death in bed likely while asleep. pete: the massacre occurred near campus and police do not have a suspect or person of interest. rachel: ashley stromier has the latest on the grewsome case from idaho. >> a lot of questions unanswered and police without a suspect or person of interest in the killing of the four college students. this shows where the four students were in the early mornings of their tragic death. the time line details the final movements beginning with a social media post and saying

they were likely in bed during the attack. >> seems likely they were sleeping it it seems like it was a very large knife so hard to call them puncture wounds and has to be something that's pretty angry in order to stab four people to death. fatal ones to the chest area or the upper body area. >> police officially ruling out roommates and food truck bystanders as potential suspects and kaylee's sister reportedly saying kaylee and maddie call add man named jack a -- called a man named jack nine times before 3:00 a.m. and a mystery man spotted hanging with kali and maddie outside of the food truck has been identified and is cooperating with police and students at the university of idaho are still in shock though. >> all four of them truly touched countless students on campus. it's been extremely difficult since their lost. >> ethan and zana, it was a pleasure to know them. a lot of people came in and out of the house just because of how kind all four of them were and

welcoming. hope they come to a quick discovery and able to bring someone to justice. >> dozens of police officers and an elite fbi unit working around the clock to try and crack the case. back to you guys. rachel: thank you, ashley. will: bring in lenny depaul and he's a fugitive and former marshal and can hopefully answer some of our questions on this case. good morning, lenny. i want to start with you aif i wering or dis-avowing some assumptions i'd have in the way law enforcement would be approaching this case. i've always opened under the a-- operated under the assumption that a knife ask s a very personal crime leading you to believe the assailant would have known the students. a, is that true and b, doesn't that give you a pool of people then that you can work from that you would think law enforcement would have more leads today?

>> well, good morning. that's a hate crime. they were up close and personal and four victims stabbed to death in the upper torso multiple times. you're right on the money with that but right now law enforcement is chasing a ghost. they may have a suspect or somebody, a person of interest and they're keeping it close to the vest, and i completely understand that as well but the crime scene speaks for itself. i mean, there was no signs of forced entry. i think there was a key pad on the front door and had to key yourself in. i get it, it was a frat house or a dorm and the door was unlocked or whatever and the door was wide open when the pd showed up and got to that gruesome scene and you're spot on. rachel: lenny, through few details but one thing is from the victim's sister saying her sister called a man named jack

six times on the night of the murder. what does that tell you? >> that digital footprint is extremely important and they're q and as people and knocking on doors and looking at security cameras. it's tough and they're putting that puzzle together and connecting the dots and hopefully come up with a suspect. pete: lenny, the fact there's no leads yet. someone would have left that house with a lot of blood on them in a gruesome -- also the fact that that clothes or other things haven't been found already also killing four people with a knife without other people hearing. does that mean this person probably knew how to use a weapon like that and was familiar with it? >> not only knew that but i think they knew whoever it was knew their victims. there were two other folks in

the house that were unharmed. i mean i'm sure they were spoken to but, yeah, absolutely. again, no signs of forced entry and that person was not there to rob the place. there was no sex assault that appeared on the victims. they're going to be important. one of them i believe one of the females fought back. i mean what's under her fingernails and again, i'm sure there's things that the investigators know that we don't but, you know, hopefully they can put this thing to bed and bring closure to the families. will: it's a really interesting point, pete, i hadn't consider that had. it was reporting it was a k bar style knife with hunting and military applications but to be so efficient in this. think maybe it's not someone that's unfamiliar with weaponry or how to use it. i want to ask you about this and this is directly in your line of work, lenny, so again, we're making some assumptions here but the crime scene you'd have to think would be incredibly messy. dr. michael bott is a forensic

pathologist and talked about for example with that much blood, leaving behind of shoe prints and he was on hannity and here's what he had to say. >> there was a lot of blood on the floor, a lot of it from the stab wounds and the blood itself can tell how many people were stepping in it. the perpetrators step in the blood and one can tell if there's sneakers, bo boots and shoes and different sizes and shapes and one of the issues is how many perpetrators were there. the information at the scene gives them a lot of information about whether it was a single person or not. will: yeah, i guess i kind of want to tie that into pete's question, lenny, it seems like how could there not be a trail? you mentioned a digital trail. i mean a physical trail with that much blood, clothes, shoes, i have a hard time believing these perpetrators can

disappear. >> yeah, no, absolutely. whether it's one or two and could be multiple suspects. who knows at this point and it's all about collection right now. they're looking at all that and the fbi is involved and forensic folks turning that world upside downright now and hopefully they have some answers but again, once somebody is identified and my former folks, u.s. marshals are not involved yet but once they get somebody on their radar, hopefully they bring them on board and they're the best in the business in finding people and are pretty good at it. you can run but you can't hide and when you run, you only go to jail tired. pete: lenny, real quick, how do these things usually get solved in cases like this? is it forensics or someone, human intel and somebody knows somebody that says something or how does it end up? >> it's a variety of different ways and signal intelligence and human intense and they're putting that together. the streets talk as well. i don't know if there's a reward or not but they'll put it

