lawrence says her hunger games character was the first female action hero. the night cap crew has news for j-law. we begin with james baker who went from russianclusion to the twitter files and is now out of a job. kevin corke is live for us in the nation's capital with more. good evening, kevin. >> kevin: a major plot twist in the twitter shakeup after elon musk announces the firing of the company's top lawyer. that lawyer a familiar face and name in the trump russianclusion -- collusion probe. he was ultimately forced out of his role at the d.o.j. according to congressional transcripts released by house republicans, he came under criminal investigation for claims he leaked to the media. all this was before he landed a job at twitter as its general counsel. >> he goes to twitter and he's the guy who helps suppress the

hunter biden story and says, oh, it's reasonable to assume hunter biden laptop was a hacker leak operation when everyone knew it wasn't. >> kevin: matt, the independent journalist and substack writer who first published the twitter files says baker had his hands on the document before they went public without elon musk's knowledge. and after he released the initial batch, things got, "complicated." he added over the weekend, "while we both dealt with obstacles to new searches, it was very wise that the person who discovered who was in charge of releasing the files was someone named jim." when she called to ask jim's last name, the answer came back baker, and the plot thickens. in the meantime, over at the white house, still no answers on how the biden campaign may or may not have coordinated with twitter. >> of course, it's up to these companies to make their own

decisions about the content on their platforms and to ensure content follows their own standards and policies, but i'm just not going to comment on a decision that was made during the campaign. >> kevin: more to come on that. in the meantime, tonight, we're awaiting a long form report from barry weis about twitter's decision-making about the hunter biden laptop story. of course, we saw a lot about that from the "new york post" but we want to know what happened with respect to twitter. now, this is all happening as the incoming house oversight chairman james comber says he wants to hear from all twitter employees, past and present. he wants them to testify about censorship claims perhaps as early as next month which should make for a great january here in washington. >> trace: yeah, kevin. we're going to dig a little dipper into jim being jim baker. kevin corke live in d.c. thank you. tom fenton, always great to have you on! i know in the runup to the 2020 election, the f.b.i. was

briefing social media companies every single week. everyone's asking why were they doing that? andy mccarthy says in the national review that twitter files missed the real scandal f.b.i. interference in the 2020 election going on saying, quoting, the f.b.i. wasn't in a position to order the companies to suppression information. it was, however, well positioned to make them fear that the failure to suppress information it might appear as dodgy could be perceived as serious legal consequences. he's saying the f.b.i. was planting seeds before the "new york post" story was released, tom. >> the deep state had their man in twitter, james baker. so you had the f.b.i. reaping the top former f.b.i. lawyer who was a top lawyer at twitter at the time on these very issues, and, of course, you know, baker is infamous for running this anti-trump -- or helping run this anti-trump

operation at the f.b.i. that involves shady pfizer warrants and remember he had the meeting with hillary clinton's top campaign lawyer who supposedly didn't tell him that the hillary campaign wanted the f.b.i. to pursue this fake claim that russia was colluding with trump through bank -- secret bank servers and such so baker, it turns out, was a part of the deep state and still operating as a deep state at twitter, because you have, you know, the reporters suggesting he was withholding information and then separately, you had musk himself talk about information that had been withheld from the previous owner, jack dorsey, the previous c.e.o., and maybe that information had been deleted. i don't know who's involved in that but he needs to do an audit of the system there at twitter and get all of these documents out as quickly as possible. >> trace: we don't know -- that's the whole thing. inside the company, you have james baker, right? he's saying he doesn't know if

it's a russian hack. it could be. it might not be but you have to proceed with caution meaning we have to hold this whole thing up. on the outside, you have the 51 intel officials writing up a letter saying, boy, it sure looks like it's got all the hallmarks of russian disinformation but really we're not sure. for safety, let's just hold this up. that's the whole thing. let's hold this up for a few days, get this election going and we can move on. >> you know, isn't it convenient all this decision-making always comes down one way or the other? it comes down either on behalf of hillary or against trump or in the case of 2020, to help biden and against trump. i'll tell you, this is campaign intervention in a dramatic way and you have this unique guy, james baker, who was involved in a government scandal and it looks like a corporate scandal and a political scandal when he was over at twitter. >> trace: yeah, when when they release all the documents, it's going to be fascinating to see what barry

weis and matt taibi comes up with. there could be a lot more out there. when it comes out, we'll bring you back, tom fenton, thank you. >> thank you. >> trace: a border patrol agent earlier today was killed in a high-speed pursuit of migrants crossing into texas. matt finn is live with that story. good evening. >> reporter: good evening, trace. the 38-year-old border patrol agent this morning was killed when he crashed his atv while pursuing that group of illegal migrants who crossed the border near mission, texas. fox's bill melugin reports sources say the unidentified agent was a father of two. the united states border patrol chief writing the death of an agent who dies while securing our nation's border is a tremendous loss for our organization and our nation. our prayers are with his family and co-workers during this difficult time period. this tragic death comes just one day after president biden went to arizona but chose not to visit the border telling fox news he has other

