have a trial over larry krasner and win or lose, we'll find out a lot more why progressive prosecutors won't prosecute crime. paul: thanks to you all, that's it for this week's show things to my panel and thanks to all of you for watching. i am paul gigot, i hope to see you here next week. >> we begin with a massive group of hundreds of migrants at the southern border this morning. red flags are raised over the vetting process after agents nabbed hundreds of criminals illegally entering the u.s. last month. hello, welcome to fox news live, i am arthel neville. >> for row number two today my
1:01 pm
friend, good to see you. i am bryan yanez in for eric shawn as border agents faced tens of thousands of illegal crossings each month but state governors continue to send migrants north, 72 arriving in philadelphia. it's expected to grow worse with the exploration of title 42, trump era that lets the turn away migrants at the border. >> when you look historically we should only apprehend 30 to 40000 people every month. we are up to 200 people. we should only see 5000 getaways every month. we are seeing upwards of 60000 every month and it continues. month over month. >> numbers are astonishing, kc steagall live at the border. >> good to see you, more than two 30,000 migrant encounters, just how many were reported at the border last month. we haven't even seen the numbers
1:02 pm
for november yet as we prepare to wrap the month up from 40% increase from the previous october and more than 220% increase from two octobers ago. the dr read del rio sector exchanges large groups of migrants traveling together. this morning we saw a group of at least 180 and a short time later another group of more than 200 that were apprehended. it's a mix of cuban, colombians, ecuadorians and dominicans while the last day, a fourth bus of migrants arrived in philadelphia. officials tell us time and time again they hear migrants telling them word is out the u.s. is open. >> red carpet, welcome red carpet to immigrants and that's why they continue. we are not seeing consequences.
1:03 pm
we are consequences yet nothing is being done. >> dhs pushing back against calls for secretary alejandro mayorkas to resign or face possible impeachment. that's from gop house leader kevin mccarthy. dhs says mayorkas is not planning to step down and contend the agency inherited a broken immigration system. bryan: kc steagall live in eagle pass, texas. thank you. >> for more, the border crisis and republican calling on dhs secretary mayorkas to resign. let's bring in arizona attorney general mark brnovich, thank you for joining us again. i want to start here, cdp commissioner resigned last week at the request of secretary mayorkas so should mayorkas also resign? how would it help? >> eventually you have to hold
1:04 pm
people accountable and as the report indicated we see record numbers, we are losing adjectives. since joe biden became pres president, is the equivalent of four u.s. states illegally entering the country. we seen enough internal to potentially kill every single american and this last month more than 200,000 encounters, that's like to tiger stadiums in louisiana every single month entering the country illegally so we as a society, not fair to taxpayers and we've allowed them to seize control of our border so secretary mayorkas needs to either resign or impeached because someone needs to be held accountable for this incredible failure or catastrophe joe biden created at the southern border. arthel: who should replace him? >> i'm not sure i think joe biden kamala harris should reach out to republicans.
1:05 pm
on the attorney general of the state, federal prosecutor gained prosecutor, i've invited kamala harris and joe biden to visit and sit down with us. i've tried to reach out to secretary mayorkas and they said nothing and refuse to meet with us or talk to people on the ground and states like arizona or texas so you have to have someone willing to work with law enforcement and across the aisle to protect americans to secure the border. arthel: did i hear you write that you said you reached out to the vice president and the president and got no response at all? not thank you for reaching out but we'll get back to you or something, we don't need your help, nothing? >> essentially nothing. at one time dhs responded for request for information regarding the cost to house people illegally in our country and we talked about this months ago but u.s. taxpayers spend tens of millions of dollars
1:06 pm
housing people illegally entering the country so people legally enter across the border, the toughest question is the want single bed or a double bed and where they want the flight to go? it's not fair other than that on the cost, they refuse to meet with us or talk and refuse to collaborate with the state on how we can work together to solve the crisis because the cartel seized control and america is less safe. arthel: seems like you would be a good resource. let me play this from debbie klesko, she's from arizona as well. >> i've gone down to the border multiple times and talked to border patrol officers, they are so frustrated, the border is wide open. arthel: again, how would talks
1:07 pm
of investigating -- i get someone needs to be held accountable. meanwhile you see the numbers, casey stegall is down there right now, numbers are astonishing they keep coming over and over. what's going to help stem the flow of illegal crossings immediately? not to say needs to be a long-term fix but what happens right now? >> this shouldn't be republican versus democrat, right versus left, it's a fundamental issue of right versus wrong and starts with policy so even if right now you hire thousands of new ag agents, it wouldn't matter when federal government joe biden and secretary mayorkas that have policies that incentivize people to break the law so you have to stop the incentivize nation. we saw the biden administration and dhs to a deal with the aclu to drop title 42 to encourage
1:08 pm
more people -- they keep incentivizing -- one think we should do is go back to president obama, you can have a surge of the border and get federal prosecutors and judges and start prosecuting people legally entering our country and it will deter people from crossing. arthel: we need to get something done but i want to be on the record saying the past week the federal judge put on hold his initial ruling the u.s. title 42 to be expelled, that was his order in the biden administration -- go ahead. >> i didn't mean to interrupt, it's still set to expire. arthel: you are right, 21. go ahead. >> you incentivize and decriminalize activity and you see more and that's what we see at the southern border spee8.
1:09 pm
arthel: dhs says they have plans to include removal authorities such as expedited removal and migrants and they will not be allowed in the you feel it's stuff on paper not working. >> i guess that's what they do in d.c., the people, republicans and democrats they talk and complain and meanwhile the border states pay the consequences, every state is a border state as a result of cartel flooding our country not only fentanyl, we seen increase of cocaine coming in and more than 100,000 pounds of fentanyl this past year so we are paying the cost as a result of failed policies out of the biden administration in washington d.c. arthel: you're right, something has to be done because it's not a republican or democratic problem, it's an american problem. mr. ag, thank you so much. bryan: the murder mystery in