together digitalty, q and aing people and hopefully come up with the suspect and again, like i said earlier, hopefully it's a matter of time because they need closure on this thing. rachel: there's been some mistakes. there was the trash dumpster from that house that was combined with the trash of another house, which of course not good when you're trying to collect evidence. hopefully they will get to the bottom of this. i know that town is on edge and so many parents whose children go to college there just not feeling safe right now. lenny depaul, thank you. >> thank you. pete: now to our other top story this morning. the justice department appointing yet another special council to oversee two trump related probes. will: the former president unloading at ag garland for pushing what he feels is a politically motivated witch hunt. rachel: kevin cork is live in washington. >> morning, guys. for the second time president trump is the target of a special council probe. this time the government says

it's investigating actions related to the 2020 election and the certification thereafter. let me tell you about the new special council, it's a gentleman by the name of jack smith, lead prosecutor is a special court overseeing war crime investigations against korea in new york in the 1990s and from 2010-2015 he read the doj's public integrity section. attorney general merrick garland refused to appoint a special council to look into hunter biden's business dealings for example said this decision was brought on by extraordinary circumstances. >> i have conclude that had it is in the -- concluded that it is in the public interest to appoint a special council. such an appointment underscores the department's commitment to both independence and accountable and particularly sensitive matters. i also believe that appointing a

to restore government for the people. >> trump later added, i've been going through this for six years, six years i've been going through this. i'm not going to go through it anymore. i'm not going to partake in it. now as you can probably well imagine, the president may not have a say in whether or not he partakes in the strobe. if he's saying he'll be less cooperative than in previous investigations, one might reason that the frustration is warranted. guys. pete: for sure. kevin, thank you. so donald trump announces for the white house and then just a few days later the department of justice announces a special counsel over his papers. rachel: it's the weaponization of our federal law enforcement and the doj and it looks bad because it is bad. it feels like a persecution and it has huge implications for the credibility of our law enforcement at the federal level but also we talked about this a

little bit earlier, who would want to run as a conservative knowing that if, you know, this could happen to you. you could have beyond the time you're in office, they're still going after him. will: as you mentioned in the previous hour, rachel, it still come withs no appetite from the department of justice. we'll see about republicans potentially taking -- i say potentially and i'll tell you why later but control of the house. i do think there's investigations that they'll try to focus on that as well looking at house members and seeing if there's other ways to take control of the house. the point is no appetite to look at other things like hunter biden. mike davis article 3 project president talked about that. >> this special counsel is going to investigate the noncrimes of objecting to the president's election. if it were a crime, the democrats would have been charged in 1969, 2001, 2005,

2017 when they objected to the election and they're investigating the noncrime of a former president taking a personal copy of his presidential records when he leaves office. he is specifically allowed to do that under the presidential records act, and where the heck is the special counsel to investigate president biden, his son hunter and brother james when there's clear smoking gun evidence of foreign corruption in china and the ukraine? rachel: amen to everything he says. it is not a crime to object to what you think might be fraud in an election. you're allowed to say that as an american. also this is a smoking gun with hunter biden. you know, again, the mar-a-lago raid, we talked about it earlier, they went through baron's bedroom and rifled through that and melania's closet and no one has gone after hunter biden. he's not gotten this kind of scrutiny and neither has the president or jill biden who's also involved in some of these dirty deals. pete: they execute add general

search warrant ornament a former president's home. that's what occurred looking for whatever they could find without his lawyer's there. only begrudgingly providing a warrant later on. we had to fight to get that. this is the follow through on that with a special counsel because they want a political persecution of a political opponent. be careful what you wish for because when you keep targeting someone who you'd like to end their political career, sometimes you reinvigorate it because people say, look at what they're willing to do in going after donald trump. that alongside the republican media establishment saying no, no, no more tram. can't be trump. you say that enough and people say, why are so many people telling me not to go for this guy? maybe i want to. rachel: you gave me an idea and hadn't occurred to me till you said that, maybe this solves two problems. they go after donald trump with this new investigation. they go after donald trump so they accomplish that goal.

and it does spark the republicans to go after hunter and joe biden, which many of the establishment on the left don't want joe biden to run. they want to take him out. so maybe this accomplishes two things at once. who knows. will: who knows. pete: very, very interesting and we'll continue to unpack this morning. turning to a few additional headlines starting with this. no arrests after three women were found stabbed to death inside a home in queens, new york. the nypd said the victims are all family members and a home health worker made the grim discovery and investigators believe the victims were killed in a domestic incident. and vice president kamala harris meeting briefly with chinese president xi with a trip to bangkok and both on the way to a closed door meeting with leaders across the asia pacific region. during their talk, harris echoed comments made by joe biden about maintaining opalines of communication between washington