>> you would think so. i interviewed a special retired border patrol agent just today, and he said the number of illegal aliens into the country since the biden administration is probably closer to five million. this is just absolutely, completely, totally outrageous, and i still can't quite figure out what the rationale is. i used to think it was that he wanted ultimately millions of illegal aliens to turn citizens to turn voters and they vote democrat. i then thought perhaps he was reversing everything that donald trump did because donald trump was a racist. i can't figure out what the rationale is i can't understand why more people aren't outraged. i often watch bill melugin's reports in the morning. i switch over to rival cable channels to see if they're covering it. they don't know. they're not covering it. i think a lot of americans have completely no idea what's going on with our border. >> the two top stories tonight you'll never see on cnn and msnbc and it's a very good question because i thought the same thing, kevin. i thought he's just reversing

whatever president trump did. he's shutting down the keystone pipeline. he's shutting down the border wall it doesn't look like that anymore. here's a democrat and two republicans talking about border agents, and i'll get your response. >> border security is not ahcan or a democratic -- a republican or a democratic issue, it's an issue that affects all americans. >> aboondoned, those are the -- abandoned, those are the exact words so many border patrol agents have talked to me about. >> there's no doubt what is happening at the border is impacting our agents. and you just -- the numbers speak for itself. the fact that 14, customs and border patrol agents have committed suicide. something is wrong. >> trace: he's right, kevin, something is wrong! ier thoughts on this -- your thoughts on this? >> trace, i've been very up front with you and others on fox as a democrat. i believe this is a crisis at our border. i think what you need to do is look at what the president is actually doing. he's rolling up his sleeves. we've hired hundreds of more

border patrol agents this past year alone. in his budget request, he asked for $5 billion more. he got $1.5 billion from mexico for additional security. i'm with congresswoman cuellar who you just played where he says we need republicans and democrats to come together on this issue. i'm hopeful with a democratic senate and a republican house that we might be able to revisit some of the priorities from the 2013 comprehensive bipartisan immigration bill. let's resurrect that going forward and let's just not point fingers. let's actually work on solutions across party lines on this issue but it is a crisis, trace. >> trace: henry cuellar has been down there. democrat, republican, independent, whatever they are, his constituents are saying this is crazy no one is doing anything about it. i want to move on, if i can, to the so-called racist voting laws in georgia which saw the highest turnout. here is korean john pierre when asked about the voter turn outs. she said this.

changed in america! come on! knock it off! >> trace: it is, rafael warnock says lines were very long. the lines were really long but yet no complaints about anyone not being able to vote. your final thoughts? >> well, listen, i think it's a great thing when you see a record smashed, 3.5 million georgians went to the polls in the runoff election securing that democratic majority for rafael warnock. you saw republicans over the last four years trying to restrict the early days of voting and shorten the runoff period. we had to sue to get the saturday of early voting on the books in a lot of those counties so it's a good outcome i think when you see anyone turning out in those kinds of numbers. it was a good night obviously for democrats in the state of georgia. >> trace: yeah, kevin. larry? >> they made it easier to vote and harder to cheat. they going to give back the $100 million or so that atlanta lost because of the all-star game being moved to colorado? an apology?

they were saying black people were too stupid to figure out how to vote. insulting. >> trace: thank you for coming on, gentlemen. a retail survey finds americans are feeling the pain of inflation as we move into the holiday season. in fact, we're there. ashley strohmier live for us in new york with a closer look. ashley, doesn't look like a relief is coming. >> it doesn't, trace. good evening to you, first off. it is interesting to see some of these reports saying inflation is easing but the consumers not are just aren't buying it. with christmas right around the corner, people are having to tighten their spending habits with everyday necessities like their groceries. a new report says 2/3 of consumers are having a hard time paying their food bill and have altered the way that they spend in the past year. now, nearly 60% say they have budgeted for their holiday meals. half the people who were surveyed say they are now shopping based on discounts and promotions. only 17% of the people who participated in this survey

said share shopping -- their shopping habits haven't changed. with kroger and albertsons recent news of the $45 billion merger, these types of consolidations of giant supermarkets will only force prices to go even higher and if the higher prices aren't bad enough, the threat of a food shortage is still looming. that's according to the national black farmer's association president john boyd. he's been predicting since july if the administration, the biden administration doesn't intervene, it'll be very common to see the grocery shelves empty, especially now that fuel and fertilizer costs are really sky rocketing. food shortages may not be the only thing we're in store for as there's a possible lack of medicine due to the increase of illness like the flu and rsv right now, trace. >> very true. we'll see you in a bit. thank you. well, the fox news @ night commonsense department points out along with record inflation pushing up prices, there's also record crime

