking for another $$37.7 billion. when they hear general milley say as long as it takes they are looking to find somebody in the administration, let's just ask you. you are on the ground and fighting and made this decision. why is it important for americans to support the war in ukraine? >> it's incredibly important. that struggle is not about
7:21 am
communism versus fascism or whatever the political structure of the day was. it was between freedom and democracy versus dictatorship and that's what we see here. we need to fight for the world that we want to live in. and especially here. when you start talking about money, it is funny, you start talking $50 billion, $30 billion. a small amount of money what we spend on defense as total. i think it's 1.72 trillion, something like that. that's a rounding error per year. you talk about a fight that hasn't happened since world war ii really. people are fighting in trenches. when was the last time that happened, right? so -- >> dana: tell me about what you sense from the ukrainians you with fighting with. what is their level of commitment and what are you seeing on the ground as they try to take back some of this territory? >> any soldiers knows that morale has highs and lows.
7:22 am
before the car kiev. taking back kherson this week are incredible things that no o one predicted ukraine would do. they want their country back. every piece of land. i think that's very clear. they made it abundantly clear it includes crimea as well now. so we should support them however we can to not let russia continue its aggression. >> dana: i wish you a good visit with your family. america is lucky to have you as one of its patriots. if you were here you would probably get an award. the ukrainians are fortunate to have you as well. please stay in touch and stay safe. >> bill: 22 past now. it is deadline day for twitter staffers. check it out. the new ceo is giving his
7:23 am
employees until 5:00 today -- i think it's pacific coast time -- if they want to stay and face extremely hard core long hours at high intensity, end quote. or take a three month severance. door number 1 or 2. susan lee has it now. >> try working at fox news extremely hard core. twitter workers have until the end of business today to commit or leave with a little bit of pay. company-wide email that musk sent out to build a break through twitter 2.0 it will mean working long hours at high intensity adding if you are sure you want to be part of the new twitter please click yes on the link below. anyone who hasn't done so by 5:00 p.m. thursday will receive three months severance. engineering will be focus and designing products is also important to him. you have to remember musk fired half of the staff just a few
7:24 am
weeks ago. yesterday testifying on the stand separate test la pay package lawsuit says he doesn't want to be the ceo of twitter or any company and expects to find somebody else the run it. twitter has taken up the lions share of his time the past few weeks and majority owner in three big companies so tesla, twitter and spacex. several fired spacex employees who said they were unfairly let go from the company after speaking up against elon musk and also reported that he fired two dozen twitter employees earlier who openly criticized him. musk loves twitter humor and tweeted a photo of the -- in my conversation with those in silicon valley elon musk is a tough boss but his track record is unmatched.
7:25 am
>> bill: he has electric cars, rockets and social media. he is all about tomorrow. hard work is good work and it can be worth it, susan. thank you for your time. nice to see you from fox business. back to dana. >> dana: 25 sheriffs recruits recovering from horrific injuries after being hit by a wrong way driver. we have video of the terrifying moment. that's next. plus democratic governors are being looked at as the future of the democratic party. can the mid-term wins lead to success in 2024. colorado governor joins us on that and more. my most important kitchen tool? my brain. so i choose neuriva plus. unlike some others, neuriva plus is a multitasker supporting 6 key indicators of brain health. to help keep me sharp. neuriva: think bigger.

7:31 am
you have some potential candidates now in this batch for 2024. democratic governor of colorado is jared polis back with us today. congratulations on your re-election and we have questions for you. thanks for being here. >> it is always a pleasure. great to be with you this morning. >> bill: should joe biden seek a second term as president? >> that's a question for you to ask president joe biden. i hope he gets to do a good sit-down interview with you. today the big news will be whether nancy pelosi is seeking another term and leadership. a lot of soul searching and thinking going on. people will make their decision. >> bill: would you support him seeking a second term? >> it's a decision for him to make. certainly i'm in the camp where whatever we need to do to defeat former president trump we should do. i really feel that he is a great threat to international safety and international order and even to our democracy itself. so i will plan on backing
7:32 am
whoever we can do to make sure that we cannot return trump to the presidency. >> dana: one of the things i was wondering as republicans search through the mid-term election results and think about what went right and wrong and what they could do better on the democratic side do you think the wrong lesson would be learned we did better than we thought we would? there are still real challenges with hispanic voters, working class. do you think about that and is there a disconnect between what you see as the governor of colorado and then what your colleagues in washington are seeing and doing? >> look, i think that it's fair to say that democrats, myself included, we did better than expected. i thought we were in a strong position 10 to 12 points up. we were 18 1/2 up and won a congressional race in colorado that we thought we were 3 or 3 points down and instead won it by a point. in colorado there was a shift. part of that was just our
7:33 am
effective role of governing. people said we can trust the democrats and done a good job. economy is strong and who is best positioned to face the challenges ahead? the challenges ahead this cycle in colorado at least nationally as well public safety, reducing crime, and saving people money and reducing costs. we have a strong track record on both. a lot of work ahead and look forward to getting it done. >> bill: if you were watching our program in the last hour you can tell things are changing in washington with republicans taking the majority of the house. a lot of story lines will be different. you have a number of people like yourself living in other states outside washington. desantis said this yesterday. >> look, i think we just finished this election, okay? people just need to chill out a little bit on some of this stuff, seriously. we just ran an election. >> bill: he said also we had a storm, a hurricane, we
7:34 am
recovered. we had an election, we counted almost 8 million ballots by 11:00 at night and another storm and took care of that when people counting ballots in other states. it's extraordinary forthink what is happening still in california. desantis is in the mix in the conversation and you are, too. how far would you like to see your political future go? >> well, you know, occasionally i agree with ron desantis when he said chill out. i would second that. i'm excited to be elected to a new term of colorado. we have a lot of work to do. that's my entire focus. i know governor desantis's attention is florida. the advice of chill out for a little while and let us do the work for the positions we were elected to. he can do his best to show successes in florida and we have a lot of other governors that have a lot of work ahead. >> dana: governor polis, thank
7:35 am
you for being with us today. we appreciate it. >> thank you, have a great day. >> bill: thank you, sir. >> dana: yesterday was the second chance for tailor swift fans. the state of tennessee is investigating the ticketmaster disaster that left thousands of fans empty-handed. cat >> she says things. i see people have meltdowns actually on the internet about this. she is supposed to be the feeling singer with all the feelings. she should say something. it is a bit of a disaster. i'm not a fan at all but i went through it in 82. tom is back in the band.
