washers, but the lowlife shoved him to the ground, and weeks later gary died due to complications from that attack. the suspect is still on the loose medical examiner rules hs death a homicide. thieves in north carolina have a license to steal. if it's valued at less than $1,000, a shoplifter is slapped with a weak misdemeanor charge, not even a felony. gary's son is speaking out about the horrible crime. watch. >> just heartbreaking. my dad was just trying to do a job, right? and now he's -- now he's no longer with us. it's paramount to me and my family that we find this particular person. and that he receives the justice he so richly deserved. >> robberies are getting so bad in philly, a gas station owner had to retire kevlar

commerce. now there's this casual callous reckless disregard for the law. the it is i'm going to do this, i'm going to do it. i think that you will -- the arc of history will solve this, because they will confront it with more and more of the armed guards. i remember in the old days, in the bodega -- judge, you probably remember this -- they used to put someone with a shotgun behind the cashier. you come in and. >>come and rob the bodega, aguyp there will be a violent response, because society can't sustain that arrogant disregard for the law. >> this guy is on the loose. there has to be video of him, because there's cameras in the stores, judge. hopefully we get him. >> well, i mean, if you have a law enforcement agency that has the ability to seek out

individuals as opposed to just enough law enforcement or police officers to handle the crimes as they come in. you know, you have squads that are looking for, you know, criminals who are on the loose. i mean, police have been defunded. they don't have what we used to have. even i could assign, among my criminal investigators, you're doing this, you're doing this, you're doing this. here's the issue -- and i just want people to understand this -- this guy, once he's caught, can be charged with homicide. >> sure. >> he can be charge with reckless homicide. there's causation between the injury -- the defendant will claim, if i did that to a 30-year-old he wouldn't have died. well, you take your victim as you find him. it's absolutely a homicide they're looking at this guy for. the problem is, we live in a society that is becoming, you know, more cold and more inhumane, criminals more emboldened. who's going to step up and do something about this, when we've got this social justice baloney,

they're proposing? i mean, at some point maybe we'll get to what geraldo is talking about, but i don't see it happening. when you have 10 robberies in chicago in two hours, criminals are on a high right now, and they know nobody is looking for them, nobody wants to arrest them, nobody wants to get in a fight. this guy dies because he tries to stop a guy from taking putin power washers, pressure cookers, whatever they were. then in california, this past weekend, a guy ends up coming out and shooting a guy who was stealing from this shop mart, or whatever. the guy shoots back at him, kills him, and they don't charge him with murder. they're saying it was self-defense. >> wow. >> what's happening is our society is now standing down. the laws protecting the stand-down, people when they see this, are stepping back, they don't want to get involved, they'll get shot and killed, or taking out their cameras. we're in a mess in this country. >> the thieves used to hit the warehouse or trucks.

now they just waltz right into the store, grab what they want, and stroll out of there. >> just like you with the christmas tree. taking a christmas tree home from fox. imagine the reverse. i don't know if this situation would play out, that mr. razor were alive, but the offendedder was dead. imagine how that would be covered, right? it would be, he was a vigilante, a victim of an oppressed society. this happens, barely a people. even with video like that, it's -- it is clear that businesses this large probably tell everyone not to get involved, that's what insurance is for, but to geraldo's point there's a message there. that message is contagious. rob these places until they move out. this is a slow roll looting operation. they don't care if these places leave. they don't care about the people that are suffering, because whether they're mini marts,

clothek stores being shut down, because of riots they never reopened. they don't care. so the thing is you have the insurance companies that are going to -- well, you know what, we don't want anybody to get hurt. at the same time, well, close all of these down. this is like a metaphorral snapshot of the last two years. no fear of r repercussions. we allow the media and activists to tell us that law enforcement is permanently stained. there's nothing you can do about it, right? even prisons. so this guy was a repeat offender, menace to society, already known, not in prison because we agreed with the assumption that prisons were somehow offensive. we should have less prisons, not more. we need more prisons, because right now we're in the eggs that are getting broken to make this

progressive omelet, you know. you know, where are reparations for victims? if we honestly believe that the origins of all of these problems are 400 years of oppression and slavery, right, and that caused us to change all of these policies, no cash bail, reduced sentences, where are the reparations? doesn't even matter the color of the skin for the criminal, where are the reparations for the victims that were killed, attacked, raped, by people let out, based on the assumption that all of these rules were racist or oppressive based on 400 years of persecution. that's an interesting lawsuit. >> well, i would hope that the executives at home depot would do right by this family. >> yes. >> and maybe give some restitution there. >> i certainly hope so. they shouldn't have to, right? where is the aarp? >> yeah. >> you know, who's standing up for him? in man was 83 years old. he loved to work.

