thank you. >> dana: fox news alert right now the supreme court is set to hear arguments in a case challenging the authority of the biden administration to set immigration policy. the case u.s. versus texas coming as thousands of migrants every single day enter the country illegally threatening national safety and putting a major strain on border states. retired border patrol chief explaining his major concern with the growing number of illegal crossings. >> what worries me wasn't what we arrested? but what got away. we had no idea who was coming across and it's the worst i have seen in the last 35 years. >> dana: so they will have this argument today. dr. bill bennett was talking about it earlier. we can bring it up if you have it. maybe we don't have it. that might be for later. i would love that. this is dr. bill bennett talking about the importance of the
7:01 am
supreme court argument zbloochlt what's at stake is the well-being of the united states and if we protect its borders and protect the integrity of this country. texas understands that these cartels are foreign terrorist organizations and should be treated as such. >> dana: so we'll watch that indeed. >> bill: when he talks about the gotaways, remember, october 1st to mid november 13, 6000. where did they go? right? >> dana: we got started a little bit -- a minute late because i wanted to talk about that. welcome to a new hour of "america's newsroom." i'm dana perino. >> bill: i'm william george hemmer. more than 1,000 venezuelans fighting with police while waiting in mexico to get into the u.s. casey stiegel stands by at the border as we look at a supreme court case that puts biden's immigration policy on the docket. the key issue a 2021 directive

halting most migrant ex importanttations except in cases involving a serious threat to public safety. three issues. do states have legal standing or the right to bring the lawsuit? does the biden policy disregard federal law? and does the judge who vacated the directive in june nationwide actually have power to set the policy aside? big ones on the agenda for them. >> dana: indeed. there is going to be other states that are paying attention to this. i said it affects border states a lot. not just border states. all the states are feeling it. you can see that across the board. casey stiegel is live in eagle pass, texas. you see it every day, casey. what have you found today? >> let's talk about that clash. we want to show you the video. this happened between mostly venezuelan migrants and mexican authorities. it happened just across the river from the city of el paso after officials in mexico tried
7:03 am
to dismantle a makeshift migrant camp that at one point reportedly housed up to 1,000 migrants who said that they were all waiting there until title 42 expires next month. then they were planning to cross into the u.s. well, anger and chaos ensued as mexican officials cleared that site and migrants were offered bus rides to official shelters. u.s. law enforcement monitored by ground and by air because this is the same spot where weeks ago migrants did illegally cross and assault american agents. >> if you are getting hit with people that are surrendering in a local area, you have to collapse your operation. to be able to deal with those in processing. which means they are going to be huge blind spots along the border that you simply can't patrol. >> agents in nogales, arizona