case. for the first time we saw investigators poking around the crime scene, this is behavioral analysis unit from the fbi i'm a they've been here a week trying to come up with a criminal profile to catch the killer. if they have one developed if not shared with the public, retired fbi profiler tells fox news the killer is likely about the same age as the victims compulsive, felt rejected or cumulated by a victim and it's probably his first homicide. police continue to process a lot of evidence, we are told they submitted to 60 digital photos in the area. there's a lot of work at the mobile forensics unit and we are told 113 pieces of physical evidence has been sent to the idaho state patrol crime lab for processing and analysis.

but did you manage to get some while you are there? >> i had clam chowder and lobster rolls as well, don't worry, i'm well said. arthel: very good. thank you. from a cruise ship is set out from new orleans thanksgiving eve. alexandria hoff has the remarkable story. >> what makes the survival miraculous and so unlikely is no one reported seeing him fall so it's not even known he gone overboard into the next afternoon yet he was spotted. keeping himself afloat in dark watters of the gulf. it is believed he was treading water up to 21 hours. the coast guard rushed to organize a rescue after a ship aware of the search spotted him 20 miles from the mouth of the mississippi river and hoisted them to safety. the coast guard rescue mission coordinator for the new orleans sector shared this. it took a team effort from coast guard watch standards response crews and professional partners operating gulf of mexico to locate the missing individual

and get him to safety. first responders say the man identified, was exhibiting hypothermic like symptoms but clearly responsive. they are calling the outcome a miracle. he was last seen by his sister 11:00 p.m. the night before when he left the cruiseship bar and reported her brother missing when it was clear he didn't make it back to his room. six hours before 8:30 p.m. thursday thanksgiving day the rescue was made. the ship the man was on was bound for cozumel, mexico and the vessel assisted in the search by turning around and retracing the route. bryan: not only 21 hours treading in the water, surviving up to a 13 story fall. arthel: i was wondering what he might have been thinking to keep himself afloat and think goodness for the coast guard. holiday shoppers snagging discounts.