he loved to go to work. his wife, i was reading an article, about how much she misses him. the son obviously misses him. the grandchildren are going to miss im. 83 years old, healthy enough to go to work every day. he was from the generation, as jimmy fallon pointed out, if they saw something they did something. then we were from the generation, if you see something you say something. and now it's, like, just pretend you don't see it. then order it from amazon, because you don't have to worry about going to a store and getting it. what's happening to the working class? the gentleman interviewed as the shop owner, forced to hire security, this is an entrepreneurial immigrant, in our country, who wanted to take a risk. he's doing everything that america is offering, and we are not holding up our end of the social contract for him. do you know, in washington, d.c., the candy is behind the

i've done so many things right nothing comes to mind, because i can never admit a mistake. the b-roll at the top of the segment, a guy with a mask, behind a plastic divider, he's probably had covid a dozen times. i don't mind that we're suggesting that we bring the masks back, i don't like the mandate. that's my problem. newsom is in a tough spot, because if l.a. county officially brings back the mandate, what's he going to do? that's not going to look good for gavin newsom. if he's still following the science to mask mandates, that's bad. if 8-10 cdc workers are working from home, quarantining, quadruple boosted, they're supposed to know about being healthy, this isn't about catching covid, they just want to watch tv all day. >> geraldo, they said masking, and moved beyond covid.

>> there's a preview. tucker joins us on "the five." lots of questions here. we'll start with greg with a question for tucker. >> what's on your originals that's not on fox, i was going to ask you, but i'm interested in you've lived in d.c. for a long time. you ran into hunter. you must have had some kind of interactions with him. how would you characterize him in your capacity? >> i knew him really well. i always liked him, a neighbor and friend. had dinner with him a bunch. we talked a lot about drinking. i don't drink. he was struggling with that. in the background, i knew, i knew people who worked with him in his business, that he was effectively selling access to his dad. >> yeah. >> i'll be totally honest about it, i never thought about it, because i lived in d.c. for 35 years, where people sell access to government officials. they're called lobbyists. that's the business of the city. i never really thought, wow,

that's kind of a crime, so i knew -- i didn't know the extent of it of course, but i remember someone who worked with him saying, wow, he's getting really, really close to, you know, what you shouldn't be doing, because it's criminal. turns out, based on what we know now from the laptop, that it was absolutely criminal. the reason we made the documentary was not to inform you that he was doing something wrong. everyone knows that. it was to take a long form piece and explain it exactly on the screen how we know this. it's not a partisan attack. it's not attacking the president's son. this guy shared a bank account with his dad while his dad was the vice president, his dad bringing him on chips, including to china, kicking back the money to his dad. that's not an allegation. that's shown on the laptop, which is why they suppressed it. >> judge, do you have a question for tucker? >> tucker, the frustrating part about all of this -- i'm curious were you think this all goes -- the first amendment is being pooh-poohed. now that this is out there, and elon musk has disclosed it,

they'rek, like, this is old news, no big deal. i mean, where is this country going with respect to the first amendment when it's politically instigated? there was a presidential campaign instigating censorship against the american people. >> well, of course. i mean, you're the judge. you know much better than as a legal matter. private companies arguably have a right to do what they want with information. the government may not under the bill of rights -- the first amendment to the bill of rights -- may not censor information, political information in particular. that's exactly what you had here. we've seen evidence, proof of the fact, that the fbi -- then the biden campaign and now the biden administration -- pressured social media companies, twitter in this case, to withhold relevant facts from the public on the basis of which people might cast their votes. so that's not an attack on democracy. i don't know how we're defining attack on democracy.

you can't have a democracy without a free flow of information. if i don't know about the facts about a candidate, i can't vote for them in an informed way. you can't have a democracy. they prevented the rest of us from knowing things, did it in secret, illegally, in contravention of the first amendment. it couldn't be clearer. >> geraldo? >> tucker, do you have an opinion about whether or not this information, had it been known, would have affected the result of the election? if you think it would have changed the result of the election, do you think that president trump was on to something, when he suggested that maybe we have to suspend all the rules and regulations, including the constitution, because it was such a colossal fraud? >> i'm not good at predicting political outcomes, i'm never doing that again, either looking ahead or retrospectively. i'm not going to do that again because i'm bad at it. as a matter of principle and