journalist bombards a u.s. team member. both teams need to win in the match today. coverage in a moment with clay travis standing by to reaction. alex hogan is live in qatar. >> if either team loses tonight they'll need to pack their bags and head home. for the u.s. there is a lot at stake. their first world cup in eight years. a tremendous amount of pressures from the players from iran and the political turmoil off the field. their players did not sing the national anthem before their first match seemingly in solidarity with the protests for women's rights back home and now the families of iran's athletes have been threatened with
7:06 am
torture and violence if the soccer players make that stance again. i asked the u.s. team about that heading into today's match. >> will you give me your reaction to seeing the players in their first match not singing the national anthem? >> we know they are going through things right now. they are human and we empathize with that human emotion. we completely feel for them. >> the u.s. has played iran twice losing at the world cup in 1998 and then tying in a friendly in 2000. americans here tell me they're nervous but confident in this team. >> i have a feeling we'll win. >> i think they can really rise up and show the world what american soccer is all about. >> a great number of these players actually played pro in europe. something they say helped them a lot in the world cup so far. they are also the second youngest team at the world's
7:07 am
largest sporting competition. >> bill: they have an opportunity. let's go grab it. alex hogan. >> dana: let's bring in outkick.com founder clay troveis and you are suited up and ready for the game. quite a moment to watch the u.s. versus iran. there is the sport and athleticism but also the geopolitical issue underlying all of it. >> yeah. dana, that's what is really standing out. if you are just a sports fan and you love soccer, i know there are tens of millions of americans in that camp, this is a massive game because it is win or the world cup is over. remember we weren't in the world cup four years ago. this is the biggest match the united states has had in at least eight years. then you add on the layering here of the team that we are going up against is iran and it feels an awful lot, bill and dana, like a 1980s style match-up against russia against
7:08 am
the soviet union when we were in the middle of the cold war. it's not china necessarily. certainly or north korea but i think of those three countries, iran, north and china as the four most adversaries on the global stage for american way of life right now. and given what's going on in iran, the protests and the fact that women are speaking out there asking to have basic human rights. there is a lot of talk about how come the u.s. women's soccer team is better than the u.s. men's soccer team on the global stage? i think it's because of what's happening in iran now. do you know when the women's world cup bracket comes out and you look at the match-ups, you can pick every winner of those matches just about solely by analyzing which country provides more freedom to women, right? men around the world, if they are great athletes, the end to get opportunities to make a lot of money and represent their
7:09 am
countries. many women still don't. certainly not in iran where recently they wouldn't allow women to watch their national team play and forcing women to wear the hijab. some countries don't allow women to wear shorts to play a soccer match in the middle east. our men certainly have way more competition on the national stage than our women do. it is because of american -- women athletes have opportunities in the united states and much of the western world that don't exist anywhere else. that's important on these national stages to point out american exceptionalism and what alex reported. think about how much time we say it's so brave of american athletes to take knees when they get awarded by woke corporations millions of dollars in endorsements for this. iran merely not singing the national anthem there are reports as we just shared that the players' families could be tortured in their country.
7:10 am
that's true bravery. there is a lot at stake here, far more than who wins this match. i want the u.s. to win but this is a seismic day on the global stage not just for sports but human rights around the world. >> i think the u.s. men's team has a real opportunity here. they can catapult this sport as we've been trying to do for three decades today with a single victory. one of these teams goes home and what i'll be looking for is what happens before the match begins? what sort of transaction happens physically between these two teams? what kind of pictures do they take? do they exchange anything? there is a real opportunity, for those men during that press conference who kept their composure and took those shots and took those questions and answered it with maturity, they have an opportunity here to show a gesture of peace or whatever you call it between these two
7:11 am
countries prior to the kickoff of this match. last comment there. >> there is no doubt. this is why it's so fraught. on the pitch, on the field, however you want to classify it, iran has a great defense. and so i expect they will pack the defenders back and the tension will continue to grow over whether the united states can score and sort of free up the way this game is going to be played. but yes, when they're playing the national anthem. you guys have covered this story on fox news, i know it is up on foxnews.com and outkick. we talk about good and evil. many people want to tear down the american form of government and argue that america is racist or an awful place. the truth of the matter is iran and their government, not the iranian people. the iran government represents true evil in the world today. it does. and the players certainly do not represent that. they've been willing to try to stand up for change to fight
7:12 am
back against this regime of their country. to the extent that the united states -- i thought the answers to the questions were so goodbye united states players. to the extent we can continue to point out hey, we welcome the iranian people. we appreciate and support you as we do in china the people protesting their government. we may not love it when they are protests that take place in the united states streets but it is fundamental for the united states. they kill protestors in iran and china. they disappear. even the world cup broadcast, every time they are showing fans not wearing masks in china, they are editing those shots because they don't want the chinese people to know that most of the rest of the world is over covid. this is big, it's crazy. it is a seismic day on the global world stage not just for sports but for human rights. >> bill: let's get a w. >> dana: well said about the

freedom for women around the world. thank you, clay. good to have you. two outcomes for the u.s. in today's match with iran. win and advance to the next round but if they lose or just tie, they go home. all eyes will be tuned in. coverage begins at 1:00 p.m. eastern on fox. >> bill: we're watching. the fight for freedom unfolding in china. mass protests going beyond easing covid restrictions. should the u.s. get more involved? senator tom cotton has a voice on that and coming up next. >> dana: president biden pushing oil production in venezuela. pulling the plug on the keystone pipeline here in the u.s. what happened to all the energy jobs he promised? >> president biden: not going to lose jobs, we'll create jobs. these aren't pie in the sky dreams. these are concrete actionable solutions. we know how to do this. together we support immune function. supply fuel for immune cells and sustain tissue health. ensure with twenty-five vitamins and minerals,

