rachel: we're back with a fox news alert at least five people are dead and 18 others are hurt after a gunman opened fire inside a gay club in colorado springs overnight. >> club now revealing customers stepping in to help stop the attack. the club saying in a statement in part, that they're devastated by the senseless attack on our community. we thank the quick reactions of heroic customers that subdued the gunman. police and the fire department captain were all on the scene. >> but working with pd we're able to get everybody transported out of here in a

pretty we can manner. and get them to the hospital where they have a definitely a better chance for their injuries. >> officials are still working to identify a motive. gunman is in custody and undergoing treatment at the hospital. rachel: and now to another fox news alert. moscow, idaho police are shedding new light on the gruesome murders of four college students. will: police have not identified the suspects or any suspects or revealed any suspects as the fbi arrives at the crime scene. the university of idaho is now planning on holding vimg toll honor victims on november 30th. pete: ashley strohmier has more. ashley. >> good morning new information in brutal murderrings of four university students police honing in on details of the victim final moments now clarifying that a surviving roommate made that first 9-1-1 call before last seasoned that roommate identity hasn't been reveal thed but police did not

consider them a suspect. investigators also seen yesterday measuring tire marks near the crime scene after clarifying that two of the victims took a, quote, private party ride home. not an über as originally suggested. it is not clear who drove that private vehicle. but police say they do not believe he's involved. fbi agents and proximate results were also seen near the crime scene yesterday as the investigation hits the one-week mark. the parents of victim kaylee join lawrence jones last night with these memories of their daughter. >> our daughter was driven. she was a three-time deans list member. grades were amazing she competed with everybody. she loved competing. she was just a highly driven person who -- >> had many goals in her life. she was literally a through and through you hear about this type of stuff happening. mom did you hear about that? she kept track of it and and she

was very aware of her surroundings and think someone was following her and saying mom there's somebody following me and i'm like kaylee call the police nevermind they just turned into 7-eleven just she was aware. you know, and very aware. rachel: phone records show kaylee called ex-boyfriend long time friend jack multiple times night of the attack her family says that isn't unusual for her and insist on her innocence. police are reviewing fient movements hoping to turn up any new clues as they say there were no signs of forced entry anywhere in the home. moscow police are set to hold a press conference with the latest at 3 p.m. pacific time. well rachel, pete back to you. pete: thank you ashley. meanwhile, one of the victims kay lease parents were on cross country with lawrence jones last night. they were asking you saw mention there and ashley's report asking for people to contradict to timeline look at it.

getting band-aids. >> any piece of evidence at this point. right you were talking about they talk about teslas must be a technology -- will: they're on the path to being self-driving crams all over. i don't know if they record all of the time wouldn't be surprised if they do. but if you -- if you live in that area and you know the timeline of where they were and when they were there, anyone along that route i'm sure that's part of what law enforcement is doing too right now. cell phones entire society is video these days for more on this let's talk to someone who has -- deep experience in homicide investigations. he's a former homicide detective ted williams. and he's with us this morning live from moscow, idaho, ted glad to have you with us this morning. you were with us earlier in the show if i could without leaving information or jumping ahead of the information. i did topght follow-up on something on notice several times in the conversation earlier. you said law enforcement is, you know, not revealing as much as they might know about the person

or persons involved in this crime. is it significant that i've heard you and others continue to say potentially persons or is that sort of standard, standard language used to keep as many options open as possible? is law enforcement suspecting this could be multiple individuals? >> we don't really know what they suspect. but they don't mean law enforcement want to have a closed mind. and so they are looking at a broad perspective they at this stage i would assume know by the evidence in that house over my shoulder here how many individuals are involved. it's really strange and eerie. when we look at the house that's over my shoulder here, we see the automobiles. these are the automobiles of the victims. these automobiles as well as the

lights that we see on in this home with exception of one law enforcement vehicle here are frozen in time. all of this guys are part of the investigation. and even as we were here yesterday, we saw law enforcement officers. we have state and we have the fbi, and we have the local police that are going in and out of here. so this is really, still a very, very active crime scene. pete: is there any evidence that things were taken from the home. any theft at all? or is this at this point just a targeted killing of maybe one or two with others caught in it as well? what else do we know about that? >> from what we know at this time, law enforcement have ruled out robbery.