holiday break, a lot of travel and increased circulation of illnesses right now and steep increases in the number of people sick with the flu and r rsp. >> it's true covid is smoldering but now we have rsv and influenza searching. those are also serious viruses so it seems a reasonable thing to do if you are going in pu public, put on the mask and social distancing. this may be the time to rent a movie rather than going to the movie. >> health officials are recommending people mask up in indoor public settings, a recommendation, not a mandate. >> the mask is a polarizing way given everything we've been through but a mask mandate is a
1:27 pm
different thing. mandate is different than voluntarily wearing a mask. arthel: even though is a rise in covid cases, covid hospitalizations and deaths remain low spike in cases is below the surge during the hike of the pandemic health officials want people to be careful in public indoor settings considering the recent rise in infections and it could be nice to stay home and enjoy hot clam chowder. >> especially if you're in nantucket. arthel: sad news from the entertainment world. oscar-winning 80s pop icon irene cara found dead in her home in florida. no word on her cause of death. she was the voice of it theme songs for 80s movies, fame and flashdance. she started in fame, she was a

early voting is now underway and george is closely watched senate run off of the state supreme court gave green light in a last-minute ruling. money continues to fall in is democrat senator raphael warnock and challenger herschel walker look to get out the vote. steve harrigan is live with the latest. >> a study low here for early voting mile an hour to two hour wait in many going places across the state seems to be enthusiasm
1:33 pm
for people to come in runoff election for the senate in georgia and it is raphael warnock against republican candidate herschel walker in the two sides are pouring money into the race, $35 million so far just on tv and radio ads in the runoff election alone and a theme of the ads on both sides for and against, is the character of herschel walker. >> you think herschel walker would want to explain what he do in the senate if he actually wants to represent georgia. instead, he repeats the same lies. >> he's the heart of a servant, he wants to give back and help the people of georgia. >> warnock won the first round by 737,000 votes but didn't reach 50s% and that's why we are in the run it. they are moving toward the

center, suburbs around atlanta trying to pick up moderate independent voters in the key is governor brian kemp among the public and. 200,000 more votes than herschel walker and now on the campaign trail trying to let his support to walker. arthel: i see the lines behind you, thank you. bryan: control of the senate has already decided that the runoff will impact the balance of po power, a win for democrat will give a clear majority without needing tie-breaking votes from vice president harris. that would affect the committee memberships and legislation. let's bring in judith miller, pulitzer prize winning author and journalist and fox news contributor. let's talk about why this matters, why does this matter in your estimation given the fact that the senate has been decided and democrats have the tie-breaking vote? >> what the democrats are
1:35 pm
looking for in a warnock victory if they could see her secure his breathing room. they don't want to powershare with mitch mcconnell, the republican leader, they want to pursue the biden agenda and get as much done in the senate as they can since they have lost the house. therefore, for them, warnock is really important vote and very important to democrats because they've been pointing out almost every candidate donald trump act and herschel walker was one of his chosen candidates has not one. for a lot of reasons, a lot is at stake in georgia. bryan: who will talk about the latest poll from the aa rp, warnock is up ahead of walker by
1:36 pm
four percentage points. according to the reporting, it looks like people are showing up. i wonder what you make of the high turnout and what does herschel walker need to do? >> i think the high turnout will help democrats. this past week georgia supreme court reinstated the six week abortion ban and is likely to energize those people were actively or grow antiabortion but in a state of georgia as conservative as it is, pro- abortion people turned out in far greater numbers. another thing that helps war warnock, i believe is the fact that he continues to maintain the 11-point advantage when it
1:37 pm
comes to independence. it was the independence that gave governor brian kemp, georges ron desantis if you will, superstar of the republicans in georgia, he got that because independence sided with him. what will they do now that it's just warnock and walker? walker has to convince them to vote republican and that's an uphill battle. bryan: you mentioned the former president, a lot has been made whether or not his influence hurt or help. many have said it hurt them. what you make of him staying out of the race so far and kemp who avoided herschel walker and all of a sudden dragging him to the finish line? >> all of a sudden there's
1:38 pm
solidarity but it's very late and the fact that donald trump has not gone to georgia to campaign for walker tells you he wants to maintain distance. on the democratic side barack obama is going to come to georgia thursday just before voting ends and i think it will boost warnock as well so trump's distance and democrats embrace of warnock also helps. bryan: if you are governor ron desantis, you're looking at this privately and thinking what? >> brian kemp is almost as popular as ron desantis is in florida. these were two big wins and i think brian kemp will be watching very closely. of course he wants walker to win
1:39 pm
but it would not be so bad if walker did not win if kemp was not on the ticket so a lot is at stake. bryan: final sprint, ten days to go before the december 6 runoff. thank you for joining us. arthel: now live look at alex hogan's office, the world cup matches. the latest from qatar, next. in which means mr. harvey, could picture the perfect night. we're ready for the holidays, so you're ready for what's next.