clearly china is a major economic player and china still struggling with covid. there is an impact on the economy obviously. >> shanghai disneyland closed again after opening four days ago. a $5 billion facility from disney saying they are complying with china's covid 0 restrictions. china reported 32,000 new covid cases monday and a country whose health system is underdeveloped. the latest world bank data showing china has fewer hospital beds per 1,000 people than kazakhstan. it's why beijing argues they need strict measures to prevent covid from spreading across the country. >> bill: susan lee, thank you for running it down. >> dana: let's bring in arkansas republican senator tom cotton. author of the new book "only the strong," a great back and i really enjoyed it. china hasn't done anything to
7:22 am
improve its health system or hospitals. if they can't take care of people if they get sick from covid. >> no, it hasn't. china unleashed the plague on the world including its own people. they have had the counterproductive 0 covid policy for a long time and now they have a dilemma. for unpopular and caused many deaths in its own right. if china were to relax the policy because of their low and poor quality vaccinations since they refused to use foreign vaccinations as well as low rates of immune tease they would have a big surge in cases. more fundamentally biden shouldn't be treating it as a public health china to give them to address he should voice american support for these brave chinese who are in the streets demonstrating against their communist government. again, this is not just some protest on a college campus in america or european capital. these chinese are protesting the
7:23 am
world's most powerful, dangerous, totalitarian government. like ronald reagan stood with the voices of freedom in the solidarity movement in poland or t told -- we should stand up for the brave chinese protesting their government. >> dana: unlikely to happen. the "new york post" cover people saying they know what they would like to write on it but know they can't because their government will go after them. there is dissident, the son of a communist party leader living in the united states writes don't let china stage another tiananmen square massacre. i would love your take on what the white house should have said instead of saying we stand with protestors but we're moving on.
7:24 am
>> one reason president biden should speak in his own voice on camera in support of these brave chinese protesting the communist government is to prevent another tiananmen square massacre by saying if the chinese communists use force against their own people there would be massive consequences not just sanctions on those responsible in china's government or withholding visas from family members but concrete actions like withdrawing china's most favored nation status. we should stand with these voices of freedom inside our number one adversary. joe biden is saying exactly what he did throughout the cold war and what barack obama did in 2009, we don't want to be seen as foreign meddling. everyone knows we aren't meddling and these are organic protests of the chinese people not just about covid policies but their yearning for freedom. they're dying to hear from america, from the leader of the free world, that we support their deepest aspirations.
7:25 am
>> dana: do you think we're helping behind the scenes at all? >> probably not doing enough that we could. corporate america could take steps to help these chinese citizens communicate with each other. apple, which of course is deeply invested in china and has deep market penetration on its iphones could be enabling certain features that would allow them to communicate with each other so they can organize larger protests. we should take every step possible to help these chinese voice their deepest aspirations for freedom. it's exactly what ronald reagan did in the cold war, what we should be doing now. as i write it didn't lead to confrontational war it led to peace, success and victory. >> dana: you wrote that in "only the strong." thank you for coming on. see you soon. >> thank you. >> bill: elon musk picking a fight with apple suggesting the tech giant hates free speech.

7:32 am
that's the context to keep in mind as we bring up on screen a sample of the musk tweets. apple is mostly stopped advertising on twitter. the question, do they hate free speech in america? apple threatened to withhold twitter from its app store. won't tell us why. musk put a poll up on the twitter feed asking if apple should publish all censorship actions it's taken. we're waiting for the results. he will open up about twitter. before he arrived at the company. the twitter files on free speech suppression soon to be published on twitter itself. public deserves to know what really happened. apple has its own issues related the free speech. the company took action to limit the use of air drop in china. now that air drop feature has been used to get around cran sores. new restrictions would allow you to air drop a picture or something else to someone not in your contacts for ten minutes. and that new feature was put in
7:33 am
place before the recent protests began in china. no response from apple to our request for comment. any of this as we've been saying twitter is doing most of the talking these days through its owner's twitter feed. the bottom line financially, musk said twitter is losing $4 million a day. an advertiser revolt. some cases when they leave say they are upset about content moderation concerns. that is an area where apple, because of the app store, has a lot of power. >> dana: what about picking up the phone? thanks much. >> bill: tyrus here to talk about it. >> you don't pick up the phone anymore. >> dana: why doesn't lon call apple? >> he will win some of these battles. >> he will win all of them. this is virtue signaling. they are pulling advertisers for
7:34 am
their woke followers. i wish apple was this way. if they were so gung-ho about rights and platforms and freedom of speech and all these things they are claiming, which i have not seen twitter stop. it's been the opposite. it's been opening things up. you aren't being shadowed anymore. algorithms aren't taking away from you. i can actually speak to other african-americans on twitter again. it's crazy. it's funny, twitter is opening the doors but apple doesn't like that. for some reason they liked it before when they could decide who -- >> bill: you were prevented before? >> i'm so crazy with some of the right wing stuff i say like work out, take care of your kids, go to work on time. but forever i was stuck at
7:35 am
400,000, whatever the case may be. when mr. musk came in, amazingly suddenly within a matter of hours 150,000 new followers and most of them to my shocking surprise were minorities and i am no longer alone. so it goes back to -- i don't know this is true, but it feels like it is to me. it goes back to this virtue signaling thing. they'll pull advertisers, he will be fine. they are losing $4 million a day but tesla is making how much a day? they'll be fine. this is all -- they're all holding their nose and they'll come back. >> dana: the other big story but will smith coming out and saying finally let's talk about the slap that he gave to chris rock. this is what he said on the daily show. >> that was a rage that had been bottled for a really long time.
7:36 am
it was a horrific night, as you can imagine. you know, there are many nuances and complexities to it, you know, but at the end of the day i just lost it. >> dana: what do you think? >> my brother, the only thing he should have been saying was mr. rock, i apologize, there are no words, there are no excuses. please accept my apology. that's it. >> dana: no nuances. >> i don't want to hear the ingredients to the most stupid act. this is -- will smith is an intelligent brilliant artist and i've always respected him but it is hard when you see people try to put an excuse around what is a big plate of crow he should be eating. >> he said it was the little boy

