progress. >> sandra: fox news alert to kick off "america reports" on this monday afternoon. hello, everyone, sandra smith in new york. great to start another week with you. >> john: good to start another week with you. hope you had a great weekend. supreme court just minutes ago wrapping up oral arguments in a high profile case. it involves a private business owner who says she won't create websites for same sex weddings because doing so goes against her religious beliefs. >> sandra: all of this with a colorado law prohibiting discrimination on the basis of sexual orientation. it puts the high court at the center of a critical first amendment battle. >> john: and shannon bream is live outside the supreme court. what happened inside the marble halls today? >> well, john, this was an argument scheduled to go 70 minutes, it went two and a half hours. you can hear the protest from both sides continue outside the court, and the nine justices

really struggled with where to draw the line on this issue. this is a first amendment case. business owner says she has plenty of lgbtq clients, happy to serve them and do business with them. she does not want to put her name on a custom crafted website for a same sex ceremony. soed questions came up where you could draw the line. if you have a business in the stream of commerce, what if you object to interracial marriage, or don't think disabled people should get married, could you object to that. all kinds of back and forth issues and whether a heterosexual relationship, we had an affair and found true love, she's made clear she will not do messages about violence, something that violates her religious beliefs or personally

objectionable. so where do you draw the line. and justice gorsuch said digging down with the attorneys, sounds to me this is more about the what and not the who. this is not about discriminating against specific people, it's about messages. so, where that line ultimately gets drawn will probably take weeks, maybe months before we know a decision by june in this case, a follow-up to the one a few years ago, the cake baker out of colorado says i will sell cakes to anyone, i will not do the custom cake for the same-sex marriage, it suggests the justices are ready to give better guidance and draw that line and now we have to wait. >> john: a lot of time for the noisy demonstrators to stand by for a decision. more on this coming up, too, sandra. >> sandra: jonathan turley will

be joining us. shannon cut through all the noise. >> john: more than three weeks passed since four idaho university students were stabbed to death inside their off campus house and police do not have a suspect, motive, weapon for the killings. one of the fathers is growing frustrated, believes his daughter or her friend were targeted based on how the killer moved through the house. >> they have said the entry point was the slider or the window, the middle floor. so to me he doesn't have to go upstairs. his entry and exit are available without having to go upstairs or downstairs. looks like he probably may have not gone downstairs, we don't know that for sure, obviously went upstairs, so i'm using logic that he chose to go up there when he didn't have to. >> john: complete coverage with

former fbi investigator bill daley says he believes police are making headway in the case but begin with christina coleman, is there any indication that police are getting any closer to solving this case? >> hi, john. idaho state police tell me they are making progress in this case, and they note that moscow police called in additional resources as soon as this horrific crime was reported. >> it's basically all hands on deck, and so the first call, you know, basically went to the chief and the command, but the third call to the idaho state police, so the crime lab was called out. >> but, kaylee's parents are still very frustrated with the lack of information being shared on this investigation. >> seems they are trying to suppress the story. we want to put rewards out, they don't want you to do that.

you are not going to get students if they see those things, but this community will not healed until the guy is pulled off the streets. it ain't going to happen, it's not going to happen, we all are working for the same thing. he has to be off the streets. p>> kaylee's father also says kaylee and her best friend maddy, out of the two of them, one of them had injuries that were much more brutal than the other, which could suggest that one of them was targeted. but again, that is still under investigation. meantime, their friends continue to grieve, they are devastated by their loss. maddy's sorority sisters shared heartfelt stories about her at the last large service honoring the victims. >> maddy was one of my best friends, and inner sorority, that was a bonus. she loved everyone around here,

more than life. she was one of the best people i knew. >> heartbreaking hearing the stories from the family and friends, and we are expecting an update some time today from mos investigation and hopefully will get more answers. >> john: watching and waiting to say they have found a suspect but nothing more. >> sandra: for more, bill, great to have you here. you have been with us throughout this story and three plus weeks now and does feel like there's a degree of lost support, perhaps some skepticism. >> three weeks, and not a-ha moment with the suspect or suspects, round them up and moves forward towards prosecution. this is more complicated, we talked about this before with

the crime scene, the evidence collected needs to be processed. i do say that the fact that police have not been communicating, not good for the family or the community. but from an investigative standpoint, a, does not provide information to the killer or killers or does not provide information to people who are potentially interviewed where they could be polluted, and when they catch the person, i believe they will, hopefully sooner than later, make sure nothing is tainted or to reverse the prosecution. >> sandra: you sound optimistic or hopeful the investigation is progressing and hopefully we will learn more soon. bill, learning a bit more about the possible point of entry for this suspect, put up sort of this diagram that shows the idaho home off campus home floor

levels, the first floor, second floor, third floor, appears kaylee goncalves father believes the suspect chose to go upstairs. he believes that the girls upstairs were targeted because of the point of entry on the second floor, the second chose to go upstairs. >> and certainly this has merit, and something around, we have discussed from the beginning of this case there may have been some targeting, that this was not just a random crime because two other people were not victimized, and the fact that the father pointed out the access on the second floor, those jibe with what believes have said. we have seen them on the hillside behind the home, examining the point of entry, and a hypothesis, leads credence to it. and i don't say the -- the