there was nothing that we know was taken from this home. the one idaho division of criminal investigation investigator has mad it clear that one or more individuals in that home was a target of this killer or killers. so there's a elemented amount we know hopefully this afternoon law enforcement will share more with us that we can disseminate to the public. because i listen to those parents this morning. and your heart just have to bleed for them as well as the other victims and their relatives involved here. that are what they believe is that the public -- in the eyes of the public can help them and help law enforcement to solve this. the fbi has brought in their forensic unit, and they have taken as much as they could in

the sense of samples out of this home. they're still processing it as i said. there was a great, great deal of blood at this scene. and as a result of that, the blood would have gotten off on the perpetrator or perpetrators and those people would have left some kind of a digital fingerprint i believe and law enforcement i believe is following up on that also. rachel: ted, i interviewed doctor michael baden a little while ago and he was concerned about botched evidence. i want you to hear what he said and then get your thought on the other side. >> concerned about tire marks. that is, should have been done right away because the passage of time weather conditions -- other vehicles coming in and out such as ambulances and medical examiner coroner vehicles, will

obliterate or change tire marks they are not protected immediately. ted that's not the only mistake. there was a combining of trash from outside one house with the house of the victims. another mistake. how can these -- what do you make of all of that? >> you know, i share concerns of doctor michael one of the most forensic pathologist we have in this country. the contamination of a crime scene is certainly something that law enforcement is always concerned about. not taking anything away from the moscow police department. but they're not a police department that have had a great deal of -- experience dealing with homicides or here in this city. and as a result of that, when they first got here, they got in after they got that call around 12:00 on sunday and they came in.

they found the door here open at this time. and then they went in, they found carnage and i'm deeply concerned about the contamination as michael baden is of this crime scene at the initial stages. but i do believe that law enforcement have enough information. they have enough evidence to work with to try to bring the perpetrator or perpetrators to justice in this case irrespective of maybe some contamination at a crime scene. >> they would as you're talking we have images on the screen that show the home you're stapgding in front of in daylight i'm curious we've talked about ring doorbells and way technology records every aspect of life. one thing i haven't been able to gather is context of where you're standing is that a neighborhood with a lot of homes. i do see other structures around this house on the video screen. are you buried in a neighborhood with a lot of other dwellings that could have those ring cameras? what's that area like?

>> that's a good question. i can tell you this is a very contained neighborhood. and i'm sure that law enforcement is going door to door to find out about who may have various kinds of video or cameras that they can use in this investigation. but again, without being redundant there are homes all over the place apartment buildings, it is a college town. it's a college area. and a lot of students live in this area. so it's a -- large gigantic job that law enforcement have in front of them in trying to bring the perpetrator to justice. >> it could take time and sometimes colder the case could get. ted williams thank you so much for your time this morning. >> my pleasure. will: we appreciate it. smart guy now turning to few additional headlines starting with this.

world war ii hero john heffernan finally laid to rest after returning home tuesday. he was kilted in action 80 years ago after japanese forces shot down his b25 bomber in burma. he was considered missing since 1944 and remains weren't found and identified until last year. his funeral was held yesterday in new jersey. he was laid to rest in st. johns cemetery in queens. beautiful to see us following through on hero like that. and where else in new york, disbarred lawyer who fire bombed a police car during the george floyd protest in 2020, is sentenced to -- just 15 months in prison. initially facing ten year prison sentence before dropped to five year and ultimately just 15 months. she'll also have to pay $30,000 in restitution to the nmgd. so if you walked into ka toll you might be in prison for ten

i want to show you the roads here in south buffalo. you can sew right over here some of the main roads look they're messy and for the most part they are clear. but if you walk over here and turn corner we go from main street and turn over to the residential streets you can see over here it looks like it is barely been touched. and this is what local officials will be working on all morning. they'll be addressing these residential streets. they have about 90 to 100 pieces of large equipment. but crews are the only ones who have their work cut out for them. if you can take a look, those are actually cars hard to tell because they're buried under feet of snow so people here are going to have a hard time digging out this is heavy wet snow something that local officials have been warning people about. because they don't want people overexert themselves. despite all of that, officials here do sound optimistic and they're making sol progress in the mood here does feel brighter. rachel.