7:36 am
my mom and dad wouldn't let me go see it. i won't miss my chance. i was on for hours trying to get tickets and finally got some. they weren't as good as the ones i wanted. >> i'm talking with taylor right now to get to the bottom of this. >> dana: you are a father and when you are a mom or dad and trying to get these tickets. people are upset. call for number one. they are saying according to bookings.com after thousands of tickets purchased by ticket brokers over 1,002,000 tickets remain. it is easier to cross our southern border illegally than get taylor swift tickets. >> one, there is a huge demand obviously for ms. swift. and my kids are not really into that yet. so i haven't got to that point. mine are still little babies so they aren't into concerts and stuff. i wait for that.
7:37 am
>> dana: you do big venues. >> i my sales and we sell out occasionally most of the time but that's what is horrible as an entertaining. you put your faith in ticketmaster. their job. they are the ticketmaster. not mediocre tickets. we'll do the best we can tickets. apparently their system could not handle the amount. that's again -- it is not just ticketmaster. you can't vote in a lot of states without waiting months for results. something is going on with counting. we have to get back on math. >> dana: we have to get back to capitol hill. let's go there. >> not giving shorter sentences to the violent convicts who hurt them. we stand for securing our border and enforcing our laws instead of letting unvetted people and illegal drugs pour into our country 24/7.
7:38 am
we stand for putting parents' rights and parents' involvement back into our nation's schools and getting radical indoctrination out. we stand for the quaint notion that judges need to follow our laws and the constitution as they are written, not act like third legislative branch that our citizens can't vote out. we stand for free speech, religious liberty and the freedom of worship. instead of using the courts and the government to prosecute men and women of faith. this is where we stand, madam president. it just so happens the american people stand with us. last week's exit polls show that republicans are more trusted on kitchen table issues that keep american families awake at night. when the american people got a clear unmuddled look at the common sense approach to the issues, they liked what they saw. we've got 49 outstanding members on this side of the aisle living
7:39 am
proof of that fact and in just a few more weeks we'll have 50. it's the honor of a lifetime to serve alongside my distinguished colleagues and serve our conference in this leadership role. yesterday evening brought confirmation of great news for the future of our country. republicans have secured the majority of the house of representatives for the next two years. it will be senate republicans great pleasure to partner closely with and serve alongside the new republican house. i want to congratulate the soon to be speaker mccarthy and all the new and returning members of congress across the capitol whose elections will be transforming the people's house from a reckless rubber stamp into a sorely needed check and balance. the composition of the new house demonstrates that fatigue and exhaustion with reckless and radical far left policies is not just limited to so-called red or
7:40 am
purple states. new republican congressmen and women have been hired by their neighbors, even in deep blue states like new york and california. even further evidence that when the american people get an unmuddled look at the common sense conservative vision on the issues, they like what they see. so i look forward to working with our house republican colleagues, new and returning, in the years to come. now on a related matter the capitol may be preparing for the next congress but hard working americans are still being hurt every day by the reckless party line spending that democrats rammed through during this congress. since president biden took office, and his all democratic government fired up the printing presses our nation has been hit with 13.9% inflation. in the state of georgia, inflation is even worse. it is closer to 15% since
7:41 am
january of 2021. families are having to pay hundreds of dollars extra every month just to maintain their standard of living from before the democrats got power let alone trying to get ahead. the many georgia families who can't afford it are falling farther and farther behind. >> dana: you have been listening to senator mitch mcconnell. he just won re-election as the majority leader of the republicans so that will happen and he has got a big race in georgia with herschel walker and raphael warnock. that was his comments. >> bill: we're still waiting on nancy pelosi. she will be on the floor of the house maybe in an hour or so, maybe more than that, dana. before that happens, however, first responders, have you seen this? they arrive at the scene of a burning car. a woman trapped underneath the car. the stunning rescue in a moment.
7:42 am
also it's official. republicans control the house. what will they do with their new-found power? we got a glimpse last hour and we'll get back to it coming up in a moment. y parties... even retirement parties. man, i love parties. subway keeps refreshing and refreshing veteran homeowners, need cash? with the newday 100 loan, there are no upfront costs for appraisal or termite inspections. no upfront costs at all to get the cash you need. veterans get more at newday.

7:46 am
>> bill: heart stopping video of the moment officers pull a woman from her burning car.
7:47 am