including shoplifting and organized retail gangs costing companies like target, walmart, cvs and others billions in profits. retail theft in 2021 was up 26.5% from 2020. we're still waiting on 2022 numbers but commonsense is expecting another significant jump. and it won't include unreported theft. remember, retailers often don't report crimes because police won't show up. police won't show up because d.a.'s won't prosecute and because d.a.'s won't prosecute, criminals get to keep on stealing. i say "criminals" except blue states would rather we say misunderstood victims, although it seems to me these thieves -- sorry, victims understand very much how they could get stolen goods on the internet and sell them and the prosecutors and politicians who are against putting these "misunderstood" people behind bars are the same ones who keep telling us crime is not getting worse. it just "seems" worse, they say.

commonsense thinks maybe it's our lying eyes that are misunderstood. on that note, first up in tonight's crime round-up, police in tennessee broke up a robbery in progress at a mall. the criminals smashed in glass cases to get the jewelry and one suspect wrestled with an officer and tried to grab his gun. police arrested four of the robbers. one remains at large. at a philadelphia mini mart a robber pulled a gun and demanded money from the cash register but an employee saw it unfold and fired first. turns out that mini mart was the final stop on a violent multi-county crime spree. the robber didn't die but he is in custody on $1 million bail. brand-new video shows a disturbing scene unfolding in philadelphia. 2:00 in the morning, a suspect gets into an argument with a 33-year-old man, then got into his car, ran the man over and dragged him. the assault broke the victim's leg. the d.o.j. ripped the federal

>> trace: internal documents reveal woke progressive policies shaping what oregon students are being taught in school has contributed to an exodus from the beaver state's teachers' union. american federation for children senior fellow corey deangelis joining us now. one in five teachers in oregon are fleeing from unions. the oregon education association handbook page 105 says the following, quoting here, the cabinet is updated on locals that are experiencing downward trends in membership and locals that are in a membership crisis. we are made aware of plans to support these locals, plans of membership drives within these locals and plans to connect with active members as well as potential members in local associations. that all means they are scrambling up in oregon. corey? >> yeah, this is a membership crisis of their own making. look, if you play stupid games,

you should expect to win stupid prizes. ever since the 2018 janis supreme court decision, now it's no longer legal for government unions to compel members to pay membership dues because it infringes upon their first amendment rights. since then, just a few years, the oregon teachers' union lost 1 in every 5 members. this is a mass exodus. it's partially because the unions are so concerned about winning and scoring political points more than they're concerned about actually representing their members. if you look at the union policies that they push for, per-pupil education expenditures nationwide vin creased about 152% after adjusting for inflation since 1970 but teachers' salaries only went up 8% in real terms. the unions are just pushing for political points and pushing for more people in the buildings but that means less money for the teachers that are doing a good job in the system. teachers' unions are bad for families but they're also bad for teachers, too, and some

teachers are waking up. >> trace: you wrote in the "wall street journal" here, even democrats are adapting to real political realities. it's clear for both parties it's becoming politically profitable to support education freedom. that's because parents have woken up far too long in k-12 education. the only groups that demanded attention were unions representing the employees in the system. now the kids have a union of their own. their parents. are we about to see more options, especially for kids in failing schools, corey? >> yeah, look, there wasn't a red wave. there wasn't a blue wave but there was a school choice wave. 76% of the candidates supported by my organization, the american federation for children, won their races in the midterms. if you look at the liberal tiers in the atlantic magazine, the author said education freedom advocates fared depressingly well in the midterm. you know what? they could cry harder. although it's bad news for socialist who has want to control other people's kids, it's great news for families who

want to have more of a say in their own kids' education. we even have some democrats supporting education freedom now. josh shapiro flipped his education stance in pennsylvania a couple of months before election day. he's probably reading the tea leaves. maybe had a change of heart but it doesn't matter. what matters is families are winning in the end because it's profitable to support them. >> you look at reading levels and math levels at 40-year lows. how could anyone who cares about the kids of this nation saying we're doing something wrong? your final thoughts on this, corey. >> if you look at the polling, real clear opinion research polling from june of 2022, 72% of americans supporting school choice. super majority of republicans, democrats and independents. we should all get together and support school choice. it's passing in red states all around the country right now but it's only a matter of time before blue states follow suit as well because parents have woken up. they're never going back to sleep. they're paying attention and politicians will be wise to listen to them. >> trace: these cans are kids