rachel: thank you madeleine. appreciate it. well -- >> so texas governor greg abbott combat overwhelming surge of illegal immigrants and let's ask chris olivarez with public safety. lieutenant great to have you on the show we appreciate what you guys do and how much information you give us so we had this discussion yesterday. what does governor abbott, there's been a lot of discussion about potential to declare invasion what powers that gives the state so under what governor greg abbott declared what now can you do differently than what you have done in the past? >> right good morning, will thanks for having me on great to be with you guys this morning. we know now that state of texas continues to take action especially leading this border crisis by being at the fore front in boater security and now with the governor announced most recently is to invoke invasion clause to give us authority to

apprehend illegal immigrants and turn them over to officials in mexico where they'll then be returned to their countries. right now we're apprehending immigrants on private property but what we're doing is taking them to ports of entry turning them over u.s. border patrol who then for the most part we've seen released into interior and hoping this will give us authority to apprehend illegal immigrants who go into country illegally and turn over to officials illegally and everything from day one has been criticized we've been challenged by the federal government and it's going to be no different with this. initially that governor announce sod we do expect challenges from the federal government but again going to continue moving forward. our state leadership will be having that conversation to implement this invasion clause because again it is going require manpower and going require additional resources as far as vehicles to transport also process centers if so we want to make sure that we have everything lined up because we do expect challenges from the

federal government. will: great information. okay, lieutenant i appreciate that so first of all always good to put into context in response to failure to act bit federal government what we could be looking at now is not just a failure to act but affirmative position in stopping you, texas, from acting but listening carefully to what you say. in the past would have apprehended turned them over to federal immigration officials. what you're hoping i heard you say is now, this declaration gives you the power to return those illegal immigrants to mexico and hand them over to mexican official nows many, some have pointed out lieutenant that abbott declaration says return them to the border. and then there's been some criticism or some question over what does that mean to border is not across the border. return them back to mexico -- what is your current understanding of that? is it that you do have the power to de-- deport is not the right word but to put them back over the mexican side of the border to

mexican officials? do you have that power? >> that's what we're hoping with this invasion clause as i mention, though, our leadership will be having those discussions this coming week with governor office to see how we're going to implement that. back to your question we were explaining situation is fact that yes right now we're still apprehending immigrants but we are turning them over to ports of entry, and releasing them to u.s. border patrol and then again processes and releasing to the country. so now with this invasion clause, we want to kind of just completely cancel that process where we don't have to turn them over to u.s. border patrol but to mexico. now, also in addition to that, we've got to make sure that mexican government is also -- is going to be onboard with a current initiative and accept these immigrants from the state of texas. we know they accept them from border patrol but now the question is are they going to accept them from us when we turn them over so we should have some more information this coming week as far as how we implement this invasion clause, but again sending a clear message that state of texas is stepping in and we're going to do much as we can with resources that we have to try to stop this flow of mass

a 2022 election waiting on us in georgia with herschel washing and maybe get through that one before too far into 2024 but it is fun for political bheem like to play the game of picking winners and losers and horse races but it is way too early to determine who is going to break out of this very crowded field. rachel: do you think these candidates or people went to speak at this jewish association dinner made it they shouldn't have done made these statements perhaps that they should just wait until we know what happens with herschel walker? >> i think it's inevitable that the people who are seriously considering running they're going to, you know, throw the line in the water and say let's see if any, you know, anything bites it. but i think it is too early personally. i think it is way too early. we need to get through the cycle we're in and then we can turn our focus on the next one. we need to also get behind a republican house of representatives and get them started on the right foot in january.

but you know i don't get to make that decision. each of these candidates will make their own. and because it's starting early, they'll all jump out early. but a lot of them will burn through the money they raise and they'll wish they hadn't started out so early by the time a year goes by and then they're actually into a serious primary hunt. >> that's interest. that's an interesting point how rt -- starting early may not be strategy in terms of the money you sound like someone who doesn't like christmas to start until after thanksgiving, right? basically nothing. but brought down by the collapse of the sub prime mortgage market lehman brothers highly leveraged mean they brothered a lot of money to double down on those bets, which means you don't have the money in the first place. and then the value of the underlying asset goes away, and you really have nothing. j same thing with ftx borrowed against underlying asset ftt and minute mortgage rates or interest rates in this case go up now you can't pay back debt that you have borrowed against that fake money. >> correct and then effectively saying -- i'll go bankrupt. but in this particular case what's interest about this lehman breers very powerful wall street firm no one ever prosecuted or jailed i think it is a little bit different in that it was a very speculative bet that went wrong for a lot of people in the process. >> this beget final collapse this was a beginning of a larger recession that impacted many of us. many waving a ftx scandal but