# # >> reporter: pete, what a difference 24 hours made. yesterday downtown buffalo got less than a foot of snow and that's not the case now. buffalo got walloped overnight as a snow band moved through the area sports grill shifted north and -- and shifted north and areas outside of buffalo got five feet of snow in roughly 24 hours. with snowfalling at that pace, it's hard for plow trucks to keep up, many of them getting stuck. this is why the county, erie county imposed a travel ban for most of the hart hit areas. of course not everyone listens. more than 300 people received tickets for violating that travel ban. buffalo area runways are closed and hundreds of people without power but local officials are

and let's get your reaction to what he said and your follow up actions. the letter said your silence in the face of repeated pleas are deafening your refusal to look at the border to see firsthand the ai don't say and open border policies have made an un-precedented crisis and caused us to invoke the constitutional authority to protect ourselves. texas will deport illegal immigrants to the border. tell me your reaction. >> well, to the border is not deporting. and understand deport is an immigration word to be clear. this isn't immigration law and texas has authority under the constitution to protect itself, it's sovereignty and boarders when it is invaded. well, governor abbott acknowledge that had texas is being invaded and acknowledged the constitution gives him the ability to protect themselves, and this is a war power.

institutions they need to get serious. for example, the fbi needs to start directing resources properly toward national threats. rachel, no one can say this is not a top national threat to our national security. you have the fbi as you know has diverted resources to investigating parents that stand up at school board meetings so number one, they need to get serious. the fbi admits between every 10 to 12 hours they open a national security espionage case against china and between 2,000 and 5,000 cases going on right now. rachel: makes no sense why any chinese citizen would be getting this kind of training and funding from our government with top secret clearance and developing weapons. i'm literally flabbergasted and by the way with the fbi as well, you're right, they've now moved into getting after domestic terrorists and more

will: at least two snow related deaths in erie county, new york. the state is under a state of emergency and the county issuing a travel ban for hardest hilt areas. chief meteorologist rick reichmuth is tracking this. >> reporter: l people don't realize the great lakes are unique to the united states and the pattern that sets up the lake-effect snow doesn't happen like this anywhere else in the world and we're getting really extreme amounts right now. take a look at the map and we've got cold air in place. the issue is that the great lakes, the water temperatures

are still into the 50s and so you have that difference in air temperature from water temperature and that's what causes the lake effect snow to pile up, especially when the winds go the entire length of the lake and that's what we've seen the last couple of days and that's both lake erie and lake ontario and we've got about 240 miles in lake erie where you've got that wind going in one direction over the lake and it sets up this very narrow snow band. you notice that snow band has shift add bit to the north now. we have it to the south of the buffalo area and that's really where it was stuck for about 36 hours bringing up to 6 feet of -- 66 inches of snow in the highest spot and now that snow band has moved off towards the north and will stay through the day and eventually the snow will come back through with the wind direction change later in the afternoon and evening. big travel week, pete. if you haven't done it yet, download the fox weather app and if you have travel plans, fox weather app will get you home for the holidays safely and track all your conditions for

recalled chester bodin because of the same accusations he was recalled and they almost got the same da out in los angeles and going after larry krasner in philadelphia with the same accusations lee zeldin is putting on alvin bragg and shows race has nothing do to it's the position and policies you have. what i did when you guys asked me to do the story, i texted lee zeldin and he gave me a fiery response that i just gave to the news division but i'll read you the response. three things, he says if he was not -- if he was serious about cracking down on crime, he'd get rid of procriminal policies like the halt act, less is more and raising age. then saying our criticism of bragg has nothing do with the skin color but being the weakest and procriminal das in the country and bragg keeps on focusing on the facts that murders and shootings are down. good, congratulations, i'm happy about that but every major -- the other major, z seven mayor

criminal categories are up to the tune of 70% from 2021 to 2022. it's up 25%. think about how different, pete, that is from what we were living through over the last 15, 20 years. we've been commuting to the city. we went from the safest city to one of the most unsafest cities. this guy takes over and makes the criminals first. he wants to lean on race. i'm insulted by that. every black person in the country should be insulted by that. they're the victims of most of the crimes. pete: lee zeldin simply pointing out the reality of policies never made it about the color of anybody's skin. but that's where he reflectively goes or he has to defend the policies you talked about, brian, he doesn't want to and can't. the lawlessness he's creating is something he knows he's encouraging. how could you not when you let criminals out of jail and don't prosecute. >> pete, the other thing is when you look at what's happening in new york and people around the
