all of this as the supreme court puts the president's student loan handout on hold. until it hears the case next february. plus, the white house press secretary started laughing when peter doocy asked about the president visiting the southern border. but even democrats don't find it very funny. police in moscow, idaho, where four university students were stabbed to death are changing their statements yet again. but we begin with team fox coverage. ashley strohmier with the mixed messages on what's killing the economy. at first to the white house correspondent kevin corke with brand-new pressure over the continuing crisis on the border. >> good evening. court watchers have been expecting this for some time. the supreme court says yes it will take up a court fight between the biden administration and a coalition of six republican-led states challenging the legality of the presidents student loan forgiveness program, or as some critics have called it, a lone giveaway. courts said in a brief order

that yes, he will hear arguments in february. but will in the meantime keep the program on hold for now. last week you probably know this, the president actually extended his paws on federal student loan payments until jun. in order to give the court more time. the white house press secretary said "this program is necessary to help over 40 million eligible americans struggling under the burden of stude student loan stt loan debt. g.o.p. lawmakers have repeatedly assailed plan calling it a giveaway. fundamentally unfair and unconstitutional especially if millions of americans who say didn't go to college or benefit from the degrees earned without money had to help pay back the loans. the white house is reeling over new criticism of its border policy or lack thereof. new numbers show what critics

republicans threatening to block the annual defense authorization bill, senator? because of mandatory military vaccinations. >> what republicans are doing is working to be certain that we get included in the defense authorization act. the ability to keep dod from firing our men and women in uniform because they are not taking a covid shot. bear in mind, carbon vaccine, it's not like any of those vaccines you think of with polio or smallpox, things of that nature, trace. this is a shot. it is important to stand with our men and women in uniform to protect them and make certain that our military is able to meet their recruiting numbers so that we do not harm our nation's security because we have a shrinking military. >> trace: senator blackburn, thank you for coming on.

we appreciate it. >> you've got it. thank you. >> trace: speaking of military vaccines, the "fox news @ night" common sense department is getting were that house republicans have uncovered evidence the u.s. naval academy is denying diplomas to midshipmen who sought religious exemptions to the pentagon's covid vaccine mandate. the navy won't tell fox news how many diplomas are being denied or if that denial is affecting overall military readiness. but we don't need the navy to tell us that because we already know. recruitment goals for the navy, army, and air force are at all-time or 50 year lows. according to the reagan national defense forum, just 13% of 18 to 29-year-olds are very or extremely willing to join the military, meaning those recruitment numbers are not out to rise and yet the threat from russia and china are definitely rising. common sense would like to

remind the military that despite president biden, the commander in chief, repeatedly calling this pandemic of the unvaccinated, covid vaccines neither keep you from getting or spreading the virus. and to the evidence that it protects you from dying is being challenged every day. meantime the young people at the naval academy decided to go there because they decided to serve their country. maybe they should be allowed to make some other common sense decisions. president biden wants to shake up the democrats 2024 presidential primary calendar. he sent a letter to party leaders urging them to let south carolina host the first nominating contest in the name of embracing diversity. the potential change would displace iowa's caucus and new hampshire's first in the nation primary. a federal appeals court has halted an independent review of documents seized from former president trump's mar-a-lago estate which means the justice department can resume its criminal investigation into the

retention of top secret government information. trump's lawyers argue he's entitled to have a special master review thousands of documents taken from the property to figure out what is and what is not relevant to investigators. the supreme court could be asked to review the case. now for a breaking update on the murders of those four idaho students. moscow law enforcement are now clarifying statement they made although the clarification is causing a bit of confusion. matt finn is live with the latest on that. >> good evening. from the start moscow police said they think the student murders were targeted but then in an interview earlier this week, the county prosecutor questioned whether police should be using the term targeted. >> it seems like there were targeted has had different understandings for different people who are listening and perhaps isn't the best word to

use. >> that line goes against what police have said today to about the nature of the university of idaho murders and because the public and students and family to question the investigation. well, yesterday moscow police responded, adding to the confusion, rating and part "this was a miscommunication. detectives do not currently know if the residence or any occupants were specifically targeted but continue to investigate." today police reversed course once again, saying that they do believe this was a targeted attack. the father of the victim kaylee gonzalez tells fox news it creates more questions than answers. >> i don't like it. these statements take hours, multiple individuals to review, it's not like this was something said on the side of the street within the first five hours of the case. >> that father confirmed to fox news that his daughter, kaylee, and her friend madison were found killed in the same

>> trace: first stop, five family members. found dead in a home in illinois. two young children. investigators believe the incident was domestic but did not disclose what kind of weapon was used. autopsies showed all five died from sharp force injuries. police were initially called for a wellness check and eventually forced their way into the home.

in someone's carport. police in new york looking for two suspects involved in a deadly shooting, this week in manhattan, two armed suspects got into a dispute with a 39-year-old man when one of the suspects shot him in the chest. the male victim tried to drive away but crashed into a street divider and was killed. police new york city say violent offenses are increasingly being committed by and against minors. the senior correspondent laura ingle is in new york. >> a 14-year-old boy shot and killed this week in the bronx is the latest victim of what police have called a disturbing trend here in new york city. the number of teenage shooters and victims in the big apple tripling in recent years with devastating consequences. the nypd is looking for two suspects accused of shooting and killing a 14-year-old who was walking with his 15-year-old brother in the bronx wednesday night. local reports say a dispute over drill rap video which often