>> dana: the biden administration giving chevron the green light to pump oil in venezuela after pulling the plug on the keystone xl pipeline while taking away good paying jobs from thousands of hard-working americans. grady trimble is in chicago reporting for fox business. >> good morning. the would be keystone pipeline
7:44 am
workers are understandably not happy at all. they've been waiting almost two years since president biden promised in investing if green energy would create lots of new jobs. >> key plank of our build back better recovery plan is building a modern, resilient climate infrastructure and clean energy future that create millions of good paying union jobs. not 7, 8, 10, $12 an hour but prevailing wage and benefits. >> fast forward to today and the reality is the fuel sector, including oil and gas, coal and bio fuels saw a drop of nearly 30,000 jobs from 2020 to 2021. so jobs in fossil fuels are declining and the latest data from the bureau of labor statistics found the green energy sector is projected to add in their words only a relatively small amount of new jobs over the next decade. right around 26,000. it has the keystone pipeline workers we've been talking to
7:45 am
wondering where are their green jobs? >> i have not heard anything about these so-called green jobs. don't have a clue. i haven't been contacted nothing about these green jobs. >> for those workers, the decision to let chevron start drilling in venezuela again while seemingly discouraging production and infrastructure building in the united states is salt in the wound. >> dana: grady trimble from fox business. thank you. >> recent los angeles city council meeting members voted to prohibit homeless people from setting up tents within 500 feet of schools and day-care centers. protestors shut down the meeting angered by new restrike thins re shuns to expand the number of locations where sleeping and camping are prohibited. >> that was from dr. phil. the latest attempt to control l.a.'s surging homeless

population by refusing to allow homeless tents near schools and day-care centers. that's the proposal that a democrat says his colleagues in the heated city council vote are against. the councilman is joe and hope we got the name right. good morning and thank you for your time. so you put this up there and what did the other guys say? >> well, it was over a year ago i proposed this bill. my colleagues wanted to send it to committee to study. banning encampments next to schools. common sense, right? it took the new schools chief to come to full council and plead with my colleagues to support my bill to ban these encampments because our students already are suffering enough trauma, serb owe economic issues and they shouldn't be allowed to step over needles, feces and experience psychotic behavior next to their school yards. >> bill: that makes sense.
7:47 am
apparently there was outrage on behalf of some activists. what did they do and say? >> well, i call these activists enablers. they prefer to have individuals actually sleep on sidewalks and use sidewalks as waiting rooms for an apartment unit. now, here is the model to follow what we've done in my district is advanced on interim housing but enforced the rules. we have pushed back against lawlessness and chaos in my district and today you won't find a single large encampment that's dangerous to the community and to our kids. >> bill: that sound like a good thing. i want to show our viewers you are up 16% from 2019 to 2022. that spans a three-year period. my understanding is los angeles is welcoming people from a lot of surrounding states and become a magnet for homeless all over the american west. you can speak to that if you like. you have an incoming mayor now.
7:48 am
what is her position on this? >> absolutely. let me start with l.a. has been a welcoming mat. i'm a former police officer and i know we have to enforce the law to address quality of life concerns and ordinances but we haven't been doing that for years. in fact, our neighboring cities are enforcing no camping laws. not only we're welcoming individuals from our neighboring cities but across the country. we're saying come to l.a. pitch a tent, do drugs and not be held accountable. we hope the new mayor karen bass comes to this position and advances on her promise of 15,000 interim beds within the next year. but at the same time, bill, she has a couple mandates to follow. she also has to push back against the not in my backyard and get to yes on solutions and same people who elected her, the vast majority of her supporters
7:49 am
are pushing for apartment beds. so she has to lead with balance on solving this humanitarian crisis in los angeles. i hope she does that. >> bill: we'll keep an eye on it. thank you for coming on. democratic council member. we have breaking news now. >> dana: president biden had been meeting with congressional leaders at the white house to discuss legislative priorities through the end of 2022 and said you have to deal with funding the government, covid and ukraine. let's listen here. >> president biden: we had a nice thanksgiving and i asked the four top leaders to congress to come in and talk about what we'll do between now and christmas in terms of legislation. there is a lot to do including resolving the train strike, the what we're doing now and congress, i think, has to act to prevent it. i think we have to do it. the economy is at risk. we'll work together to fund the government, i hope. covid and the war in ukraine all