police do need to and have kept an open mind. it can put blinders on. and look at it as a broad spectrum of potential suspects and reasons why these four young people were killed. >> sandra: this is so brutal for a father to even imagine this, but kaylee's father appeared on lawrence jones cross country and he hints his daughter's wounds were significantly more brutal, also indicating to him, he says, that perhaps she or her friend upstairs were targeted. listen. >> their means of death don't match. >> maddie's and kaylee's cause of death, based on the autopsy report. >> they don't match. >> points of damage don't match, i'm just going to say, it wasn't leaked to me, i earned that, i paid for that funeral. >> sandra: just so heartbreaking the parents who they are going

through. but he seems to be drawing some conclusions based on what he has been told from police so far. what did you make of that? >> i would concur, it was a personal type of attack, and where stabbings are up close and personal type of assaults, and the fact no one will reveal themselves so far as being potentially the person going after, means maybe there was something that went on some time ago, it does not mean it happened that night or a week or two before, but cases post my fbi experience, two years some one has come back and felt dised and harbored the feeling and came back and committed killing. it is possible it's something -- it may be more difficult for police to find out who the suspect is.

nuanced in the killer's mind. >> and the suspect could be anywhere, walking among the kids on campus or friends of the survivors. >> or may not from the area, home front. don't know. >> sandra: exactly, so much we don't know. john, you just have to imagine the more we hear from the parents they are absolutely exhausted, heart broken and how horrible they just don't have any more information at this point. >> john: as a parent, it's hard enough to get your head around what happened, let alone the fact you are not getting answers about what happened. the pursuit of justice in a situation like this is something that at least brings some degree of comfort to grieving parents, not a whole lot, but a little bit. and if you don't even know who the suspect is, the poor parents are twisting in the wind. more on this coming up in the next hour with phil holloway, by the way. >> sandra: look forward to that.

lot of campaigning for the candidates, and in essence, if he's got jim jordan on his side, the conservative favorite for speaker of the house and he really wants to stay as chairman of the judiciary committee, and backing kevin mccarthy, with it, that being said, some of these conservative members are going to ask for chairman schiff, put pressure on him. but we have to get to a point where the republican party unites and kevin mccarthy is going to be held to task to say look, i'm going to have to be tough against joe biden and push back against the democrat's radical agenda. >> john: does this play into the democrat's hand, republican majority much smaller than anticipated, now all of this in-fighting as well, they got control of the congress but can not control their conference.

>> i think it's partly kevin mccarthy. he did not get it the last time he sought the post, at that point it went to paul ryan, and what you see here i think is a radical elements in the party and sometimes people are slow to acknowledge this, but don't want to get along and see their advantage, leverage saying i'm more conservative or trumpian than you are, and mccarthy has gone out of his way to bring peace but evident what the conference will not be able to do even with the slim majority you referenced. are they going to pass a deal that continues the budget, i don't have it. they are literally as mccarthy said squandering an opportunity, they prefer the performance, the kind of radical right behavior that they think gives them

traction and clicks. >> john: what a republican from new york said. >> the reality is kevin mccarthy worked hard, he delivered the majority. that was his promise and he did it so the nonsense has to stop, say enough is enough, the charade is over, he earned the speakership and he will have the gavel january 3rd. >> john: a new member of congress coming up, congressman elect, he said look, doesn't matter what your differences are, he earned it. >> i do think mccarthy has earned it to become speaker of the house. at the same time, i think the house freedom caucus and many conservative members are gonna put pressure on mccarthy to deliver. one thing republicans and democrats are slightly different is that pelosi was able to keep the coalition together, progressives and moderates. this is going to be a bigger challenge for republicans where they are more individualistic and like to make a point. but who does he have on his

side? marjorie taylor greene, outspoken conservative and you would never think would support mccarthy but he brought her along and i think you will see him spend a lot of time with these members to say let's work out a deal, we know where we have to push back on, they are going to hold him accountable, want to make sure that mccarthy basically leads strong, more of a fighter as opposed to caving into the democrats. >> john: put on his best car salesman hat. no offense to them. >> i think it's the american people will want to know what republicans are actually going to get done as the majority in the house. all hunter biden, a tax on joe biden, on dr. fauci, do something about the economy, the stand in ukraine, do something about the chinese. >> it's very difficult when you only have one chamber of congress to get something done.

and barring people questioning the mask policy, questioning some covid policies and one of the emails had a twitter person say look, the timing is tricky this week. that week was a hearing with the twitter ceo and he was actually asked about censorship by surrogate, they quoted my testimony earlier to that same committee, and he said there is no censorship department. you don't need a department, if the entire committee is censoring on issues. >> sandra: and wall street journal on the twitter censorship files, says the release of the 2020 censorship is news by any definition, even if the mainstream media dismisses it, that is the case. this is the media coverage of the new documents, and networks, some absolutely no coverage at

all, and then a matter of just minutes on other networks. jonathan. so, even if the news is out there, nobody is there to cover it. does this stay alive? >> that's absolutely right. you have these censorship a apollo -- apologyists, no, they have officials talking about how they don't have evidence of hacking. preventing the story from being shared, not the pictures and said it was a mistake. but it's like an alternative universe when you go to some other sites, and the one thing they don't want to talk about is what's on the computer. some are admitting it's authentic, but that means the emails are authentic, means there was a multi-million dollar influence scam by the biden family, the one thing washington does not want to discuss.
